Washington Street Indianapolis, IN 46204 Dear Senator Bray, The undersigned organizations strongly oppose House Bill 1414. The sole purpose of this legislation is to sustain the profits of two coal mining companies, regardless of the negative consequences – higher utility bills, harm to public health, and making it harder for utilities to retire aging, uneconomic coal-fired plants that are not necessary to ensure a reliable supply of electricity. There is overwhelming opposition to this legislation, including from all five investor-owned utilities in Indiana. It runs fundamentally counter to the inevitable trends in the power market, including the systematic phaseout of coal-fired power. Coal’s demise is certain. • The Energy Information Administration projects that renewables will overtake coal as a source of electricity next year, generating 22 percent of the nation’s power, compared to 21 percent for coal plants. • Morgan Stanley expects up to 80 percent of the remaining coal fleet to be financially at risk from renewable energy investments through 2030. • The shuttering of coal plants from 2005 to 2016 saved over 26,000 lives and resulted in higher crop yields near the plants from reduced air pollution, according to a University of California study. • As of 2017, in Great Lakes states, there were about 345,000 clean energy jobs, compared to about 57,000 jobs at coal, natural gas and nuclear power plants and about 21,000 jobs in coal mining and natural gas drilling. • By 2025, NextEra Energy estimates wind and solar facilities coupled with energy storage will be cheaper than most existing coal-fired, nuclear or natural gas-fired power plants. -

This report will be updated as additional election results are received in the hours and days following. Another Election for the Record Books in Indiana Indiana Business for Responsive Government (IBRG), the non-partisan political action program of the Indiana Chamber of Commerce, scored a very successful general election. 48 of 49 IBRG- endorsed candidates facing opposition were victorious, including Republicans and Democrats. Forty-three (43) additional endorsed candidates did not face general election challenges. Twelve (12) new legislators won with IBRG-endorsements. IBRG was significantly-engaged in support of six (6) top-target challenger and open-seat races, as well as successfully defending twelve (12) pro-economy incumbents seriously challenged with defeat. In one of the most dramatic turn of events in years, Republicans won significant battles for state legislative seats across the state to expand their “quorum-proof majorities.” These victories were particularly surprising to those working for months closely in campaigns and candidates, as Indiana’s public opinion environment on issues and views of incumbents was - right up until Election Day - about as bad an environment for Republicans and incumbents as seen in years. This marks the third election cycle in a row that Republicans have expanded their margins in the Indiana House and Senate. The Republicans won a net two (2) seat gain in the Indiana House of Representatives to achieve a 71-29 margin. Four (4) incumbent legislators lost reelection bids in the House (one Republican and three Democrats). -

Advocacy Guide There are many ways to make a difference as an advocate for people with disabilities. Let Your Local Officials Hear Your Opinion As a citizen, your opinions help elected officials decide how to vote on issues. Let your elected officials know your opinions through letters, e-mails, phone calls, etc. Remember, they are very busy and you want your message to have as much impact as possible. For the most impact, your communication should be brief, clear and focused on just one issue. Attend Public Meetings Meetings of the city council, county council, Indiana General Assembly, school board, etc. are open to the public. Attending these meetings helps keep you informed of the way public business is transacted and how the various elected officials interact. In addition, public meetings give citizens a good opportunity to give their opinions by speaking during the public feedback section of the meetings. Nearly all elected officials host public meetings. They are at schools, libraries, churches, etc. This is your opportunity to hear from your elected official what they are working on and to give your input on issues. Letters to the Editor Writing a letter to the editor is an effective way to publicly discuss an issue and influence the decisions of local officials. Every newspaper has different requirements for letters to the editor. In general, as with letters to elected officials, it is important to be brief, clear, and concise and focus on just one issue. Join an Advocacy Group Joining an advocacy group is one way to increase your awareness to elected officials. -

Indiana Law Review Volume 52 2019 Number 3 NOTES PUBLIC BUSINESS IS THE PUBLIC’S BUSINESS: KOCH’S IMPLICATIONS FOR INDIANA’S ACCESS TO PUBLIC RECORDS ACT COURTNEY ABSHIRE* INTRODUCTION “Public business is the public’s business. The people have the right to know. Freedom of information is their just heritage. Without that the citizens of a democracy have but changed their kings.” – Harold L. Cross1 In 2016, the Indiana Supreme Court faced the question of whether records requested pursuant to the Access to Public Records Act (“APRA”) could be withheld on the basis of the legislative work product exemption in APRA, and the Court held for the first time that APRA applied to the Indiana General Assembly.2 But the Court declined to review the question of whether the Indiana House Republican Caucus properly denied the requested records out of concern that doing so would violate the distribution of powers provision in the Indiana Constitution.3 The Court principally relied on two precedent cases involving the Indiana Constitution’s distribution of powers provision, Masariu v. Marion Superior Court and Berry v. Crawford, to formulate its holding in Citizens Action Coalition v. Koch.4 Shortly after the Indiana Supreme Court decided Koch, the Indiana Court of Appeals heard a case involving nondisclosure of records by the Governor’s *. J.D. Indiana General Assembly Report Week Nine The final committee hearings on bills took place on Monday in the House. The balance of the week was dedicated to House and Senate floor action on 2nd and 3rd Readings. The Senate completed work on 3rd readings Tuesday and the House finished 3rd readings Thursday. A number of concurrence and dissent motions also progressed, sending a handful of bills to the Governor. On Wednesday, the Senate honored seven members who are retiring along with Lieutenant Governor Ellspermann, who resigned her office on Wednesday. Former GOP State Chair, Eric Holcomb, nominated by Governor Pence as Ellspermann’s replacement, was approved as the new Lieutenant Governor by both chambers on Thursday. In an effort to adjourn earlier in the week next week, both the House and Senate were in session Friday, which is typically a day legislators are back home. On Tuesday in the Senate, Senate Bill 383 received a 49-1 vote on the motion to concur with changes made in the House. As a reminder, SB 383 creates a new tracker for water utilities to use for infrastructure improvements and repairs with some important “first of its kind” accountability measures imposed on the utility. Additionally, SB383 includes a new policy statement from the legislature, which is applicable to all public utilities, declaring that utility bills should be affordable for current and future generations. CAC offered strong support for this important policy direction from the legislature. SB383 is authored by Sen. Ed Charbonneau (R- Valparaiso) and proceeds to the Governor for further action. On Friday SB15, a concurrence motion to study food desert challenges, received the Senate’s support with a vote of 36-9. -

Lloyd Arnold has been a resident of District 74 his entire life and is a member of the 118th General Assembly freshman class. He was raised in Crawford County and now raises a family there with his wife, Jody, a Perry County native. Rep. Arnold graduated from Perry Central High School in 1992, where his father taught. After graduation, Rep. Arnold went on to join the U.S. Army and later joined the Indiana National Guard. During his service in the National Guard, he attended Oakland City University where he studied Business Management and earned a commission as an officer. Rep. Arnold was commissioned as a lieutenant in 1998, and in 2003 he served the Indiana National Guard in Iraq as an executive officer. Rep. Arnold has also served eight years as a reserve sheriff’s deputy in District 74, and now serves on the Crawford County Sheriff’s Department Merit Board. During his service in the National Guard, Rep. Arnold was employed by Toyota in Princeton as part of the Quality Management Team. Using the experience gained from that position, Rep. Arnold made the decision to open his own businesses in 2007. While serving in the Statehouse, Rep. Arnold sold his business and is now helping entrepreneurs succeed as the executive director of Orange County Economic Development Partnership. -
