Pre-application advice relating to the management of the Pulverised Fuel Ash (PFA) at the Former Rugeley Power Station, Armitage Road, Armitage, Rugeley
We write further to our meeting on 28th June and your subsequent pre-application advice. In that advice you requested confirmation of the following in relation to the management of pulverised fuel ash (PFA) on the Rugeley power station site.
In particular you have asked for confirmation that the PFA works can be carried out under `PD rights', as part of the EA Permit surrender and under Prior Approval to carry out the demolition:
as Rugeley Power Limited continues to hold a licence to generate electricity under section 6(1) of the Electricity Act 1989; and,
the land is `operational' in accordance with the Town and Country Planning (General Permitted Development) (England) Order 2015 Schedule 2, Part 15 Class B -electricity undertakings.
Electricity Generation Licence
Rugeley Power Generation Limited, the operator of the Rugeley B Power Station site, holds an electricity generation licence through which its activities on site were, and continue to be, regulated. This is confirmed by Ofgem in its most recent list of generation licences which can be accessed here: https://www.ofgem.qov.uk/system/files/does/2019/06/electricity registered or service addresses new O.pdf

Operational Land
`Operational land' is defined in section 263 of the TCPA 1990 as land which is used by statutory undertakers for the purpose of carrying on their undertaking, and land in which an interest is held for that purpose. The holder of an electricity generation licence is considered a `statutory undertaker', as defined in section 262 TCPA 1990.
The land is owned by Rugeley Power Limited under title number SF436495. A copy of the Land Registry office copy entries and title plan are also enclosed.

The Rugeley B Power Station was granted consent on 31 August 1964. That consent, granted under section 2 of the Electric Lighting Act 1902 (as amended), also granted deemed planning permission under section 41 (1) of the Town and Country Planning Act 1962. Rugeley B was constructed and operated under that consent. The land continues to be used for purposes related to the generation of electricity by Rugeley B.
It is not unusual for the operating company and the land ownership of a power station site to be held in different but related companies. Here, Rugeley Power Generation Limited and Rugeley Power Limited and both subsidiaries of the same parent, International Power Consolidated Holdings Limited.
We trust this provides the necessary information to confirm the availability of permitted development rights at the Rugeley B power station site.

The leases grant and reserve easements as therein mentioned. 13 (05.02.2001) The land is subject to the following rights reserved by a Transfer of the land in this title and other land dated 2 January 2001 made between (1) Innogy Plc (Transferor) and (2) TXU Europe Merchant Properties Limited (Transferee):- "Rights reserved for the benefit of the Retained Land The following rights are excepted and reserved out of the Relevant Property for the benefit of the whole and every part of the Retained Land (in common with others so entitled and subject to all third party rights in respect of the Relevant Property): 2.1 The right to carry out (or to consent to others carrying out) any building, rebuilding, alteration, addition or other work on the Retained Land (including the erection of scaffolding) notwithstanding interference with the light and air enjoyed by the Relevant Property; 2.2 Free and uninterrupted use of all Conduits now or during the Perpetuity Period in on or under the Relevant Property; 2.3 The right at all reasonable times with or without workmen and equipment on reasonable prior written notice (except in case of emergency when written notice sha11 not be required) to enter the Relevant Property for the purpose of laying inspecting repairing renewing relaying cleansing. maintaining and connecting up to any such existing or future Conduits referred to in paragraph 2.2 Provided that: 2.3.1 the Transferee shall have the right at its own expense to divert or relocate such Conduits to a reasonable alternative location and the Transferor shall co-operate in respect of that diversion or relocation and shall (where appropriate) permit the Transferee to divert or relocate such Conduits in or under the Retained Land (the Transferee causing the minimum disturbance and damage to the Retained Land which is reasonably practicable and making good forthwith all damage caused thereby to the Retained Land Pane 9 Title number SF436495 C: Charges register continued to the reasonable satisfaction of the Transferor); 2.3.2 when the Transferor exercises any right of entry on to the Relevant Property it shall cause the minimum disturbance and damage which is reasonably practicable, comply with all reasonable requirements of the Transferee and shall make good forthwith all damage caused thereby to the Relevant Property to the reasonable satisfaction of the Transferee; 2.3.3 the right to lay new Conduits shall be entirely at the Transferor's cost and shall apply only to the part of the Relevant Property lying to the south-east of the blue line on Plan 1 and during the Perpetuity Period (being 80 years from the date of this Transfer) and the route of new Conduits shall: (i) be approved by the Transferee (such approval not to be unreasonably withheld or delayed and the Transferor acknowledges that it would be reasonable for the Transferee to withhold consent in circumstances where the proposed new Conduit would interfere with the current use of the Relevant Property); (ii) folloca the route of any existing road or services corridor through the Relevant Property so far as reasonably practicable. Definitions In this part of this Schedule: Retained Land means the land retained by the Transferor being the remainder of the land comprised in title number SF425075 and other land all as shown edged green on the attached plan numbered 1 Conduits means sewers, drains, pipes, gullies, gutters, flues, watercourses, channels, subways, wires, cables and other conducting media of whatsoever nature."
