There was one member of the public who requested access to the meeting and was able to login and observe the meeting. No other requests were received. The Township attempted to electronically record the meeting but experienced technical difficulties due to the limitations of the internet connection and length of meeting.

(1) VIANET COMMUNICATION TOWER

NOW THEREFORE BE IT RESOLVED That Council prepare a letter of concurrence authorizing the construction of the telecommunications tower as proposed by Vianet, subject to the following conditions:

1) That the tower be limited to a maximum height of 60.96 metres with no increase in height permitted without going through an a proper consultation as deemed appropriate by the Township; 2) That the proposed tower not include any lighting as was indicated would be the case by Transport Canada; 3) That a gate be installed along the entire 20 metre frontage of the property for security reasons; 4) That the base of the tower and any equipment closure at the base of the tower be appropriately fenced; 5) That signage be included at the base of the tower and at the entrance to the site indicating it is a private property and no unauthorized access is permitted as well as providing Vianet’s contact information; 6) That the tower be video monitored for security purposes; and 7) That prior to the construction of the tower, Vianet comply with any requirements of the Canadian Environmental Assessment Act to the satisfaction of the appropriate federal government authority (Innovation, Science and Economic Development Canada).

BY-LAW 2020-

Being a By-law to appoint a Chief Building Official and authorize the execution of an employment contract

WHEREAS, pursuant to The Building Code Act, Section 3(1), the council of each municipality is responsible for the enforcement of the Building Code Act in the municipality;

AND WHEREAS pursuant to The Building Code Act, Section 3(2), the council of each municipality shall appoint a chief building official and such inspectors as are necessary for the enforcement of this Act in the areas in which the municipality has jurisdiction.

AND WHEREAS section 8 of the Municipal Act, S.O., 2001, C25, as amended provides that the powers of a municipality shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality’s ability to respond to municipal issues;

AND WHEREAS section 9 of the Municipal Act, S.O. 2001, c25 as amended, provides that a municipality has the capacity, rights, powers and privileges of an natural person for the purpose of exercising its authority under the Municipal Act of any other Act;

AND WHEREAS, pursuant to The Police Services Act, R.S.O. 1990, Chapter P. 15, and amendments thereto, the Council may appoint such officers and servants as may be necessary for the enforcement of the By-laws of the Municipality;

NOW THEREFORE, the Council of the Corporation of the Township of Carling hereby as follows:

1. THAT Naythan Nunes is hereby appointed as Chief Building Official for the Township of Carling effective May 18 , 2020.

2. That By-law 2015-52 hereby be repealed

3. THAT this By-law shall come into full force and effect upon the date of passage.

RECOMMENDATION:

This Report is for information purposes only.

Report:

Current Status: Declared Emergency

The Command Group organizing the Township’s response to the COVID-19 Pandemic has been working diligently to ensure the safe provision of Municipal services. Even though some services that are normally provided have been curtailed by Provincial order or safety concerns, the majority of services are still being provided. We continue to have safe roads, operate transfer sites, pay bills and respond to emergencies. Administrative Staff are either working from home or rotating shifts in order to prevent transmission of the virus from person to person within our organization. Public Works and Fire Department personnel are adhering to social distancing and infection control protocols.

Recovery Plan: A methodology to guide our return to normality has been developed. It will work in conjunction the Province’s Framework for Recovery and be guided by risk-benefit analysis and safety procedures established by the Province of Ontario.

Operations Updates:

Construction waste, shingles and bulky items are now being accepted at the Killbear landfill;

Snug Harbour Dock will be closed until further notice;

Special Council Agenda Package Page 19 And Access Points will remain closed until further notice. This decision will be reviewed when the Essential Services List has been updated to allow Marinas to open fully.

The Fire Department is responding to medical emergencies with the exception of COVID-19 possible calls.

We continue to work with our community and municipal partners to ensure the delivery of necessities for vulnerable people and those that need to self-isolate.

A By-law to Amend Schedule “A” of By-law 2018-46 being a By-law to Consolidate the Delegation of Powers and Duties

WHEREAS Section 8(1) of the Municipal Act, 2001, S.O. 2001, C.25, provides in part, that the powers of a municipality under the Municipal Act shall be interpreted to enable the municipality to govern its affairs as it considers appropriate; and

WHEREAS Section 23.1 (1) of the Municipal Act, 2001, S.O, C.25, authorizes a municipality to delegate its powers and duties, subject to certain restrictions; and

WHEREAS The Township of Carling Council has deemed that the delegation of certain administrative and legislative powers would contribute to the efficient management of the Township while still adhering to the principles of accountability with prevailing legislation; and

WEREAS Council deems it appropriate that the Treasurer has the discretion to wave penalty and interest as deemed appropriate; and

WHEREAS Schedule “A” of this by-law is a consolidated list of delegations of Authority

THEREFORE BE IT RESOLVED that Council of the Corporation of the Township of Carling hereby enacts as follows:

1. That Schedule “A” of By-law 2018-46 be amended to include a provision allowing the Treasurer to have discretion to wave penalty and interest as he or she deems appropriate.

EREAS Section 8(1) of the Municipal Act, 2001, S.O. 2001 , C.25, provides in part, t the powers of a municipality under the Municipal Act shall be interpreted to enable municipality to govern its affairs as it considers appropriate; and

EREAS Section 23.1 (1) of the Municipal Act, 2001 , S.O, C.25, authorizes a nicipality to delegate its powers and duties, subject to certain restrictions; and

HEREAS The Township of Carling Council has deemed that the delegation of certain ministrative and legislative powers would contribute to the efficient management of Township while still adhering to the principles of accountability with prevailing slation; and

EREFORE BE lT RESOLVED that Council of the Corporation of the Township of ing hereby enacts as follows

1 DEFINITION:

1.1 "TOWNSHIP" shall mean the Corporation of the Township of Carling

1.2 " COUNCIL" shall mean the Council of the Township of Carling

1.3 "DELEGATE" shall mean an officer, employee, agent or body which have been delegated by by-law

1.4 "LEGISLATIVE POWERS" shall mean all matters where Council acts in a legislative or quasi-judicial function including enacting by-laws, setting policies, and exercising decision-making authority.

1.5 "MUNICIPAL ACT, 2001" shall mean the Municipal Act, 2001, S.O. 2001, c25;

1.6 "PLANNING ACT" shall mean the Planning Act, RSO 1990, CP.13

1.7 "LAME DUCK" shall mean the period of time between nomination day to Election Day and from Election Day to the end of the current term of council when it is guaranteed that fewer than 75o/o of council members will be returning for the next term of council.

O GENERAL:

2.1 Thatthis By-law may be referred to as the "Delegation of Authority By-law".

2.2 Council delegates the powers, duties, and restrictions thereto as set out in the Consolidated List of Delegation of Authority to those officers, employees, or committees listed.

2.3 Should any position identified in this by-law with a delegated authority, no longer exist in the Corporation, then the Chief Administrative Officer may in writing designate another person to assume the delegated authority.

Special Council Agenda Package Page 22 2.4 All powers and duties of Council shall remain with Council unless a power or duty has been expressly delegated by by-law.

2.5 In the event the provisions of this by-law are inconsistent with the provisions of another by-law, the provisions of this by-law shall apply.

2.6 ln the event the provisions of this by-law are inconsistent with the provisions of the Municipal Act, 2001, its Regulations or any other Act, the provisions of the Act or Regulation shall prevail.

2.7 Council shall not delegate the following powers or duties, in accordance with the limits set out in subsection 23.3 (1) of the Municipal Act, 2001. a. To appoint or remove from office an officer or the municipality whose appointment is required by the MunicipalAct, 2001; b. To pass a by-law under Parts Vlll, lX and X of the Municipal Act, 2001; c. To incorporate corporations in accordance with section 203 of the Municipal Act, 2001; d. To adopt an official plan or an amendment to an official plan under the Planning Act; e. To pass a zoning by-law under the Planning Act; f. To pass a by-law under subsections 108 (1) and (2) and 1 10 (3), (6) and (7) of the MunicipalAct, 2001; g. To adopt a community improvement plan under section 28 of the Planning Act, if the plan includes provisions that authorize the exercise of any power under subsections 28(6) or (7) of that Act or under section 365.1 of the Municipal Act, 2001; h. To adopt or amend the Township budget; or i. Any other power or duty that may be prescribed.

2.8 This by-law shall come into force and effect upon the final passing thereof at which time all by-laws, policies and resolutions that are inconsistent with the provisions of this by-law are hereby repealed insofar as it is necessary to give effect to the provisions of this by-law.

Delegation of Authority During Periods of Lame Duck

1 GENERAL

1.0 A Council shall become "Lame Duck" when it is guaranteed that fewer than 75o/o of Council members will be returning after the election.

1.2 A Council may become "Lame Duck" from nomination day to Election Day and from Election Day to the end of the current term of council

1.3 When a Council is in a "Lame Duck" position the Council shall not take on the following actions a) The appointment or removal from office of any officer of the municipality b) The hiring or dismissal of any employee of the municipality c) The disposition of any real or personal property of the municipality which has a value exceeding $50,000.00 at the time of disposal, unless the disposition was included in the most recent budget adopted by the Council before Nomination day; and d) Making any expenditures or incurring any other liability which exceeds $50,000, unless the liability was included in the most recent budget adopted by the Council before Nomination Day.

2 DELEGATION

2.1 THAT the delegation of authority will only take effect during any election where Council's authority to take action is limited due to Lame Duck ("Lame Duck period")

2.2That the Chief Administrative Officer is hereby delegated the authority to

a. Approve expenditures, outside the current approved budgets exceeding $50,000.00. b. Execute the agreement of purchase and sale, pertaining to the disposition of any real or personal property of the Corporation of the Township of Carling. c. To appoint or remove from office any officer of the municipality where authority is not already delegated to the Chief Administrative Officer under section 8.2.5 of the Employee Hand Book and Policies manual. d. To repeal by-laws appointing Officers of the Township of Carling which have ceased employment with the Corporation per the authority previously granted to the Chief Administrative Officer under section 8.2.5 of the Employee Hand Book and Policies manual.

2.3 Should the delegated authority be exercised, the sitting Council shall be informed at the next regularly scheduled meeting or special meeting called for this purpose.

INFORMATION REPORT

PURPOSE: To inform Council of a potential transfer of land from Thunder Development Company Limited to the Georgian Bay Land Trust (GBLT).

To seek direction from Council as to how the Township wants to proceed with the transfer of Part 1, Plan 42R- 11554 as part of the conveyance of land to GBLT.

BACKGROUND: Thunder Development Company Limited is the owner of 113 Island 65C (Rose Island), being Rose Island’s large interior parcel. The property measures approximately 113 hectares (279 acres) in size. A key map is attached to this report identifying the location of the subject land.

The owner is engaged with the GBLT to donate this parcel of land for conservation purposes. Upon searching title, it was determined that the Township has retained interest in an easement over Part 1 of Plan 42R-11554. This easement, being 20 metres (66 feet) in width, was established to permit access to Lots 3 and 4 Plan 42M- 574 for the purpose of constructing, maintaining, repairing or replacing sewage disposal systems on the said lots. A copy of the Transfer of Easement and a copy of Plan 42R-11554 is attached to this report.

The GBLT has indicated that this easement is an impediment and would stand in the way of the conveyance. The solicitor for the owner of the subject land has advised that any encumbrances on the land, including easements, will create complications for the GBLT in securing necessary funding.

To rectify this issue, legal counsel for the owner of the subject land has recommended two options:

1) The Township release the easement in its entirety, removing any rights for access over Part 1 42R- 11554; or 2) Accept a dedication (gratis) of lands forming part of the easement so it is no longer an encumbrance on the title for the subject land.

Either of these options would resolve the title concern, allowing the lands to be conveyed to GBLT for long term conservation purposes.

INFORMATION FOR COUNCIL: When the Plan of Subdivision (42M-574) was being reviewed by the Province in 1989, the Ministry of Environment included a requirement that a 20 metre wide vacant water access corridor be established to provide access to Lots 3 and 4 Plan 42M-574 for the purposes of moving fill material for sewage disposal Special Council Agenda Package Page 28 systems. Due to the steep frontages along these particular lots, access for equipment would have been difficult. A copy of the letter from the Ministry of Municipal Affairs to the Township, dated January 18, 1989 has been attached to this report.

The Minister's conditions of draft approval were amended to include this requirement. Plan 42R-11-554 was created and the Transfer of easement was granted to the Township to afford the owners of those lots the necessary access.

Prope rtv Tax I m plicati ons When title of a property is transferred to the GBLT through donation, the land becomes eligible for the Conservation Land Tax lncentive Program. Though the GBLT would assume responsibility for the property taxes, they would actually be exempt through this program. ln 2019, propertytaxes on the subject land totalled 54,601.68. Based on preliminary budget discussions and a 2020 assessment for the subject land would be 5705,000 and property taxes for the year of 2020 would total $4,840.27. This is an increase of 5239.59 from 20L9.

Zoninq and Development Potential The subject land is zoned Waterfront Residential 2 (WF2) in the Township's Comprehensive Zoning By-law C500-20L1. A portion of the interior of the island is zoned Environmental Protection (EP)due to the presence of Type 1. (Critical) Fish Habitat.

Although a large parcel, the subject land only includes approximately 975 metres (3,200 feet) of shoreline feet. This frontage is spread out amongst several shoreline locations. The majority of this frontage exists in an enclosed bay on the western boundary of the island. However, this bay appears to be extremely shallow in nature and access by boat may be difficult to impossible during periods of low water. An aerial image of the subject land is attached highlighting the subject land.

Given the size of the subject land, the subject land would be entitled to the maximum development envelope of 750m2 of Gross Floor Area for a principal dwelling and 280m2 of total floor area for accessory structures. There is potential that the subject land could be further severed. However, frontage would limit the number of available lots which could be created.

CONCTUSIONS: The mandate of the GBLT aligns with the Township's vision, goals, and objectives outlined in the Official Plan. The idea of land conservation for the purpose of natural heritage and environmental preservation is central to the makeup of the Township's waterfront areas.

Given the nature of the easement and its original intent, it is recommended that the Township do not proceed with releasing the easement entirely. The owners of Lots 3 and 4 Plan 42M-574 should continue to maintain the right to use the easement for maintenance purposes given the topography of the shoreline. Accepting a dedication of the,easement would transfer it into the public domain, ensuring this access corridor remains available for future use by the owners of those lots.

We are very excited to tell you about our new program! On May 1st, we are launching the gardening program called Growing Together. The program will provide “ready-to-grow” vegetable planters for people in need in our communities. Planters can be safely delivered to program partners for pick-up by participants and be easily maintained and harvested for a healthy supplement to any diet. Growing Together will help promote food security and food sustainability in the region – a need that has increased since Covid-19.

Local nurseries and garden centres are supplying 25” diameter planters filled with a variety of vegetables and herbs. Also included will be educational resources about container gardening, children’s activities, and contact information if participants need advice. Our suppliers will deliver the planters to our partner agencies, who can distribute them to the clients they support.

Last week, we raised $6,000 for Growing Together. Program expenses are $100 per container, including pot, soil, plants, educational resources, and delivery. Our goal is to provide 1,000 people in need with a free vegetable planter this spring and summer - we need your help!
