81 'A' BARNSLEY METROPOLITAN BOROUGH COUNCIL -- PLANNING REGULATORY BOARD 5th May, 2009 Present: Councillors Wilde (Chairman), D. Birkinshaw, M. P. Brankin, M. B. Brankin, Brown (meeting only), G. Smith, Spence (meeting only), Worton (meeting only), C. C. Wraith and R. Wraith. 2. Site Visits - Declarations of Personal Interests Councillor G. Carr declared a personal interest in respect of Planning Application No. 2009/0232, outline application for residential development at former S. R. Gent site, Dodworth Road, Barnsley, in view of the fact that a close relative lived in an adjacent housing estate. 3 Site Visits The Planning Regulatory Board made visits of inspection to the following sites which were the subject of planning applications:- Plan No. Site Outline application for residential development at 2009/0232 former S. ft Gent site, Dodworth Road, Barnsley 2009/0032 Production of egg production unit and a deer unit building on land at Little Doubting Farm, Hartcliffe Hill Road, Penistone 2009/0191 Erection of 3 office units, additional employment accommodation, retail units (Al, A3 and A5) car parking and associated works on land adjacent to Chestnut Tree Public House, Barugh Green Road/Claycliffe Road, Barugh Green 4. Declarations of Personal Interest Councillor G. Carr declared a personal interest in respect of Planning Application No. 2009/0232, outline application for residential development at former S. ft Gent site, Dodworth Road, Barnsley, in view of the fact that a close relative lived in an adjacent housing estate. Councillor Morgan declared a personal interest in respect of Planning Application No. 2009/0386, conversion of existing chapel into community centre, Former Church Cemetery Road, Wombwell, Barnsley and Planning Application No. 2009/0385, conversion of existing chapel into community centre (listed building consent), Former Church Cemetery Road, Wombwell, Barnsley, in view of her membership of the Management Group for the building. 82 PLANNING REGULATORY BOARD Date: 5th May, 2009 Councillor Wilde declared a personal interest in respect of Planning Application No. 2009/0386, conversion of existing chapel into community centre, Former Church Cemetery Road, Wombwell, Barnsley and Planning Application No. 2009/0385, conversion of existing chapel into community centre (listed building consent), Former Church Cemetery Road, Wombwell, Barnsley, in view of her invitation to become a member of the Management Group for the building. 5. Minutes The minutes of the meeting held on 7th April, 2009 were taken as read and signed by the Chairman as a correct record. 6. Town and Country Planning Act 1990 - Part Ill - Applications - Speakers (a) Ms S. Ansbro addressed the Board and spoke in favour of the officer recommendation to approve Planning Application No. 2009/0232 outline application for the erection of 172 dwellings and associated works and re-sited access (outline) former S. R. Gent Factory site, Dodworth Road, Barnsley, South Yorkshire. RESOLVED that the application be refused on the grounds that the site is allocated an Employment Policy Area in the UDP and loss of employment land without justification. In accordance with the agreed protocol in cases where the decision of the Board is contrary to the recommendation of the Assistant Director Planning and Transportation a recorded vote was taken on this application with amendment to refuse the application being:- MOVED by Councillor T. Smith and SECONDED by Councillor Price. With the voting being as follows:- In Favour of the Amendment to Refuse the Application - Councillors M. B. Brankin, M. P. Brankin, Brown, Hand-Davis, Marsh, Price, Richardson, T. Smith, Spence and R. Wraith. Against the Amendment to Refuse the Application - Councillors D. Birkinshaw, Cave, Hancock, Morgan, Noble, J. Smith, Wilde, Worton and C. C. Wraith. Councillor G. Carr, having declared a personal interest in respect of this application, declined to vote. (b) Mr. M. A. Clynch addressed the Board and spoke in favour of the officer recommendation to approve Planning Application No. 2009/0032, erection of an egg production unit building and a deer unit building, Little Doubting Farm, Hartcliffe Hill Road, Penistone, Sheffield. RESOLVED that the application be deferred for further consideration and the submission of additional information. (c) Mr. R. Barnes addressed the Board and spoke in favour of the officer recommendation to approval Planning Application No. 2009/0191 erection of 3 office units, additional employment accommodation, retail units (Al, A3 and AS) car parking and associated works, land adjacent to the Chestnut Tree, Barugh Green Road/Claycliffe Road, Barugh Green, Barnsley. 83 PLANNING REGULATORY BOARD Date: 5th May, 2009 RESOLVED that the application be granted subject to conditions outlined in the report of the Assistant Director (Planning and Transportation) and subject to the two additional conditions. (d) Mrs. A. Hughes addressed the Board and spoke against the officer recommendation to approve Planning Application No. 2009/0216 construction of new carriageway running lane linking Grange Lane to Doncaster Road, Grange Lane, Stairfoot, Barnsley. RESOLVED that consideration of the application be deferred pending a site visit by Members of the Board. 7. Tree Preservation Order No. 3/2009 Tankersley Park Golf Course. Tankersley The Assistant Director (Planning and Transportation) submitted a report stating that an objection had been received in respect of Tree Preservation Order No. 3/2009 and seeking confirmation of the Order without modification. RESOLVED:- (i) that the objection to making and confirming the Order be dismissed; (ii) that the Borough Secretary be authorised to confirm Tree Preservation Order No. 3/2009 without modification; (iii) that the objectors and the other persons by the land affected by the Order be informed accordingly. 8. Planning Applications and Related Planning Matters - Proposed Revisions to the Delegation Arrangements of 2009 This item was withdrawn. 9. Development Control Performance The Assistant Director (Planning and Transportation) submitted a report outlining the general performance of the Development Control Service for the period January to March, 2009. The report gave details of the performance set against the Local Area Agreement (LAA) targets together with the cumulative figures since April, 2008. It indicated that performance had continued to improve and that the targets set had been exceeded. It also indicated that the LAA targets for 2009/10 had been stretched. The Assistant Director (Planning and Transportation) commented that current performance was very good and that this performance was being maintained. RESOLVED:- (i) that the report be noted; (ii) that staff within the Development Control Service be thanked for their hard work and dedication in ensuring the continued improvement in performance. - 84 PLANNING REGULATORY BOARD Date: 5th May, 2009 10. Town and Country Planning Act 1990- Part Ill - Applications The Assistant Director (Planning and Transportation) submitted a report on applications received for consideration. RESOLVED that the following applications be granted, subject to the conditions outlined in the report of the Assistant Director (Planning and Transportation) duties of which are contained in the schedule submitted:- 2009/0012 (subject to an additional condition); 2009/0100; 2009/0241; 2009/0285; 2009/0286; 2009/0316; 2009/0382; 2009/0386; (subject to an additional condition); 2009/0385 (subject to referral to the Government Office); 2009/0416; 2009/0439 Chairman.
