Designation of Neighbourhood Plan Area

Following an application from Parish Council and subsequent statutory consultation of that bodies relevance to make the application and appropriateness of the proposed designation for the Neighbourhood Plan for Wiveliscombe; Borough Council as the Planning Authority hereby approves the designation.

The Parish Council is a ‘relevant body’ under the Localism Act, Section 61F (authorisation to act in relation to neighbourhood areas) of the Town and Country Planning Act 1990, for the purpose of producing a Neighbourhood Plan and designating the Neighbourhood Plan Area under Section 61G (meaning of “neighbourhood area”); and is therefore qualified to undertake neighbourhood planning

The proposed Neighbourhood Area follows the Parish boundary; and is shown on the attached map.

In accordance with Regulation 7 of The Neighbourhood Planning (General) Regulations 2012 Taunton Deane Borough Council is publicising the designation of the Neighbourhood Area

About Wiveliscombe

Wiveliscombe, a former borough, is a market town to the west of Taunton and five miles from the / border. It is situated at the foot of the and acts as a gateway to . While the population of this rural centre is only about 2,800 persons, its shops and services meet the needs of a much larger population, spread through scattered farms and villages. There are more than 300 businesses within a five mile radius of the town.

Wiveliscombe has two breweries. There is a good variety of shops, a post office, one bank, two estate agents, solicitors, accountants, hairdressers, garages, inns and restaurants. There is also a doctors' surgery, a dentist and two veterinary practices.

The primary school and Childrens Centre serves most of the surrounding villages, Kingsmead Community School for pupils aged 11 – 16. The school houses a theatre and sports hall and a youth club and playgroup complementing the town's recreation ground where the tennis, swimming, rugby, cricket and football clubs have their bases.

Relationship between Wiveliscombe Neighbourhood Plan and Taunton Deane Core Strategy

Taunton Deane Borough Council has recently published its Core Strategy. The document is scheduled for submission to the Secretary of State and Planning Inspectorate in October with examination anticipated in early 2012. The emerging Core Strategy recognises Wiveliscombe as a Major Rural Centre within its settlement hierarchy. Policy SP1 states that:

“Major Rural Centres are identified as Wiveliscombe and . These settlements will provide the focus for essential facilities within rural communities, this will include an appropriate balance of housing provision, small-scale employment and other local services. In these settlements allocations of up to 200 new net additional dwellings will be made through the Site Allocations Development Plan Document.”

The Wiveliscombe Neighbourhood Plan will be prepared consistent with the Council’s Core Strategy. It will articulate a clear vision for the long term future of the town with the exact scope of the plan will be determined in part by the results of early engagement. It is anticipated that that the Plan will identify appropriate allocations to ensure that the town fulfills the role and function identified in the emerging Core Strategy.

Status and adoption

Subject to the outcome of the referendum being successful, the Neighbourhood Plan will then be adopted by Taunton Deane Borough Council. Dependent on compliance with the provisions of the Localism Act, the final document may achieve either formal status as part of the Statutory Development Plan or be adopted as a Supplementary Planning Document.

Route Map to Localism The following section sets out the Community’s proposed approach to the preparation of the Wiveliscombe Neighbourhood Plan. This draws on previous experience and follows a flexible approach. The Community Plan Steering Group refer to this process as the Neighbourhood Plan Route Map:..

1. Establish Ownership. (The Steering Group will feed back progress at Parish Meetings)

2. Vote at Parish Council on need for Plan.

6. Draft Plan published. Open meeting of public/feed back day in Wiveliscombe House

Make changes to plan in response to feedback.

7. Publish Wiveliscombe Neighbourhood Plan.

8. Examination of plan by professional (Planning Inspector)

9. Referendum in Parish on Plan.

10.Plan adopted by Taunton Deane Borough Council as a Neighbourhood Plan or Supplementary Planning Document.

Note: Whilst no explicit timeframe has been set out for the preparation of the Plan, it is anticipated that the document will take approximately 12-18 months to progress to adoption following the award of any grant.

Examination & Referendum

We propose to engage an appropriately qualified independent inspector who will undertake a public examination into the soundness of the Wiveliscombe Town Plan within the existing and emerging statutory planning framework. The output of the examination would be a non-binding report in line with procedures outlined in the Localism Bill. Following any amendments deemed necessary, the Wiveliscombe Town Plan would then be put to a public referendum. The Parish and District Council would together discuss and determine the best means by which to undertake the referendum.

Wiveliscombe Parish Council voted at their September 2011 meeting to support this application from Taunton Deane Council and is fully committed to the Wiveliscombe Neighbourhood Plan and the work it requires.

Notice of Consultation Under Section 61F&G of the Town and Country Planning Act 1990 and Section 2 Regulation 5 of The Neighbourhood Planning (General) Regulations 2012; an application has been received from Wiveliscombe Parish Council to produce a Neighbourhood Plan for Wiveliscombe covering the area defined on the attached map.
