THE JUVENILE JUSTICE (CARE AND PROThCTION OF CHILDREN) AMENDMENT ACE 2006 (Act No. 33 OF 2006) AN
ACT
to qmend the ./uvenile Justice (Care and Protection of children) Act, 2000: BE it enacted by Parliament in the Fifty-seventh Year of the Republic of India as follows:— - $ - I. Short title. —This Act may be called the Juvenile Justice (Care and Protection-of Children) Amendment Act, 2006
2. Amendment of long title.—n the Juvenile Justice (Care and Protection of Children) Act.- 2000 56 of 2000 (hereinafter refened to as the principal Act), in the long title, for the words "through various institutions established under this enactment", the words "and for matters connected therewitlr or incidental thereto" shall be substituted.
3. Amendment of section 1.—In section 1 of the principal Act, in the marginal heading, for the words "and commencemenf', the words, "commencement and application" shall be substituted; after sub-section (3), 'the following sub-section shall be inserte namely:—.
"(4) Notwithstanding anything contained in any other law for the time being in force, the provisions of this Act shall apply to all cases involving detention, prosecution, penalty or sentence of imprisonment of juveniles in conflict with law under such other law.". .
4. Amendment of section 2.—In section 2 of the principal Act,- (i) after clause (a), the following clause shall be inserted, namely:- '(aa) "adoption" means the process through which the adopted child is permanently separated from lis biological parents and become the legitimate chi'ld of his adoptive parents with all the rights, privileges and responsibilities that are attached to the relationship;';

(ii) in clause (d),- after sub-clause (i), the follG%'&ing sub-clause shall be inserted, namely:- "(ia) who is found begging, or who is either a street child or a working child in sub-clause (v), aftpr the word 'abandoned', the words 'or surrendered' shall be inserted; (iii) in clause (Ii), for the words "competent authority", the words "State Government on the recommendation of the competent authority" shall be substituted; (iv) for clause (1), the following clause shall be substituted, namely:- '(I) "juvenile in conflict with law" means a juvenile who is alleged to have committed an offence and has not completed eighteenth year of age as on the date of commission of such offence;'; (v) clause (m) shall be othitted. Omission of certain espressi'ons.—Throughout the principal Act, the words "local authority","or local authority" and "or the local authority", wherever they occur, shall be omitted. - Amendment of section 4.—In sôction 4 of the principal Act, in sub-section (1), for the words "by notification in the Qffiçial Gazette, constitute • a district or a group of districts specified in the notification", the words ,ithin 4 period of one year from the date of commencement of the Juvenile Justice (Care and Piotection of Children) Amendment Act, 2006, by notification in the Official Gazette, constitute for every district" shall be substituted. of section 6.—In section 6 of the principal Act: i j-i a 7. Amendment V-section (1), the words "or a group of districts" shall be omitted. 8. Ynsertion of new section 7A.—After section 7 of the principal Act, the fd}lowing section shall be Inserted, namely:- "7A. Procedure to be followed when claim of juvenility is raised befpre any cour%—(l) Whenever a claim of juvenility is raised before any court or a &ourt is of the opinion that an accused persop was a juvenile on the date of commission of the offence, the court shall make an inquiry, take such evidence as may .be necessary (but not an affidavit) 4

so as to determine the age of such person, and shall record a finding whether the person is a juvenile or a child or not, stating his age as nearly as may be: - Provided that a claim of juvenility .may be raised before any court and it shall be recognised at any stage, even after final disposal of the case, and such claim shall be determined in terms of the provisions contained in this Act and the rules made thereunder, even if the juvenile has ceased to be so on before the date of commencement of this Act. (2) If the court finds a person to be a juvenile on the dat )f commission,of the offence under sub-section (1), it shall forwardee juvenile to the Board for passing appropriate order, and the sentence if any, passed by a court shall be deemed to have no effect.".
9. Amendment of section 10.—in seption 10 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:- "( 1 ) As son as a juvenile in conflict with law is apprehended by police, he shall be placed under the chEge of the special juvenile police unit or the designated police officer, who shall produce the juvenile before the Board without any loss of time but within a period of twenty- four, hours of his apprehension exdluding the time necessary for the journey, from the place where the juvenile was apprehended, to the Board: • Provided that in no case, a juvenile in conflict with law shalt be placed in a police lockup or lodged in a jail.".
10. Amendment of section 12—In section 12 of the principal Act, in sub-section (1), after the words "with or without surety"; the words "or placed under the supervision of a Probation Officer or under the care of any fit institution or fit person" shall be inserted.
11. Amendment of section J4..L.Section 14 of the principal Act shall be renumbered as sub-section (1) thereof, and after sub-section (1) as so renumbered, the following sub-section shall be inserted, namely:- "(2) The Chief Judicial Magistratç or the Chief Metropolitan Magistrate flaIl review the pendency of cases of the Board at every six months, and shall direct the Board to increase the frequency ofits sittings or may cause the constitution of additional Boards.". - 12. Amendment of section 15—In section 15 of the principal Act, in sub-section (1), for clause (g), the following clause shall be substituted, nakne*- "(g) make an order directing the juvenile to be sent to a special home for a period of three years: Provided that the Board may, if it is satisfied that having ¶e.gard to the nature of the offence and the circumstances of the case, it is expedient so to do, for reasons to be rçcorded, reduce the period of stay to such period as it thinks fit.".
13.Amendment of sectioi 16.-'-In section 16 of the principal Act,- in sub-section (lh for the words "or life imprisonment", the words "or imprisonment for any term which may extthd to imprisonment for life" shall be substituted; in sub-section (2), for the proviso,'the following proviso shall be substituted, namely:- "Provided that the period of detention so ordered shall not exceed in any case the maximum period provided under section IS of this Act:".
14. Amendment of section 20.—in sectign 20 of the principal Act, the following proviso and Explanation shall be inserted, namely:- "Provided that the Board may, for any adequate and special reason to be mentioned in the order, review the case and pass appropriate order ' in the interest of such jueni1e. Explanation.-4n all pending cases including trial, revision, appeal or any other criminal proceedings in respect of ajuvemle in conflict with law, in any court, the determination of juvenility of such a juvenile shall be in terms of clause (1) of section 2, even if the juvenile ceases to be so on or • before the date of commernement of this Act and the provisions of this Act shall apply as if the said provisions had beqi in force, for all purposes and at all material times wheb the alleged offence was committed.". 15. Substitution of new section for section 21—For section 21 of the principal Act, the following section shall be substituted, namely:- "21. Prohibition of publication of name, etc., of juvenile in conflict with law or child in need of care and protec(ion involved in any proceeding under the Act.—(1) No report in any newspaper, magazine, news-sheet or visual media of any inquiry, regarding 'a juvenile in conflict with law or a child in need of care and protection under this AcJ shall disclose the name, address or school or any other particulars calculated to lead to the identification of the juvenile or child nor shall any picture of any such juvenile or child be published: Provided that for reasons to be recorded in writing, the authority holding the inquiry may permit such disclosure, if in its opinion such disclosure is in the interest of the juvenile or the child. (2) Any person who contravenes the provisthns of sub-section (1 <), shall be liable to a penalty which may extend to twent9-five thou .1 rupees.".
16. Amendment of sedion 2— In section 29 of the principal Act, in sub- section (1), for the words "by notificition in Official Gazette, constitute for every district,or group of district' specified in the notification", the words "within a period of one Year from the date of commencement of the Juvenile Justice (Care and Protection of Children) Amendn'ent Act, 2006, by notification in the Official- Gazette, constitute for every distric'l shall be substituted.
17. Amendment of section 32.—ln soction 32 of the principal Act,- (a) in sub-section(l),— in clause (iv), the words "authorized by the State Government" shall be omitted; '4- in following pioviso shall be inserted at the end, namely:- "Provided that the child shall be produced before the Connnitt without any loss of time but within a period of twenty-four hou . excluding the time necessary for the journey."; (b) 'insub-section (2), the words "to the police and" shall be omitted. 18. Amendment of section 33.—In secti,n 33 of the principal Act,- in sub-section (1), the words "or. any police officer or special juvenile police unit or the designated police officer" shall be omitted; for sub-section (3), the following sub-sections shall be substituted, namely:- "(3) The State Government shall review the pendency of cases of the Committee at eVery 'six months, and shall direct'the Committee to increase the frequency of its sittings or may cuse thç constitution of additional Committees. ..' - 1 0
- (4) After the completion of the inquiry, if, the Committee is of the opinion that the said child has no family or ostensible support or is in continued need of care and protection, it may illow the child to remain in the children's home or shelter home till suitable rehabilitation is found for him or till he attains th( age- of eighteen years.". Act, after • 19. Amendmsnt of sectiOn 34.—In sectioti 34 of the principal. sub-section (2), the following sub-section shalj be inserted, namely:- -: "(3) Without prejudice to anything contained in any other law for thetime being in force; all institutions, whetber State Government run or those run by voluntary organisations for children in need of carç and protection shall, within a period of six months from the date of commencement of the Juvenile Justice (Care and Protection of Children) Amendment Act, 2005, be registered under this Act in such manner as may be prescrikd.". 20. Amendment of section 39—I11 section 39 Sf the principal Act, for the Explanation, the following Explanation shall be substituted, nainely:- 'Explanation—For the purØoses of this section "restoration of - and protection of a child" means restoration to- - (a) parents; • (b) adopted parents; (c) foster parents; (d) guardian; - - (e) fit person; , - . . (f) fit- institution.'. .21. Amendment of section 41.—In section 41 of the principal Act,- (i) for sub-sections (2), (3) and (4), the following sub-sections • shall be substituted, namely:- - "(2) Adoption shall be resorted to for the rehabilitation of the children who are orphan, abandoned or surrendered through such mechanism as may be prescribed. - (3) in keeping with the provisions the various guidelines for adoption issued from time to time, by the State Government, 'or the Central Adoption Resource Agency and notified by the Central t o

Government, children may be given in adoption by a court after satisfying itself regarding the investigations having been carried out, as are required for giving such chiren in adoption. (4) The State Government shall recognize one or more of its iflstltutions or voluntary organisations in each district as specialized • adoption agencies in such manner as maybe prescribed for the • placement of orphan, aband6necl or surrendered childreh for adoptiQn in accordance with the guidenes notified under sub-section (3) Provided that the children's homes and the institutionsrun by ñe ' State Govermnent or a voluntary organization for children in fleef care and protection, who are orphan, abandoned or surrendered, s il ensure that'these children are declared free for adoption by the Committee and all such cases shall be referred to the adoption agency in that district for placenient of such children in adoption in ac'cordance with the guidelines notified tinder sub-section (3)."; (ii) for sub-section (6), the following sub-section shall be • substituted, namely:--
• "(6) The court may allow A child to be given in adoption- to a person irrespective of marital status; or to parents to adopt a child of same sex irrespective of the number of living biological sons or daughters; or • (c) to childless couples.". I 22. Substirutioji of new section 4or section 57.—For section 57 of th... principal Act, the following setion shall be substituted, namely:-
"57. Transfer between children's homes una4r the Act, and * juvenile homes of like nature in different parts of India—The St Government may direct any child or the juvenile to be transferred fro any children's home or special home within the State to any other children's home, special home or institution of a like nature or to such institutions outside the State in consultation with the concerned State Government and withjhe prior intimation to the Committee or the Board, as the case niy be, and such order shall be deemed to be operative for the competent authority of the area to which the child or the juvenile is sent.". .0
•A ,nendment of section 59.—In section 59 of the principal Act, in sub- section (2), for the words "for- maximum seven days", the words "for a period generally not exceeding seven days" shall be substituted. Insertion of new section 62A.—After section 62 of the prinoipal Act; the following section shall be inserted, namely:- "62A. Constitution of Child Protection Unit responsible for unpiementatithi, of the Act.—Every State Government shall constitute a Child Protection Unit for the State and, such Units for every - District, consisting of such officers and other employees, as may be appointed by that Gbverninent, to take up matters relating to children in need of care and pro.teptiqn and juveniles in conflict with law with a view to I ensure the implementation of this Act including the establishment and • maintenance of homes, notification of competent authorities in relation to these children and their rehabilitation and coordination with various official and non-official agencies concerned.".
Amendment of section 64.—In section 64 of the principal Act,- (i) for the words "may direct", the words "shall direct" shall be substituted; .. . - • (ii) the following proviso' and Explanation shall be inserted, - namely:—. - - - "Provided that the State Government, or as the case may he the Board, may, for any adequate and special reaspn to be recorded in writing, review the case of a'juvenile in conflict with law undergoing a - sentence of im$isonment, who has ceased to be so on or before the 9: - commencement of thii, Act, and pass appopriate order in the interest of such juvenile. - Explanatiofl.--in all cases whcre a juvenile in conflict with law is - undergoing a sentence of imprisonment at any stage on the date of commencement of this Act; his case including the issue of juvenility, shall be deemed to be decided in tenns of clause (1) of section 2 and other proviions oontained in this Act and the rules made thereunder, • irrespective of the fact that he ceases to be a juvenile' onor before - such date and accordingly he shall be sent to the special home or a fit institution, as the case may be, for the remainder of the period of the sentence hilt- such sentence shall not in any case exceed the maximum period provided in section 15 of this Act.". -

26. Amendment of sectio$ 68.—In section 68 of the principal Act,-- in sub-section (1), the following proviso shall be thserted, - namely:— -
"Provided that the Ccjtral Government rnay, frame model rules in respect of all or any of the matters with respect to which the State Uovenunent may make rules under this section, and Where any Such model rules have been framed in respect of any such matter, they shall apply to the State untilthe rules in respect of that matter is made by the State Government and while , making any such rules, solar as is practicable, they conform to such model rules."; in sub-section (2), (i) inclause (x), after the words, letter and brackets "sub- sectib (2)", the following words, lettet and brackets shall be inserted, namely:—
"and the manner of registration of institutions under sub-sCejion (3)" , . .
. . (ii) after, clause (xiii), the following clause shall be inserted naMely:— - . .
"(xiia) rehabilitation m6cha m to be resorted to in adoption \ under sub-section (2), notification of guidelines under sub-àection (3) and the manner of recognition of specialised adoption agencies under sub-section (4) of section 41;"; . sub-section (3) shall be re-numbered as sub-section (4) thereof, and before sub-section' (4) as so re-numbered, the follàwing sub-section shall be inserted namely:—
- "(3) Every rule made by the Central Government under this' Act shli be laid; as soon as may be after it is made, before each House of Parliament, whileit is in session, for a total period Of. thirty days whic may be comprised in one sessin or in two or more successive sessions, and i4 before the expiry Of the session immediately following the session or the sticcessjvt sessions aforesaid, both Houses agree in making any modification in the rule or both Houses agree that the 'rule should not be made, the rule shall thereafter have effect only in such mbdified form or be of no effet, as the case may be; so, however, that Any- such modification or annulment shall be without prejudice S the validity of anything previously done under, thatrule?'. THE JUVENILE JUSTICE ACT, 1986
AN ACT
to provide for the care, protection, treatment development and rehabilitation of neglected or delinquent juveniles and for the adjudication of certain matters relating to, and disposition of, delinquent juveniles. BE it enacted by Pqrliament in the Thirty-5?Venth Year of the Republic of India as follows CHAPTER I
PRELIMINARY This Act may 1. Short title, extent and cwnmenôentent.—(1) called the Juvenile Justice Act, 1986. I It extends to the whole of India except the State of Jammu and Kashmir. It shall come ánto force on such date as the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Act and for different States. this Act, unless the context otherwise 2. Definitions.—In rei uires,- •(a) "begging" means- soliciting or receiving alms in a public place or entering into any private premises for the purpose of soliciting or receiving alms, whether under the pretence of singing, dancing. fortunetelling, performing tricks or selling -T • articles or otherwise; exposing or exhibiting, with the object of obtaining or extorting alms, any sore, wound, injury, deformity or disease, whether of himself or of any other person or of an animal; . (iii) a.Iowing oneself to be used as an exhibit for the purpose of soliciting or receiving alms; (b) "Board" means a J uvenile Welfare Board constituted uider section 4; 6
"brothel", "prostitute." "prostitution" and "public place" shall have the meanings respectively assigned to them in the Suppression of Xmmoral Traffic in Women and Girls Act, (104 of 1956); 1956 "competent authority" means, in relation to neglected juveniles, a Board and in relation to delinquent juveniles a Juvenile Court and where no such Board or Juvenile Court has been consituted, includes any Court empowered under sub- section (2) of section 7 to exercise the powers conferred on a Board or Juvenile Court; 'deiinquent juvenile" means a ju'enile who has been - - found to have committed an offence; "fit person" or "fit nstitu'[i" means any person or institution (not being a police station or jail) found fit by the competent authority to receive and take care of a juvenile entrusted to his or its care and protection on the terms and conditions specified by the competent authority; "guardian" in relation to a juvenile, includes any pers who, in the opinion of the competent authority, having cognizance of any proceeding in relation to a juvenile, has, for the time being, the actual charge of, or control over, that juvenile. "juvenile" means a boy who has not attained the age of sixteen years or a girl who has not attained the age of eighteen years; - "Juvenile Court" - means a Court constituted under section 5, "juvenile home" means an institution established or certified by the State Government under section home; 9 as a juvenile "narcotic drug" and "psychotropic substance" shall have the meanings respectively assigned to them in the Drugs and Psychotropic Substances Act, Narcotic 1985; (61 of 1985). (I) "neglected juvenile" means a juvenile who--- is found begging; or is found without having any home or settled place of abode and without any ostensible means of subsisten and is destitute; c has a parent or guardian who is unfit or incapacitated to exercise control over the juvenile; or lives in a brothel or with a prostAtute or frequently goes to any place used for the purpose of prostitution, or 7
is found to asociate with any prostitute or any other person who leads an immoral, drunken or depraved life; (v) who is being or is likely to be abused or exploited for immoral or illegal purposes or unconscionable gain; "observa&n home" means any institution or place established or recognised by the State Government under section 11 as an observation home; "offence" means an offence punishable under any law for the time being in force; "place of safety"_ means any place or institution (not j being a police station or jail), the person in charge of which is mporarily to receive and take care of a juvenile and willing te which; in the opinion of the competent authority may be a place of safety for the juvenile; "prescribed" means prescribed by rules made under this Act; (q) "probation officer" means an officer appointed as a •probation officer under this Act or under the Probation of 1958); Offenders Act, 1958 (20 of "special home" means an institution established or certified b the State Government under section 10; "supervision" in relation to a juvenile placed under the any parent, guardian or other fit person or fit institiitickn care of, that juvenile by a under this Act, means the supervision of - . probation officer for the purpose of ensuring that the juvenile is d that the conditions imposed by the • properly looked after an eomptent authority are complied with; (t) all words and expressions used but not defined in this • 1973 (2 of Act and defined in the Code of Criminal Procedure, respectiyely assigned to them 1974), shall have the meanings - in that Code. 4inquiry in respect of jwvenile wiw has 3. continuattm1 of an inquiry has been initiated be a juveni2e.W' cee&dagainst to a juvenile and during the course of such inquiry the juvenile ceases to be such, then, notwithskandi anything contained in this Act or in any other law for the time being in force, the inquiry may be inade in respect of such person as b ntinued and orders may if such person had continued to be a juvenile. - [ii
CHAPTER II
COMPETENT AUTHORITIES AND INSTITUTIONS FOR JUVENILES 4. Juvenile Welfare Board$._(1) k may, by notification in the Official Gazette,The constitute State Government for any area specified in the notificafon one or more Juvenile Welfare Boards for exercising the powers and discharging the duties conferred or Act.imposed on such Board in relation to neglected Juveniles under this A Board shall consist of a Chairman and such other members as the State Government thinks fit to appoint, of I om not less than one shall be a woman; and every such member o:sialJ Criminal be vested Procedure, with the powers of a Magistrate under the Code - 1973 (2 of 1974). The Board shall function as a Bench of Magistrates and 1973siall have,12 the powers conferred by the Code of Criminal Procedure, a Judicialof Magis1974), on a Metropolitan Magistrate or, as the case ma3, trate of the first class. 5. Procedure etc., in relation to Boards and Juvenize Courts. To the event of any difference of opinion among the members of a- Board, or among the Magistrat5 of a Juvenile Court, the Opinion of the majority shall prevail, but where there is no such • majority, the opinion of the Chairman or of the Principal Magistrate, as the case may be, shall prevail. A Board or Juvenile Court may act notwithtandfing the * absence of any member of the Board or, as the case rn2.y be, any Magistrate of the! Juvenile Court, and no order, made by the Board or Juvenile Court shall be invalid by reason only of the absence of any member or Magistrate, as the case: may be, during any stage of the proceeding. No person shall be appointed as a member of 'the Board as a Magistrate dn the Juvenile' Court unless he has, in the opinon of the State' Governmnt, special knowledge of child psychology and child welfare'. 7. Powers of Board and Juvenile Court.—(1) Where a Board • or a Juvenile Court has been constituted for any area, such Board or Court shall, notwithstanding anything contained in any other law for the' time being in force but save, as otherwise exprcs.siy pr ded in this Act, have, power to deal •e:xcu.sive'ly with all pr eedings under this Act re'lat'ing to neglected juveniles or delinquent juveniles, as the , case may be: Provided that a Board or a Juvenile' Court may, if it is of opinion that it is necessary so to do having regard to the .circumstances of the case, transfer any proceedings: to any Juvenile Court or Board, as the case may be: Provided further that where there is any difference' of opinion between a Board and a Juvenile Court regarding the transfer of any procedingn under the first proviso, it shall be referred 'to the! Chief 'Metropolitan Magistrate or, as the case may be', the Chief, Ju&ial Magistrate for decisk.n, and fri a. case where: the District Magistrate is functioning a's a Board or a Juvenile' 'Court, such difference of opinio:n shall be referred to the Court of Session, and the decision of the Chief Metropolitan Magistrate or Chief Judicial VMagistra,Le or', as the case' may be, the Court of Session on such reference shall be! filIal. (2) V/here no Board or Juvenile Court has been constituted for any area, the powers conferred on the Board or the Juvenile Court by or under this Act shall be exercised in that area, only by the following, namely:- the District Magistrate; or the Sub-Diviejioñal Magistrate; or any Metropolitan Magistrate or Judicial Magistrate of the first class, as the ease may be. (3) The powers coiiferred on the Board or Juvenile Court by or under this Act may also be exercised by the Hugh Court and the Court of Session, when the proceeding comes before them in appeal, revision or otherwise.
8. Procedure to be followed by a Magi.strate not empowered t uuder the Act.— (1) When any Magistrate not empowered to exercise the powers of a Board or a JuenjJe Court under this Ac' is of opinion that a person brought before him under any of the provisions of , this Act (otherwise than for the purpose of giving evidence) is a juvenile, he shall record such opinion and forward the juvenile and the record of the proce&ing to the competent authority having jurisdiction over the proceeding. (2) The coi+petent authority to which the proceeding is forwarded under sub-section. (1) shall hold the inquiry as if the juvenile had originally been brought before it. 9. Juvenile homes._(1) The State Government may establish and maintain as many juvenile homes as may be necessary for• reception of neglected juveniles under this Act. Where the State. Government is of opinion that any institution other than a home established or maintained under sub- section (1) is fit for the reception of the neglected juveniles to be sent there under this Act, it may certify such institution as a juvenile home for the purposes of this Act. Every juvenile home to which a neglected juvenile is sent under this Act shall not -only provide the juvenile with accommodation, maintenance and facilities for education, votational training and rehabilitation, but also provide him with facilities for the development of his character and abilities and give him necessary training for protecting himself against moral danger or exploitation and shall also perform such other functions as may be prescribed to ensure: all round growth and development of his personality.
The State Government may, by rules made undr this Act, provide for the management of juvenile, homes, including the standards and the nature of services to be maintained by them and the circumstances under which, and the manner in which, the certification of a juvenile home may be granted or withdrawn 10. Special lwme&(1) The State. Government may establish and maintain as many special homes as may be necessary for the reception of delinquent juveniles under this Act. 11
Where the State Government is of opindon that any institution other than a home established or maintained under sub- section (1), is fit for the reception of the delinquent juveniles to be sent there under this Act, it may certify such institution as a special home for the purposes of this Act. juvethle is Every special home to which a delinquept sent under this Act shall not only provide the juvenile with accommodation, maintenance and facilities for education, vocational training and rehabilitation, but also provide him with facilities for the development of his character and abilities and give hun necessary raining for his reformation and shall also perform such other functions as may be prescribed to ensure all round growth and • develoiment of his personality. The State Government may, by rules made under this Act1 provide for the tianagement of special homes, including the4 standards and the, nature of services to be maintained by them, and the circumstances under wMch, and the manner in which, the cficatiomn of a special home may be granted or withdrawn. The rules made under subsection (4) may also provide • • for the classificatiolt and separation of delinquent juveniles on the basis of age and nature of offences committed by them. The State Government may ii. CHAPTER III
NEGLECTED JUVENILES 1.3. Productj of neglected juvenile8 before Boards_(I) any police officer or any other person or crganisation autho!'ised byIf, the State. observation home (but not to a police station or jail) until he can be brought before a Board. Special procedure to be followed when neglected juveirile has parcn.ts.—(1) If a person who in the opinion of the police officer or the a.u'thorised person or organisation is a neglected juvenile, Ins a parent or guardian who has the actual charge of, or control over, the juvenile, the police officer or the authorised person or the organisation may, instead of taking charge of the juvenile, make k report to the Board for iniUating an inquiry regarding that juvenile. (2) On receipt of a report under sub-section (1), 'the Board may call upon the parent or guardian to produce the juvenile bifore Pb it and to show cause why the juvenile should not be dealt with as a neglected juvenile under 11w provisions of this Act and if it appears to the Board -'that the juvenile is likely to be removed from its jurisdiction or to be ce-nceaied, it may immediately order his re- moval (if necessary by issuing a search warrant for the immediate oduction of the juvenile) to ax observati6n home or a place of ety. Inquiry by Board regarding neglected juvenile6.—(1) When a person alleged to be a neglected juvenile is produced before a Board, it shall examine the police officer or the authorised person or the organisa'tion who brought the juvenile or made the report
- and reóord the substance of such examination and hold the inquiry in the prescribed manner and may make such ôrdors in relation to the juvenile as it may dee-rn fit. (2) %Vherea Board is satisfied on inquiry that a juvenile isa • neglected juvenile and that it is expedient so to -deal with him, the Board may make an order directing the juvenile- to be , s-'n'b to -a juvenile home for the period until he ceases to be a juvenile:
• - Provided that the Board may, for reasons to be recorded, extend the period of such 'stay, but in no case the period of stay shall extend beyond the time when the juvenile attains- the age of eighteen years in the case of a boy, or twenty years, in the case of a girl.: - Provided fth'ther that the Board may, if it is satisfied that having regard to the circurnjstances- of the case it is expedient so to do, for reassns to be recorded, reduce the periOd of stay to such siod a' it thinks fit. - -' W During the nend-ency of any inquiry regarding a juvcnile, the juvenile shall, unless he S kept with his parent or guardian, be sent to an observation hone or a place of safety for such period as maybe specified in the order of the Board: - 14
Provided that no juvenile shall be kept with his parent or guardian if, in the opinion of the Board, such parent or guardian is unfit or unable to exercise or does not exercise proper care and control over the juvenile.
16. Power to commit neglected juvenile to suitable custody.-- - (1) If the Board so thinks fit, it may, instead of making an order under sub-secticri (2) of section 15, for sending the juvenile to a juvenile home, make an order placing the juvenile under the care of a parent, guardian or other fit person, on such parent, guardian or fit person executing a bond with or without surety to be responsible for the good behaviour and well-being of the juvenile and for the observance of such conditions as the Board may think fit to impose. At the time of making an order under sub-section (1) or at any time subsequently, the Board may, in addition, make an order that the juvenile be placed under supervision for any period not exceeding three years in the , first instance. Notwithstanding anything contained in sub-section or sub-section (2), if at any time it appears to the Board, on receiving a report from the probation officer or otherwise, that 'there has been a breach of any of 'the conditions imposed by it in respect of the juvenile, it may, after making such inquiry as it deems fit, order the juvenile to be sent to a juvenile home.
Uncontrollabl3 juvcniles.—Wher e a parent or guardian of a juvenile complains to the Board that he is not able to exercise proper care and control over the juvenile and the Board is satisfied on inquiry that proceedings under this Act should be initiated regarding the juvenile, it may send the juvenile to an obsefvation home or a place of safety and make such further inquiry as it may deem fit and the provisions of section 15 and section 16 shall, as far as may be, apply to such proceedings.
CHAPTER IV
DELINQUENT JUVENILES
Bait and custody of juveniles.—(1) When any person accused of a bailable or non-bailable offence and apparently a juvcnile is arrested or detained or appears or is brought before! Juvenile Court such person shall, notwithstanding anything contain in the Code of Criminal Procedure, 1973 (2 of 1974',or in any other law for the time being in force, be released on bail wdth or without surety but he shall not be so released if there appear reasonable grounds for believin.g that the release is likely to bring him into 15 association with any knowli criminal or expose: him to moral danger or that his release would defeat the ends of justice. When such person having been arrested is not released on bail under sub-section (1) by the officer-in-charge of the police station, such officer shall cause him to be kept in an observation home or a place of safc(y dii the prescribed manner (but not in a - police station or jail) until he can be brought before a Juvenile court. When such person d5 not released on bail under sub- section (1) by the Juvenile Court it shall instead of comnttting hun to prison, make an order sending him to an observation home! or a place of safety for such perdod during the pendency of the inqu&ry regarding him as may be specified in the order. Inforntatioti to parent or guardiain or probatwti officer.- Where a juvenile is arrested, the officer-in-charge of the police statton to which the juvenile is brought shall, as soon as may be after the arrest, inform— - (a) the parent or guardian of the juvenile, if he can be found, of such arrest and direct him to be present at the . Juvenile Court before which the juvenile will appear; and (b) the probation officer of such arrest in order to enable him to obtain information regarding the antecedents and family history of the juvepile and other material circumstances ldkely to be of assistance to the Juvenile Court for making the inquiry. Inquiry by Juvenile Court regarding delinquent juveniles.- Where a juvenile having been charged with an offence appean cr is produced before a Juvenile Court, the Juvenile Court shaH hold the inquiry in accordance with the provisions of section 39 and may, subject to the provisions of this Act, make such order in relation to the juvenile as it deems fit. Orders that may be passed regarding delinquent juveniles.-- (1) Where a Juvenile Court is satisfied on inquiry that a juvenile has committed an offence, then!, notwithstanding anything to the contrary contained in any other law for the time being in force, the Juvenile Court may, if it 50 thinks fit,- (a) allow the juvenile to go home after advice or admonition; 0 (b) direct the juvenile to be released on probation of good conduct and placed under the care of any parent, guardian or other fit person, on such parent, guardian or other fit person executing a bond, with or without surety as that Court may 16
require, for the good behaviour and well-being of the for any period not exceeding three years; jutnile direct the juvenile to be released on probation of good conduct and placed under the care of any fit institution for the good behaviour and well-being of the juvenile for any period not exceeding three years; make an order directing the juvenile to be sent to a special home,-
(1) in the case of a bby over fourteen years of age or of a girl over sixteen years of age!, for a period of not less than three years; - (ii) in the case of any other juvenile, for the period until he ceases to be a juvenile: Provided that the Juvenile Court may, if it is satisfied that having regard to the nature of the offence and the ciréunstances of the case it is expedient so to do, for reasons to be recorded, reduce 'the period of stay to such period as it thinks fit: Provided further that the Juvenile Court may for reasons to be recerded, extend the period of such stay, but in no , case the period of sCay shall extend beyond the time when the juvenile attains the age of eighteen years, in the case of a boy, or twenty years, in the case of a girl;
order the juvenile to pay a fine if he is over fourteet years of age and earns money. (2) Where an order under clause (b), clause (c) or clause (e) of sub-section (1) is made, the Juvenile. Court may, if it is of dpinion that in the interests of the juvenile and of the public it is expedient so to do, in addition make an order that the delinquent juvenile shall remain under the supervision of a probation officer named in the order during such period, not exceeding three . years, as may be specified therein, and may in such suDervision order impose such conditions as it deems necessary for the due supervision of the delinquent juvenile;
Provided that if at any time afterwards it appears to the Juvenile Court on receiving a report from the probation officer or otherwise, that the delinquent juvenile has not been of good behaviour during the period of supervision or that the fit institution und whose care the juvenile was placed is no longer able or willing till ensure the good behaviour and well-being of the juvenile: it may, after making such inquiry as it deems fit order the delinquent juvenile te be sent to a special home. 17
The Juvenile Court making a supervision order under sub-section (2), shall explain to the. juvenile and the parent, guarthali or other fit person or fit institution, as the case may be, under whose care the juvenile has been placed, the terms and conditions of the order and shall forthwith furnish one copy of the supervision order P parent, guardian or other i fit person or fit to the juvenile, the fl institution, as the case may be, the sureties, f any, and the probation officer. In determining the special home,' or any person or VJL institution to whose custody a juvenile is to be committed or trusted under this Act, the Court shall pay due regard to the eligious denoSnation of the juvenile to ensure that religious instruption contrary to the religious persuasion of the juvenile is not imparted to him. 22. Orders that may not be passed against delinquent juvenQes.— (1) Notwithstanding anything to the contrary contained in any other law -for. the time being in force, no delinquent juveniles sba be sentenced to death or imprisonment, or committed to prison in fault of payment of fine or in default of furnishing security: Provided that where a juvenile who has attained the age of fourteen years has committed an offence and the Juvenile Court is satisfied that the offence committed is of so serious a nature or that his conduct and behaviour have been. such that it would not be in his interest or in the interest of other juvenile in a special home to send him to such special home and that none of the other measures provided under this Act is suitable or sufficient, the Juvenile Court, may order the delinquent juvenile to be kept in safe custody in such place and manner as it thinks fit and shall report the case for the orders f the State Government. (2) On receipt of a report from a Juvenile Court under sub- section (1), the State Government may make' such arrangement in respect of the juvenile as it deems proper and may order such Jelinquent juvenile to be detained at such place and on which conditions at is thinks fit: Provided that the period of detention so ordered shall not exceed the maximum period of imprisonment to which the' juvenile could have been sentenced for the offence committed. 23. Proceeding v,nder Ckciptcr VIII of the Code of Criaincd Pr jedure not comipetent aga%'nst juvenile.__Notwithstanding any- thing to the contrary contained in the Code of Criminal, Procedure, 1973 (2 of 1974), no proceeding shall be instituted and no order shall be passed against a juvenile under Chapter V1JJ of the said Code. G. 6921MC. ' IU No joint trial of juvenile and persàn not a juvenite.—(1) Notwithstanding anything contained in section 223 of the Code of Criminal Procedure, 1973 (2 of 1974), or in any other law for the time being in'force, no juvenile shall be charged with or tried for any offence together with a person who is not a juvenile. (2) If a juvenile is accused of an offence for which under section 223 of the Code of Crimfinal Procedure, 1973 (2 of 1974), or any other law for the time being in force, such juvenile and any person who is not a juvenil'e would, but for the prohibition contained in sub-section (1), have been charged and tried together, the court mo taking cognizance of that offence shall direct separate trials of juvenile and the other person. VW Removal of disqualification attaching to conviction.- Notwithstanding anything contained in any other law, a. juvenile who has committed an offence and has been dealt with under the pro- visions of this Act shall not suffer disqualification, if any, attaching to a conviction of an offence under such law. Special provMion in respect of pending cases.—N ith- standing anything contained in this Act, all proceedings in re pect of a juvenile pending in any court in, any area on the date on which this Act comes into force in that area, shall be continued in tht court as if this Act had not been passed and if the court finds that the juvenile has committed an offence, it shall record such finding and instead of passing any sentence in respect of the juvenile, forward the juvenile to the Juvenile Court. which shall pass orders in respect of that juvenile in accordance with the provisions of this Act as if it had been sat is.fied on inquiry under this Act that the :iuvenite has committed the offence.
CHAPTER V
PROCEDURE OF COMPETENT AUTHORITIES GENERALLY AND APPEALS AND REVISION FROM ORDERS OF SUCH AUTHORITIES
Sittings, etc., of Boards and Juvenile Court.—(1) A Board or a Juvenile Court shall hold its sittings at such place, on such day and in such manner, as may be prescribed. (2) A Magistrate empowered to exercise the powers Af a Board or, as the case may be, a Juvenile Court under sub-secti 2) of section 7 shall, while holding any inquiry regarding a juvenile under this Act, as far as practicable, sit in a building or room different from that in which the ordinary sittings of Civil and Criminal Courts are held, or on different days or at times different from those at which the or dinary sittings of such Courts are held. 19 - egarding a juvenile under this Act shall be () An inquiry r held expeditiouslY and shall ordinarily be completed within a period of three months from the date of its commencement, unless, for pecial reasons to be recorded in writing, the competent authority btherwise directs. competent authoritY. 28. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:- the places at which, the days on which, the time at which, and the maimer in which, a competent, authority may hold its sittings; the procedure to be followed by a competent. authority in holding inquiries under this Act, and the mode of dealing with juveniles suffering from dangerous diseases or mental complaints; the circumstances in wMch, and the conditions subject to which, an institution may be certified as a special home or a juvenile's home or recognised as an observation home, and the certification or recognition withdrawn; the internal management of special homes, juvenile homes and observation homes and the standards and the nature of services to be maintained by 'them; the functions and responsibilities of special homes, juvenile homes and observation homes; the inspection of special homes, juvenile homes, observation homes and after-care organisations; the establishment, management and functions of after-care organisations; the circumstances in which, and the conditions subject to which au institution may be recognised as an after-care organisation and such other matters as are referred to in section 12; the qualifications and duties of probation officers; the recruitment and train'g of persons appthited to carry out the purposes of this Act and the terms and _____ conditions of their service; the conditions subject to which a girl who is a neglected or delinquent juvenile may be escorted from one place to another, and the manner in which a juvenile may be sent outside the jurisdiction of a competent authority; the manner in which contributio.n for the niaijj tenance of a juvenile may be ordered to be paid by a parent or guardian; (1) the officers or authorities by whom, the manner in rhieh and the purpose for which the Fund created under section 52 shall be administered 21
the teligiovs persuasign of the juvenile; such other circumstances as may, in the opinion of the competent authority, require to be taken into consideration P in the interest of the welfare of the juvenile: Provided that in the case of a delinquent juvenile, the above circumstances shall -be taken into consideration after the Juvenile Court has recorded a finding against the juvenile that he has committed the offence: Provided further that if, no report of the probation officer is received within ten weeks of his being informed under section 19, it shall be open to the Juvenile Court to proceed without it. sending a juvenile outside jurisdiction—In the case of a neglected or delinquent juvenile whose ordinary place of residence lies outside the jurisdiction of the competent authority before which he is brought, the competent authority may, if satisfied alter due inquiry that it is expedient so to do, send the juvenile back to a elative or other person who is. fit and willing to receive him at is ordinary place of residence and exercise proper care and control over him, notwithstanding that such place of residence is outside the • jurisdiction of the competent authority; and the competent authority exercising jurisdiction over the place to which the juvenile is sent shall in respect of any matter arising subsequently have the same powers in relation to the juvenile as if the original order had been passed by itself. Reports to be treated as confidentiaL—The report of the probation officer or any circumstance considered by the competent authoFity under section 33 shall he treated as confidential: Provided that the competent authority may, if it so thinks fit. communicate the substance thereof to the juvenile, or his parent or -• guardian and may give such juvenile, parent or guardian an ' opportunity of producing such -evidence as may be relevant to the matter stated in the report. etc., of juvenile '36. Prohibition of publication of names, invc7red in any proceeding under time Act.—(1) No report in any newspaper, magazine or news-sheet ot any inquiry regarding a iuvenile under this Act shall disclose the name, address or school or •ny- other particulars- calculated. to lead to the identification of the jnvenile nor shall any picture of any such juvenile be published: Pi'ovided that for reasons to be recorded in writing, the authority holding the inquiry - may permit such disclosure, if in dts, opinion such disclosure is in the interest of the juvenile. - 22
(2) Any person contravening the provisions of sub-section (1) shall be publishable with fine which may extend to one thousand rupees.
37: Appeals.—(1) Subject to the provisions of this section, any person aggrieved by an order made by a competent authority under this Act may, within thirty days from the date of such order, prefer an appeal to the Court of Session:
Provided that the Court of Session may entertain the appeal after the expiry of the said period of thirty days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. (2) No appeal shall lie from- any order of acquittal made by the Juvenile Court in respect of a juvenile alleged to have committed an offence; or any order made by a. Board in respect of a finding'that a person is not a neglected juvenile. (3) No second appeal shall lie from any order of the Court of Session passed in appeal under this section.
38. RevLsion.—The High Court may, at any time, either of its own motion or on an application received in this behalf, can for the record of any proceeding in which any competent authority or Court ' of Session has passed an order for the purpose of satisfying itself as to the legality or propriety of any such order and may pass such order in relation thereto as it thinks fit:
Provided that the ligh Court shall not pass an order under this section prejudicial to any person without giving him a reasonable opportunity of being heard.
39. Proeethtre in inquiries, appeals and revision proceeding&— (1) Save as otherwise expressly provided by this Act, a competent Of authority while holding any inqüiy under any of the provisiotis of this Act, shall follow such proureced as may be prescribed and subject thereto, shall follow, as far as may be, the procedure laid down in the Code of Criminal Procedure 1973 (2 of 1974), for trial in summons cases. (2) Save as otherwise expressly provided by or under this S Act, the procedure to be followed in hearing appeals or revision proceedings under this Act shall be, as far as practicable, in accordance with the provisions of the Code of Criminal Procedure; 1973 (2 of 1974). 23 (1) Withovt prejudice to the amend orders.— 40. Power to reviision wider this Act, any competent provisions for appeal and own motion or on an applicatioli received authority may, either on its order as to the institution to which a in this behalf, amend any to the person under whose care or juvenile is to be sent or a supervision a juvenile is t( be placed under this Act. - (2) Clerical mistakes in orders passed by a competent authority or errors arising therein from any accidental slip or omission may, at any time be corrected by the competent authority either on its own motion or on an appcation received in this behalf.
CHAPTER VI SPECIAL OFFENCES IN ItESPECT OF JUVENILES juvcnile.—) Whoever, having 41. Punishment for cruelty to the actual charge of, or control over, a juvenile, assaults, abandons, exposes or wilfully neglects the juvenile or causes or procures him to be assaulted, abandoned, exposed or neglected in a manner likely to cause such juvenile unnecessary mental or physical suffering shall be punishable with imprisonment for a term which may extend to six months, or with fine, or with both. ' (2) No court shall take cognizance of an offence punishable under sub-section (1) unless the complaint is filed with the previous sanction of the State Government or an officer authorised by it in this behalf. Whoever 42. Employt1Wit of juveniles for bcgging.—(l) employs or uses any juvenile for the purposes of begging or causes any juvenile to beg shall be punishable with imprisonment for a term which may extend to three years and shall also be liable to fine. Whoever, having the actual charge of, or control over a juvenile abets, the commission of the offence punishable under sub- section (1), shall be punishable with imprisonment for a term which W may extend to one year and shall also be liable: to fine. The offence punishable under this section shall be cognizable. 43. Penalty for giving intowicating liquor or narcotic drug or psychotropic substance to a juvenile.—Whoever gives, or causes to . given, to any juvenile any intoxicating liquor in a public place • or any narcotic drug or psychotropic substance except upon the order of a duly qualified medical practitioner or in case of sickness shall be punishable with imprisonment for a term which may extend to three years and shall also be liable to fine. 24 Bxploitation of juvenile procures a juvenile employees._Whoever ostensibly for the purpose of any employment and withholds the earnings of the juvenile or uses such earnings for his own purposee shall be punishable with imprisonment for a term which may extend to three years and shall also be liable to fine. Power of State Government to discharge and transfer JZtVefliic8...(1) The State Government 'nay, notwithstanding any- thing contained in this Act, at any time, order a neglected • delinquent juvenile to be discharged from the juvenile home or special home, either absolutely or on such corditions as it may think fit to impose. (2) The State Government 'nay, notwithstanding anything contained in this Act, order— - a neglected juvenile to be transferred from one juvenile home to another; a deldnquen.t juvenile to be transferred from one special home to another or from a special home to a borstal school where such school exists or from a special home to a juvenile home; a neglected juvenile or a delinquent juvenile to be transferred from a juvenile home or a special home to a fit person or a fit institution.; (ci) a juvenile who has been released on licence which has of been revoked or forfeited, to be sent to the special home or juvenile home from which he was released or to any other juvenile home or special home or borstal school: Provided that 'the total period of the stay of the juvenile in juvenile home or a special home or a. fit institution or under a fit person shall not be increased by such transfer. (3) The State Government may, notwithstanding anything conlahled in this Act, at any time discharge a juvenile .frorn the 25
o&e of any person under whom he was placed under th* Act etthct absolutely or on such conditions as may think fit to impose. Tratisfer between juvenile homes, etc., under the Act and ' jwveniie homes, etc., of like nature in different parts of india.—(1) The uovernment ot a State may direct any neglected juvemle or delinquent juvenile to be transferred from any juvemle home or speciai home within the State to any other juvenile home, specual home or institution of a like nature in any other State with the consent of the Government of that State. (2) The Government of a State may, by general or special order, provide for the reception in a juveniLe home or special home ss4thin the State of a negiected juvenile or delinquent juvenile detained in a juvenile home or special home or institution of a like nature in any other State where the uovernment of that State makes ai order for such transfer, and upon such transfer the provisions of this Act shall apply to such juvenile as if he nad been o ignally ordered to be sent to such juvenile home or special home er this Act. - Transfer of juveniles of unsound mind or suffering from leprosy or adttcted to drugs.— (1) Where it appears to the State Government that any juvenile kept in a special home or juvenile home or institution in pursuance of this Act is suffering trom leprosy or is of unsound mind, or is addicted to any narcotic urug or psychotropic substance, the State Government may order his removal to a leper asylum or mental hospital or treatment centre for drug addicts or other place of safe custody for being kept there for such period not exceeding the period for which he is required to be kept in custody under the orders of the competent authority or for such further period as may be certified by the medical officer to be necessary for the proper treatment of the juvenile. (2) Where it appears to the State Government that the juvenile is cured of leprosy or of unsoundness of mind or drug J addiction it may, if the juvenile is still liable to be kept in custody, order the person having charge of the juvenile to send him to the special home or juvenile home or institution from which he was removed or, if the juvenile is no longer liable to be kept in custody, order him to be discharged, Placing out on licence.—(1) When a juvenile i kept in a j venile home or special home, the State Government may, if At • so thinks fit, release the juvenile from the juvenile home or specaJ home and grant him a written licence for such period and on such conditions as may be specified in the licence permitting him to live with, or under the supervision of, any responsible person named G. 6921MC. 26
in the licence willing to receive and take charge of ham with a view to educate him and train him for some useful trade or calling. Any licence so granted under sub-section (1) shall be in force for the period specified in the licence or until revoked or forfeited by the breach of any of the conditions on which it was granted. H The State Goveniment may, at any tinie, by order in writing, revoke any such licence and order the juvenile to return to the juvenile home or pecial home from which he was released or to any other juvenile home or special home, and shall do so at the desire of the person with whom or under whose supervision th juvenile has been pernilti:cd to live in accordance with a licence granted under sub-section (1). When a licence has been revoked or forfeited and the - juvenile refuses or tails to return to the special home or juvenile home to which he was di Lccted so to return, the- State Governmes may, if necessary, cause him to be taken charge of and to be taken back to the SPCCISIhome or juvenile home., The time during which a - juvenile is absent from a special home or jvenilë home in pursuance c-f a licence granted under this section sha.11 he deemed to be part of the time for which he is liable to be kept dn custody in the special home or juvenile bone:
Provided that when a juvenile has - failed to return to th e special home or juvenile home on the licence being revoked or forfeited, the time which elapses after his failure so to return shall be excluded in computing the time during which he is liable to be kept in custody. - 50. Pro-vision in respect of escaped juveniles.—No standing anything to the contrary contained in any other lawtw forith- the time b-sing in force, any police officer may take charge without warnuit of a juvenile who has escaped from a special home or a $3 juvenile home or from the care of a person under who-rn he was placed wider this Act and shall send the juvenile back to the special home or the juvenile home or that person, as the case may be; and no proceeding shall be instituted in respect of the juvenile by reason of such escape but the special home, juvenile home the person may, after giving the information, to the con pet authority which Passed the order in respect of the juvenile, take such steps against the juvenile as may be deemed necessary. 51. Contribution by parents._... (1) The competent authority which makes an order for sending a neglected juvenile or a 127 delinquent juvenile to a juvenile home or a ejedal home or placing the juvenile under the care of a fit penon or at institution may make an order requiring the parent or other person liable to mañntá.in the juvenile to contribute to his maintenance, if able 'to do so, in the prescribed manner. The competent authority before making any order under sub-section (1) shall inquire into the cfrcurnataflces of the parent or other person liable to maintain the juvenile and shall record evidencp, if any, in the presence of the parent or such other person, the case may be. The nerson liable to maintain a juvenile shall, for the purposes of sub-section (1), incinde in the case of illegithnnAy, his putative father: Provided that where the juvenile is illegitimate and an order for his maintenance has been made under section 125 of the Code the comneteat authority o riminal Procedure, 1973 (2 of 1974), not ordinarily make an order for contribution against the sflW1putative father, but may order the whole or any part of the sums 'accruing due under the said order for maintenance to be paid to such nerson as may be named by the convetent authority and such, rum hail be paid by him towards the maintenance of the juvenile. Any order made under this section may he enforced in the same manner as an order under section 125 of the Code of Criminal Procedure, 1073 (2 of 1974).
52. Fund.—(l) The State Government may create a Fund wider such name as it thinks fit for the welfare and rehabilitation of the juveniles deaR with under this Act. • (2) There shall be credited to the Fund such voluntary onations, contributions or subscriptions as may be made by any individual or organisation. (3) The Fund created under sub-section (1) shall be administered by such officers or authority, in such manner and for such purposes as may be prescribed. The State Government may 53 Advisory Board.— (1) constitute9 an Advisory Board to advise it on matters relating to mob! iisation of the establishment and maintenance of homes • resources, provision of facilities for education, training and rehabilk- tation of neglected and delinquent juveniles and. co-ordinaUo among the various official and non-official agencies concerned.

(2) The Advisory Board shall consist of such number of officers and other persons as the State Government thinks fit and may also incluae experts and the representatives of voluntary organisatjons engaged in the relevant areas. - Visitors.—(1) The State Government may nominate not more than three non-officials to be Visitors for each of the homes established under this Act. (2) A Visitor non'jnatcd for a home under sub-section (1) shall periodically visit such home: and make a report to the Stat Government. Controt of cwstodjijn over juvenile.—Any person in whose custody a juvenile is placed in pursuance of this Act shall, while the order is in force, have the like control o ver the juvenile as he would have if he were his parent, and shall be responsible for his maintenance, and the juvenile shall continue in his custody for the period stated by the conipetent authority, notwithstanng that he is claimed by his parent or any other person: Provided that no juvenile while in such custody shall be carried except with the' permission of the competent authority. 58. Delinquent ment of juvenile under going sentence at commeiwe- ethe Act.—In any area in which this Act is brought into force, th State Government may direct that a delinquent juvenile who is undergoing any sentence of imprisonment at the cornmence ment of this Act shall, in lieu of undergoing such sentence, be sent to a special home or be kept in safe custody in such- place and manner as the State Goverimient thinks fit, for the remainder of the period of the sentence; and the provisions of this Act shall apply to the juvenile as if he had been ordered by a Juvenile Court to be sent to 'such special home or, as the case may be, ordered to be detained under sub-section (2) of section 22.
57. Appointment of officers.—(1) The State Government may appoint as many probation officers, officers for the inspection of special homes, juvenile homes, observation home s or after-care organisations and such other officers as it may deem necessary for carrying out the purposes of this Act. (2) It shall be the duty of the probation officer- (a) to inquire, in accordance with the direction of a competent authority, hito the antecedents and family history - ! of any juvenile accused of an offence, with a view to assist the authority in making the inquiry; 29 to visit neglected and delinquent juveniles at such intervals as the probation officer may think fit; to report to the conietent authority as to the • behaviour of any neglected or delinquent juvenile; to advise and assist neglected or delinquent juveniles and, if necessary, endeavour to find them suitable employment; is placed % (e) where a neglected or delinquent juvenile under the care of any person or institution on certain conditions, to see whether such conditions are being complied with; and (f) to perform such other duties as may be prescribed. (3) Any officer empowered in this behalf by the State Government may enter any special home, juvenile home, observa- tion home or after-care organisation and make a complete inspection hereof in all its departmeTvts and of all papers, registers and ccounts relating, thereto and shall submit the report of such inspection to the State Government. Officer8 aippointed under the Act to be public servants.— Probation officers and other officers appointed in pursuance of this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code (45 of 1860). bonds.—The provisions of Procedure in respect of 1973 (2 of Chapter XXXIII of the Code of Criminal Procedure, 1974), shall, as far as may be, apply to bonds taken under this Act. powers.—The State Government may, by DelegatiOn of general or special order, direct that any power exercisable by it under this Act shall, in such circumstances and under such conditions, if any, as may be specified in the order, be exercisable M also by an officer subordinate to that Goveniment. or Protection of action taken in good faith.--No suit other legal proceeding shall lie against the State Government or any probation officer or other officer appointed under this Act in spect of anything which is in good faith done, or intended to be ne in pursuance of this Act or of any rules or orders made thereunder. Power to make riiles.—(l) The State Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act. I

(2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for the following matters, namely:- all or any of the places at which, the days on which, the time at which, and the manner in which, a competent. authority may hold its sittings; the procedure to he followed by a competent authority in holding inquiries under this Act, and the mode of dealing with juveniles suffering from dangerous diseases or mental complaints; the circulñstances in which, and the conditions subject to which, an institution may be certified as a special home or a juvenile's home or recognised as an observation home, and the certification or recognition withthtwn• the internal management of special homes, juvenile homes and observation homes and the standards and the nature of services to be maintained by 'them; I the functions and responsibilities of special homes, juvenile homes and observation homes; - the inspection of special homes, juvenile homes, observation homes and after-care organisations; the establishment, management and functions of after-care organisationg; the circumstances in which, And the conditions subject to which au institution may be recognised as an after-care organisation and such other matters as are referred to in section 12; the qualifications and duties of probation officers; the recruitznei-t and training of persons appointed to carry out the purposes of this Act and the terms and conditions of their service; the conditions subject to which 'a girl who is 'a neglected or delinquent juvenile may be escorted from one place to another, and the manner in which a juvenile may be sent outside the jurisdiction of a competent authority; the manner in which contribution for the main tenance of a juvenile may be ordered to be paid by a parent or guardian; (1). the officers ot.' authorities by whom, the manner in which and the purpose for which the Find created under section 52 shall be administered; V

(m) the conditions under which a juvenile may be placed out on licence and the form and conditions of such licence; (n) the conditions subject to which juveniles may be • placed under the care of any parent, guardian or other fit person or fit institution under this Act and the obligations of such persons or institutions towards the juveniles so placed; (o) any other matter which has to be, or may be, prescribed; (3) Everi rule made by a Stafe Governmnt under this Act shall be laid, as soon as may be aft-er it is made, before the Legislature of that State- 63. Repeal and savings.—If, immediately before the date on which this Mt comes into force in any State, there is in force in that State, any law corresponding to this Act, that law shall stand •pealed on the said date: Provided that the repeal shall not affect- • the previous operation of any law so repealed or • anything duly done or suffered theleunder; or any right, privilege, obligation or liability acquired, accrued or incurred under any law so repealed; or any penalty, forfeiture or punishnzent incurred in respect of any offence committed aginst any law so repealed; or - any investigatOn, legal 'proceeding or remedy in * respect of any such right, privilege, obligation., liability, petialty, forfeiture or punishment as aforesaid; and any such iiivestigation, legal proceeding or remedy may be P instituted, continued or enforced and any such penalty, forfeiture or punishment may he imposed, as if this Act had not been passed.

- PRELIMINARY .. -. 1. Short title, extent and commencàment.—(l) This Act may be called the Juvenile Justice (Care and Protection of Cbtdren) Act, 2000. It extends to the whole, of India except the State of Jaxnmu and K.ashmir.. . . It shall come into force on such date as the Central Government may, by notificatioi in the Qificial Gazette, - . appoint. 2. Definitions.—In this Act, unless the context otherwise requires,- (a) "advisory board" means a Central or a State ad ry board or a district and city level advisory board, as tlWase may be, constituted under Section 62 ; (b) "begging". means- ' soliciting or receiving alms in a public place or entering in to any private premises for the - . purpose of soliciting or receiving alms, whether under any. pretence; exposing or exhibiting with the object of obtaining or extorting aims, any sore, wound, injury,, deformity or disease, ,whethei of hiniself Or of any other, person or of an animal (c) "Board" means a' Juvenile Justice Board 'constituted unde,rsection 4;' 3

Immoral Traffic (Prevention) Act, (1956 104 of 1956; - (u) "shelter home" means a home or a drop-in-centre set up under section 37 (v) "spcial home" means an institution established by a State Government or by a voluntary organisation and certifl&l by that- Government under section 9 • - (w) "spdial juvenile police unit" means a unit of the police force of a State designated for handling of juveniJes or children under section 63 (x) "State Gover ntnent'i, iii relation to a Union territory, means the Administrator of that Union territory appoineçl by the President under article 239 of the Constitution • (y) all words and expression's used but not defined in this Act and defined in the Code of Criminal Procedure, 1973 (2 of 1974) shall have the meanings respectively assigned to them in that Code • C'ontinuation of inquiry in respect of juuozile who has ceased to he a juvenile.—Where an inquiry has beeninitiated against a juvenile in conflict with law or a child in need of cale and prOtection and during the course suchinquiry the juvenile or the child ceases to be such i then, not Sthstanding Anything contained in this Act or in any other law for the time being in force, the inquiry m;y be continued and orders may be made in respect of such person as if such person had continued to be a juvenile or A child. C2-IAPTI&R. II JUVENILE IN CONFLICT WITH LAW Juvenile Justice Baard.—(1) Notwithstanding anything contained in the Code,of Criminal Procedure, 1973 (2 of 1974), the State Governthent may; by notification in the Official Gazette, constitute for a district or a ¼ grouTóT distncts specified in the notification, oneor_msreJuvenilejitstice' Boards fQ wcercising the powys and discharging the duties conferred or imposed on such Boards in relation to juveniles in coriHict with law under this Act. - • (2) A Board shall consist of a Metropolitan Magistrate or a - Judicial Majistrate. of the first class, as the case may be, and two social workers of whom at least one shall be a woman, forming a Bench and every such Bench shall have the powers confrred by the Code of Criminal Procedure, 1973 (2 of 1974) on -a Metropolitan Magistrate or as the case may be, a Judicial Magistrate of the first class and the Magistrate on the B rd shall be designated as the Principal Magistrate. S (3) No Magistrate shall be appointed as a member of the Board unless he has special knowledge or training in child psychology or child welfare and no £oci4l worker shall be appointed as a member of the Board unless he has.been actively involved in health, education, or welfare activities pertaining to children for at least seven year. • (4) The term of office of the members of the Board and the manner in which such member may resignshail- be such as maw be prescribed. (5) The appointment of any membr of the Board may. be terminated after holding inquiry, by the StAte Government, if—. (i) he has been found guilty of misuse of ppyer vested under • • thisAct. H. H or he has been convicted of an offence involving moral turpitude, and such conviction has not been reversed or he has not been granted full pardon in respect of such offence, he fails, to attend the proceedings of the oard - for consecutive- three months without any valid reason or he fails to attend less than three-fourth of the sittings in a year. - 5. Procedure, etc. in relation to.Boardc—.(l) The floard shall meet at such times, and shall observe such rules of procedure in regard to the transaction of business at its meetings, as- may be prescribed. - (2) A child in conflict with law may be proiuced bdfore an individual member of the Board, when the Board is not sitting. (a) A Board may act notwithstanding the absence of any member of the Board, and no order made by the Board thall be invalid . by reason only of the absence of an9 member during any stage of proceedings: Provided that there shall be at least two members including the Principal Magistrate presen't at the time of final disposal of the case. (4) In the event of any differene 'of opinion among the - members of the Board in the interim or final disposition, the opinion of the majority shall prevail, but where there is no such majority, the opinion of the Principal Magistrate shall prevail. - 6. Powers of juvenile Justice Board.—(l) Wheçe a Board has been 4 cothfltuted for any district or a- group of districts; such Board shall, notwithstanding anything contained in any other law for the - time being in force but save as otherwise cxpresslyprovided in this -Act, have power to . deal exclusively with all proceedings under this Act relating to juvenile in conflict with law.
- (2) The powers conferred - on L -th Board by Or under this Act may also be exercised by the High Court and Court of Session, when the proceeding comes before them in appeal, revision or otherwise. - 7. -Procedure to be followed by a Magistrate not empowered under the Att. (1) When any Magistrate not empowered to exercise the powers of a Board under this Ac1 is oft-he opinion that person brought before him' under any of the provisions of this Act (other than for the - - purpose of giving evidence), is a juvenile or the child, he shall without - any delax record such opinion and forwatd the juvenile or the child and the record of, the proceeding to the competent authority, having jurisdictioti over the proceeding. - - - (2) Thecompetent authority to which:the proceeding is forwarded under sub-section (1) shall hold the inquiry as if the juvenile or the child had originally been brought before it. . , -
8. Qbsertatian homes.—( 1) Any State Government may establish and maintain either by itslf or under an agreement with voluntary o rganisations, observation homes in' evcry district or 'a group of districu, as may be required for the temporary reception of any pivenile in * conflict with law during the pendency of any inquiry retarding them - under this Act. Where 'the State Government is of opinion that any institution, other than a home established or maintained under sub-section (1) is fit for the temporary reception of juvenile in conflict with law during the pendency of any inquiry regarding them under this Act, it maycertify such institution as an observation home for the purposes of this Act. The State Government may, by rules made under this Act provide for the management of observaiion homes, including the standards and various types of services to be provided by them for rehabilitation and social integ-ration of a juvenile, and the circumstances under which, • and the manner in which, the . certification of an observatiofi home may be granted or withdrawn. Every juvenile who is not placed under the charge of parent • or guardian and is sent to an observation home shall be initially kept in a reception unit of the observaçion home for preliminary inquiries care and classification for juveniles according to his age group, such as seven to twelve years, twelve to sixteen years and sixteen to eighteen years, giving due considerations to physical and mental status and degree U the offence committed, for further induction into observation home. 9. Special homes.—(l) . Any State Gov&rnnxent, may establish and - maintain either by itself or under an agreement with voluntary organi- sations, special homes in every district or a groUp of disfricts, as may be required for reception and rehabilitation of juvenile in conflict with law under this Act. Where the State Government is of opinion that an institution Gther than a home eitablished or maintained under sub-section (1), is ' AL for the reception of juvenile in conflict with' law to be sent there under Mis Act, it may certify such institution as a special homq for the purposes of this Act. The State Government may, by rules' made under this Act, provide for the management of special homes, including the standards and various types of services . to be provided by them ' which are necessary for re-socialisation of a ju,venile, and the dreumstances under which, and the manner in which, the certification of 'a specal hothe may be granted or withdrawn.' - The rules 'made under sub-section (3) may also provide for 'the classification and separation" of juvenile in conflict, with law • on the basis of age and the nature of offences committed by them and his mental and physical status. . - IH. 10. Appeltension of juvenite'f in conflict with law.—(l) As soon as a juvenile in conflict, with law is apprehended by police; he shall be
placed under the charge of the special - juvenile police unit or the designated police officer who sha!1 immediately report the matter to a meitber of the Board. (2) The State Government may make rules cotisütent with this Actc (1) to provide for persons through whom (including Mgistered - volu.ntary organisiations) any juvenile in conflict with law may 0 be produced before the Board; (ii) to provide the manner in which such juvenile may be sent to ail, observation home.
ii. Control of custodiaiz over juvcnile. — Any. person in whose charge a juvenile is placed in pursuance of this' Act shall, while the order is in force have the control over the juvenile as he would have if he were his parents, and shall be responsible for his maintenance, and the jyvenile shall continue in his charge for the period 'stated by Eompetént authority, notwithstanding that he is claimed by his parents
or any other person. - 12.. Bail of juvenile.—(l) When any person accused of a bailable or njm-bailable offence, and apparently a juVenile, is errested or detained or appears or is brought before a Board, such person. shall, notwithstanding anything contAined in the Code of Criminal Procedure,. 1973 (2 of 1,974) ~r in any other Jaw for the time being in force, be relçased on, bail with or ,without surety but he shall not be so. released if there appear reasQnale grounds for believing that the release is likely to bring him into association with any known criminal or expose him, to moral, physical or psychologtcal, danger or that his release would defeat the ends of justice. When such petson hating been arrested is not released on bail under sub-section (1) by the officer-in-charge of the police station, such officer shall cause him to be kept only, in an observation home in the prescribed thanner until lie can be brought befor a Board. When such person is not released on bail under sub-seedon (1) by the Board" it shall, instead ofcominitui him to prison, make an order sending him to in observation home or a place of safety for such period during the pendency of the inquiry regarding him as may be specified in the order. • 13. Information to parent guardian or probation officer.—Whee a-juvenile isarrested, the officer incharge of the police stationor the specialjuvenile police unit to which the juvenile is brought shall, as soon as may be after the arrest, inform—. (a) the parent or guardian of the jtiveni!e if he can, be found ' of such arrest and diçect him to be present at the Board before which -the juvenile will appear; and ' - I * (b) the probation officer ofueh arrest to enable him to bbtain information reg3rding the antecedents and Tamity background of the juvenile and other mater: ial circumstances : likely to be of assistance to the Board for making the inquiry. - 14 Inquiry by Board regarding juvenile.—W.herc a juvenile having been charged with the offence is produced bethre a Board s the Board shall hold the inquiry in accordance with the provisions of this Act and- may make such order in relaøon to the juvenile as it deems fit: 0 Provided that an inquiry under this section shall be completed within a period of four months from the date, of tñi commence- ment, nAless the period is extended by the Board having regard to e circumstances of the cese and in special cases after recording e reasons in writing for such extension. ' 15. Order that may be passed regarding jtweniie.-r(l) Where 'a Board is satisfied on inquiry at a juvenile has committed an offence, then, notwithstanding anything to the contrary contained in any other law for the time being in force, the Board may, if it tlUnks so fit,- (a) allow the juvenile to go home after advice or admonition following appropriate inquiry against and counselling to the parent or the guardian and the juvenile; • (b) dircdt the juvenile to participate in group counselling and similar activities • (c)• order the juvenile to perform community. service (d) order th parent of the juvenile or the juvenile himself to pay a fine, if he is over - fourteen . years of age and earns • 'mOney; • (e) direct the juvenile to be released on probation of good conduct and placed under the care of any parent, guardian or other fit person - on such parent, guardian or othei fit person • executing a, bond, with or withopt surety, as -the Board may require, for the good behaviour and well-being of the juvenile • for any period not exceeding three years; - • • (f) direct the juvenile- to be released on probatiog of good • - conduct and placed under the care of any fit institution for the good .-behaviour and well-being of the juvenile for any1 period not exceeding three! years - (g) make an order directing the juvenile to be sent to a special homG,- (i)! in the case of juvenile, over seventeen years but less than eighteen yexs of age for a period oinot less than two years;
(ii) in case of any othw juvenile for the period until he ceases to be a juvenile GA. 69812001JG. • 10 L1 Provided that the Boar4 may, if it is satisfied that having- regard to the nature of the offence and the circumstances of ti*_, case it is expedient so t,o do, fbr reasons to be recorded, reducc the period of stay to such period, as it thinks fit. (2) The Board shall obtain the social investigation report on juvenile either through a probation officer or a recognjed voluntary organisation or otherwise, and shall t4ke into consideration the findiigs of such report before passing an order. - 0 (3) Where an order under clause (d), clauie (eJ er clause (f) of sub-section (1) is made, the -Board may, ifit is of oinion that in the interests of the juvenile and of the public, it is,, expedient so do, in addition make an order that the juvenile in tonflict with 1 thall remain under the supervision of a probation offlcer named in the order during such period, not exceeding three years as may be specified therein, and may in such supervision order impose such conditioni as it deems necessary for the due supervision of the juvenile in conflict with law : - - Provided that if at any time afterwards it appears to the board on receiving a report from the probation officer or otherwise, that the juvenile in Lonflict with law has not been of good behaviour during the period of supervisioai or that the fit institution under whose care the juvenile was placed is no longer able or willing to ensure the good behaviour and well-being of the juvenile it may, after making such - i,nqu'ry as it deems ut, order the juvenile in conffit with Jaw to be sent to a special home. (4) The Board shall while making a supervision ordr under sub-sectiçn (3),_ explain to the juvenile and the parent,. guardian or other, fit person or In institution, ?s'the case may be, under whose care • the juvenile has been placed, the terms and conditions of the order and - shall forthwith furnish one copy of *be supervision order to the juvenile, the parent, guardian or other fit person or fit institution as the case may be, the sureties, if any, and the probation offier . 16. Order that may not &e pqssed against juvenile.—(l). Notwithstan g anyt1ing to the contrary contained in any other law for the time being in force, no juvenile in conflict with law shall be sentenced to death or life inigrisonment, or committed - to prisonS in default of payment of fine or in default of furnihing security.: Provided that where a juvenile who has attained thç -age of sixteen years has committed an offence and the Board is satisfied that the offence- committed is of •so serious in nature or that his conduct and behaviour have been such that it would not be in his interest or in - the interest of other juvenile in a special home to send him to such special hothe. and that nonb of the other 'thôàsuies provided

under this .Act is suitable or suflicieni, the Board may ordet th c juvenik in conflict with law to be kept in such place of safety and in such manner as it thinks fit and shall repOrt the case br the order of the State Government. - (2) On receipt of a report from a Board under sub-ecdon (1), the 'State ioverninent may make such arrangement in respect of the juvenile as itdeems proper and may order such juvenile to • be kept under protective Custody at such place-and on such conditions • ar it thinks fit: Provided that the period of detention so ordered shall not exceed the maximum period of imprisonment to, which the juvenile could tave been sentenced for the offence committed. • 17. Proceeditj under Chapter VIII of the Code of Criminal Procedure not comfielent against juvenile.—Notwithstanding anything to- the contrary cohtained in the Code of Criminal Procedure, 1973 2 of 1974 no I proceeding shall be instituted and no order, shall be passed a ainst the juvenile un4er Chapter yin of the said Code. ' No joint proceeding of jzwenile and person not'ajupenile.—(l) Not'With standing anything contained in -section 223 of the Code of Criminal • - Procedure, 1973 (2 of 1974) or in any othet law for the tirne 4being - in. force: no luvenile shall be 'charged' with', or tried . for any offence 'together with a person, who is not a juvenile. - ' (2) If a juveni1e is accued of an offence for which under section r 223 of the Code of Criminal , Procedure, 1973 (2 of 1974) or any other law for the time being in force, such juvenile and any person who.is not a- juvenile would, but - for the prohibition contained in- - sub-section (1), have -been charged and tried togeth, the Board taking cognizance of that offence shall 'dlirect separate trials of the juvenile and the 'other person. Removal ofdisqualzjicationattachingto conviction.—(1) Notwithstanding anything contained in any other - law, a juvenile who has committed an Qffence and has been dealt with under the provisions of this shall not suffer disqualification, if any,- attachiqg to a conviction • an offence under such law. (2) The Board shall make an order directing that the relevant records of such conviction shall be removed after the expiry of the period of appe?.l or a reasonable period as prescribed under the rules; as the case may be. Specal provisior in' respect - of pendiitg cases. --Notwithstanding anything contained in this Act, all proceedings in respeCt - of a - - juvenile pen4pg in any cOurt in any area on the date on which this Act comes, into force in that area, shall be cOntinued in that' - ôourt as if this Act had - not been ' passed and if the court finds - that- the juvenile has committed, an offence, it ' shall ' record such 12 findixg and instead of passing any sentence in respect of the juvenile, forward thp juvenile to the Board'which shall pass orders in respect of that juvenile in accordance with the provisions of this Act as if it had been satisfied on inquiry, under this Adt that it juvenile has committed the offence. Prohibition of publication of name, etc., of juvenile involved in any proceeding under the Act.—(l) No report in any newspaper, ngazine, news-sheet or visual media of any inquiry regarding a juvçnile in conflict with law-under this Act shall disclose the name,, address or school or any other articulars c46ulated to lead tol the identification of the juvenile nor shall any picture of any such juvenile be published: - Prqvided that for reasons to be recorded in writing the authof holding the inquiry may permit such disclosure, if in its - opiAion S disclosure is in the intqest of the juvenile; (2) Any person contravening the provisions of sub-section (1)' shall be punishable with fine, which may extend to one tbousand.rupees. Provision in respect of escaped juzeiz1e.—Notwithstanding anything to the - contrary contained in any other law for the time being in force, any pollee officer may take charge without warrant of a juvenile iz conflict with law who has escaped from a special home or an observation home or from the care of a person under whom he was pladed under this Act, and shall be sent, back to the special hoxn' or The observation hothe or that person, a, the case may be ; and no proceeding shall be instituted in respect, of the * - juvenile by reason of such escape, but the special home, or the observation home or the 'person may, after giving the information to the Board which passed " the order in respect of the juvenile, take - such steps in respect of the juvenile as may be deemed necessary under the provisions of this Act. Punishment for cruelty to juvenile or child.—Whoever, having the actual charge of or control over, a juvenile or the child, assaults, abandons, exposes or wilfully negJetts the juvenile or causes or procures him to be assaulted, abandonet, exposed or neglected in a manner likely to cause such juvenila or the child unnecessary ntal 1or' physical suffering shaij be punishable With imprisonment for' tcrmr which may extend th six months, or fine, or with both. • 24. Employment ofjuvenile or child for begging.—( 1) Whoever, çmploys or use' any juvenije or the child for the purpose or causes any 3uvenile to beg shall be punishable with imprisonment - for a term which may extend to three ye.rs and shalL also be liable to fine.-' (2)' Whoever, having the 'actual "charge of, or -control over, a juvenile 1 or the child abets - the conimission of the offence punishable under sub-section (1),' shall be punishable with imprisonment for a term which may extend to one year and shall also be - liable to fine. ,, - '3
25. Penalty for giving intoxicating liquor or narcotic drug or psyckotropic - substance to juvenile orchild.—Whoevei gives,, or causes to be given, to any juvenile or the child any- intoxicating liquor in a publid place or any narcotic drug or psychotropic substance except upon the or4er of duly qualified medical practitioner or in case of sickness shall be • punishable - with imprisonment for a term which may ektencL to three years and shall also be liable to fine. ' 26. Exploitation of juvenile or child employee—Whoever . osten'sibly • • procures a juvenile or the child for the purpose of any hazardous employment keeps him in bondage and withholds his earnings or uses such earning for his own purposes shall be punishable with
. mprisonment for a term which may extend to three years and hall also be liable, to fine. 27. Special ofences.—The offences punishable under sections 23,24, * • 25 and 26 shall be cognizale. Altervnatirie punishment.—Where an act or omission constitute an offence' punishable undcr this Act and also under any other Central or State Act, then, notwithstanding anything contained in any law for the time -being in force, the offender, found guilty of such offencnf shalT be liable to punishment only under such Act as provides for punishment which is greater in degree. -
CRAPTER lIT Cl)JLD- IN NEED OF CARE AND PROTECTION Child welfare 'Commit (ee.—(l) The State Governmei$ may, by notification in Official Gazette s constitute for every district or group of districts, specified in the nbtiflcation, ,oneor more Child Welfare • Committees for exercising the powers and disqh3rge the dutiesconferred On such Committees in relation- to child in need of,' care and protection under this Act. (2,) The Committee shall consist of a Chairperson and four • other 'members as the State Government may think fit to appoint, whom at least one shall be a woman and another, an expert matters concerning, children. • (3) The qualifications of the Chairperson and the members, and the tenure for which they may be appointed shall be such as may be prescribed. • . (4) The . appointment of any'member of the Committee may be terminated, after hDlditlg inquiry, by the State Government, hf- he has been found guilty of misuse of power vested under this Act he has been convicted of an offence involving moral turpitude, and such conviction . has not been reversed or he h • • not been granted full pardon in respect of such offence;
14 S . (iii) he fails to attend the pro6cedings of the Committee for consecutive three months without any valid, reason or he fails to attend less than three-fourth of the sittihgs in a year.
• (5) The Committee shall function as . a Buch of Magistrates and shall have the powers conferred by the Code of Criminal Procedure, 1973 to of 1974 (2) on a Metropolitan Magistrate or, as he case may be, a Judicial Magistrate of the first class.
30.' Procedure,etc., in relation to Committee.— (l) The áommitte.e shall meet at such: times and shall observe such rules, of procedure in regard to the tMnsaction of businçis at its meetings, as may be prescribed. (2) A child in need of care and protection niay be produced before • an individual member for being placed in safe costody otherwise when the Committee is not in session. . - 16
- (3) In the event of any difference of opinion among the members of the Committee at the time of any interim decision, the opinion of the majoFity shall prevail but where there is no such majority the optnion of the Chairpersod shall prevail. (4) Subject to the provisions of sub-sectiOn (1), the Committee may act, notwithstanding the absence of any member of the Committed, and no order) made by the Cqmmittee shall be invalid by . reason only of the absence of any nmnber during any stage of the proceeding.
Powers of Committee. — (l) The Committee shall have the final authority to dispose of cass for the -care, protection, treatment, development and rehabilitation of the children as well as to provide for their basic needs and protection of human rights. (2) . Where a Committee has been coustitu ted for any area,. such Committee shall, notwithstanding anything contained in any Other law for the time being in force but save, as otherwia expressly provided in this Act, have the power to 'deal, exclusively wi[h all proceedings' under this Act relating to children in need of care and protection. Production bfore Committee.—(l) Any child in need of, care and protection may be produced before the Committee by one ofe. following persons- any poli& officer or spccial juvenile police unit or a
designated police officer ; -
any public 'servaht; ,. childline;a registered voluntary' organisation or by such other voluntary organisation or an agency as may be recognised
by the State Government ,
('iv) . any social works or a public spirited citi ~en7 authorised by '.'the State Government ; or (v) by the child himself.

(g) The State Government may make rules consistent with this Act to provide for the manner of making the report to the police and to the Committee and the manner of sending and entrusting the child to children's home pending the inquiry. Inquiry,—(l) On receipt of a report under section 32-, the Committ& or any police officer or special juvenile police unit or the designated police officer 'shall hold an inquiry in the prescribed - manner and the Committee, on its own or on the report from any person or agency as mentioned in sb-sectioh (1) of section 32, may pass an oraer to send the- child to the children's home for speedy inquiry by a social worker o/° child welfare officer. - (2) The inquiry under this 'scction' shall be completed within • Øu? -months of the ieceipt of the order or within such shorter period as may be fixed by the committee: - - Providdd that the time for. - the submission of the, inquiry report may be extended by such period as the Committee may, having regard to thçcircumstances and for the reasons recorded in Writing, determine. - - - (3), After the - ôompleti.on of the inquiry if the Committee • . is of ,the opinion that the said child has no family or ostensible • support, it may allow the child .to remain in the children's home or shelter - Jioma till - suitable rehabilitation is found for him or till, he attains the age of eighteen years. - - - Children's homes.—(fl The State Government may establish and maintain either by itself or in association with the voluntary, organisations, children's 'homes, in every district or group of districts, • as the case may be, •fbr the recèpti6n of - child in need of care and protection during -the. pendency of any inquiry and subsequently for - their care, treatment, education, training, development ad rehabilitation. • - (2) The . State' Government may, b' rule's made under this Act, provide for the management of children's hdmes incicuding the 'sjjpdards and the nature, 0f services to be provided by 'them, and the umstances - under which, and the manner in which, the ' certi- fication of a children's home - or recognjtion to a voluntary organisation may - be - granted or withdrawn. - Jnspection.—(l) The State Government mayppoint inspection - committees for the children's homes (hereinaft a referred to ' as the inspection committees) for the State, a district and city, - as the case may be, for such period and for such urposes as may bd prescribed. '(2)- - The inpection committee of a"State, district or of a,' city •, shall consist of such nurnber of representatives from the State Government, local - authority, Committee, voluntary organ isations and such other medical experts and social workers as may be prescribed.

6.. Social audting.—The Central Government or State may monitor and evaluate the functioning of the Children's homes at such period and through such persons and institutions- as may be specified by that Government. 37. Shelter h'omes.—(l) The State Gtyernment may recognise, reputed and capable voluntary organisations and provide them assista,lce toset up and administer as many shelter homes for juveniles or children as may be required. - The shelter homes referred in sub-section (1) shall function ..as drop-in-centres for the children in the need of urgent support Who have been brought to such homes through such persons as are referred to in sub-section (1) of sectiQ 32. As far as possible, the shelter homes shall have such facilities as may be prescribed by the rules. 38. Transjèr.—(l) If during the inquiry it is found that the • child hails from the place outside the juriülictioij of the Committee, the Committee shall order the transfer of the- child to the competent authority having jurisdiction 'over the place of residence of the child. (2) Such juvenile or the child shall be escorted by the staff of the home in which he is lodged originally. - - - (3) The State Government'may make rules to proVide for the travelling -allowance to be paid to the child. 39. Restoration.—(1) RestoratIon of an&'protection to a child shall be the prime objective of any childrens home or the shelter home. - The children's home ora shelter home, as the case may be,shall take such steps as are considered necessary for the restoration of. and protection to a child deprived of his' farhily environment tcmporarili- or pernianenly where such child is under the care and protection of a children's home or - a shelter home, as the case may. The Committee shall have the powers to itstoi-e any, child in need of care - and protection to his parent, guardian,- fit person or fit institution, as the case may be, and give them suitable diredtions.' Explantation.—For the purposes of this section "restoration of - child" means restoration to- parents; - adopted parents ; foster parents.

CHAPTER tM. I • kEHAEIIJTATION AND SOCIAL REINTEGRATION 40. Process -of rehabilitation and social reintegration.—The rehabilitation • atti social reintegration of a child shall begin during the stay of the child in a chil&en's home or special home and the rehabilitation and social reintegration of children shall be carried out alternatively by (1) adoption, (ii) foster care, (iii) sponsorship and (iv) sending the child • to an after-care ôrganisation. - • 41 Adoption.—(l) The primary responsibility for providing care and protection to dlldren shall be that of his family. • (2) Adoption shall be' [resorted to for the -rehabilitation of gffiph children as are ofphaned, abandoned, neglected and abused rough istituti onal and non-institutionl methods. (3) In keeping with the provisions of the various guidelines for adoption issued from time to time by the State Govern4nent, the Board shall be empowered to give children in adoption and - carry out such investigations as are required for giving children in adoption in accordance with the- guideliies issued by .the State Government-from time t& 4time - in this reg4rd. • (4) lIe children's homes or' the state Government ru-ft - institutions for tirphans shall be recognised as an adoption agencies botl} for scrutiny and placement of such children for adoption - in accordance with the guidelines issued under sub-section (3). No child shall be offerd for adoption— - - - - (a) until two fCmbers of the Committee declare - the child legally -free for placement in the case of abandoned childrep, - -> - (b) - till the two months period for reconsideration by the - parent is over in -the case of surrendered - children, and - - - (c) witlout his consent in the - case of a child - who can p - understand and express his consent. - - - - The Board may allow a - child tó be given in adoptioa- el • • (a) to a single partht;and - - - - (b) to parents to adopt a child of safne sex irrespecitve of - the number of living biological Sons or daughters. - 42. Foster care.—(l) The foster care may be used for temporary placement of those infants who are ultimately to be given , for adoption. - (2) In foster _care, - the child may be placed in another family - for a short or extended- -peod of time, depending upon the circumtances where the child's own parent usually visit regularly and eventually - - after the rdhabilitation, where the children may return to their - - own homes - - - - -' :- .. Sponsorship .-( I) The (sponsorship programme may .rovide supplementary support to families, to childrefi's homes and to special hones to, meet mqdical, hutritional, educational and other needs of the children with a view to improving their' quality of life. (2) The State Government may make rules for the purposes of carrying out various schemes 'of sponsorship of children, such as • individual to inaividual sponsorship, group sponsorship or cOmmunity • - sponsorship., - 44. After-care organisatian.—The State Government may, by rule • made un4er this Act, proviHe- 7 - for the establishment or recognition of after.care organisations and' the functions that may be, performed by • thçm under this Act for a scheme of alter-care programme to be followed by such after-care organisations for the purppse of taking care of juveniles or the children After they leave special homes, children homes and for the purpose of enabling' them to lead an honest, industrious and useful life for the preparation or submision of a report by. the probation officer or any other officer appointed by that . Gqvernment in respect of each juvenile or the child prior to his dischar?c • from a special home, children's home, regarding the necessity and nature of-after-care of such juvenile or of a child ; the period of such after-care, sitpervision thereof and for the submission of report b9 the probation officerS or any other officer appointed for the purpose, on the progress of each juvenile or the child ;- for the standards and the nature of services- to be maintained .- by such after-care organisations; for such other matters as . may be necessary for the pi.irpose ofcarrying out the scheme of after-care progra, • for the juvenile or the child • Provided that any rule made under this section shall not provide for such juvenile or child to stay in, the after-care organisation for more than three years . .. Provided furthr that a juvenile or child over [sventeen year of age but less than eighteen years of a,ge would staS' in the after- care organisation till he attains the age of twezity years. 45. Linkages and co-ordination.—The State Government may make rules to ensure efféqtive linkages between various governmental, non-gove.uimental, corporate and other community agencies t'or lacilitating. the rehabilitation and social reintegration of the child. 19

, t purpose of: inquiry, the competent authority may dispee. with • his attendance and proceed with the inquiry in the absen6c of the juvenile or the child. .4- Committal to approvedplace'ofjztvenile or child sufferi4f?dm dangerous -. diseases and'/jis future disposaL—) When -. a juvenile or the child who has been brought before a ccfmpeteñt author'ity under this Act, is found to be suffering frorn a disease requiring prolonged medical treatment or physical or mental complaint that will respond to treatment, the comp'etent authorfty may send the juvenile or the child to any place recognised to be an approved place in accordance with the rules made under this Act for such . period as it many think necessary for the required tzeatment. - (2) Where a juvenile or . the, child is f9und to be suffering from leprosy, sexually tiansmitted disease, Hepatitis B, - open cases Of Tuberculosis and such other diseases or is of unsound mind, he shall be déalt with seperately through various specialised referral service or under the relevant laws as suéh. Presumption and dettrmMation of age.—(l) Where it 'appears to a cothpetent authority that person brought before it under any of the provisions of this Mt (otherwise than for the purpose of giving e ençe) is a juvenile or the child, the competent authority- shall 48 e due inquiry so as to the age of that person and for tht purpose shall take such evidence as may be necessary (but not an affidavit) ani) èhall record a finding whether the person is a juvenile or the child or not, stating his age as nearly' as may be. (2). No order of a eompetent authority sitall be deernd to have become invalid merely by any subsequent proof ;hat the person in respect of whom the- order has been made is not a juvenile Sr the child, anfl the age ,recorded by the competent authority to be the age of person, so brought before it, shall for the purpose of this Act, be deemed to be the true age of thav person. - G:69812001/G. - 50. SendingajSoenile or child outside jurisdiction.—In the tase ta - -- juvenile or the child, whose ordinary place of residence lies outside the jurisdiction of the competent authority before which he is brought, the competent authority may, if satisfied after due ihquiry that it is ei*pedient o to do, send the juvenile or the child back to a relative or other person who is fit and willing to receive him at his ordinary place of residence and exercike proper care and control over him, notwithstanding that such place of residence is outside the jurisdiction of the competent authority ; and the competent authority exercising jurisdiction over the place to which the juvenile or the child is sent. 40 shall in respect Of any matter arising subsequently have the same poWers in relation to the juvenile or the child as if the original order had been passed by itself. : • 51. Reports jto be treated as confidentiaL'.—The report of the probatiØ officer, or social worker considered by the competent authority shall be treated as confidential Provided that the competent authority may, if it so thinks fit, communicate: the substance thereof to the juvenile or the child or - his parent or guardian and may give such'Juvenile or the child, parent or guardian an opportunity of producing such evidence as may be relevant to the matter stated in the report. . '52. Appeals—(I) Subject to the provisions of this stetion, any person aggrieved by an order made by a competent authority under this Act may, within thirty days from the date of such order, 4 prefer an - appeal to tle. Court of Section : - Provided that the' Court of Section may entertain: the appeal after ,the expiry of the said period of thirty days if it is satisfied that the appellant was Fevented by sufficient cause from filing the appeal in time, ' (2) No appeal shall lie from- any order of acquittal made by the Board in respect of a juvenile alleged to have committdd an offence ; or any order made by a, Committee in i'espect of a 'finding that .a person is not a neglected juvenile. 3) No second appeal shall lie from' any order of the Court• • of. Section passed in appeal under this section. .53. Revision.---The High Court nay, at any time, either of its own motion or on an application received in this behalf, caJi for the record, of any proceeding in which, any competent authority or Court of Sesion has passed an order for the purpose of satisfying itself as to the legality' or • propriety of any such order and may pass such order in relation thereto as it thinks -fit Provided that the High Court shall not pass an order under this section prejudicial to any person without giving him a reasonable o'pportunity of being heard. , . I H 21.: • 54. Procedure in inquiries, appeals and revision procee&itgs.—(1) Save as o;herwise expressly provided by this Act, a competent authority while holding any Inquiry under any of the provisions of this Act, shall • fellow such procedure as may be prescribed and subject, thereto, shall. follow, as far as may be, the procedure laid down in the Code of Criminal Procedure, 1973 (2 of 1974) for . trials in summons cases (2) Save as otheiwisc expressly provided -by or under this • Act, the procedure to be followed in hearing appeals or revisioq proceedtngs under. this Act shall be, as far, - as practicable, in accordance with the provisions of the. Code of Criminal Procedure, 1973 (2 of 1974). PoSer to amend orders.—( 1) Without prejudice to the provisions o appeal and revision under this Act, any competent authority may,, on an application received in this behalf, amend any order as to the institution to which a juvenile or the child is to be sent or as to the person under whose pare, or supervision a juvenile or the child, is to be , placed under this Act: Provided that there shall be at least two members and the parties. or its defence present during the . coure of hearii* for passing an amendment in relation to any of its order. (2) Clerical mistakes in orders passed by a competent authority or errors arising therein from any accidental slip or omission , may, at any time, be ocirrected by the competent authority' either on its own motion or on an applicaion1 received in this behalf. Power of competent authority to discharge and tranjer juvenile or child.-.The' competent authority or the local authority may, notwith- standing anything contained in this Act, at any time, order a child in need of care and j,.rotectión or a juvenile in conflict with Jaw to be discharged . or trasesferred from one children's home or special home to another, as the case may .be, keeping in view the bet interest of the child or the juvenile, and his natural . place of stay,, either absolutely or on such co'iiditions as it may think fit to impose: •rovided that the total' period of stay of the' juvenile or the, child inchildren's home or a special home or a, fit institution or under a fit person shall not be increased by such. transfer. . Transfer between children's homes, under the Act and juvenile homes of like nature in different parts of India.—The State Government or the 1ocl authority may direct any child or the juycnile to be transferred from any children's home or special . home outsIde the 'State to any other children's home, special home . or institution of a like nature with the prior intimation . to the local Committee or the Board; as the case may be, and such order shall be deemed to be operative . for the, competent an thoiity of the area to which the child or the juvçnile is sent. 4. 22
Transfer of juvenile or chi Id of qpsound mind or suffering from lejrosy or addicted to drugs —Where it appear's to the competent authority that any juvenile or the child kept in a special home or a children's home or shelter home or in an institution in pursuancq, of this Act, is sufferipg from leprosy or is of unsound mind or is addicted to any narcotic drug or psychotropic substance, the competent authority may order his removal to a leper asylum or .mental hospital or treatment centre for drug addicts or to a phice of safety fqi being kept there for such period not exceeding the periodt for which he is required to be kept under the order of the competent authority ' or for such further period as may be certified by the medical officer necessary for the proper treatment of the juvjzile or the, child. 'Release and absence of juvenile or child on - Placement.—.(l) When juvenile or the qhild is kept in a children's home or special home5' - and on a -report of a probation officer or social •worker or of Government or a voluntary organisation, as the case nay be, the- competent authority may : consider, the release of such juvenile or the child permitting him to live with his parent or guardian or under the supervision of any authorised person named in the order, willing - to receive and take charge of the juvenile or the child to - educate and train him for some useful trade or calling or to look after him - for rehabilitation. The competent authority may also permit - 'leave of absence to any juveniTh or the áhild, to allow- him, pn •special occasions like 4 dxamination, marriage of relatives, death of 'kith and kin or the accident or serious illness of parent or any emergency of like natute, to go on leave under supervision, for maximum sevat days, excluding the time taken in journey. - ,- - - Where a permission has been revoked or forfeited and the juvenile or the child refuses- or fails to returh to the home concerned or juvenile to - which he was directed so to returns the Board may, if necessary, cause him to be taken charge of and to be taken back to the concerned home. - - - - (4) The time during which a juvenile or the child is aSt S from a concerned home in Iursuance f such permission granted uzuiler this section shall be deemed to be part of the time for which he is liable to be kept in the special home: -- . - - Provided that when a juvenile has failed to return to the speéial home on the permission being revoked or -forfcited, the time which c1pses after his failure so to retuin shall be excluded in cémputing

(2) The competent authority may direct, if necessary, the paymeift to be made to poor parent or guardian by the Superintendent or the Project, Manag7 - of the home to pay such expenses for the journey of the inmate or parent or guai'dian or both, from the home to his ordinary -place of residence at the time of sending the juvenile as, may be prescribed. 61, Fund.—(l) The State Government or local authority may create A Fund under such name as it thinks -fit for the welfare and •ehabilitatton of the juvenile or the child dealt with under this Act. Thei shall be tcerdited to the Fund such voluntary donations, contributions or subscriptions as may be made by any • individual, or organisation. The Fund created under sub-section (I) shall be administered • by the State advisory board in such manner And for such purposes. a's may be 'prescribed, • '62. Central, State, district and city advisory boards.-4(l) 'The Central Government or - a State Government may constitute a Central or a State advisory board, As the case may be,' to a'dvise that Government on matter relating to the establishment and maintenance of the homes, mobilisation of resour'ces, provision of facilities for education, training and rehabilitation of child in need of care and protection and -juvenile in conflict with law and co-ordination aritong the various official and non,-offlcial agencies concerned. (2) The Central or State advisory board, shall - consist of such persons as the Centçal Government or the Stte Government, as the case may be, may think fit and shall include eminent social workers, 'representatives of véluntary organjsation in the field of child welfare corporate sector, academicians, medical professionals and the oncerned Department of the State Government. • • (3) The district or city level inspection committee constituted under section 35 of this Act shall also fuoction as the district or city advisoty boards. 63. Special juvenile police unit.—(l) In order to enable the police dificers who frequently or exclusively deal With juveniles or are primatily 'engaged in the prevention of juvenile of critne o? handling of the juveniles or children under this Act to perforp their functions more effectively, they shall be specially in%tructed 'and trained:, •. • (2) In every police station at least one officer with aptitude and appropriate training and orientatiOn may be designated as the 'juvenile or the child welfare ,, officer' who will handle the juvenile or the child in . co-ordination with the police. 24 C T (3) Special juvenile police unit, of whrch ill police officers designated as above, to handle juveniles or children will be members, may be created in every district and city to co-ordinate and to upgrade the police treatment of, the juveniles and the children. Juvenile in conflict with law undergoing se'ntence at commencement of this Act—In any area in which this Act is brought into force, the State Government or the local authority may direct that a juvenile in. conflict with law who is undergoing any sentence of imprisonment • at the cqmniencement of this Act, shalj, in lieu of undergoing such sentence, be sent to a special home or be kept in fit institution in • such manner as the State Government of the local authority thinks fit for the remainder of the period of the sentence -; and the provisions of this Act• shall apply: to the juvenile as is he had been ordered by the Board to be sent to such special home or institution or, as the case may be, ordered to be kept under protective care under sub-section (2) of section 16 of this Act. Procedure in respect of4oads.—Provisions of Chapt.er XXXIII of the Code of Criminal Procedure, 1973 (2 of 1974) shall, as far as] may be apply to bonds taken under this Act. Delegation of ftowers.--The State Governmentmay, by the general order, direct that any power exercisable by it under this Act shall, in such circumstances and under such conditions, if any, as may be -- prescribed in the order, be exercisable also by an officer subordrnatc to - that Government or the local authority. - Protection of action taken in good faith.—No suit or legal proceedings shall lie against the State Government or voluntary organisation running the home or any officer and the staff appointed in -pursuance of this Act in respect of -anything which is in good faith done or intended to be done in pursuance 9f this Act or of any rules or. - orLer made - thereunder. - - - - - Power to make rules.—( I) The State Government may, by noti- .flcation in the Official Gazette, make rules - to carry out the ; purpos - - - of this Act. (2) In particular, and without prejudice to the generality of the fotegoing powers, such rules may provide for all or, any of the following Platters, namely:— . the term of -office of the members of the Board and the manner in which such member may resign under sub-section (4)of section4 - - the time of the meetings of the Board and the rules of procedure in regard - to the transaction of business at its meeting j&nder sub-section (1) - of section 5 ; -

• - (un the management of observation homes including • the standards and various types of services to be provided' by them and the circumstances in which and the maimer in - which, the certification of the observation home may be granted: or withdrawn and such other matters as are referred to in section8; - - (iv) the, management of special homes including the standard and various types of services to be provided by them and the cirdumstances in which and the manner in which, the certification of the special home May -be granted oi withdrawn and such other matters as are referred to in section 9

(v) persons to whom any juvenile in conflict with Jaw may be produced before the Board and the ranner of sending such • juvenile, toan observation liume under sub-section (2) of section 10; matters relating to remowil of disqualification attaching • to conviction of a juvenile under section 19 ; the qualifications of the. Chairperson and members, and the tenure for which they may be appointed under sub-section (3) of r ' section29; the time of the meetings of the Committee and the rules of procedure in regard to the trans'ction of business at its meeting under sub-section (1) of section 30 (is) the manner of making the report to the police and to • the Committee and the manner of sending and entrusting the child • to children's home pending the inquir7 under sub-section (2) of section 32 ; (z) the management of children's 1omes including the ssndards and nature of services to be provided by them,, and the manner in - which certification of a children's home orjecognition to a voluntary, organisation may be granted or-withdrawn under sub-section (2) of • seCtion 34 * • (xi) appointment of inspection committees for children's homes,- their tenure and -purposes for - which inspection committees may be -appointed and such other matters , as are referred to in section 35 - (xii) facilities to be provided by the shçlter homes under - sub-section (3) of lection 37; - - (idui) for carrying out the , scheme of foster care programme of. • children under sub-section (3) of section - 42 ; -• + - - - (xiv) for carrying out various schemes - of spousorship of • children under sub-section 2) of section 43; - 26 .,
(tv) matters relating to after-care organisation under section 44 for ensuring effective linkages between various agezicies for facilitating rehabiliration and social integration of the chilØ under section 45 ; the purposs and the manner in which the Fund shaU be administered under sub-section (3) of section 61 - * any other matter which is required to / be, or may be, prescribed. - (3) Every rule made by a State Government under this Act shall - be laid, as spoxz as. may beafter it is made, before the Legislature.of that State. Repeal and savings.—(l) The Juvenile Justice Act, 1986 (53 o 1986) is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Act shall be deemed to have been done or taken under the corresponding provisions of this Act. - Power to remove difficulties.—(l) If any difficulty arises in giving effect to the provisions of this Act, the Central Government may, by order, not inconsistent with the procisions of this Act, ..remove the difficlty Provided that no such 'order sfzall be made after the expiry - of the period of two years from the commencement of this Act. (2) However, order made under the section shall be laid, as soon as may be after it is made, before each House of Parliament. '4
