OPTION 3: THAT the Regional Board refuse authorization for the application, as submitted, to proceed to the Agricultural Land Commission on the basis that the PRRD Agricultural Advisory Committee recommended refusal it is not permitted in its current zone. aA LAND USE POLICIES AND REGULATIONS OFFICIAL COMMUNITY PLAN (OCP): Agriculture – Rural Resource, Bylaw No. 477, 1986 ZONING: A-2 (Large Agricultural Holdings Zone), Bylaw No. 1343, 2001 AGRICULTURAL LAND RESERVE (ALR): Within BUILDING INSPECTION AREA: Outside COMPREHENSIVE DEVELOPMENT PLAN: Outside aA SITE CONTEXT The subject property is located about 13 km (8 miles) northeast of the City of Dawson Creek via Rolla Road and Highway 49. The site is about a mile north of McQueen’s Slough. This is a farming area of predominately quarter- section parcels that are cultivated and entirely within the Agricultural Land Reserve. This area is mainly a farming area, though the oil and gas industry has become increasingly prominant in the last few years.

SITE FEATURES LAND: The subject property is cleared and cultivated with canola. There are two other wellsites located on the subject property. STRUCTURES: The only structures on the subject property are the existing wells, and associated equipment. ACCESS: The paved Rolla Road runs along the eastern boundary of the subject property. CLI SOIL Class 2C – moderate limitations that restrict the range of crops or require moderate conservation RATING: practices. Subclass C refers to an adverse climate. FIRE: Outside all rural fire protection areas. aA PREVIOUS APPLICATIONS – SUBJECT PROPERTY There have been no ALR-related applications on the subject property. aA PREVIOUS APPLICATIONS – PROPERTIES WITHIN 100 M There have been no ALR-related applications within 100 meters of the subject property. aA COMMENTS AND OBSERVATIONS APPLICANT: It is the intent of the agent, Secure Energy Services, to construct and operate a water disposal facility that would dispose, via a deep well injection, waste water and produced water from oil/gas operations. ALR: The subject property and proposed non-farm use lies within the Agricultural Land Reserve. Pursuant to the OGC-ALC Delegation Agreement, “commercial waste handling and disposal, including deep well disposal projects" require an ALR Non-Farm Use application. Therefore, this proposal requires the approval of the Agricultural Land Commission. Note: Pursuant to the Agricultural Land Commission Act, an application may not be considered by the ALC unless the Regional Board authorizes the proposal to proceed to the ALC. This is intended to provide local governments with latitude to consider and weigh the local community interests of each application, in addition to its zoning and official community plan. Should the Regional District forward the application to the ALC, the information and recommendation offered by the Regional District is taken into consideration by the Commission but should not be construed as being binding on the Commission’s opinions or decisions. OCP: Pursuant to the Dawson Creek Rural Area Official Community Plan Bylaw No. 477, 1986, the subject property is designated “Agriculture – Rural Resource”. This designation permits oil and gas installations. The proposal is consistent with the OCP.

ZONING: The subject property is zoned A-2 (Large Agricultural Holdings) pursuant to PRRD Zoning Bylaw No. 1343, 2001. Oil field waste management facilities that require a permit under the Waste Management Act are not permitted in this zone. The proposal requires an amendment to the zoning bylaw. DISTURBED The quarter-section already has 3.50 ha (8.65 acres) of non-farm use associated with existing LAND: wellsites. This proposed additional 3.42 ha (8.45 acres) brings the aggregate disturbed area to 6.92 ha (17.10 acres). WELLSITE: The proposed disposal well is located about 0.8 km (0.5 miles) to the east, on NW¼ Section 4, Township 79, Range 14, W6M, PRD. It was drilled as an exploratory well and is now being proposed to be used as a disposal well. The property subject to this application is the commercial waste handling facility with associated equipment for the waste water disposal. Page 2 of 3 File No. 64/2009 Once pumped out of the trucks at this site the water would be transferred via pipeline to the actual disposal well to the east.

EQUIPMENT: The proposal involves using this land for a flare stack, a tank farm, risers and a work shop and office. Secure Energy Services also plans to add a hopper and a solids processing building with a receiving pad.

AAC: Pursuant to Board Resolution RD/08/11/26 this application was forwarded to the Agricultural Advisory Committee for comment. The AAC meeting took place on June 16, 2009. The AAC adopted the following resolution: THAT the Agriculture Advisory Committee recommend to the Regional Board that the Non-Farm Use Application 64/2009 for Secure Energy Services Inc. to construct and operate a water disposal facility to service the oil and gas industry on the Northeast ¼, Section 5, Township 79, Range 14,W6M, PRD be refused for the following reasons: a) the application, on Class 2 soils, does not preserve agriculture land b) the application reduces the viability of the agricultural industry.

THAT the Agriculture Advisory Committee recommend to the Regional Board that the Oil and Gas Commission be requested to refer all disposal well facility applications on agricultural lands to the Regional District for comment. PUBLIC In their letter (attached), Secure Energy states that they are “committed to working openly CONSULTATION: with all stakeholders to fully understand and address all questions and concerns as effectively and fairly as possible … [and] ongoing public input and feedback will be appreciated and encouraged throughout the project’s development and after project start-up”. Secure Energy has provided the Regional District with a copy of the Project Line List with Notification/Consultation dates and comments from landowners. A representative from Secure Energy was made available to the AAC meeting and also has delegation status at the June 25 Regional Board Meeting. aA IMPACT ANALYSIS AGRICULTURE: This non-farm use would occur on currently cultivated land. The application was reviewed by the PRRD Agricultural Advisory Committee which has provided feedback above.

CONTEXT: There is some oil and gas development dispersed throughout the area amongst the farmland.

SETBACK: The closest homesites to this leased area are about 1.3 km (0.8 miles) to the northeast and northwest.

TRAFFIC: The agent expects about 10 trucks to enter/leave the site daily. It is located along a paved all- weather road suitable for such traffic. The facility’s service area extends from the Chetwynd- area to the Peace River and into . Its location is accessible from Alberta via Highway 49 without going through any BC communities. Its location south of Rolla means trucks coming from the north would pass through that community. Its location northeast of Dawson Creek means traffic coming from the south or west may travel through the City.

EMPLOYMENT: In their letter (attached), Secure Energy states they expect the facility to “be continuously manned with the majority of the activity expected between the hours of 7 am and 7 pm”, and that it would employ 4 to 6 people (and, if successful, up to 12 people in the long term).

David Armstrong uses surface runoff next to the facility which feeds a dugout on his property and would like to know how the facility will contain any contaminates from entering off the facility and potentially entering the surface water run-off. John David Rounds is concerned over H2S emission escaping from storage tanks, would sort of products this site will be accepting, how sour will it be, is there any acid used on site, what is wrong with using the existing site set-up in Gordondale and why wasn’t the proposed facility moved further east away from the highway and homes? John David Rounds wants to know if products are trucked as far as Tumbler Ridge, why does the proposed facility need to be in Rolla and not Tumbler Ridge. John David Rounds wants to know why public consultation didn’t take place a year ago after drilling operations were completed on Wellsite location 11-4-79-14. John David Rounds would like a public meeting with Secure Energy Services prior to approval application being submitted to the Oil & Gas Commission. As of May 19th, 2009 no other concerns noted.
