EXECUTIVE SUMMARY

Introduction

The Government of Uttar Pradesh announced the construction of Bundelkhand Expressway in the year 2017 in order to improve road connectivity in the backward regions of Uttar Pradesh. The 296 km stretch of expressway will pass through Chitrakoot, Banda, , Hamirpur, , Auraiya and Banda. Eastern UP will be connected to - NCR via - Expressway and Agra- through this Expressway.

The act requires the Government to analyse the socio- economic condition of PAFs, potential social impacts of the project and seek mitigation measures.

This SIA study is a part of Bundelkhand Expressway project and provides an assessment of land acquisition in Banda District, UP. For the current project in Banda district, the Department of Revenue, Banda, Uttar Pradesh in its Notification No. 518/Eight- Vibhuaa/ Banda dated 11th October, 2019 appointed SR Asia to conduct Social Impact Assessment Study in the project affected area, as per the provisions of RFCTLARR Act 2013 and UPRFCTLARR Rules 2016.

Project and public purpose The project aims to transform the backwards districts of the state of Uttar Pradesh where over 95 percent of the population does not have access to proper road and railway infrastructure. The purpose of the project is to substantially reduce the travel time between and Bundelkhand region and to provide quality travel experience to the commuters. Other envisaged benefits include generation of employment opportunities, reduction in migration, boost in tourism,

enhancement in agriculture, and establishment of industries near expressway and overall development of the region. The project team is of the opinion that the project is serving public purpose as per section 2 of RFCTLARR 2013.

Project Location The project is spread across six packages from Chitrakoot to via Banda District. In Banda, the project is passing through three tehsils i.e. Banda, Baberu and and 26 villages namely Surauli, Bilbai, Hathauda, Pipri, Kanwara, Achraud, Mawai buzurg, Doha, Jaurahi, Jaari, Mahokhar, Tilehata, Jamalpur, Chahitara, Pawai, Bisanda rural, Ghoori, Punahur, Ballan, Chausad, Gandaav, Chandaur, Mawai khurd, Koni, Mohanpurva and Pesta. The nearest railway station is Banda and nearest airport is (approx. 100 Km).

Size and attributes of land acquisition Total land required for the construction of Bundelkhand Expressway in Banda district is 794.394 hectares. The district authorities have already acquired majority of land, however, a total of 30.6714 hectares of land is to be acquired in Tehsil Banda, Baberu and Atarra as per provision of RFCTLARR Act 2013. The land for SIA study is owned by 148 families spread over 185 survey numbers. The ownership of land is through heredity and direct purchase. Project Affected Families use the land majorly for agricultural purpose, which is their main source of income. Further details are mentioned in Table -1.

Alternatives considered The team has assessed for the possibility of alternative route; however, majority of the expressway land has already been acquired by the district administration and in and around there is agriculture land only. Hence the current layout of the road is appropriate and other alternatives are not suggested.

Social Impacts The project will have both positive and negative impacts on the PAFs, local population and environment. On one hand, it will lead to the holistic development of the region- improving road connectivity, enhancing access to other parts of the country, reducing travel time, increasing employment opportunities, minimizing migration, and contributing in better state of art & infrastructure. The project will prove to be a positive step in national interest. However, it will be at the cost of people whose land will be affected due to its construction. Some of the PAFs will lose their land substantially which is a source of income for them. Village Tilheta will see

Temples of village, Mawai Buzurg, Ghoori and Gadaanv will also be affected which are worshipped by residents. University of Agriculture and technology, Banda will also be affected that will automatically impact students and teachers.

The loss of individual and community assets such as tube wells bore wells and trees will also affect environment and access to natural resources, but appropriate mitigations suggested will ensure and maximize the overall positive impact.

Mitigation measures The potential negative impacts of the project can be minimized by adopting mitigation measures. In order to mitigate economic impacts, the PAFs should be compensated as mandated under Section 26-31 of the RFCTLARR 2013. During the construction phase, preference should be given to the PAFs for income generation opportunities depending on the impact on their source of livelihood. This would compensate the livelihood options which are likely to be affected due to the acquisition of the land. With respect to environmental impacts, the project should be designed in a way that minimizes the impact on flora and fauna of the village. More number of trees plantation shall be undertaken in the project site to compensate the loss of trees. Similarly, there should be a plan to re-establish affected bore wells and tube wells in order to maintain and preserve water needs of the project area. To mitigate social impacts, PAFs demanding land in lieu of land should be compensated. Agricultural University, mosque and three temples that will be displaced should be re-established at an appropriate location where the community agrees for the same. There should be a provision of construction of underpass for easy passage of pedestrian and animals.

Public hearing SR Asia conducted a public hearing three weeks after the notification was issued by the Administration of Banda District. The hearing was attended by public of all 26 villages. Most of them shared their concerns regarding compensation. Some of them clarifies their doubts regarding marking too land to be acquired. District administration and officials from UPEIDA resolved the queries of all the PAPs and shared that fair compensation according to actual land acquired will be provided to them. They also mentioned that there will be a remarking of land.

Assessment of Social Costs and Benefits A detailed assessment suggests that the construction of Bundelkhand Expressway will have more positive than negative impacts for the PAFs, local population and future generations. The social costs incurred by PAFs in terms of loss of ancestral land/property, loss of livelihood, discomfort in rehabilitation, loss of educational institute and loss of cultural heritage can be compensated mostly by taking proactive measures. The project will benefit the entire population of Banda District.

The discussions and interactions with stakeholders including the project affected families, public representative, officials of government departments and local people indicate that the project will prove to be a milestone for the development of Bundelkhand region.

The SIA team is unanimous to state that PAFs are ready for acquisition of their land and should be acquired by providing compensation as per the provisions of RFCTLARR Act 2013 and suggested value in this report. The government is suggested to balance environmental and social considerations, and benefits through implementation of the proposed mitigation measures. It is recommended that preventive measures be given first consideration in order to reduce the cost of mitigation measures and at the same time minimize the negative impact of the project.

1. DETAILED PROJECT REPORT

1.1 About the project The acquisition of partial land of 26 villages in Banda district in the state of Uttar Pradesh, India is part of the major state flagship expressway project (called Bundelkhand Expressway). The proposed expressway is a 4-lane (expandable to 6-lane) access controlled, Greenfield expressway project of approx. 296 km length. The project starts at 266.6 Km of NH 76/new NH 35 (- Banda road), near Bharatkoop and ends at Agra-Lucknow Expressway near village Kudrel in . The expressway will pass through Chitrakoot, Banda, Hamirpur, Auraiya and Jalaun. From Jalaun, it will go to Etawah and reach Naseempur via Bateshwar in Agra before joining the Agra-Lucknow Expressway.

The construction of expressway in Banda District will be done by Apco Infratech Pvt. Ltd. The overall management of the project will be done by UPEIDA, Government of Uttar Pradesh with the cooperation of district authorities.

1.2 Purpose of the Project The project aims to transform the backward districts of the state of Uttar Pradesh such as Hamirpur, Banda, Etawah, Mahoba, Chitrakoot, Jalaun and Auraiya where over 95 percent of the population does not have access to proper road and railway infrastructure. The purpose of the project is to substantially reduce the travel time between New Delhi and Bundelkhand region. Other envisaged benefits are:  Creation of 50,000 direct and indirect jobs  Boost tourism and bring holistic development of the state

 Provide access to proposed defence corridor (10,000 acres), proposed along this expressway  Generate employment for youth and minimize migration  Facilitate easy implementation of various Government Schemes in Bundelkhand region The project team is of the opinion that the project is serving public purpose as per section 2 of RFCTLARR 2013.

1.3 Project Location In Banda, the project will impact 26 villages of Banda, Baberu, Aatra Tehsils. Banda is well- connected with major of India with the help of railways, roadways and airways. Closest airport to Banda railway station is , which is situated at a distance of about 85 km.

1.4 Project Alternative This project option has been arrived at after considering several options by the state government and Govt. of India. This option is found to be the most suitable option from an extreme environmental and social perspective. The land that will be acquired is the bare minimum requirement for the completion of this project. This decision will indeed involve certain losses such as land, source of livelihood, loss of crops and fodder, loss of grazing land for livestock, university, temple, mosque, trees, hand pumps and bore wells for many PAFs. However, comparing the positives and negatives, this project option is found to be the most preferred option from the socio-economic and environmental perspectives.

Detailed project report and Environmental Impact Assessment report was not accessible to the project team. Hence, more details about the projects are not included in this report.

1.5 Legal and Policy Framework The Policy Framework and Entitlements for the program are based on the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 (RFCTLARR Act 2013); and UPRFCTLARR Rules 2016, for issues related to R&R and land acquisition.

Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act (RFCTLARR), 2013 The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act, 2013, provides for a transparent process and fair compensation to the affected families whose land is acquired or proposed to be acquired or are affected by such acquisition and provides for rehabilitation and resettlement of the affected families.

This Central Act aims to ensure a humane, participative, informed and transparent process for land acquisition for development of essential infrastructural facilities, industrialization and urbanization with least disturbance to the owners of the land and other affected families and provide just and fair compensation to the affected families whose land has been acquired or proposed to be acquired or are affected by such acquisitions and make adequate provision for such affected persons for their rehabilitation and resettlement and for ensuring that the cumulative outcome of compulsory acquisition should be that affected persons become partners in development leading to an improvement in their post-acquisition social and economic status and for matters connected there with.

Section 11 states that, whenever it appears to the appropriate government that land in any area is required or likely to be required for any public purpose, a notification to that effect along with details of land to be acquired shall be published in the Official Gazette, two daily newspapers, uploaded on the website of appropriate government and in the affected areas to all the persons affected. Prior to the acquisition section 4 of the act mandates conduct of a Social Impact Assessment study of the affected area to study the impact the project is likely to have on various components such as livelihood of project affected families, public and community properties, assets and infrastructure particularly roads, public transport.

Similarly, where land is acquired, fair compensation shall be paid promptly to all persons affected in accordance with sections 28, 29 and 30 of the Act, along the following parameters:

 Area of land acquired,  Market value of the property decided by the Collector,  Value of things attached to land or building Damages sustained from the severance of the land parcel from the land,  Damages to other property in the process of acquiring the said land,  Consequences of changing residence or place of business by the land owners,  Damages from diminution of profits of the land acquired.  Award of solarium  Interest paid at the rate of minimum 12% per annum on such market value for the period  Commencing on and from the date of the publication of the notification of the social impact assessment study.  The Proponent has undertaken Social Impact Assessment and developed mitigation measures for those who will be affected by the proposed project. The Proponent shall adhere to the requirements of the Act in the implementation of land acquisition.

The RFCTLARR Act applies to acquisition of land for a public purpose, as defined in the Act. The Act provides for consultation with and involvement of local self-government in undertaking a Social Impact Assessment (SIA). The SIA is reviewed by an Expert Group to assess if the potential benefits of the project outweigh the social cost and adverse social impacts.

2. TEAM COMPOSITION, APPROACH, METHODOLOGY AND SCHEDULE OF SIA

SR Asia is an ISO 9001:2015 certified international organization and registered under Section 8of the Companies Act-2013. It is head quartered in India and has presence in over 12 countries in the Asian region. SR Asia works in sustainability domain and is currently working for government, public and private sector and multilateral agencies. The organization has professionals who are qualified and have expertise in diverse disciplines functioning at all levels. The team consists of Management professionals, Economists, Social Scientists/Anthropologist etc. The organization has an experience of conducting Social Impact Assessments in various states of the country. SR Asia is empanelled with various state governments such as Daman and Diu, Dadra Nagar and , Himachal Pradesh, Jharkhand etc. for conducting SIA studies as per RFCTLARR-2013.

Section 4 of RFCTLARR Act2013 requires that all SIA studies undertake surveys /public consultations as part of the study. The aim of SIA is to ensure that all stakeholders interested in a proposed project including project beneficiaries and the general public in the vicinity of the proposed project be identified and their opinion considered during project planning, design, construction, operation and decommission phase. In compliance with the requirements of the regulations, the SIA team conducted the assessment during the month of January 2019 and interacted with project affected families, Panchayat members and other stakeholders of the current project.

This chapter illustrates the approach and methodology adopted for undertaking the social impact assessment and gives an overview of the SIA unit and activity schedule of the study.

2.1 Objectives and scope of study The SIA study was conducted with the following objectives:  To assess whether the proposed acquisition serves public purpose  To estimate the number of affected families and number of families among them likely to be displaced  To understand extent of land acquired is bare minimum needed for the project  To examine the positive and negative impacts on the socio-economic condition of people in the project area  To develop appropriate measures to minimize the negative socio-economic impacts of the project

2.2 Team Composition Project team comprised professionals who are graduates/ post graduates and well versed in investigating social phenomena, undertaking interviews and questionnaire surveys, conducting group discussions and PRA techniques to elicit information pertaining to the subject of inquiry. 2.3 Approach and Methodology In view of the RFCTLARR Act 2013 all initiatives have been taken to fairly identify the rights of PAFs, PAPs and indirectly affected families and people to discuss the project in detail. The advantage the project will bring for directly and indirectly families and the opportunities the RFCTLARR Act 2013 brings to compensate PAPs fairly for their rights to compensate in fair and transparent manner of land acquisition.

The team has looked for the notification released in the newspaper in to see that the impacted population is well informed prior to social impact assessment study. The project team

SIA Report of Bundelkhand Expressway Project in District Banda, UP, India has further utilized the opportunity for bringing the people views, opinions, feedbacks, various means and mechanisms such as meeting public representatives, PAPs, one to one discussion, verification of PAPs complete details as per given form 2 of the act.

Further for minimizing the communication gaps a team of locally and trained by SR Asia experts were used to collect data, brief communities and bring maximum participation by organizing public meetings, personal interviews, focused group discussions, etc. The views, feedbacks and concerns of the PAPs has been highlighted as is to reflect the fundamentals of the act for maximum transparency and minimal modulation of the impact.

The approach to study the social impact of construction of Bundelkhand Expressway was planned in a manner to cover the requirements of the RFCTLARR Act 2013. It involved a combination of qualitative and quantitative research methods such as desk research, public consultations with project affected population and public representatives, focus group discussions and Questionnaire survey.

2.4 Methods and tools used A mix of qualitative and quantitative methods was used for the SIA study. These methods helped in understanding the profile of the village, socio- economic profile of PAFs, the potential impacts of construction of Bundelkhand Expressway, and mitigation measures that can be adopted to minimize the negative impacts of the project.

The following steps were adopted for the SIA study:

2.4.1 Team composition/ formation SR Asia built a team of experts for the current study and briefed them about the project.

2.4.2 Desk Review RFCTLARR Act 2013, UPRFCTLARR Rules 2016, available reports, project related documents and records from Department of Revenue and Land Reforms, and literature including maps, details of land owners etc. were reviewed during the study. This was done to understand the socio-cultural and economic status of PAFs, magnitude of impact of the project, and measures that can be taken to mitigate the negative impacts of the project. Desk review also helped in developing tools for primary data collection.

2.4.3 Development of tools In order to understand the socio- economic profile of affected families and all categories of impacts of the project, a questionnaire was prepared. The questionnaire consisted of both open and close ended questions eliciting information required as per the provision of act. Sample of the questionnaire is attached as Annexure 1 in the report. Similarly guidelines for stakeholders’ consultation was also prepared. For the current study, online questionnaires were also prepared and used on field.

2.4.4 Site Visit The project team visited the land that was to be acquired in order to make an independent assessment of the resources on the project land and the land use pattern. Site visits also helped in assessing the potential impact that the project will have on the land. For the field survey a team of local field Investigators were also involved to mitigate loss of any information provided by PAFs due to language barrier and acceptance of project team in the area.

2.4.5 Stakeholders' Consultation To gain in-depth understanding of the situation, stakeholders' consultation was conducted with the project affected families, panchayat members, officials of Collectorate, etc. Maps of the project site and other related documents were made available by the Office of Collectorate. These documents were used to understand details about the land, necessity of acquiring that land, benefits that the project will bring to the village and its impact on the stakeholders. Details of discussions held are mentioned in the following chapter of the report.

A discussion was held with the PAFs on the background of the land and the potential impact of the project. The discussion helped in understanding the opinion of the PAFs regarding their land to be acquired for construction of expressway project. During the consultation, PAFs shared their concerns and conditions regarding land acquisition.

2.4.6 Data analysis

The data obtained from questionnaire survey and consultations was analyzed to provide a summary of relevant baseline information on affected populations; all categories of project impact which include direct and indirect impact of physical and/or economic nature on the people and the general environment. The responses received through the public consultation and socio-economic survey are presented in the subsequent chapters of this report.

2.4.7 Public Hearing Section 5 of RFCTLARR Act 2013 envisages that whenever a SIA study is required to be conducted, the Government shall ensure that a Public Hearing is held at the affected area to ascertain that the views of affected families are recorded and included in the SIA Report. Uttar Pradesh RFCTLARR Rules 2016 have prescribed detailed procedure for the conduct of the public hearing. In accordance with the above, SR Asia organized a public hearing after the submission of draft report.

2.4.8 Report writing A final report is submitted after the public hearing is completed. All the data collected through primary and secondary research was compiled and analyzed in the form of report. The format prescribed in RFCTLARR Rules 2016 was followed.

2.5 Schedule of SIA study On receipt of confirmation of SIA work from the Land Acquisition Department, detailed planning of the project activities was worked out. As proposed in terms of reference (ToR), a work schedule was developed.

2.6 Monitoring & Quality Assurance  The project was monitored by the Project Team Leader. Roles and responsibilities of different members of the project team were defined by the Project Lead before the start of the project.  In order to finish the project in time, the work break-down structure was prepared identifying various activities and milestones.  Scheduling of activities was done in order to define the start and end date of each activity, and the milestones. This document was reviewed at regular intervals to check status against the planned target date. Quality was built into every process of the project study. For every milestone there is some quality requirements in terms of correctness or accuracy, completeness, representation, techniques employed etc.

3. LAND ASSESSMENT

Banda is the district and commissionaire headquarters of Chitrakoot Dham Mandal, Banda. Banda is surrounded by Districts Fatehpur, Hamirpur, Mahoba and Chitrakoot having a spread over an area of 4,408 sq km. It has a population of 1,799,410 of which 9,65,876 are males and 8,33,534. In rural areas, sex ratio is 860 females per 1000 males. Agriculture was the main occupation of the area earlier. However, over the years the area has been fast growing in industrial sector with the establishment of many big and small-scale industries. FIGURE 3 VIEW OF AFFECTED LAND

3.1 Land and Area The land to be acquired for the construction of Bundelkhand Expressway falls partly in twenty six villages- Surauli, Bilbai, Hathauda, Pipri, Kanwara, Achraud, Mawai buzurg, Doha, Jaurahi, Jaari, Mahokhar, Tilehata, Jamalpur, Chahitara, Pawai, Bisanda rural, Ghoori, Punahur, Ballan, Chausad, Gandaav, Chandaur, Mawai khurd, Koni, Mohanpurva and Pesta. The nearest railway station is Banda and nearest airport is Gwalior (approx. 100 Km).

FIGURE 4 PAPS SHOWING THEIR LAND 3.2 Land required for project A total of 794.394 hectares of land in Banda is required for the construction of Bundelkhand Expressway in Banda district. Approximately 96% of this land has already been acquired for the project. 30.6714 hectares of land is yet to be acquired in Tehsil Banda, Baberu and Atarra of Banda district.

3.3 Type of land The land to be acquired is irrigated land however mostly cultivated during the site visit. Soil of this area is sandy and loam clay. The major crops grown here are wheat, paddy, maize, pulses and oilseeds. Main fruits grown are mango and guava.

3.4 Land Use pattern During discussion with the PAFs, it was found that the land to be acquired is mostly used for agricultural, cultural and educational purpose.

3.5 Land assessment Details The land to be acquired is located partly in twenty-six villages of Banda District. Project team visited the site location and verified the details provided by Land Acquisition office. Details are mentioned in the table below.

3.5.1 Assessment of land The land covered under SIA study (30.6714 hectares) is owned by 147 families spread over 185 survey numbers. The land is privately owned by PAFs. Majority of PAFs gained ownership for the property at the project location through heredity while very few had directly purchased the land from others.

3.6 Bare minimum land assessment More than 96% of the project area has already been acquired for the construction of Bundelkhand Expressway. As landowners are willing to sell their land and are ready to cooperate for compensation/relocation within the project area, same may be considered. The assessment of requirement of land has been done considering the wider layout of the expressway. Hence, the land to be acquired in Banda is the bare minimum that is required for completion of this project.

3.7 Extent of impact The land spread over 185 survey numbers and is owned by 147 families. The land is used for agricultural purpose, which is the main source of livelihood of the PAFs. Acquisition of land will immensely affect their livelihood and would also lead to loss of livestock. At the same time, acquisition of land where educational institution is located will impact access to education for students. Sentiments of people are attached with temple and mosque, which will also be affected due to land acquisition. The present acquisition will substantially impact the land, property, livestock, livelihood, education, and religious sentiments of people.

3.8 Number of families and persons affected Acquisition of land and property at the project location will affect 147 families and their dependents, totalling to a population of approx. 375 people.

3.9 Changes in ownership, transfer and use of lands over the last 3 years Almost all the PAFs have owned the land through heredity and have been engaged in agricultural practices for a very long time. No significant changes in the land use pattern and ownership were found during the site visit by SIA team and interaction with PAFs.

4. ESTIMATION AND ENUMERATION OF AFFECTED FAMILIES’ ASSETS

This chapter describes in detail about directly affected landowners and the impact that the construction of this expressway will have on their family, property, resources, assets, community resources etc.

4.1 Number of property and families affected The land of 30.6714 hectares, spread over 185 survey numbers and owned by 147 families, will be impacted by the construction of Bundelkhand Expressway. Very few people have built property/structures at the project site since the land is primarily used for agricultural purpose by PAFs. However, structures and assets of university, mosque and a temple in Mawai Buzurg, Ghoori, Mahokar, Tilheta and Gadaon will be affected due to construction of this expressway.

4.2 Ownership of land The land to be acquired is privately owned by 147 families. Most of the PAFs have owned the land through heredity while only a few have purchased the land. The information about the ownership of land was collected by Department of Revenue and verified with PAFs by the project team. Out of the 147 PAFs affected by the project, most of them gained ownership through the heredity. In case of the remaining families, the land was acquired through direct purchase from others in the past years indicating an ownership period between 3-6 years.

5. SOCIO- ECONOMIC AND CULTURAL PROFILE

The region which is presently known as Banda district can boast of a rich historical tradition going back to the remote antiquity. Banda District is one among 71 Districts of Uttar Pradesh State, India. Banda District Administrative head quarter is Banda. The total geographic area of the district is about 4460 Sq. km. It has a population of 1,799,410 people.

The current project will pass through FIGURE 5 PROJECT LOCATION the following 26 villages.

Surauli, Bilbai, Hathauda, Pipri, Kanwara, Achraud, Mawai buzurg, Doha, Jaurahi, Jaari, Mahokhar, Tilehata, Jamalpur, Chahitara, Pawai, Bisanda rural, Ghoori, Punahur, Ballan, Chausad, Gandaav, Chandaur, Mawai khurd, Koni, Mohanpurva and Pesta.

5.1 Demographic Profile The present socio-economic assessment was part of the Social Impact Assessment study to understand the population who will be affected by the construction of Bundelkhand Expressway. The household survey was targeted to cover 147 families with a representation 88.8% of the directly affected families at the project site. The land to be acquired for the construction of Bundelkhand Expressway is privately owned by the families. Majority of families belong to Hindu religion while a few belong to Muslim Religion. The average family size is five to seven members in each family and most of the PAPs fall in the age group of 20- 50 years. Information related to various socio-economic aspects was gathered from the adult member representatives of each household.

5.2 Socio-Economic Profile of PAF For the current project, 147 families will be affected. The land to be acquired for the construction of Bundelkhand Expressway project is privately owned by the families. Majority of families belong to Hindu religion while a few are Muslims. Most of the PAPs fall in the age group of 20-50 years and the families belong to Other Backward Classes.

Household Particulars of family Details of the socio- economic conditions of the PAFs are mentioned in this section. All the data reported in the graph is in percentage terms. a) Religion There were households adhering to the Hindu and Muslim faiths amongst the surveyed households. It concurs with the district figures where 76% of the population belongs to Hindu religious belief. The number of Islam households comes at the second position. Among the households surveyed most of the households belonged to Hindu religion while the remaining to Muslim religion. b) Social Group The predominant social group amongst the affected group is Other Backward Class/Caste (OBC). Most of the families belonged to this social group. There are very few families that belong to general social community. c) Family Size The average size of the households under the SIA study is 4.8 persons per household. More than 50% of the PAFs have 5-7 members while some (32.8%) of them also have above 7 members. About a quarter of the families have 2-4 members. There are 4 households where the number of family members is more than 8 persons. The number of persons in the household and the factor of the size of the households gain importance given the comparatively small income of the houses that impinge on the living conditions of the family members. More than half of the PAFs live in joint families while some also live in nuclear families.

d) Type of house structure Of the households covered under the SIA study cent percent were living in houses of their own. It needs to be observed here that the residences of the affected people were away from the project area though they possessed agricultural land at the project site. The nature and type of place of stay highlights those families with a distribution from the affected group, owned either pucca or semi-pucca houses. Pucca here means houses which are strong and permanent; terraced and tiled houses that are properly maintained. Kaccha houses meant those which are not strongly built, and which can be easily destroyed. e) Gender Gender-wise, most of the respondents in the study were men. Women constituted almost one third of the affected people. It enabled due representation to the views of the women group. Majority of them irrespective of the gender variation were heads of the households facilitating a detailed elicitation of the information pertaining to subject. f) Monthly salary of PAF More than 40% of the PAFs shared that their monthly income is between Rs 5000-10000. An almost equal percentage of PAFs shared that their monthly income is more than Rs 10000. Only few (3-4%) of the PAFs have monthly income of less than INR 3000. Many of the PAFs were resistant of sharing information regarding their monthly salary during the visit. g) Age of PAP The average age of the respondents who participated in the SIA study was 45 years. In consonance with the average age, more than half of the PAPs of all villages are in the age bracket of 20-50 years.

Stakeholders’ Consultation The project team identified and consulted stakeholders of the project. District Collector, Additional District Collector, Tehsildar, Clerical staff of Collectorate, Lakhpals, Village Pradhans and PAFs were consulted during the study. During the interaction, it was found that most of the PAFs have already sold a part of their land for the construction under the project. The project team identified and consulted stakeholders of the project during the field visit. The consultation was carried out in FIGURE 6 PUBLIC CONSULTATION order to understand the project in a better way and to gather different perspectives.

During the interaction, Mr Abhishek Bhatt, Project Manager, sensitized the participants about the project and details of land acquisition. He also informed the families on the provisions of RFCTLARR 2013.

During the interaction, it was found that most of the PAFs have already sold a part of their land for the construction under the project. They shared that they are satisfied with the project and would like to get monetary compensation from government for their land. They added that the acquisition of land is for national interest and it will serve the purpose of the project. PAFs assured that they will cooperate for the construction of Bundelkhand Expressway. However, they are willing to sell their land at an appropriate compensation.

The summary of responses of various stakeholders is mentioned below.

entire village are attached to this temple and hence they want the temple to be built on different area in the same village.” Another PAFs also shared that they are willing to sell their land for cash compensation. Few of them shared that they may consider selling the land in case land of similar nature within the village is provided to them. The opinions provided by some of the PAFs during interaction with the project team have been recorded in the above table. Most of them shared that they would cooperate in case the compensation offered by the government is appropriate. Some of the PAPs also shared their issues and concerned. District administration of Banda should resolve these issues of PAFs.

6. SOCIAL IMPACT This chapter summarizes and presents the major social impacts both negative and positive and the mitigation measures to be adhered to at various stages of the project with a vision to mitigate the negative social impact and enhance the positive ones. Following are the positive and negative impacts of the project:

6.1 Positive Impact Responses highlight that with the construction and operation of the Bundelkhand Expressway the people and the area will have positive impacts considering future requirements in mind. A few of the major ones cited are:

(i) Increase in land price With the construction, the value of the land holdings in the entire district of Banda is likely to go higher.

(ii) Improved Infrastructure The construction of Bundelkhand Expressway will lead to the overall development of area in terms of improved infrastructure for travelling.

(iii) Allied economic activities Responses of various stakeholders suggest that there will be an enhancement in the economic activities of the area as more hospitality centres including restaurants, lodges and other small- scale business enterprises are likely to emerge and become active as time goes by.

(iv) Brand value to village, state and district All categories (directly/indirectly affected and key informants) of respondents perceived that with the construction under the project, the village, district and state will be earmarked and known at the National and International level. This could bring in more people to the area and become instrumental in the promotion of tourism in the area.

6.2 Negative Impact The negative impacts of the project were discussed by the PAFs. Based on their input and project team’s assessment, the acquisition of land is likely to bring the following negative impacts for the people of the area:

(i) Impact on Land The identified land for construction of Bundelkhand Expressway is privately owned by the PAFs through heredity. The acquisition will lead them to leave their ancestral property. Land acquisition for the project will also lead to loss of grazing land for livestock which might deprive them from their alternate source of income.

(ii) Impact on livelihood (Loss of source of income) The land to be acquired is used for agricultural purpose. Acquisition of this land will affect the source of income for many PAFs. It will permanently take away a source of their income.

(iii) Impact on Physical resources (Loss of assets) The acquisition will impact individual assets of the PAFs such as bore wells, hand pumps, trees, etc. (iv) Impact on common public resources Three temples i.e Bhagwan Shankar Mandir, Shankar ji Virajman Mandir and Thakur ji Maharaj Virajman Mandir of villages i.e. Tilheta, Ghoori and Gadaanv will be fully affected and one mosque of Doha Village will also be affected. This will impact the religious sentiments of the people since there are many believers of this temple. Similarly impact on mosque will also affect the sentiments of people.

(v) Impact on education University of agriculture and technology, will also be impacted by this project. This University is the first Agriculture University of Bundelkhand. Students come here from different areas. With the construction of this project, accessibility and availability of education for students will be impacted.

(vi) Impact on environment Due to increase in the flow of traffic on the road, the level of pollution in air and noise is likely to increase. This will impact the health of the people.

(vii) Safety issues and increase in distance for going from one side of village to other Due to the construction of the expressway villagers may have to travel extra miles to cross the road. This will impact the accessibility of the villagers to reach their fields. At the same time, crossing the expressway to reach to the other side of the village (since it goes from within the village) might pose safety issues.

7. COST AND BENEFIT ANALYSIS

After careful analysis of positive and negative impacts of the construction of Bundelkhand Expressway, the SIA team compared the cost with its benefits. In the following section, a detailed analysis of benefits and respective costs are presented.

The specific cost of the Bundelkhand Expressway project in Banda district was not accessible to the project team. Hence the SIA team was constrained to carry out detailed cost-benefit analysis.

7.1 Assessment of Public Purpose The construction of Bundelkhand Expressway will help in creating employment opportunities for the youth in the coming years and will also lead to better infrastructure & road connectivity. However, the project will prove fruitful for the PAFs and people of nearby villages.

It can further be established that a public purpose will be certainly served by acquiring the private land and thereby, completing the construction of the project. If the project is completed, it will improve connectivity and provide smooth, fast and safe commuting and transportation services to the commuters. If the project is delayed, it will lead to rise in overall cost of the project, affecting both Government of UP and as well its residents. If the project is stopped, it will lead to not only loss in funds but also waste of the entire manpower and resources spent on the project till now. Hence, the social costs and benefits of the proposed land acquisition have been assessed assuming that there will be no change in the location of the project or the quantum of land that will be acquired.

7.2 Impacts on structures and its magnitude Majority of PAFs will lose agricultural land from which they derive their livelihood. A mosque and three temples are also present on the land to be acquired. An educational institution will also be impacted. The land/ property owned by PAFs will be substantially affected.

7.3 Determinants of Compensation As per section 26 and 27 of RFCTLARR-2013, the collector shall adopt following criteria to assess and determine the market value of land and amount of compensation. Market value specified in the Indian Stamp Act, 1899, for the registration of sale deeds or agreement to sell where land is situated, the average sale price of similar type of land situated in the nearest village or nearest vicinity.

During the interaction with the PAFs and PAPs, majority of them are demanding an average compensation of Rs 24-28 lakhs per hectare. As per them such rates have already been paid by other builders/buyers in the same area. The compensation should be made keeping in mind the provisions of the RFCTLARR-2013

7.4 Entitlement Matrix The PAFs will be entitled to the following six types of compensation and assistance packages:

 Compensation for the loss of land, crops/ trees at their replacement cost.  Compensation for structures (residential/ commercial) if any and other immovable assets at their replacement cost.  Assistance in lieu of the loss of business/wage income and income restoration assistance.  Alternate housing or cash in lieu of house to physically displaces households not having any house site.  Assistance for shifting and provision for the relocation site (if required), and  Rebuilding and/ or restoration of community resources/facilities

As per section 26 and 27 of RFCTLARR-2016, the collector shall adopt following criteria to assess and determine the market value of land and amount of compensation. Market value specified in the Indian Stamp Act, 1899, for the registration of sale deeds or agreement to sell where land is situated.

 The average sale price of similar type of land situated in the nearest village or nearest vicinity,  Consented amount of compensation as agreed upon under sub-section (2) of section 2 in case of acquisition of lands for private companies  R& R package as per RFCTLARR-2013

7.5 Criteria for compensation based on Quality of Soil / Land As the land trade/ transactions have been happening among every community in the area, PAPs have their own view about the amount they must get as compensation. As per PAPs the market rate of the land should be compensated minimum four times the market rate of the land plus property value of houses if the same is being acquired. However, when Land and Revenue Department, Govt. of UP was approached, they shared that the rate of lands are fixed as per the classification of the land /soil.

7.6 Conditions and Recommendations for the Acquisition of Land

Comparing the impact of the social costs of the project vis-a-vis the benefits that will accrue to the community once the project is completed; the SIA Team submits the following -

 The project fulfils the criteria set by sub-section (4) of section 4 of RFCTLARR Act, 2013, which requires that the project serves the public purpose and the bare minimum amount of land is being acquired for it.  The costs that will be incurred by the potential PAPs and environment can be mitigated and are not completely irreplaceable.  Therefore, land can be acquired as requested by the requiring body so that the project can be completed.

However, the acquisition of land should be subject to the conditions and recommendations laid down below and given in the Social Impact Management Plan and other relevant chapters of this report, which in turn, are based on the above cost-benefit analysis.

7.7 Compensation amount awarded to the Landowners based on government approved rate of Land In the public consultations, landowners have shown their apprehension towards the amount and process of compensation of their land and structures for the project. The compensation amount should be proper and as per the law. Besides, it should be beneficial for the land and structure owners who will lose their land and structures. The District Collectors should obtain this price information from the UPEDA and should actively consider it while determining the existing value of land as per Section 26(1) of the RFCTLARR Act, 2013.

 Valuation and Compensation for Immovable Assets Immovable assets belonging to the Landowners, such as trees, wells, tube wells, cattle shed, boundary wall and other immovable assets will be affected, if the land is acquired. It is recommended that valuation and compensation of these immovable should be based on section 28 and 29 of RFCTLARR Act, 2013.

 Restoration of Livelihood of Affected Persons / Households The PAFs are likely to lose a part or whole of their farm incomes and farm-based livelihoods or their existing livelihood. It is recommended that adequate financial and material support should be provided by the requiring body to restore their livelihoods, if the land is acquired. The restoration of livelihoods should be based on existing livelihood assets, skills and education and current occupation and income of each potential PAF. The support should be provided at least to the level that incomes are restored to the pre-project levels and their overall well-being is improved after the acquisition.

7.8 Cost estimation of Land Based on discussion with the public, the following cost of the estimation for the compensation is given below. There is variation of cost of the land. They mentioned that the market of 1 hectare of agricultural land ranges from Rs. 8-24 lakhs.

The final compensation should be decided in consent with the PAFs and as per the RFTLARR 2013.

Compensation should be given as per RFCTLARR Act 2013 or as per populated demand of minimum four times of the circle rate since the land belongs to rural area. Adding the cost of compensation for loss of livelihood and assets, and cost incurred for mitigation measures, the total cost is estimated to be approx. Rs 58,95,73,480.00.

It should be noted that this is an estimated cost. Final cost should be calculated by concerned valuation agencies after valuation of assets and resources of the PAFs.

8. SOCIAL IMPACT MANAGEMENT PLAN

This Social Impact Management Plan (SIMP) has been prepared to mitigate negative social impacts of this project according to RFCTLARR. The SIMP consists of a set of mitigation, monitoring and institutional measures to be taken during the design, construction and operational phases of the project to eliminate adverse social impacts or to reduce them to acceptable levels. The main aim of the SIMP is to ensure that the various adverse impacts are mitigated and the positive impacts are enhanced. The SIMP shall be implemented during the various stages of the project viz. pre-construction stage, construction stage and operational stage. In compliance with section 4 of the Right to Fair Compensation and Transparency in Land Acquisition, resettlement and rehabilitation Act of 2013, the present social impact assessment was carried out with the prime objective to identify the potential socio-economic positive and negative impacts of land acquisition and to develop attainable mitigation measures to enhance positive impacts and reduce or avoid negative impacts and thereby ensure a participative, informed and transparent process of land acquisition for the construction of Bundelkhand Expressway.

8.1 Approach to mitigation The SIA team made use of a combination of research approaches i.e., quantitative and qualitative, for the identification of various social impact and the mitigation measures. Adoption of a combination of both qualitative and quantitative methodology was intended to obtain a more comprehensive data and more holistic result without excluding any important area of assessment. The mitigation measures proposed were arrived at through a series of interactions and discussions with different categories of stakeholders, viz., the project affected population, panchayat member, government officials of Department of Revenue and Land Reforms. The collected information on social impact was studied and discussed internally and externally with experts in order to frame the mitigation plan. The process of such interactions culminated at framing various measures to mitigate and avoid or reduce the impact.

8.2 Summary of key impacts and their mitigation Based on the desk review, field investigations and consultations undertaken during the social impact assessment study for the construction of the Bundelkhand Expressway, the following Social Impact Mitigation Plan (SIMP) has been developed to mitigate negative social impact that may arise from the same at Banda district. Environment degradation, social impact and economic loss were found to be the negative impacts of the project. In this regards, the following mitigation measures can be adopted:

8.3 Measures to Avoid, Mitigate and compensate The Proponent should ensure that preventive measures are taken to address the issues. A redressal system may be set up with representatives from Revenue department, Panchayat and the proponent for the speedy settlement of the unanticipated issues that may crop up during various stages of the project. Comparing/weighing the positive against the negative impacts, it can be easily concluded that the former outweighs the latter reaffirming the identified site as the most suitable and apt one for the construction of Bundelkhand Expressway. It is observed that although the

SIA Report of Bundelkhand Expressway Project in District Banda, UP, India landholders for sure lose the land, their quality of life is less likely to get affected as they are mainly depended on agriculture as the major means of livelihood. The loss of asset which is ancestral for most will have its negative impact physically and psychologically. Yet, analysing the impacts it is inferred that there is absolutely no displacement of households on one side and on the other the negative impact on land, livelihood, physical resources, public facilities or culture are comparatively lesser or minimum. It is also observed by the SIA team that many of the negative impacts highlighted above can be minimized or reduced further with appropriate and effective mitigation measures/strategies mentioned above.

9. PUBLIC HEARING

Public hearing was held on 28th February, 2020 in all the three tehsils of Banda District. The notice was issued by the Administration of Banda District wide Notification No. 8074, UPEIDA 19/1103/ Bhu- Arjun dated 24/02/2020. The Public Hearing witnessed participation of project affected families, members of Panchayat committee (Gram Pradhan), State (SDM), official from UPEIDA, Tehsildaar, Lekhpal and representatives of SR Asia (Attendance sheet is attached as Annexure 3).

A) Public Hearing at Pipri, Kanwara, Jaari and Johari villages

Lekhpal discussed an issue on behalf of many PAPs that the land of owners in the north direction has been left for the completion of deed whereas the land in the south direction is acquired less. Similar issue was raised by the lekhpal that more land is acquired than registered. Mr Sanjay Yadav, shared that 99.5% of the land acquisition is completed, only the deed of the disputed cases is pending. Villagers of Jaari, Johari, Pipri and Kanwara villagers seemed happy with the development and were willing to give their land for the construction of the expressway.

Few of the PAPs informed the officials that their case is disputed in the court. Due to this the deed is not completed. Other few of the PAPs also informed them that the land acquired is more or less than the marked.Many of the PAPs present during the public hearing demanded for the construction of an underpass drainage as their present source of irrigation is getting impacted due to acquisition of land for the construction of the expressway.

Most of the PAPs agreed to give away their land for the construction of the expressway. Few of the PAPs present during the public hearing raised their concern to officials saying that their case is disputed in the court. Public hearing ended with a good note. All the issues were noted down by the officials and SR Asia’s representatives.

6. RECOMMENDATIONS

After the analysis of the data collected through tools developed, meetings with stakeholders and public hearing the project team has prepared some recommendations.

 Some of the PAFs shared that they are ready to sell their land in lieu of appropriate monetary compensation. The department should make provisions in this regard as per the provisions of RFCTLARR Act 2013.  The compensation amount should be four times the market rate since the land belongs to rural area, as per the provisions of RFCTLARR Act 2013.  Land/ alternative for fodder production/grazing of livestock of the PAFs may be planned in the nearby areas.  Most of the land owners has raised an issue of proper mapping of their land which is going to be acquired and as a suspicion size may vary therefore the team recommended that an official from the revenue department must be appointed to verify the land acquired and accordingly the compensation can be calculated.  Incase PAPs and PAFs want to grab an employment opportunity during the construction phase of the project, preference can be given to them.  If a toll plaza falls somewhere near to any village, under those circumstances the nearby villagers should get free access across the road for their daily communication.  Underpasses needs to be identified by the agency concerned for the free movement of the villagers whenever the expressway is creating a barricade for their entry to the either side of the road in their day to day life and work.  The farmers should either be compensated for the total production of kharif crops or the expressway should be constructed after the final harvesting of the crops is completed.  The construction of the expressway will block the free flow of storm water which can further result into flooding. Therefore, the drainage system of the underpass can be designed accordingly.  Vegetation can be planned to the size that it can mitigate the risk of the environmental degradation and also improve the vegetation characteristics of the area for more water availability.  Social Impact Management plan (SIMP) has been developed and should be adhered
