In that advice you requested confirmation of the following in relation to the management of pulverised fuel ash (PFA) on the Rugeley power station site. In particular you have asked for confirmation that the PFA works can be carried out under `PD rights', as part of the EA Permit surrender and under Prior Approval to carry out the demolition: as Rugeley Power Limited continues to hold a licence to generate electricity under section 6(1) of the Electricity Act 1989; and, the land is `operational' in accordance with the Town and Country Planning (General Permitted Development) (England) Order 2015 Schedule 2, Part 15 Class B -electricity undertakings. Electricity Generation Licence Rugeley Power Generation Limited, the operator of the Rugeley B Power Station site, holds an electricity generation licence through which its activities on site were, and continue to be, regulated.
