Farmonov, Mr. N. Isakov, Mr. Z. Rakhimov, Mr. K. Okpulatov, Mr. A. Karamatov and Mr. G. Zhalilov Azamzhon Turgunovich Farmonov Born 13 December 1978, an ethnic Uzbek, citizen of Uzbekistan and native of Beshariq district in Farg‘ona province, sentenced on 15 June 2006 by the Yangiyer municipal court of Sirdaryo province to 9 years’ deprivation of liberty under article 165, paragraph 2 (c) (Extortion), of the Criminal Code. Sentence began: 29 April 2006 Sentence will end: 29 April 2015 Is serving his sentence at the UY-64/71 correctional facility (in Jasliq, Qo‘ng‘irot district, Republic of Qoraqalpog‘iston). Mr. Farmonov has not been transferred to any other facility, before, during or since the visit by delegates of the International Committee of the Red Cross (ICRC) to UY-64/71 in 2011. On entry to correctional facility, the convict underwent a complete medical examination and was found to be in good health. While serving his sentence, Mr. Farmonov has never been subjected, nor is he now being subjected, to any torture, ill-treatment, degrading treatment or other violent or illegal action by the administration of the correctional facility. The assertion in the joint communication from the Special Rapporteurs that on 16 November 2011 Mr. Farmonov was subjected to beatings and ill-treatment while being held at the UY-64/71 correctional facility is inconsistent with the facts. While serving his sentence, the convict has made no complaints about his state of health to the administration. As at 17 May 2012, Mr. Farmonov’s health status was assessed by the facility’s medical staff as satisfactory. He requires no additional medical assistance. Nasim Achilovich Isakov Born 12 November 1966, an ethnic Uzbek, citizen of Uzbekistan and native of Jizzax province, prior conviction: on 18 May 1998, sentenced to 4 years’ deprivation of liberty by the Jizzax municipal court under article 177, paragraph 2 (c) (Illegally obtaining or selling foreign currency), of the Criminal Code; by a decision of 30 June 1998 of the Jizzax district court, sentence set at 3 years. Released from serving his sentence on 10 January 1999, in accordance with a presidential amnesty decree of 1 December 1998. In the current criminal case, sentenced on 20 December 2005 to 8 years’ deprivation of liberty by the Jizzax criminal court, under article 277, paragraph 3 (a) (Hooliganism), and article 165, paragraph 2 (a) (Extortion), of the Criminal Code. Sentence began: 27 October 2005 Sentence will end: 27 October 2013 HRC/NONE/2012/77 GE.12-13821 (E) 161012 191012 HRC/NONE/2012/77 Is serving his sentence at the UY-64/3 correctional facility (Tavak settlement, Tashkent province). When he entered the remand centre, it was ascertained that Mr. Isakov suffered from a chronic illness with craniocerebral injury, for which he had since 1999 been receiving treatment at the local medical facilities of the health services in his place of residence. The medical staff at UY-64/3 examined him and registered him with a diagnosis of schizophrenia and chronic epimesotympanitis on the right side. While serving his sentence, he has received inpatient treatment for his illness three times at the National Hospital (UY-64/18 correctional facility, Tashkent), as follows: 1. 15 April 2006 to 15 July 2006. 2. 13 August 2007 to 20 November 2007. 3. 28 March 2008 to 10 April 2008. On 28 April 2012 he was examined by specialized doctors at UY-64/18. The following diagnosis was drawn up: “Schizophrenia, chronic epimesotympanitis on the right side, deviated septum, status post radical surgery”. As at 17 May 2012, Mr. Isakov’s health status was assessed by the facility’s medical staff as satisfactory and not requiring inpatient or outpatient care. Zafar Sharapovich Rakhimov Born 21 July 1970, an ethnic Uzbek, citizen of Uzbekistan and native of Qarshi, in Qashqadaryo province, sentenced to 8 years’ deprivation of liberty on 24 October 2007 by the Qashqadaryo provincial court, under the following provisions: article 159, paragraph 3 (b) (Attack on the constitutional order of the Republic of Uzbekistan); article 244, paragraph 3 (a) (Preparation or distribution of material that endangers public order and public security); article 244, paragraph 1 (Formation, leadership or membership of religious extremist, separatist, fundamentalist or other banned organizations); and article 59 (Sentencing for multiple offences) of the Criminal Code. Sentence began: 13 May 2007 Sentence will end: 13 May 2015 Is serving his sentence at the UY-64/21 correctional facility (in Bekobod, Tashkent province). On entry to the correctional facility, the convict was examined by the medical staff and was found to be in good health. As at 17 May 2012, Mr. Rakhimov’s health status was assessed by the facility’s medical staff as satisfactory. Khabibulla Okpulatov Born 25 March 1950, an ethnic Uzbek, citizen of Uzbekistan and native of Samarqand province, prior conviction: on 18 October 2005, sentenced to 6 years’ deprivation of liberty by the Samarqand provincial court under article 139, paragraph 3 (Slander); article 165, paragraph 2 (Extortion); and article 59 (Sentencing for multiple offences) of the Criminal Code. In accordance with a decision on amnesty adopted by the Senate of the Oliy Majlis, the legislature of Uzbekistan, on 2 December 2005, the sentence was commuted, with the unserved portion reduced by a third, to 4 years and 2 months. 2 GE.12-13821 HRC/NONE/2012/77 While serving his sentence, Mr. Okpulatov has on numerous occasions violated the detention regime. He is a persistent recalcitrant violator of the regime for the serving of sentences and as such on 26 June 2009 was the subject of a criminal case initiated by the procurator responsible for the town of Navoiy under article 221, paragraph 2 (b) (Failure to comply with the lawful demands of the administration of a correctional facility). He was sentenced on 30 September 2009 by the Navoiy municipal criminal court to 3 years and 8 days’ deprivation of liberty under article 221, paragraph 2 (b), and article 60 (Establishment of penalties with multiple convictions) of the Criminal Code. Sentence began: 26 June 2009 Sentence will end: 4 July 2012 Is serving his sentence at the UY-64/45 correctional facility (in Olmaliq, Tashkent province). When he entered the remand centre, and later correctional colony UY-64/45, where he underwent a thorough medical examination, doctors of the medical service recorded his history. The convict reported that he had been injured in his left eye in childhood. The facility’s medical staff registered him with the following diagnosis: “Post-traumatic cataract in the left eye”. While serving his sentence at the correctional colony, the convict has undergone annual preventive examinations and in accordance with doctors’ recommendations has been provided with qualified medical assistance at the infirmary of the UY-64/45 correctional colony, as follows: 25 May 2008 to 31 May 2008, outpatient care with a diagnosis of “catarrhal tonsillitis”; 31 May 2008 to 5 June 2008, outpatient care with a diagnosis of “chronic osteochondritis”. As at 17 May 2012, Mr. Okpulatov’s health status was assessed by the facility’s medical staff as satisfactory. Alisher Khursanovich Karamatov Born 18 June 1968, an ethnic Uzbek, citizen of Uzbekistan and native of Farg‘ona province, sentenced on 15 June 2006 by the Yangiyer municipal court to 9 years’ deprivation of liberty under article 165, paragraph 2 (c) (Extortion), of the Criminal Code. Sentence began: 29 April 2006 Sentence will end: 29 April 2015 Served his sentence at the UY-64/49 correctional facility (Shaikh-Ali village, Qarshi, Qashqadaryo province). Was released on parole by a decision of the Qarshi district criminal court on 12 April 2012. Gaibulla Khairullaevich Zhalilov Born 24 August 1964, an ethnic Uzbek, citizen of Uzbekistan and native of Qashqadaryo province, sentenced on 18 January 2010 by the Qashqadaryo provincial criminal court to 9 years’ deprivation of liberty under article 159, paragraph 3 (b) (Attack on the constitutional order of the Republic of Uzbekistan); article 244, paragraphs 3 (a) and 3 (c) (Preparation or distribution of material that endangers public order and public security); article 244, paragraph 1 (Formation, leadership or membership of religious GE.12-13821 3 HRC/NONE/2012/77 extremist, separatist, fundamentalist or other banned organizations); and article 59 (Sentencing for multiple offences) of the Criminal Code. During his sentence, the convict, in violation of the detention regime, attempted to continue his extremist activities among the inmates. He was thus sentenced on 4 August 2010 to 11 years, 1 month and 5 days’ deprivation of liberty by the Qashqadaryo provincial court under article 159, paragraph 3 (b); article 244, paragraphs 3 (a) and 3 (c); article 244, paragraph 1; and article 59 of the Criminal Code. Sentence began: 4 August 2010 Sentence will end: 9 September 2021 Is serving his sentence at the UY-64/48 correctional facility (Zarafshon, Navoiy province). When he entered the remand centre, Mr. Zhalilov was given a thorough medical examination, which ascertained that he had a chronic illness, active chronic hepatitis, status after resection of the inferior lobe of the right lung (1992), for which he had received a course of treatment at the local medical facilities of the health services in his place of residence. Mr. Zhalilov was registered by the medical staff as having this illness and was given the necessary medical assistance, both as an outpatient and as an inpatient at the facility’s infirmary.
