Page 6 STATEMENT OF THE APPLICANT Name of Applicant: Bayonne Equities Urban Renewal, LLC (the "Applicant") Project Address: 9-11 West 12ffi Street and 281, 283-287 and 289 Broadway Block 264, Lots 15, 16, 17 and 18 (the "Property")

The Applicant seeks preliminary and final major site plan approval and bulk variance approval to construct a ten (10) story mixed-use building on the Property. The Property is zoned under a redevelopment plan (the "Redevelopment Plan") which permits mixed-use (multi-family residential and commercial) buildings. The proposed building will provide 100 residential units, 102 on-site parking spaces (including stacked/mechanical spaces) and approximately 2,420 square feet of ground floor commercial space. The structure will have building signage, lighting, rooftop amenities including terracing, green space, a fitness center, a business center and other improvements and amenities shown on the filed plans. The proposal provides the type of project described in the Redevelopment Plan and complies with almost all its requirements. However, the building is proposed with a height of 144 feet, 11 inches to the roof, whereas the Redevelopment Plan provides for a maximum height of 135 feet. The Applicant requests a (c) bulk variance for building height. The benefits of this deviation substantially outweigh any detriments. The proposed building will replace aging and obsolete structures with a modern mixed-use building. It will greatly improve the neighborhood aesthetic and inject vibrancy and activity into downtown Broadway, building on the success of multi-family residential developments to the south and north of this project. The building height is driven in part by the proposed mechanical/stacked parking system, which provide parking in excess of that required under the Redevelopment Plan. The use of a traditional parking garage would require underground excavation, subsurface parking and multiple curb cuts that would negatively impact the neighborhood for a lengthy period of construction time. The proposed building with parking system is a better design alternative because it avoids detrimental impacts on surrounding properties, meets essential bulk requirements and provides a better quality of life for residents. The additional building height will also allow rooftop space through an enclosed amenity space. The design of this space provides a significant step-back from neighboring residential properties to mitigate visual impact of the proposed height. There will be no substantial detriment to the public good with approval of the requested relief. The building will improve the area's aesthetics and provide compliant parking within the structure, thereby avoiding the burden of on-street parking. The rooftop amenities will improve the lives of the building's residents through open space and fitness activities. This project will not substantially impair the intent and purpose of the City's zone plan and the Redevelopment Plan. The building respects all use regulations and meets or exceeds all bulk standards except for the deviation for building height. The visual impact of the building height is mitigated through the building's design. The increased height will allow greater compliance with the Redevelopment Plan's other regulations and the rooftop amenities promote health and welfare. For the reasons set forth above, the Applicant respectfully requests that the Planning Board approve this application. The Applicant further seeks a waiver of the submission of a denial letter from the Zoning Officer as this Property is subject to a Redevelopment Plan and the Municipal Land Use Law permits direct application to this Board.
