Kennedy. Shortly after the group sat down in the booth, the man later identified as RUBY approached the booth and politely - askedasked if he could borrow the paper. He appeared to be interested in something in the classified want-ad section of the paper and seemed to use the classified section of the paper to locate a phone number as immediately after looking at the paper, he went to the pay phone located near the cashier's desk and made a phone call or attempted to make a phone call. He returned the paper to the booth where the youths were sitting and made some comment to the effect thatthat "it was a terrible thing about the President being shot." He did not appear to be overly enraged _ about the assassination of the President although he did appear to be sincere in the comment about it being a terrible thing.

This individual thenthen talkedtalked brieflybriefly toto oneone ofof thethe ,i ' employees in the delicatessen and MARTIN did not hear the ------conversation or gain any knowledge as to whether or not these two men knew each other. After a few minutes, RUBY again returned to the booth where the youths were sitting and rudely grabbed the newspaper and took it without asking. He appeared to again look at some- thing in the classified want-ad section and again went to the paypay --- phone andand eithereither mademade or attempted to make a phone call. When RUBY returned the newspaper this time he noticed that the youths were somewhat irritated and in a bragging fastion identified himself as owner of the Carousel and Vegas Clubs in Dallas and showed the group an advertisement in the newspaper about his clubs. He then took out some complimentary passes'to the clubs and taunted the youths with a promise to give them some tickets. He then made a comment that they were too young to see the type of show put on at these clubs and MARTIN is not sure if any of the group actually received any of the complimentary tickets but knows definitely that he did not. MARTIA believes that possibly SINDELAR was given some tickets.

RUBY then got some change from the clerk in the delica- tessen and again visited the pay phone at least attempting to place a call. MARTIN did not hear any of the conversations RUBY hadbad with persons called on the phone except as they were leaving the delicatessen he briefly overheard that RUBY was telling someone that he was closing his clubs the following weekend in observance of the President's death. MARTIN could not tell from the way RUBY made the statement if the comment was made in the form of instructions to one of his employees or merely as a comment to some acquaintance. MARTIN hac no recollection that RUBY discussed musician personalities with one of the youths but is certain that he had no such discussion with RUBY that evening. On the Sunday following the above incident,incident, MARTIN MARTIN saw, television andand newcpaper accounts of the murder of LEE HARVEY --1 '-'- OSWALD and at that time recognized the photograph ofof JACKJACK RUBYftRUBY ,v- as the man who was in Phil's Delicatessen on the evening of November 22, 1963.
