Vassar College Economics Working Paper # 80 Abstract In this note we investigate the infringement (entry) decision for a firm facing an incumbent patent holder with uncertain patent rights. The entrant risks a dispute by entering, resulting in either a settlement (licensing) or litigation and trial. Using the litigation model described by Priest and Klein, we investigate the expected dispute resolution and its impacts on the entrant’s pre-dispute behavior. The primary contribution is to show that the entrant’s expectations about the patent holder’s beliefs about patent enforceability are a driving factor behind the entry decision. -

Susan Haack SERIOUS PHILOSOPHY1 Abstract What is serious philosophy? What does it demand of us? And is it true, as some suppose, that a philosopher can’t be serious about his work unless he is solemn and humorless? Calling on ideas from C.S. Peirce, Haack argues first that philosophy is a serious form of inquiry, requiring real commitment and real intellectual effort, and then that playfulness and humor may actually be of help in such inquiry, while solemnity and self-importance will, for sure, impede it .“The serious philosopher,” she concludes “must indeed work in earnest – but not in grim earnest.” “… the spirit … is the most essential thing – the motive…” (C.S. Peirce)2 At dinner the night before I was to give a talk in her department, a young professor solemnly told me that there’s no place for humor in serious philosophy. Since the paper on the relation of science and literature I was to present the next day was full of playful literary allusions and verbal jokes this was, to say the least, an awkward moment.3 Nonetheless, my paper was a serious piece of work – jokes and all. Now, thanks to Spazio filosofico’s imaginative choice of theme, at last I have my opportunity to explore what’s wrong with the idea that, to be serious, philosophical work must be humorless. It’s been a long time coming; but, as the saying goes, better late than never. “Serious,” of course, has a whole raft of uses, and many subtly-interrelated meanings. We laugh about the apocryphal billionaire who complains that household expenses are skyrocketing – “a million here, a million there, and pretty soon you’re talking serious money”; meaning real money, a significant sum of money. -

Using the Scientific Method 2002 and 2014 GED Content Area: Science Focus: Scientific Method (2002) and Scientific Hypothesis and Investigation(2014) Activity Type: Graphic Organizer and GED Practice Objectives Students will be able to: Appreciate the purpose of the Scientific Method Understand key terms related to the Scientific Method: observation, hypothesis, test, experiment, result, conclusion Relate the Scientific Method to an experiment Answer GED questions based on the Scientific Method Directions 1. Print the handout “Using the Scientific Method” (next page). Pass out the handout to the class. 2. Explain that the scientific method is the way scientists learn about the world around us. This involves several steps, often in the form of experiments. Discuss the 5 steps in the chart on the handout and define the highlighted words. 3. Have a student or students read the first passage out loud. Ask the class to fill in the chart. They can fill in the chart individually or in pairs (discussing these concepts can help students develop their thinking skills). 4. Discuss the students’ answers. Samples: 1. Observation: Where there was Penicillium mold, there were also dead bacteria. 2. Hypothesis: The mold must produce a chemical that kills the bacteria. 3. Test: Grow more of the mold separately and then return it to the bacteria. 4. Result: When the material is returned to the mold, the bacteria died. 5. Conclusion: Penicillium kills bacteria. 5. Have students read the passage at the bottom of the page and answer the GED practice question. Choice (4) is correct because the doctor saw that when the chickens ate whole‐grain rice with thiamine, they did not have the disease. -

Accordingly, to 31 benefit from cultural evolution’s ability to solve complex adaptive problems, learners must be 32 credulous. However, credulity entails costs, including susceptibility to exploitation, and effort 33 wasted due to false beliefs. One determinant of the optimal level of credulity is the ratio between 34 the costs of two types of errors: erroneous incredulity (failing to believe information that is true) 35 and erroneous credulity (believing information that is false). This ratio can be expected to be 36 asymmetric when information concerns hazards, as the costs of erroneous incredulity will, on 37 average, exceed the costs of erroneous credulity; no equivalent asymmetry characterizes 38 information concerning benefits. Natural selection can therefore be expected to have crafted 39 learners’ minds so as to be more credulous toward information concerning hazards. -

Essays on Science, Religion, Law, Literature, and Life, Expanded Edition, New York, Prometheus Books, 2013 Reviewed by Teodor Dima In the preface to the expanded edition of the volume reviewed here, Susan Haack, Distinguished Professor in the Humanities, Cooper Senior Scholar in Arts and Sciences, professor of philosophy, and professor of law at the University of Miami, explains its genesis as follows: “... after the publication of my Evidence and Inquiry (1993), Manifesto of a Passionate Moderate (1998), and Defending Science— Within Reason (2003), I received such a variety of intriguing invitations – from people in the natural, the medieval, and the social sciences, from scholars in literature and scholars in law, from humanists and theologians, even from professors of architecture and the editors of an avant-garde art magazine – asking me to write or speak about the bearing of my work on their concerns” (p. 12). Astrology is not a science, Astronomy is science. Astrologers predict by the influence of planets and they create a psychological game. In other words they establish a perfect marketing and affect the life of an individual in every possible way. Superstition is still ruling and it is degrading the development. What’s so bad about Scientism? Moti Mizrahi Florida Institute of Technology Abstract: In their attempt to defend philosophy from accusations of uselessness made by prominent scientists, such as Stephen Hawking, some philosophers respond with the charge of “scientism.” This charge makes endorsing a scientistic stance a mistake by definition. For this reason, it begs the question against these critics of philosophy, or anyone who is inclined to endorse a scientistic stance, and turns the scientism debate into a verbal dispute. In this paper, I propose a different definition of scientism, and thus a new way of looking at the scientism debate. Those philosophers who seek to defend philosophy against accusations of uselessness would do philosophy a much better service, I submit, if they were to engage with the definition of scientism put forth in this paper, rather than simply make it analytic that scientism is a mistake. Solutions to the problem have been notably raised by the logical positivists (verificationism), Karl Popper (falsificationism), and Imre Lakatos (methodology of research programmes). Due, largely, to the conclusions drawn by Larry Laudan, in a pivotal 1981 paper which dismissed the problem of demarcation as a “pseudo-problem”, the issue was brushed aside for years. Recently, however, there has been a revival of attempts to reexamine the demarcation problem and synthesize new solutions. My aim is to survey two of the contemporary attempts and to assess these approaches over and against the broader historical trajectory of the demarcation problem. These are the efforts of Nicholas Maxwell (aim-oriented empiricism), and Paul Hoyningen-Huene (systematicity). I suggest that the main virtue of the new attempts is that they promote a self-reflexive character within the sciences. -

McGuire ii Copyright c by Zvi Biener 2008 iii The Unity of Science in Early-Modern Philosophy: Subalternation, Metaphysics and the Geometrical Manner in Scholasticism, Galileo and Descartes Zvi Biener, PhD University of Pittsburgh, 2008 The project of constructing a complete system of knowledge—a system capable of integrating all that is and could possibly be known—was common to many early-modern philosophers and was championed with particular alacrity by Ren´eDescartes. The inspiration for this project often came from mathematics in general and from geometry in particular: Just as propositions were ordered in a geometrical demonstration, the argument went, so should propositions be ordered in an overall system of knowledge. Science, it was thought, had to proceed more geometrico. I offer a new interpretation of ‘science more geometrico’ based on an analysis of the explanatory forms used in certain branches of geometry. These branches were optics, as- tronomy, and mechanics; the so-called subalternate, subordinate, or mixed-mathematical sciences.
