PETITIONERS’ NON-BINDING STATEMENT OF ISSUES TO BE RAISED

Pursuant to the Court’s Orders of April 24, 2012, and April 27,

2012, Petitioners in Case No. 12-1196 hereby submit the following non- binding statement of issues to be raised:

1. Whether the finding of the U.S. Environmental Protection

Agency (“EPA”) that regulating hazardous air pollutants (“HAPs”) from

coal- and oil-fired electric generating units (“EGUs”) is “appropriate and

necessary” under Section 112(n)(1)(A) of the Clean Air Act (“CAA”), 42

U.S.C. § 7412(n)(1)(A), is unlawful because EPA failed to adequately

consider the impact on the reliability of the electricity supply.

2. Whether EPA’s “appropriate and necessary” finding is

unlawful because EPA failed to adequately consider the costs and

economic impact of such regulation.

3. Whether EPA unlawfully failed to adequately consider HAP

emissions from EGUs “after imposition of the requirements” of the CAA

in making its “appropriate and necessary” finding under CAA Section

112(n)(1)(A).

4. Whether EPA’s pollutant-by-pollutant approach to setting

emission limits for HAPs from new EGUs violates CAA Section

112(d)(3), 42 U.S.C. § 7412(d)(3), because the emission limits are based

on emissions of different HAPs from various EGUs rather than the HAP

emissions that have been “achieved in practice by the best controlled

similar source.”
