Martinez, 249 E Street, Salida, Colorado, 81201, 719-539-5375. 3. Type of application: water rights (surface) 4. Name of structure or plan: Pedersen Spring 5. Location: NW ¼, NE ¼ of Section 25 at a point 2000 feet West of East Section line and 100 feet South of North Section line, and said Section 25, Township 48N, Range 8E, NMPM. 6. Drainage basin: Swindinski Creek, a tributary of San Luis Creek. 7. Quantity: 15 GPM conditional. 8 Appropriation date: June 8, 2001. 9. Type of use: Livestock, wildlife and recreational purposes. 10. Type of structure: spring development 11. Additional information: Spring when developed will be utilized on applicant’s land to encourage the watering of wildlife and domestic animals outside of the riparian vegetation area.

Case No. 2001CW16, The Jasper Association, P.O. Box 855, Monte Vista, Colorado, 81144. Application To Make Absolute A Conditional Water Right in County Name of structure: Jasper Spring #3. Date of Original Decree: March 30, 1984. Case No. 81CW173, Alamosa County Combined Court. Location: A point in the SE1/4 SE1/4 SW1/4 of Section 29, Township 37 North, Range 5 East, NMPM, being 160 feet from the South Section line and 2550 feet from the West Section line in Rio Grande County, Colorado. Source: The Jasper #3, a natural spring tributary to Spring Creek, a tributary of the Alamosa River. Appropriation Date: March 6, 1981. Amount: 200 GPM per minute. Use: Domestic, municipal uses including fire protection and recreational purposes. Provide a detailed outline of what has been done toward completion or for completion of the appropriation and application of water to a beneficial use as conditionally decreed, including expenditures: Over the years, since the initiation of the Jasper development in the Town of Cornwall, the Jasper Association has periodically applied for conditional water rights and has received such through Case No. 81CW173, 88CW6 and 94CW30. Water has been hauled from the spring by individuals of the Jasper Association for domestic and recreational use in camping. As cabins were built cisterns were installed and water hauled in quantities up to 500 gallon to fill the cisterns for domestic and recreational uses. Continued building has increased the number of cabins in the Jasper Association to approximately to 50 with 20 of these hauling water from the spring. Date water applied to beneficial use: June 1, 2001; Amount: 75 GPM. Use: Domestic, municipal and recreational with 125 GPM to remain conditional. Description of place of use where water is applied to beneficial use: The use of 75 GPM of water referenced above is a figure calculated to provide domestic water to residence in the Jasper Association for years to come as building of more residential and recreational cabins are constructed. This water is hauled to cisterns located at the residences as required for domestic purpose. Not all residences in the Jasper Association require water from the spring. Most of them have drilled wells that provide for their domestic water needs. The remaining 125 GPM of the 200 GPM referred to above, is requested to remain conditional for the decreed purpose. You are further notified that you have until the last day of September, 2001, to file with the Water Clerk, in quadruplicate, a verified statement of opposition setting forth facts as to why a certain application should not be granted or why it should be granted only in part or on certain conditions. A copy of such a statement of opposition must also be served upon the Applicant or the Applicant’s attorney and an affidavit or certificate of such service must be filed with the Water Clerk. A $45.00 filing fee is required.
