China beaumonttim@hotmail .com ORIGINAL SCIENTIFIC ARTICLE – RECEIVED: 29/11/18 ACCEPTED: 11/04/19 abstract: Pettit endorses a ‘republican’ conception of social freedom of the person as consisting of a state of non-domination, and takes this to refute Mill’s ‘liberal’ claim that non-domineering but coercive interference can compromise social freedom of choice . This paper argues that Pettit’s interpretation is true to the extent that Mill believes that the legitimate, non-arbitrary and just coercion of would-be dominators, for the sake of preventing them from dominating others, can render them unfree to choose to do so without rendering them socially unfree (qua dominated) persons in their own right . However, contra Pettit, Mill is correct to reject the ‘republican’ view for at least two reasons . Firstly, it enables him to avoid commitment to the implausi- ble implication that would-be dominators who sincerely deny any interest in a shared system of basic liberties are automatically rendered unfree persons by the coercion necessary to uphold such a system . PROPERTY AND PRIVACY OF CONSCIENCE IN MONTESQUIEU’S SPIRIT OF THE LAWS John Matthew Peterson, Ph.D. University of Dallas, 2018 Director: Joshua Parens Montesquieu’s Spirit of the Laws is a sprawling work with six untitled and seemingly unconnected parts. How are these parts related, and how, especially, does the sixth part, on the history of Roman, French, and Feudal laws, relate to the other parts? In particular, why does Montesquieu pay special attention to the evolving understanding of property in these different legal environments, and what might his treatment of this subject have to do with his more well-known treatments of liberty, commerce, and religion? This dissertation offers answers to these questions through a close reading of the text of Spirit of the Laws, paying particular attention to Montesquieu’s use of the figure of the barbarian in parts 6, 2, and 3, and connecting these passages to books 11–12, on political liberty, and portions of book 26 on political and civil law. It connects Montesquieu’s arguments in support of political liberty—in which he implicitly makes common cause with thinkers like Hobbes and Locke—with the more determinist, historicist, and even sociological portions of his work, which have inspired a different strand of political philosophy. Finally, it gives an account of how parts 4 and 5, on commerce and religion, are based upon the first half of the book. This investigation yields the following conclusions: Montesquieu reinterprets the history of law in Europe in order to separate out the barbarian spirit from its Christian and Roman admixtures and translate it into the modern context. -

chapter 8 Socialism and Republicanism in Imperial Germany In November 1918, German Social Democrats were suddenly confronted with the need to establish a new republican state order in Germany following the collapse of the Empire. In light of the difficulties Social Democrats experi- enced in founding a stable and viable republic in 1918–19, the question of their prior understanding of republicanism – including the importance attached to the issue within the party – merits closer attention. Theoretically, the Social Democratic Party in Imperial Germany was opposed in principle to the mon- archical state. This opposition was manifested in a number of ways, such as refusing to take part in demonstrations of loyalty to the crown, in the Reichstag, for example, a policy that precluded Social Democrats from taking up a Vice- President’s (i.e. Deputy Speaker’s) position in the parliament when the party’s numbers would have justified it.The demand that the German empire be trans- formed into a democratic republic, however, was generally muted in the party’s public agitation. Robert Michels, during the time in which he identified with the left of the party, criticised it for placing too little emphasis on agitation for a republic: this he saw as ‘a mistake, that may be half attributed to a certain degree of complacency in the party, but […] equally to our monarchical institu- tions [themselves] with their rubbery law paragraphs on lèse-majesté’.1 Perhaps it was a demonstration of the effectiveness of the latter that Michels published his own most trenchant critiques of the reign of Kaiser Wilhelm II in the rel- ative safety of Italy, in Italian.2 It is clear that the Social Democratic Party was, to some extent, constrained by the prevailing laws from making open attacks on the monarchy. -

There Augustine argues that the Christian religion did not cause the sack of Rome by the Goths in 410 ce. Augustine revised the definitions of a ‘people’ and ‘republic’ found in Cicero’s De Republica in light of the impossibility of true justice in a world corrupted by sin. If one returns these definitions ot their original context, and accounts for Cicero’s own political teachings, one finds that Augustine follows Cicero’s republicanism on several key points. -

Clark Dissertation Advisor: Christopher Kelly Montesquieu famously presents climate and terrain as enabling servitude in hot, fertile climes and on the exposed steppes of central Asia. He also traces England’s exemplary constitution, with its balanced constitution, independent judiciary, and gentle criminal practices, to the unique conditions of early medieval northern Europe. The English “found” their government “in the forests” of Germany. There, the marginal, variegated terrain favored the dispersion of political power, and a pastoral way of life until well into the Middle Ages. In pursuing a primitive honor unrelated to political liberty as such, the barbaric Franks accidentally established the rudiments of the most “well-tempered” government. His turn to these causes accidental to human purposes in Parts 3-6 begins with his analysis of the problem of unintended consequences in the history of political reform in Parts 1-2. While the idea of balancing political powers in order to prevent any one individual or group from dominating the rest has ancient roots, he shows that it has taken many centuries to understand just what needs to be balanced, and to learn to balance against one threat without inviting another. -

MONTESQUIEU ON COMMERCE, CONQUEST, WAR, AND PEACE Robert Howse* I. INTRODUCTION:COMMERCE AS THE AGENT OF PEACE:MONTESQUIEU AND THE IDEOLOGY OF LIBERALISM n the history of liberalism, Montesquieu, who died two hundred and Ififty years ago, is an iconic figure. Montesquieu is cited as the source of the idea of checks and balances, or separation of powers, and thus as an intellectual inspiration of the American founding.1 Among liberal internationalists, Montesquieu is known above all for the notion that international trade leads to peace among nation-states. When liberal international relations theorists such as Michael Doyle attribute this posi- tion to Montesquieu,2 they cite Book XX of the Spirit of the Laws,3 in which Montesquieu claims: “The natural effect of commerce is to bring peace. Two nations that negotiate between themselves become recipro- cally dependent, if one has an interest in buying and the other in selling. And all unions are based on mutual needs.”4 On its own, Montesquieu’s claim raises many issues. Montesquieu’s point is that trade based on mutual dependency discourages war. Here, Montesquieu abstracts entirely from the relative power of the states in question, a concern that is pervasive in his concrete analyses of relation- ships among political communities. For example, later on in the same section of the Spirit of the Laws he mentions that trade relations between Carthage and Marseille led to jealousy and a security conflict: There were, in the early times, great wars between Carthage and Mar- seille concerning the fishery. After the peace, they competed in eco- nomic commerce. -
