DFO has reviewed the information on the existing values, predicted Project effects, mitigation, compensation, and adaptive management provided by the Proponent in the Environmental Impact Statement and supplemental information. The project has been redesigned to address the concerns of the previous panel for the preservation of Fish Lake. The Proponent has also offered mitigation and compensation measures to offset the loss of fish habitat associated with direct and indirect effects of the Project. The direct effects are characterized as permanent disturbances associated with Project infrastructure such as the open pit and tailings embankments whereas the indirect effects are characterized as those effects associated with flow reduction on instream habitat. DFO’s review notes the following: • DFO largely agrees that the description of the existing fish habitat features and values in the Fish Lake watershed are adequately characterized by the Proponent. • DFO agrees with the Proponent’s characterization of the direct project footprint and indirect stream flow effects of the Project on fish and fish habitat. • DFO supports the habitat compensation measures/strategies proposed in the compensation plans and recognizes that the compensation and enhancement techniques are generally well understood and have been demonstrated in previous applications as technically feasible and beneficial to fish and/or fish habitats in certain circumstances. • DFO agrees that conceptually, the direct and indirect project effects can be offset through appropriate mitigation and compensation. • DFO has reviewed the proposed recirculation of flows in Fish Lake and has identified risks associated with the effectiveness of the mitigation. There is substantial uncertainty in the long term regarding fish habitat values and ecosystem functioning, which have the potential to reduce fisheries productivity of Fish Lake. • Should the Project proceed to the regulatory stage , DFO would work with the proponent on the required regulatory requirements and technical details pertaining to feasibility and habitat assessments to support a fish habitat compensation plan consistent with DFO’s policy objectives. • Any adaptive management program designed for the Project should include monitoring of potential downstream effects in the Taseko River, uncertainties regarding the lake recirculation system, mitigation for Fish Lake tributary streams, and actions to ensure any required mitigation is applied appropriately. Page 1 New Prosperity Gold-Copper Mine Project Federal Review Panel Submission of Fisheries and Oceans Canada Introduction Fisheries and Oceans Canada (DFO) has prepared this submission to the New Prosperity Gold-Copper Mine Project Federal Review Panel (the Panel) in response to the request from the Panel to attend the public hearing and present DFOs technical review of the potential environmental effects of the New Prosperity Gold-Copper Mine Project (the Project) as proposed by Taseko Mines Limited (the Proponent). The Panel requested that DFO provide relevant information and recommendations to the Panel as they relate to the department’s expertise and mandate. The Panel has requested DFO’s expertise on the following subjects: • Aquatic ecosystems (surface waterbodies including Fish Lake, Beece Creek, Taseko River, Wasp Lake, Big Onion Lake); • Fish and fish habitat; • Water quality and quantity; • Lake productivity; • Lake eutrophication; • Current use of lands and resources for traditional purposes; • Mitigation measures including fish habitat compensation; and • Monitoring and follow-up. The New Prosperity Mine Project is a modification to the previous Prosperity Mine Project proposed by the Proponent in 2009. Following the 2009/2010 environmental assessment of the Prosperity Mine Project by way of Federal Review Panel, the Government of Canada concluded that the project as then proposed was likely to cause significant adverse environmental effects that could not be justified in the circumstances. According to the Terms of Reference for the Federal Panel Reviewing the New Prosperity Gold-Copper Mine Project (May 9, 2012 and revised August 3, 2012), the environmental assessment of the Project is intended to thoroughly assess whether the Project addresses the environmental effects identified in the 2009/2010 environmental assessment of the previous Prosperity Mine Project proposal and thus should make use of the information obtained during the 2009/2010 environmental assessment, to the extent possible. As such, DFO reviewed information prepared by the Proponent in support of the environmental assessment of the Prosperity Mine Project from the 2009/2010 review and of the New Prosperity Mine Project proposal, where relevant. British Columbia 2007 BCSC 1700 (“Tsilhqot’in Nation”). Tsilhqot’in Nation (Vickers J, 2007) also recognized the Tsilhqot’in aboriginal right to hunt and trap birds and animals for the purposes of securing animals for work and transportation, food, clothing, shelter, mats, blankets, and crafts, as well as for spiritual, ceremonial, and cultural uses throughout the Brittany Triangle (Tachelach’ed) and the Xeni Gwet’in Trapline. This right is inclusive of a right to capture and use horses for transportation and work. The Court found that the Tsilhqot’in people also have an aboriginal right to trade in skins and pelts as a means of securing a moderate livelihood. These lands are within the Tsilhqot'in traditional territory, the Xeni Gwet'in First Nation’s caretaking area, and partially in the Yunesit’in Government’s caretaking area.

    PROJECT DESCRIPTION August 2011 Executive Summary Taseko Mines Limited, a British Columbia based mining company that owns and operates the Gibraltar Mine near Williams Lake, British Columbia proposes to develop its 100% owned New Prosperity Gold-Copper Project 125 kilometres to the southwest of Williams Lake. Prospected since the 1930s, the New Prosperity ore body was discovered in the late 1960s and has seen extensive exploration work to define an ore body in anticipation of a metal price regime that would support mine development. An environmental impact statement/application was submitted for mine development after the completion of an updated feasibility study in 2007, and was subject to rigorous reviews under British Columbia‟s Environmental Assessment Act (BCEAA) and the Canadian Environmental Assessment Act (CEAA) through the period 2009 to 2010. These reviews culminated in 2010 with the granting of an Environmental Assessment Certificate by the Province of British Columbia to enable the mine to proceed with development, while the federal government refused to grant approval, concluding that aspects of the mine as proposed would result in significant adverse environmental effects. Through their respective reviews, the British Columbia and Canadian government concluded similar findings during their reviews that, if the mine moved forward to development, there would be no significant environmental effects to: air quality; terrain and soil; surface or groundwater quality; moose and mule deer and their habitat; vegetation, including old growth forest and grasslands; archaeological resources; fish in the Taseko River; water quality in Onion Lake; and, human health. August 2011 Both the province and federal government concluded significant adverse effects on fish and fish habitat; the province determined the impact was justified because of the significant economic benefit a mining operation brought to the local communities, the province and the country.

This assessment summarizes existing information on habitat and stock characteristics for summer steelhead populations in the mid-Fraser River. We assessed steelhead production in the mid-Fraser using map-based habitat area estimates as input to a juvenile production model (cf. Tautz et al. 1992) which estimates fry carrying capacity, potential smolt production, and potential adult returns. The analysis may be divided into five distinct parts: 1) the identification of stream reaches used by steelhead fry, 2) the estimation of usable habitat area for steelhead fry, 3) the estimation of steelhead fry carrying capacity, 4) the estimation of potential steelhead smolt yield and adult production based on fry capacity, and 5) the determination of minimum escapements required to fully seed useable habitat and maximum exploitation rates these stocks can sustain.

Wayne McCrory, RPBio.] COVENANT: My review partly focuses on the impacts of access. At the April 29 hearing, I requested of Taseko documentation of the current vehicle use of the Taseko/Whitewater Road of 50 return trips (= 100 vpd) but they were unable to quantify this or name the source. As well, when asked as to what standards Taseko would be up-grading the Taseko/Whitewater road they were unable to provide any information other than to state that this would be left to the BC Ministry of Transportation. I requested of the Panel that they consider the Taseko EIS deficient in this regards until this information is forthcoming. EXECUTIVE SUMMARY My review, using extensive local knowledge and research on wildlife habitats, 40 years of grizzly bear/wildlife expertise combined with a conservation biology and cumulative effects literature review including mine-grizzly bear case history studies, concludes that the Taseko EIS for the proposed Prosperity Mine significantly undervalues the environmental impacts of the mine development on grizzly bears and other wildlife.
