DEFINITION OF TERMS

Beneficiary Community: All persons and households situated within the government-owned or acquired property, who voluntarily seek to avail and be part of the Program and represented by a community association that is duly recognized by the community residents, accredited by the local government, and legally registered with appropriate institutions / competent authorities. Compensation: Payment in cash or in kind of the replacement cost of the acquired assets. Entitlement: Range of measures comprising compensation, income restoration, transfer assistance, income substitution, and relocation which are due to affected persons, depending on the nature of their losses, to restore their economic and social base. Cut-off-date: shall conform to the date of commencement of the affected persons (AP) census in the specified area. Land Acquisition: The process whereby a government agency compulsorily alienate all or part of the land a person owns or possesses and transfer the ownership and possession to the government agency for public purpose in return for a consideration. Affected Person/People (AP): Any person affected by program-related changes in use of land, water, natural resources, or income losses. APs include those having losses as described in Table 2, the Entitlement Matrix which includes both titled and non-titled persons experiencing resettlement impacts due to the Program. Affected Family: All members of a household, residing under one roof and operating as a single economic unit, who are adversely affected by the program or any of its components. It may consist of a single nuclear family or an extended family group. Rehabilitation: Compensatory measures provided under the Land Acquisition and Resettlement Framework other than payment of the replacement cost of acquired assets. Replacement Value: The amount required for the Affected Household to replace/reconstruct the assets acquired by the government agency through purchase in the open market. See Table 2: Entitlement Matrix in this document. Resettlement: All measures taken to mitigate any and all adverse impacts of the program on AP’s property and/or livelihood, including compensation, relocation (where relevant), and rehabilitation. Below Poverty Line (BPL) Households: There is no designated sum determined by the Government of Uzbekistan to define a BPL household. For the purpose of this Project, the World Bank definition of poverty line for (2003-2005) of US$ 2.15 per day per person or UZS 3,225 per day per person will be used. Minimum Wage Rate: The official minimum wage rate declared is UZS 91,530 per person a month, will be used for providing assistance allowance for 3 months for affected persons belonging to the vulnerable group and those affected persons by the project by more 10% of their assets and properties. Vulnerable Households: Households headed by women, having disabled persons, ethnic minorities, elderly persons living alone and BPL households

EXECUTIVE SUMMARY

A. Project Introduction

In 2009, the Government of the Republic of Uzbekistan (the Government) entered into a Financing Framework Agreement (FFA) with the Asian Development Bank (ADB) for a multitranche financing facility (MFF) to finance Water Supply and Sanitation Services Investment Program (the Investment Program), in an aggregated amount not exceeding $300 million from ADB's Special Funds resources. On 29 September 2009 the ADB Board of Directors approved the MFF Program with Uzbekistan Agency "Uzkommunhizmat" (UCSA) as the Executive Agency (EA).

For Tranche 2, the Government requested ADB to finance rehabilitation and expansion of water supply and wastewater management systems in , , , and cities and water supply system in Rishtan city, which are priorities for development.1 Immediate rehabilitation and/or reconstruction of water supply and sanitation (WSS) systems and development of vodokanals' operational capacity is needed to prevent the systems from further deterioration and provide acceptable WSS services to about 1.1 million residents in these cities.

On 16 March 2010, the second Periodic Financing Request (PFR) was submitted to ADB for financing. The period from 2010 to 2013 was the period of gathering documents and social economic information. And on 21 September 2013 was fully updated the LARP and the date is cut of date. On 12 December 2012 was held the bid of rehabilitation of Water Supply Systems of 3 cities (Fergana, Margilan and Rishtan). On 20 September, 2013 the ADB evaluation has confirmed that the above civil works package will need to be re-bid. On 16 April, 2014 the above civil works package was announced in the ADB website to be re-bid and the deadline of submission date was on 28 May, 2014 and the civil works are being evaluated at the moment.

Initial social assessment was conducted to identify social impacts of the proposed water supply subproject for Rishton City. As a result, Land Acquisition and Resettlement Plan (LARP) was prepared to mitigate impact of the land acquisition and permanent loss of assets and property caused by the construction of 2 new water wells and other structures to be located at the land owned by “Tayyorlovsavdo” LLC located in Tekstilnaya St., Rishton City.

The objectives of the proposed LARP are: (i) to identify the project impact on the community in terms of loss of assets, livelihood and income; (ii) to outline measures to mitigate the adverse impact; and (iii) provide an estimate for budgetary allocation for compensation of loss of assets and resettlement benefits. And if required, for loss of income & livelihood, according to principles and guidelines provided in the entitlement matrix prepared for UZB: WSS Services Improvement Investment Program.

After final design was completed, minor changes have been made to some components, such as construction of 16.7 km of new water transmission main, and Installation of 2 new wells at existing Topvaldiev site have slightly changed the resettlement plan, As a result, the LARP was updated in September 2013 based on detailed survey and consultation with affected people. Table below lists the main change between original LARP in 2010 and updated one in September 2013.

I. INTRODUCTION

1. Uzbekistan Water Supply and Sanitation (WSS) Services Investment Program has been initiated with a view to improving living standard in urban areas with the help of upgrading water supply and sanitation services which, till now, is less than satisfactory. Access to safe water and sanitation facilities have direct impact on poverty reduction and welfare improvement strategy. Apart from investment in physical infrastructure the program also proposes for long term capacity building and institutional strengthening of the executing agency and staff training.

2. The objectives of the proposed LARP are the follows: (i) identify the project impact on the community in terms of loss of assets, livelihood and income; (ii) outline measures to mitigate the adverse impact; and (iii) provide an estimate for budgetary allocation for compensation of loss of assets and resettlement benefits. And if required, for loss of income & livelihood, according to principles and guidelines provided in the entitlement matrix prepared for UZB: WSS Services Improvement Investment Program. The primary purpose of this LARP is to identify steps to restore the living standards of the affected persons (APs) to the pre-project situation within a short period of time without any disruptions of their own economic and social environment.

3. This updated Land Acquisition and Resettlement Plan (LARP) was prepared in accordance with the final design and was carried out from September 2013 to July 2014. According to this design estimated amount of required land for construction of a new water intake in Rishtan subproject will be 2.1 ha. From this 1.2 ha will be required permanently and 0.9 ha temporary.

4. Permanent land acquisition will affect Tayorlovsavdo LLC (0.85 ha) and district reserve land (0.35 ha) that acquired lands are presented in Figure 1 below. The land will be used for construction of two new water wells. The land to be acquired is in unused space and the structures to be affected e.g. administration building is no longer being used by the enterprise. According to the Chairperson of the LLC, remaining 0.75 ha of land is sufficient for their company’s business operations and that the compensation for the lost structures will be used as additional capital to their enterprise’s business development. District reserve land will not be compensated since the district directly benefits from the project.

5. Temporary land acquisition will affect 2 orchards and 3 farms land (0.90 ha) by lying down pipelines. The project will impact only trees since no crops are planted on this land. After end of the project land will be given back to the households for further use.

6. The updated LARP was prepared by adopting the following approach:

(i) After final design was obtained from the engineer, field survey was undertaken to identify the impacts of land acquisition that will be required by the Project. (ii) After scope of impacts were identified, consultation with affected people was carried out with the following objectives: (i) to survey the socio economic conditions of affected people, (ii) to explain their right of compensation based on the entitlement matrix, and (iii) provide other information including the planning schedule for implementing the project, the grievance redress mechanism.

The consultation with affected people was also carried out during the period of updating LARP including consultation with other stakeholders.

7. Taking into account the above objectives, there is no change adopted for entitlement matrix and also the institutional arrangement of implementing LARP. Nonetheless, the cut of date was changed due to the new impact of the design on land acquisition. The update date of the cut date applied for this updated LARP is now September 2013.

II. PROJECT DESCRIPTION

8. The subproject is intended to extend and improve water supply access to households by constructing new transmission pipeline and rehabilitation of existing distribution networks and existing boreholes and new wells, specifically:

(i) Rehabilitation of 7 existing wells at Sokh River well field to supply 10,000 m3/day of water; (ii) Construction of new bulk water supply unit, including new pumps and chlorination system; (iii) Construction of 16.7 kms of new water transmission main impacting 2 households route and 3 farms from the well field to WDU-2; (iv) Installation of 2 new wells at existing Topvaldiev site, with capacity of 2,900 m3/day; (v) Rehabilitation of existing WDU-2, including the storage reservoirs structures and buildings, and replace all mechanical, electrical and control systems; (vi) Replacement of 33.8 kms corroded and leaking pipe in the distribution system; (vii) Construction of 20 kms of new distribution lines to expand water system coverage from 70%-100% which is in 2025 the expected number of population reaches to 38,000 people.

9. The assessment of the above works from the land and other property acquisition as well as resettlement standpoint shows the following:

(i) Construction and rehabilitation of existing wells, reservoirs and water distribution lines (points i, ii, v, vi, and vii in the paragraph 8) will be at the same place allocated to the district vodakanal and/or right-of way of the Khokimiyat city, therefore there is no requirement for additional land acquisition and will not have any impact due to land acquisition and resettlement issues.

(ii) Construction of 2 new water wells in Topvoldiev site will require 1.2 ha of land areas. It includes 0.35 ha of community reserve land and 0.85 ha of land areas used by Tayyorlovsavdo LLC which will require compensation for losses of permanent buildings and structures. The land to be acquired will not affect the income of the owner and of the workers since the land to be acquired is an unused space and that the structures to be affected e.g. administration building is no longer being used by the enterprise. According to the Chairperson of the LLC, the remained part of the land is sufficient for their company’s business operations and that the compensation for the lost structures will be used as additional capital to their enterprise. In “Tayyorlovsavdo” there are 10 employees will be affected including 1 woman and 9 men.

(iii) The construction of new trunk mains in Rishtan city also affects 2 households and 3 farms.

10. Assessment of the Rishton’s existing water supply system revealed that out of 34,000 city population, only 21,000 (62%) are being served with water supply. Because various problems such as: storage reservoir is in poor condition, most of the pumps are not working, the chlorination doesn’t work, transmission pipelines are old and leak which are causing contamination, not all households have water meters and if they have, there are not working and water pressure is low.

Tayyorlovsavdo LLC (outlined in yellow) is located along the roadside of the suburb part of the city. In the picture from the Google Earth, one can see assets of the LLC. 12. Status of the project Implementation

The final design has been completed, and the bidding for contractor selection is now being processed. It is expected that the contract could be awarded not later than 3 months.

III. SCOPE OF LAND ACQUISITION AND RESETTLEMENT

3.1 Scope of LARP

13. This land acquisition and resettlement plan (LARP) has been prepared on the final design provided by “Islohat Constalting Service”.

14. The Project construction would entail temporary and permanently land acquisitions and involuntary resettlement impacts on land and structures. The census identified a total of 2 affected households (AHs) and 3 farms that will be affected as a result of the Project. The project area is located in Rishtan city assembly of citizens (CAC) of .

15. Reconstruction and rehabilitation of existing wells, reservoirs, water distribution units (WDU-1 and WDU-2) and water distribution lines (20kms), will be at the same place allocated to the district vodakanal and/or right-of way of the Khokimiyat, therefore there is no requirement for additional land acquisition and will not have any impact due to land acquisition and resettlement issues.

16. A total of 2.1 ha of land will be required for the project. Out of 2,1 ha 1.2 ha will be required on permanent basis and 0.9 ha on temporary basis. The cropping farmland or households’ lands will not be impacted in this project. On the temporary affected land households there are only trees which are not used as cropland. And construction works will affect some trees since the trees which were planted every 10 meters on farms lands. (see Appendix 2,3 and Appendix 7 - Photo from temporary affected land of farms and households.

17. The subproject will also entail construction of 2 new water wells on 0.85 hectares private land located at Tekstilnaya Street, Rishton City, owned by “Tayorlovsavdo” LLC and will require land acquisition. However, for the construction and rehabilitation of existing wells, reservoirs and distribution lines, these will be undertaken within existing locations and existing alignment, mostly under the road or within right-of-way of Khokimiyat city jurisdiction.

18. The subproject will acquire around 0.85 hectares of land from “Tayerlovsavdo” LLC (TLLC) which is owned by 17 co-owners with 10 employees. The total assets of the TLLC are around UzSoums 500 million (or US$ 333333). The 0.85 hectares of affected land to be acquired by the subproject will be given back to the Khokimiyat of Rishton City. There are buildings and structures that will be lost by the enterprise, but some of these are old and are not being used except for the cowshed and they are requesting compensation of UzSoums 73,968,187 (USD$ 34,642) which is around 51% of the total assets and properties of the TLLC. The 17 affected co-owners of the TLLC will receive UzS 13 602 000 one month income loss compensation; and 10 affected employees will receive an income/ livelihood allowance support of UzS 91,530 per affected person for 3 months minimum wage rate. For the compensation for permanent loss of land, plots of equal value/productivity of plots lost could be provided by the Khokimyat as per request by the TLLC.

19. The director of “Tayorlovsavdo” LLC was informed about compensation of a new part of land in another place as replacement. But he does not want to get a new part of land for replacement, because the remaining part of the land that he can use is enough to continue working and do not want to pay the superfluous tax for new part of land.

20. The final census survey of the affected enterprise and owners was conducted in September 2013. The day of impact survey and the census completed on 21 September 2013 is considered as cut-off-date. After the census cut-off-date no person, building, any structure or cause, any kind of land use change will be considered eligible for resettlement assistance or compensation.

21. In September 2013 was last estimation work that was Monitored by director of estimation company, PIU specialist and chiefs of farms and orchards with local hokimiyats.

22. From total of 15.9 kms community utilized facilities (CUF) such as roads, streets, pavements and water pipelines will not be impacted.

3.2 The LAR Implications

23. By the changing design of the alignment from 2010, construction of 16,7kms new water transmission main from the well field to WDU -2, 0.90 ha of land areas will be temporarily affected. They include land areas of 2 orchards and 3 farms, affecting a total 5 households.

24. By installation of 2 new wells at existing Topvoldiev site, a total of 1,2 ha of land area will be acquired permanently, including 0,85 ha from “Tayorlovsavdo” LLC.

25. The information on type and extent of loss as well as use of the lost properties was collected during the census. Table 1 shows the extent of loss which includes land,

administration building and other structures which are used for buying, storing and trading vegetables and other farm products including a cowshed will be affected by the subproject.

26. Not all the “Tayyorlovsavdo” LLC’s land is used under structures which are empty and not used.

27. According to the survey, the project will impact a total of 408 trees including 173 fruit trees and 235 timber trees. These trees belong to 2 orchard owners and 3 farms. The following Table 2. shows full information about trees, permanent and temporary land use and economic sphere.

Permanent land acquisition for construction of two new water wells will affect Tayorlovsavdo LLC (0.85 ha) and district reserve land (0.35 ha) for losses of permanent buildings and structures (Figure 1). The land to be acquired is an unused space and that the structures to be affected e.g. administration building is no longer being used by the enterprise. According to the Chairperson of the LLC, remaining 0.75 ha of land out of 1.6 ha is sufficient for their company’s business operations and the compensation for lost structures will be used as additional capital to their enterprise’s business development. District reserve land will not be compensated since the district directly benefits from the project. Total amount of compensation for buildings of “Tayorlovsavdo” LLC is UZS 73 968 000. And compensation for 10 workers that losing limited working time by construction is UZS 2 745 900 (see also Table 3 and Table14). The valuation work was carried out by Valuation Company – “Prize and Analyze”.

29. Temporary land acquisition will affect 2 orchards and 3 farms land (0.90 ha) by lying down pipelines. The project will impact only trees since no crops are planted on these lands. After end of the project land will be given back to the households for further use. Total compensation for trees of the affected farms and household is UZS 16 761 481. The valuation works of affected trees have been conducted by the valuation company “Prize and Analyze”.

30. The total estimated budget for compensation of buildings and trees of Rishtan city is presented in the following table. Based on valuation, it includes compensation for affected trees, buildings, wage loss for employees and income loss for the company.

31. The total estimated budget for compensation of buildings and trees, cost of resettlement operation and management for the Project is UZS 107 077 381 or USD $ 50 148 (UZS 2135.26=$1). A break up of cost estimate is given in the Table 12 below. Appendixes 2, 3 and 4.

3.3 Socio-economic profile of affected households

32 The number of households affected in the sub-project area are 5. In terms of gender status 36% males and 64% females comprising of 32 persons in total. The survey shows that education status of affected households is 70% and 30% of the total men and women and have formal education. There are 10 persons work in “Tayyorlovsavdo” at the present time. There is 1 (10%) woman and 9 (90%) men.

34. Distribution by age and gender of TLLC’s and Affected Households (Table 5) shows that 44% are young and dependent; 45% are in working age and 11% are mainly pensioners/retired. There is not much difference between the genders from 20-50 ages below. However, the retired/pensioners are mostly women. The pension received by retired persons is an additional income to the households.

The data shows that out of 10 staff, 7 (70%) employees belong to the age range between 21-40 years old. This age group is young and would be the most productive among the other age groups. In terms of age and gender, 1 (10%) female belongs to the young and highly productive group and 1 (10%) male belongs to the young and highly productive group.

36. Educational level of 33 affected persons in households, farms and 10 employees of the TLLC (Table 7) show that 6% have achieved university level; 32% have achieved college level; 27% have completed secondary level and 35% have general secondary level. In terms of gender distribution there is not much difference between educated genders 52% males and 48% of the educated females. All of the co-owners households and the employees of the TLLC have attained education.

37. Table 8 shows that the “Tayorlovsavdo” LLC has 10 workers. Out of these 10 workers,9 males and 1 female. That 1 female works as a cleaner position.

39. Table 10 shows the income levels by gender of affected households and farms. Total 32 persons in the 5 affected households. Basically, females work in markets and males are main incomers of these households. Table 10 shows all income amounts of the 5 households.

40. For the Employees of the TLLC, Table 11 shows that there is no difference by gender on the monthly income, however, based on position and number of people employed by the

Company, there are more males employed by the Company and the highest positions are all occupied by males who are receiving higher income. There is only 1 female employee and she occupies the lowest position in the Company.

A. Indigenous People

42. Rishtan City subproject does not affect any indigenous ethnic group of people in the region.

IV. POLICY FRAMEWORK AND ENTITLEMENTS

43. There is no law or legislation in Uzbekistan that specifically addresses matters related to involuntary resettlement (IR). Rather land acquisition is governed by the following laws and resolutions:

(i) The Land Code; approved by the Law of the Republic of Uzbekistan from 30.04.1998, taking the changes of 2003-2004 into account;

(ii) The Civil Code of Republic of Uzbekistan from 1996, taking the changes of 2004-2008 into account;

(iii) Law of the Republic of Uzbekistan on “State Cadastre” N171-II from 15.12.2000

(iv) Law of the Republic of Uzbekistan on “State land cadastre” N666-I from 28.08.1998г taking the changes of 2002-2004 into account

(v) The Resolution of Cabinet of Ministers on “Measures to improve provision of land for urban development implementation activities and other non-agricultural activities” No.146 dated 25 May 2011;

(vi) The Resolution of the Cabinet of Ministers on “Approval of Regulation on the order of legalization of seizure and allocation of land plots for non-agricultural needs in the Republic of Uzbekistan” No. 248, 27 May 1992

(vii) The Resolution of the Cabinet of Ministers on “Approval of the Regulation on the order of adjudication of land disputes in the Republic of Uzbekistan” №246 from 25.05.1992;

(viii) The Resolution of the Cabinet of Minister on “Order of realization into private property of objects of trade and public services together with land plots, where they are located, and land plots into life inheritance tenure” №126 from 11.04.1995, taking the changes of CoM Resolution № 202 from 30.04.1999 into account;

(ix) Resolution of CoM “On approval of the sizes of agricultural production losses compensation, relating to land acquisition, for needs not connected with farming or forestry management” № 223 from 16.06.1995;

(x) Resolution of CoM “On approval of the regulation on the order of identification of the sizes of agricultural production losses compensation, relating to land acquisition, for needs not connected with farming or forestry management” № 282 from 15.06.1992;

44. Collectively, these regulations provide a sound basis for acquiring land for public purposes and for compensating land users according to the registered use of the land (i.e. for cultivation, business, residence etc.).

45. ADB’s Land Acquisition and Resettlement Framework and Policy state:

(i.) The following categories of affected persons will be entitled to compensation and/or rehabilitation benefits: a. Affected Persons (APs) losing irrespective of whether land is under valid legal rights or customary rights or without legal status; b. Tenants and sharecroppers (the workers working for a share of a crop) whether registered or not; c. Owners of buildings, crops, trees and other objects attached to the land; and d. APs losing business or income/employment opportunities

(ii.) APs and affected assets will be identified through a detailed survey/census or detailed measurement survey (DMS). The DMS end date will be the census cut- off date for compensation eligibility. APs settling in affected areas after this date will not be eligible for compensation. They will be given sufficient advance notice to vacate and dismantle the affected land/structures. Their dismantle structures will not be confiscated nor will they be fined or sanctioned.

46. The LARP is based on the updated findings of the census, socio-economic survey, observation during field visits, and participatory consultation meetings with various groups including the affected persons in the subproject area. The census was carried out on September 2013. Compensation and resettlement assistance for various types of loss have been determined following the provision made in the LARF. In brief, the people affected by the subproject will be entitled to the following types of compensation and assistance: (i) land for compensation for permanent and temporary loss of land; (ii.) compensation for loss of portions of structure at replacement cost; (ii) compensation for loss of fruit and timber trees; (iii) and compensation to affected workers for lost wages for the period of business interruption for 3 months.

47. Land use by “Tayyorlovsavdo” Company is legal based on the Land Code of Uzbekistan concerned and provision for compensation for losses of assets and properties will be made.

48. The census cut-off date is September 2013 has been considered as the cut-off-date for affected enterprise/ persons for entitlement. The entitlement matrix has been prepared in accordance with the LARF of the program, for the affected people. People moving in the project area after the cut-off date will not be entitled to any assistance. Structures built in the proposed project area will not be entitled to compensation.

V. COMPENSATION AND ENTITLEMENT

5.2 Compensation for the Affected Properties

49. The updated LARP provides compensation details according to LARF prepared for the MFF program. As described in the entitlement matrix (Table 12), the compensation for all types of losses in terms of assets / livelihood, temporary loss, permanent loss and other unanticipated loss will be given due consideration for preparing compensation adequate for rebuilding life of the APs at pre-project level.

50. Land for land compensation for permanent loss of land with plots of equal value/productivity of plots loss was proposed to TLLC by the Khokimyat. However, the TLLC’s Director rejected the proposed land plot and says that the remained land is enough for the company’s business operation.

51. Cash compensation for permanent loss of structures at replacement rate based on market price. Using The Office of Cadastral prepared the estimates documents of buildings for the affected structures owned by the TLLC that estimated by company based on market price that is UZS 73 968 187.

52. Additional allowance to 10 affected workers, living at poverty level income, equivalent to 3 months multiplied by the minimum wage per month of UzS 91,530 per affected person per month that based on average wage loss. (Table 12)

5.2 Gender Issues

53. In general, there is no any general gender issue. There are nine male employees and one female employee. Although the one employed woman occupying low positions, her monthly income is the same with the male occupying the same positions.

54. Although the income of females in households and farms are not equal with the males’ they have daily work and have their own income.

VI. PUBLIC PARTICIPATION AND CONSULTATION

55. During last social assessment the census were conducted with the project affected persons/households as well as with the Khokimiyat of Rishton City, vodakanal and the makhalla leader of Topvoldiev Makhalla. Consultations about ownership/possession right over the affected land use/structures and the ADB policy on land acquisition and compensation were discussed.

56. During the process of LARP preparation, consultation meetings were conducted with directors of enterprises and families on 12 March 2012, 8 January 2013 and September 2013. Following the meetings, the written agreements for construction were provided by them. The project information brochures had been distributed to affected people in order to inform them that during project implementation if there is any complaint and questions, they could address directly to PIU in Fergana city, local vodokanals, Khokimiyat of or local Khokimiyats. In vodokanals, "Information centers" was set up for addressing any complaints and issues raised by affected persons.

57. According to the chairperson of the enterprise, the TLLC will use the compensation for the losses of the buildings and other properties to increase the capital of their enterprise which is on the brink of bankruptcy. All 10 staff of the enterprise will be employed by the enterprise.

VII. ORGANIZATIONAL SET-UP

58. Agency of “Uzkommunhizmat” will have overall responsibility to implement the LARP as the executing agency (EA). The Program Management Unit (PMU) within Agency “Uzkommunhizmat” will be responsible for the management of LARP implementation. The PMU team will consist of safeguard team responsible for planning, implementation and internal monitoring of LARP. The PIU will work closely with mahalla, local authority representatives of the Fergana province hokimiyat and Rishtan district hokimiyats, departments of Goskomzemgeocadastre (Land Resource and Cadastre Committee).

59. In accordance with the legislation of Uzbekistan province commission on land acquisition and district evaluation boards are responsible for conducting of a resettlement. Such commissions include representatives of the following authorities:

 Province/district department of the State Committee on Land Resources, Geodesy, Cartography and State cadastre (SCLRGCSC)  Province/district Hydromeliorative Expedition  Province/Department/District Unit of Goskompriroda (State Nature Protection Committee  Province/district divisions of SES  Province/district fire units  Beneficiary organizations and contractors (UCSA, EA, the Social and Environment Sub-Unit (SESU), Design Institute. 60. The commission includes all the affected legal entities and individuals. In addition to government organizations and agencies non-government, women’s committee and makhallas may be involved in resettlement procedures to ensure safeguards of rights and legitimate interests of the affected land users.

61. UCSA has overall responsibility for all aspects of the program. The Program Preparation and Management Unit (PPMU) within UCSA is responsible for the day to day management of the program including LAR and cross-agency coordination and for compensation disbursement.

62. The Social and Environment Sub-Unit (SESU) and Project Implementation Unit (PIU)/ vodokanal under the PPMU will directly participate in all LAR related planning, implementation, inter-agency coordination and monitoring. However, they will carry out this responsibility with technical assistance from the project consultants (PC) of the program and with the active participation of the district/municipal executive powers and as advised by SCLRGCSC from time to time.

63. Design Institute is in charge in elaborating the design and construction documents for the project. It will collaborate with the PC, SESU and PIU to: (i) assemble all documents required for compensation; (ii) carry out topographic surveys of the expropriated land and replacement lands; (iii) elaborate layouts indicating the location of the worksites and the permanent infrastructures and the perimeter of the required surfaces differentiating the land use patterns in the areas being occupied to serve as a base for the selection of compensation land; (iv) establish layouts of the lands proposed as option for compensation; (v) conduct the land marking and pegging of the land assigned for temporary use and permanent occupation and of the compensation lands. The design institute, in collaboration with resettlement team of the PSC and PIU, will review the LARPs and provide the necessary information for an updated estimate of the effective compensation plan and related cost for each subproject.

64. Project Consultant–Resettlement Team is engaged to design and assist in the implementation of subprojects under the program. The Project Supervision Consultant (PSC) will have sufficient in house expertise on resettlement consisting of international and national resettlement specialists. With the assistance from the Design Institute and PIU, they will analyze the cadastral maps, carry out DMS, conduct first level compensation negotiation with the APs. The PC will submit these LARPs to the respective vodokanal/PIU and to SLAU division for approval. After its approval, PSC will submit LARPs to the respective Province and Rayon LAR Commission.

65. Local government agencies involved in LARP review and implementation are Province (Oblast) and District (Rayon) Executive Authorities who form Province Commissions on Land Acquisition and District Evaluation Commissions. These commissions will form a provincial land acquisition and resettlement committee (PLARC) which include the institutions as described below.

66. Province Commission on Land Acquisition, established under the Province Khokimiyat decision undertakes the following: (i) outlines location of constructions and structures, envisaged by the project; (ii) selects land plot for construction site, (iii) prepares and approves an Act for the right to use the land plot (title) and (iv) approved the Act for the right to use the land plot, specifying areas of the acquired farm land, accepted norms and total agricultural production losses. In addition to permanent members the Commission includes representatives of UCSA, as well as affected legal entities and individuals.

67. The Evaluation Commission established under the district khokimyat decision estimates losses of land owners and land users in accordance to the standard procedure, as well as losses in agricultural output as a result of the farm land acquisition based on data provided by the design institute. The commission prepares an Act for the right to use the plot of land specifying the acquired farm land area, accepted norms and total value of losses and agricultural output losses.

68. The regional representatives of the SCLRGCSC is the key executive authority responsible for the following: (i) identify land losses, incurred by land owners and land users as well as agricultural output losses; (ii) determine the degree and area of land re-cultivation, including removal and temporal storage of productive soil layer; (iii) determine the need for protective sanitary and water protection zones around the constructions being built and regime of their use; (iv) prepare proposals on allocation of land plots of equal value instead of the acquired; (v) estimate possibility and approximate cost of development of new land instead of the acquired; (vi) approve the Benchmark Setting up Act and the attached plan; (vii) amend the government acts on land use and land ownership as well as other cadastre documents.

69. Department of SCNP: (i) environmental impact assessment of construction projects and implemented methods; (ii) approves location of the sites affecting the land condition; (iii) develops measures for land protection for designed sites and launched facilities adversely affecting the land; and (iv) approves the Act on Land Plot Acquisition.

70. Government SES and Fire Inspection and Water Supervision authorities approve the Act of the Land Plot Acquisition.

71. At town/regional/ rayon level a grievance redress committee (GRC) will be established with the involvement of PIU/SESU/PC, leaders of affected makhallas and Khokimiyat (the local executive body).

VIII. GRIEVANCE AND REDRESS MECHANISM

72. A grievance redress mechanism will be developed for addressing the grievances/decisions not agreeable to the affected enterprise, particularly actions in reacted with compensation or payment disbursement. The affected enterprise and households were informed of their entitlement according to the short LARP and the procedures for addressing their complaints/ grievances during public consultation, census survey and verification of measurement survey at the time of LARP implementation. Also there were handed round to all persons materials as information consulting brochures and they are informed that during project implementation, if they have any complaints and questions, they could address directly to PIU in Fergana city, local vodokanals, Khokimiyat of Fergana Oblast or local Khokimiyats. In vodokanals were established the "Information centers" for consideration of complaints and issues with persons.

73. In order to prevent grievances rather than to redress these through a process to avoid lengthy redress process, participatory consultation with the affected households will be undertaken during LAR planning and implementation stages. If the grievances fail to be

resolved, all attempts will be made to resolve those informally at the local makhalla level. If this attempt fails, Affected people will have the option of taking their complaints to the formal mechanism of addressing grievances described in Table 13.

74. The PMO will be responsible for recording the complaint, taking the step to address grievance, preparing meeting minutes, and a report for each complaint. The complaint handling process will be reported to ADB through project implementation report.

IX. TRAINING IN LARP IMPLEMENTATION

75. All PIU staff, project consultants (PCs), SESU officials, leaders of Makhallas, Khokimiyat, representatives of SCLGRCSC, and District evaluation committee who will be involved in LAR activities will undergo an orientation and training on ADB’s involuntary resettlement policy and implementation of LARP. The training will be provided by the international specialist under the Program consultant’s contract and should cover the following topics:

(i) principles and procedures of land acquisition based on Uzbekistan's law and regulation; (ii) principles and guidelines of ADB’s involuntary Resettlement Policy (iii) public consultation and participation; (iv) entitlements and compensation & assistance disbursement mechanisms; (v) grievance resolution; and (vi) monitoring of resettlement operations.

X. COST ESTIMATES AND BUDGETS

76. The total estimated budget for compensation of buildings and structures, cost of resettlement operation and management for the Project is UZS 107 077 381 or USD $ 50 148 (UZS 2135.26=$1). A break up of cost estimate is given in the Table 14 below. Note: Valuation works of trees and building have been prepared by the valuation company “Prize and Analyze”.

XI. IMPLEMENTATION SCHEDULE

77. UCSA as the Executing Agency (EA) will direct the PC resettlement team with assistance from SESU and the design institute to verify documents of the Affected Enterprise and households carry out the detailed measurement survey of the affected assets. If any change in design alignment is foreseen, the team will notify the EA. The Rishton makhalla will be engaged as implementing agency and assist the SESU & PSC’s resettlement team particularly during payment disbursement and in resolving compensation issues.

78. Valuation of compensation and assistance will be done after detailed measurement of lost assets is done. Grievance, if any, will be addressed at this stage so that any delay in payment of compensation and assistance does not occur and contractor’s award is issued as per schedule.

79. After initiation of LARP the UCSA will take step to engage external monitor to review and evaluate the LARP implementation. Table 15 shows the tentative implementation schedule of LARP.

80. All LAR tasks under the program will be subject to internal monitoring. Internal monitoring will be conducted by UCSA’s Social and Environmental Sub Unit (SESU).

81. Internal monitoring will be carried out regularly by UCSA-SESU. The progress of LARP implementation to be carried out by PSC’s resettlement team and Mahalla will be communicated to ADB through the monthly Program Implementation Reports. Indicators for the internal monitoring will be those related to the processes and immediate outputs and results. This information will be collected directly from the field and reported monthly to the PMU. The monthly reports will be consolidated and included in the standard quarterly supervision reports to ADB. Internal monitoring will specifically focus on the status of:

(i) information campaign and consultation with APs; (ii) revise implementation schedule in case of design change (iii) revise AP database in case of design change (iv) compensation and assistance payments for structures and trees / other assets; (v) payments for loss of income for the vulnerable HH; (vi) grievance redress, if any; and (vii) preparing monthly progress report.

82. The above information will be collected by the UCSA-SLAU which will monitor the day- to-day resettlement activities of the Program through the following instruments: (i) review of census information for all APs; (ii) consultation and informal interviews with APs; (iii) in-depth case studies; (iv) key informant interviews; and (v) community meetings.

83. A final evaluation of LARP implementation will be carried out about a year after completion of its implementation. The compelling reason for this study is to find out if the objectives of the LARP have been attained or not. The benchmark data of socioeconomic survey of severely affected APs conducted during the preparation of the LARP will be used to compare the pre and post program conditions. The evaluation will recommend appropriate supplemental assistance for the APs if the outcome of the study shows that the objectives of the LARP have not been achieved
