    LCB_18_2_Art_4_Standen (Do Not Delete) 8/26/2014 6:33 AM THE DEMISE OF THE AFRICAN AMERICAN BASEBALL PLAYER by Jeffrey Standen* Recently alarms were raised in the sports world over the revelation that baseball player agent Scott Boras and other American investors were providing large loans to young baseball players in the Dominican Republic. Although this practice does not violate any restrictions imposed by Major League Baseball or the MLB Players Association, many commentators have termed this funding practice of dubious ethical merit and at bottom exploitative. Yet it is difficult to distinguish exploitation from empowerment. Refusing to lend money to young Dominican players reduces the money invested in athletes. The rules of baseball and the requirements of amateurism preclude similar loans to American-born baseball players. Young ballplayers unlucky enough to be born in the United States cannot borrow their training expenses against their future earning potential. The same limitations apply in similar forms to athletes in other sports, yet baseball presents some unique problems. Success at the professional level in baseball involves a great deal of skill, attention to detail, and supervised training over a long period of time. Players from impoverished financial backgrounds, including predominately the African American baseball player, have been priced out of the game. American athletes in sports that, like baseball, require a significant commitment of money over time have not been able to fund their apprenticeships through self-generated lending markets. One notable example of self-generated funding is in the sport of golf. To fund their career goals, American golfers raise money through a combination of debt and equity financing.

Professa RAp Monday - Thursday, 6:30-8:30, Craig-Lee 252 http://350hiphop.blogspot.com/ In its rise to the top of the American popular music scene, Hip-hop has taken on all comers, and issued beatdown after beatdown. Yet how many of its fans today know the origins of the music? Sure, people might have heard something of Afrika Bambaataa or Grandmaster Flash, but how about the Last Poets or Grandmaster CAZ? For this class, we’ve booked a ride on the wayback machine which will take us all the way back to Hip-hop’s precursors, including the Blues, Calypso, Ska, and West African griots. From there, we’ll trace its roots and routes through the ‘parties in the park’ in the late 1970’s, the emergence of political Hip-hop with Public Enemy and KRS-One, the turn towards “gangsta” style in the 1990’s, and on into the current pantheon of rappers. Along the way, we’ll take a closer look at the essential elements of Hip-hop culture, including Breaking (breakdancing), Writing (graffiti), and Rapping, with a special look at the past and future of turntablism and digital sampling. Our two required textbook are Bradley and DuBois’s Anthology of Rap (Yale University Press) and Neal and Forman’s That's the Joint: The Hip-Hop Studies Reader are both available at the RIC campus store. Films shown in part or in whole will include Bamboozled, Style Wars, The Freshest Kids: A History of the B-Boy, Wild Style, and Zebrahead; there will is also a course blog with a discussion board and a wide array of links to audio and text resources at http://350hiphop.blogspot.com/ WRITTEN WORK: An informal response to our readings and listenings is due each week on the blog.

Brandon Rudyk and William R. Davie University of Louisiana at Lafayette This paper explores the now-dismissed case of Louisiana artist, Stephen Allen v. Electronic Arts, Inc., & Ricky Williams. This case, filed on December 31st 2012, went before the U.S. District Court for the Western District of Louisiana. No ruling was reached but the application of contradictory precedents indicates the need for clarification. Additionally, fairness requires that the 1976 Copyright Act be revised in order to allow for art that falls within a “gray” area of the artistic world. This paper argues that the 1989 Supreme Court landmark case of Community for Creative Non-Violence v. Reid demonstrates in its application of the balancing test for determining the relationship between “employee” and “work made for hire” status that athletes should be forewarned of the potential for litigation when it comes to their body artwork. Babiskin* INTRODUCTION For the second time ever, the Supreme Court addressed the affirmative defense of fair use to copyright infringement in the context of parody in Campbell v. Acuff-Rose Music, Inc. ~ The unanimous opinion found a parody rap version of Roy Orbison's song "Oh, Pretty Woman" by the group 2 Live Crew could be a fair use within the exceptions to the protections of the Copyright Act of 1976. 2 The fair use defense is an inconsistent and confusing area that has been called "the most trouble- some [issue] in the whole law of copyright. "3 The Campbell decision helps preserve the flexible, case-by-case analysis intended by Congress and recognizes the value of parody both as a form of social criticism and catalyst in literature. The decision affords wide latitude to parodists, emphasizing the irrelevance of the judge's personal view of whether the parody is offensive or distasteful. It is unclear whether future courts will interpret this holding to be limited to fair use of parody in the context of song, or whether they will construe it more broadly to confer substantial freedom to parodists of all media. It is also unclear what effect this decision will have on the music industry's practice of digital sampling. This article will review the historical background of fair use in the context of parody and the case law preceding the Supreme Court's decision. A detailed discussion of the lower courts' decisions will be followed by analysis of the Supreme Court's decision and its implications for the future.
