Policy Tualatin Police Department ••• Policy Manual Use of Force 300.1 PURPOSE AND SCOPE This policy recognizes that the use of force by law enforcement requires constant evaluation. Even at its lowest level, the use of force is a serious responsibility. The purpose of this policy is to provide officers of this department with guidelines on the reasonable use of force. While there is no way to specify the exact amount or type of reasonable force to be applied in any situation, each officer is expected to use these guidelines to make such decisions in a professional, impartial and reasonable manner. 300.1.1 PHILOSOPHY The use of force by law enforcement personnel is a matter of critical concern both to the public and to the law enforcement community. Officers are involved on a daily basis in numerous and varied human encounters and when warranted, may use force in carrying out their duties. Officers must have an understanding of, and true appreciation for, the limitations of their authority. This is especially true with respect to officers overcoming resistance while engaged in the performance of their duties. The Department recognizes and respects the value of all human life and dignity without prejudice to anyone. It is also understood that vesting officers with the authority to use reasonable force and protect the public welfare requires a careful balancing of all human interests. 300.1.2 DUTY TO INTERCEDE Any officer present and observing another officer using force that is clearly beyond that which is objectively reasonable under the circumstances shall, when in a position to do so, intercede to prevent the use of such excessive force. -

She uses the State v. Peairs criminal and Hattori v. Peairs tort mistaken self-defense cases to illustrate why application of the reasonable person standard to the same set of facts in two areas of law can lead to different outcomes. She also uses these cases to highlight how fundamentally different the perception of what is reasonable can be in different cultures. She then questions whether both criminal and tort law should continue to treat a reasonably mistaken belief that deadly force is necessary as justifiable self-defense. Based on the different purposes that tort and criminal law serve, Professor Forell explains why in self-defense cases criminal law should retain the reasonable mistake standard while tort law should move to a strict liability with comparative fault standard. EINSTEIN1 THE RIGHT TO SELF-DEFENCE IN NATIONAL AND INTERNATIONAL LAW: THE ROLE OF THE IMMINENCE REQUIREMENT Onder Bakircioglu* This article explores the doctrine of self-defence within the context of the challenges directed at the imminence requirement, from the perspective of both national and international law. The article will attempt to illustrate that the requirement of imminence underlines the political character of the self-defence doctrine wherein private force may only be resorted to in the absence of institutional protection. This study will argue that the imminence rule can not merely be regarded as a "proxy" for establishing necessity; rather, the elements of imminence, necessity, and proportionality are inextricably connected to ensure that defensive force is only resorted to when national or international authorities are not in a position to prevent an illegal aggression, and that the defensive lethal force is not abused. INTRODUCTION The September 11 attacks aroused controversy as to whether anticipatory or pre-emptive self-defence 2 is allowed under customary international law, and if so, under what circumstances. Following the devastating attacks on New York and Washington, the 2002 National Security Strategy (NSS) made it clear that the United States would act unilaterally to protect its security against "emerging threats before they are fully formed."3 This approach signified a radical departure from the collective security system by the sole existing super power. A sample of 1400 NAMI families surveyed in 1991 revealed that 40 percent of family members with severe mental illness had been arrested one or more times. Other national studies reveal that approximately 8 percent of all jail and prison inmates suffer from severe mental illnesses such as schizophrenia or bipolar disorders. These statistics are a direct reflection of the failure of public mental health systems to provide appropriate care and treatment to individuals with severe mental illnesses. These horrifying statistics point directly to the need of NAMI families and consumers to develop greater familiarity with the workings of their local criminal justice systems. Key personnel in these systems, such as police officers, prosecutors, public defenders and jail employees may have limited knowledge about severe mental illness and the needs of those who suffer from these illnesses. Moreover, the procedures, terminology and practices which characterize the criminal justice system are likely to be bewildering for consumers and family members alike. This guide is intended to serve as an aid for those people thrust into interaction with local criminal justice systems. Since criminal procedures are complicated and often differ from state to state, readers are urged to consult the laws and procedures of their states and localities. -

Chapter 18 SELF-DEFENSE § 18.01 GENERAL PRINCIPLES [A] Overview Every state in the United States recognizes a defense for the use of force, including deadly force, in self-protection. Indeed, one court has observed: It is difficult to the point of impossibility to imagine a right in any state to abolish self defense altogether, thereby leaving one a Hobson's choice of almost certain death through violent attack now or statutorily mandated death [or life imprisonment] through trial and conviction of murder later.1 If a state legislature were to abolish the defense of self-defense, it might very well violate the United States Constitution. 2 Most issues regarding the application of defensive force arise in the context of homicide and attempted murder prosecutions. Therefore, this chapter primarily focuses on the question of when deadly force may be used in self-defense. [B] Elements of the Defense At common law, a non-aggressor is justified in using force upon another if he reasonably believes such force is necessary to protect himself from imminent use of unlawful force by the other person.3 Specifically, however, deadly force is only justified in self-protection if the actor reasonably believes that its use is necessary to prevent imminent and unlawful use of deadly force by the aggressor. 4 1 Griffin v. This is, no doubt, partly due to the relative rarity of such situations and to the fact that police and prosecutors screen out most of those cases that do come to their attention. The importance of this body of law, however, may increase as recodification of criminal law spreads. About 24 new criminal codes have been adopted in the past dozen years, and almost as many are in the legislative process. Many of these new codes have a section dealing with the necessity defense. Northern Virginia Criminal Justice Training Academy 1. Ban on chokeholds- All NVCJA member agencies currently forbid any and all types of chokeholds. To our knowledge, this has been the case for over 20 years. It makes perfect sense to suggest that use of a chokehold by police, when a lesser force option is available, could prevent death or serious injury. In a deadly force situation, an officer is permitted to use any weapon or technique, including a gun, a brick, a chokehold, or any other option to stop the threat to life presented by the perpetrator. Whether an officer is trained to use a chokehold technique is irrelevant when involved in a deadly force situation. Bottom line, when deadly force is justified by an officer, it does not matter what force is used or what type of weapon is used. It is the totality of the circumstances that decides reasonableness. Again, having said that, we do not teach any chokehold technique at the Academy. 2. Require de-escalation training- The NVCJA presently provides over 40 hours of classroom training in the areas of Interpersonal Communications, Bias awareness, interaction with specialty groups (Emotionally Disturbed, Autism, Deaf, Handicapped, etc.), community interaction, mitigation, negotiation, and ethics. It is stressed that the most powerful tool officers have is their ability to communicate. The various force options are to be utilized in conjunction with, not in place of, communication skills when the situation dictates the need for force to gain control. Control is obtained in order to allow for facilitation of a long-term remedy. -
Self-Defense Without Imminence
ARTICLES SELF-DEFENSE WITHOUT IMMINENCE Fritz Allhoff* ABSTRACT The doctrine of self-defense allows that otherwise criminal force can be justi®ed so long as the actor reasonably believes its use necessary to protect against imminent and unlawful attack. Supposing that the force is necessary to dispel the attack, why the further requirement that the attack is imminent? The restriction precludes the use of force which, ex hypothesi, is the only way that the actor could defend himself. This Article surveys and critiques the rationale for the imminence requirement, arguing that it should be jettisoned in favor of a more expansive conception of self-defense. While the focus is on domestic law, the paper concludes by gesturing towards implications for international law as well, particularly with regards to preventive war (i.e., war against non-imminent threats). I. IMMINENCE AND NECESSITY Self-defense has long been taken to justify an otherwise illicit use of force. William Blackstone, characterizing the eighteenth-century common law of England, provided: [I]f the party himself, or any of these his relations, be forcibly attacked in his person or property, it is lawful for him to repel force by force; and the breach of the peace, which happens, is chargeable upon him only who began the affray. For the law, in this case, respects the passions of the human mind; and ... makes it lawful in him to do himself that immediate justice, to which he is prompted by nature, and which no prudential motives are strong enough to restrain.
