Initially, after the codification of German law in 1900, academic lectures were still based on a study of private law with reference to Roman law, the Pandectists and Germanic law as the basis for comparison. Since 1918, education in law focused only on national law while the legal-historical and comparative possibilities that were available to adapt the law were largely ignored. Students were unable to critically analyse the law or to resist the German socialist-nationalism system. They had no value system against which their own legal system could be tested.” Du Plessis W. 1 Paper Abstract What explains that in patriarchal societies it is the father who passes on his name to his child while in matriarchal societies the child bears the surname of his mother? The biological reality is the same in both cases: it is the woman who bears the child and gives birth to it. Thus the answer does not lie in biological differences but in cultural ones. So far in feminist literature the analysis relies on a patriarchal background. Not many attempts have been made to consider the way gender has been used in matriarchal societies. -

Finding Faith: Ghana, the Netherlands, and my Year Abroad Elissa Vinnik I. Introduction Popular images of globalization stress its economic and political char- acter. However, as capital, people, goods, images, information, and ide- ologies spill across national borders, different cultures, religions, races, and social values are newly juxtaposed. As a result, there are currently thousands of Buddhists in Iowa and Pentecostal Christians in China. Islam now ranks as the second most common religion in Europe. Since September 11, 2001, Western media has given much attention to Islamic fundamentalism and clashes between Muslims and the West. Yet as a result of globalization, Christianity in both the developed and develop- ing worlds has also undergone significant changes. My months abroad in Ghana and the Netherlands have given me a unique opportunity to explore Christianity in both countries and to consider the effects of globalization on each. Drawing upon scholarly research and my own experiences, this essay will begin with a summary of the history and current practice of Christianity in Ghana, followed by a similar discus- sion of Christianity in the Netherlands. -

And, thank you to my Mum and Dad, for teaching me that faith and love come first and foremost. Abstract Employing the concepts of lifeworld (Lebenswelt) and system as primarily discussed by Edmund Husserl and Jürgen Habermas, this dissertation argues that the lifeworlds of Anglo- Indian and Goan Catholics in the Greater Toronto Area have permitted members of these communities to relatively easily understand, interact with and manoeuvre through Canada’s democratic, individualistic and market-driven system. Suggesting that the Catholic faith serves as a multi-dimensional primary lens for Canadian Goan and Anglo-Indians, this sociological ethnography explores how religion has and continues affect their identity as diasporic post- colonial communities. Modifying key elements of traditional Indian culture to reflect their Catholic beliefs, these migrants consider their faith to be the very backdrop upon which their life experiences render meaningful. Through systematic qualitative case studies, I uncover how these individuals have successfully maintained a sense of security and ethnic pride amidst the myriad cultures and religions found in Canada’s multicultural society. Oscillating between the fuzzy boundaries of the Indian traditional and North American liberal worlds, Anglo-Indians and Goans attribute their achievements to their open-minded Westernized upbringing, their traditional Indian roots and their Catholic-centred principles effectively making them, in their opinions, admirable models of accommodation to Canada’s system. -

The case study looks at the commission and its cul- tural bases through three questions: What are the historical origins of apart- heid in South Africa? How did religious themes inform the truth and recon- ciliation process? How important were international religious and political forces? Additionally, the case study also includes a timeline of key events, a summary of relevant religious, political, and nongovernmental organizations, and a list of recommended further readings. Luce Initiative on Religion and International Affairs Luce/SFS Program on Religion and International Affairs From 2006–08, the Berkley Center and the Edmund A. Walsh School of Foreign Service (SFS) col- laborated in the implementation of a generous grant from the Henry Luce Foundation’s Initiative on Religion and International Affairs. The Luce/SFS Program on Religion and International Affairs convenes symposia and seminars that bring together scholars and policy experts around emergent issues. The program is organized around two main themes: the religious sources of foreign policy in the US and around the world, and the nexus between religion and global development. Topics covered in 2007–08 included the HIV/AIDS crisis, faith-inspired organizations in the Muslim world, gender and development, religious freedom and US foreign policy, and the intersection of religion, migration, and foreign policy. The Berkley Center The Berkley Center for Religion, Peace, and World Affairs, created within the Office of the President in March 2006, is part of a university-wide effort to build knowledge about religion’s role in world affairs and promote interreligious understanding in the service of peace. The Center explores the inter- section of religion with contemporary global challenges. -

Co-supervisor: Professor Felicity Edwards ABSTRACT This thesis is an attempt to reopen the debate on the whole question of inculturation in Southern Africa especially in light of the fact that we are now in a multi-lingual and multi-religious state. It is an attempt to rehighlight the plight of the spirituality of the amaXhosa people over the last century when missionary and imperial onslaught relegated it to the doldrums. This plunged the amaXhosa in a crisis that has left them directionless, to put it mildly. This is said because the total onslaught destroyed their self-respect and their identity and begs the question as to whether their acceptability to God was contingent on renouncing their culture especially the hidden prsences - Qamata, the living-dead and the notion of evil spirits. It is precisely because of these misconceptions regarding African culture and spirituality that the thesis has a strong expository and apologetic bias primarily aimed to address, and put into proper perspective, the significance of the Supreme Being, the living-dead and the evil spirits in African culture. -

As a universal religion, Christianity has to find an expression within the cultural context. However, the contextualization of Christianity in Africa appears to have permitted the practice of syncretism. It has resulted in the emergence of African Christianity, which is the amalgamation of Christianity and African Traditional Religion. The amalgamation of Christianity and African Traditional Religion appears to overlook the essence of both religions as there is currently no clarity on how Christianity can best be expressed within the African cultural and religious heritage. This paper employs the document review method to explore the things that fall in between—“adiaphora”, which the proponents of contextual Christianity may have overlooked with regard to the African cultural and religious heritage. These include the pragmatic nature of the African cultural and religious heritage, and the African traditional methods of healing. A great number of African scholars contend for the contextualization of Christianity, which aims at providing a link between the African cultural and Christian underpinnings. -

Religiosity in South Africa: Trends Among the Public and Elites
Scriptura 116 (2017:1), pp. 1-12 http://scriptura.journals.ac.za http://dx.doi.org/10.7833/115-0-1287 RELIGIOSITY IN SOUTH AFRICA: TRENDS AMONG THE PUBLIC AND ELITES Hennie Kotzé Centre for International and Comparative Politics Stellenbosch University Reinet Loubser Centre for International and Comparative Politics Stellenbosch University Abstract This article uses statistical data from the World Values Survey (WVS) and the South African Opinion Leader Survey to examine religiosity among the following samples of South Africans: Afrikaans, English, isiXhosa and isiZulu speaking Protestants, Catholics, African Independent Church (AIC) members and non-religious people (public and parliamentarians). We find that mainline Protestant churches have suffered a loss of members, thus changing the denominational face of the country. Additionally, although South Africans remain very religious, the importance of God in their lives has declined. For many people God is now less important although not unimportant. Parliamentarians appear unaffected by these changes: God is still highly important to members of parliament who profess Christianity (the majority). However, the small number of parliamentarians who are not religious now think God is unimportant. Key Words: South Africa; Religiosity; Secularisation; Christianity; Values Introduction The South African constitution is often described as the envy of the liberal world due to its progressive acknowledgement and protection of human rights. The constitution is the product of a political transition initiated and implemented by South African elites and it grants equal rights to life, equality, freedom and dignity to all citizens. The law of the land disallows discrimination on the grounds of race, ethnicity, gender, sexual orientation or religious background (see Chapter 2 of the Constitution of the Republic of South Africa, 1996:6-9).
