Dear Sir, PENSION PAYMENTS FIXATION OF PENSION CEILING – BIPARTITE SETTLEMENTS RE-ALIGNMENT OF EFFECTIVE DATE VIS-A-VIS CEILING We refer to GOI letter No.4/8/2006-IR (Vol II) dated 31.03.2015. 2. In this connection, we advise that Bank is strictly adhering to the provisions of SBI Employees’ Pension Fund Regulations (SBI EPFR) and our recommendations for re-alignment of pension ceiling are also in conformity with the extant provisions. As a matter of fact, our proposal for re-alignment of pension is not only for removing the prevailing anomalies in respect of certain categories of pensioners but also for moving a step forward towards adherence of Pension Regulations. To elaborate further, 6 August 2015 SAMVAD we invite a reference to the extant provision vide Regulation 23(i) of SBI EPFR which reads as follows: “Regulation 23. Computation of pension – (1) Subject to the provisions of sub-regulations (2) and (3), the pension payable under regulation 22 shall be the amount calculated at the rate of one-sixtieth part of every year's pensionable service of the average monthly substantive salary drawn during the last twelve months' Pensionable service.” The prevailing pension ceilings of these pensioners are not in conformity with the above provisions and they have been receiving pension calculated on the pre-revised scale of pay even though they have received the arrears for salary revisions as per relevant bipartite wage settlements. As such, in these cases basic pension has not been calculated at the rate of one-sixtieth part of every year’s pensionable service of the average monthly substantive salary drawn during the last twelve months’ pensionable service due to non-revision in pension ceiling and/or revision in pension ceiling not in alignment with the effective date of relevant bipartite settlements. Detailed positions have been placed in the Annexure – I to IV. 3. In view of the above, we renew our recommendations as hereunder and would like to have GOI approval in the matter. I.Pension ceiling in contravention of the provisions in Regulation 23 of SBI Employees Pension Fund Regulations (SBI EPFR): a) 5th bipartite settlement – The ceilings of monthly pension in respect of the pensioners who retired during 01.11.1987 to 31.10.1992 are not aligned to their last drawn salary as per 5th Bipartite Settlement and these should have been revised from Rs.2,400/- p.m. to Rs.3,775/- p.m. (50% of the salary of highest scale during 5th Bipartite). b) 7th bipartite settlement – The pension ceiling of 7th bipartite retirees is linked to the pre-revised pay scale (i.e the pay scale of 6th Bipartite). The Pension of the 7th bipartite retirees is required to be indexed to their last drawn salary w.e.f. 01.11.1997 and computed on the basis of average of the last 12 months’ salary. II. Revisions in pension ceiling not concluding with the date of salary revisions: a)6th bipartite settlement – Although 6th bipartite wage settlement was made effective from 01.11.1992, the pension ceiling was revised to Rs.4,250.00 w.e.f. 01.11.1993. The ceiling of 6th bipartite retirees of the period 01.11.1992 to 31.10.1993 has remained at Rs.2,400/- i.e. they are drawing pension lesser than 50% which should have been Rs.4,250/-. As scuh, pension ceiling in respect of the retirees pertaining to the period from 01.11.1992 to 31.10.1993 is required to be revised to Rs.4,250/-. b) 8thbibartite settlement – Following 8thbibartite wage settlement, effective from 01.11.2002, the pension ceiling was revised w.e.f. 01.05.2005. The ceiling of 8th bipartite retirees of the period 01.11.2002 to 30.04.2005 is required to be indexed to their last drawn salary and computed on the basis of average of the last 12 months’ salary so as to pass on the benefit of revision of pension ceiling which came into effect from 01.05.2005.

We are much disappointed that due to the negative response of the Government, these efforts to provide some relief to the affected pensioners have not so far been successful. The deprivation caused to the seventh bipartite continues. Due to cost constraints reportedly faced by some of the member Banks of I.B.A., 100% neutralization of dearness relief to pre 1-11-2002 pensioners and up gradation of basic pension by merging dearness relief up to 4440 points and the much needed improvement in family pension at 30% of uniformly could not be provided along with the 10th Bipartite Settlement concluded on 25-05-2015. We therefore request that these improvements may be provided by our Bank taking a stand independent of I.B.A. on the same lines as provided by R.B.I. 4. While the above Record Note incorporates some of the demands of Retirees referred to in the Charter of Demands and discussed by officers organization with IBA during the process of discussion and IBA’s response there to, we would like to put the records straight by furnishing in brief our view point as under on IBA’s response: (a) At the outset we do not accept that no contractual relationship exists between Banks & Retirees and that their demands can be examined only as a “Welfare Measure”. We maintain that payment of Pension cannot be construed as a mere Welfare Measure. As a matter of fact, there are several court judgments upholding that pension is a deferred portion of the compensation for the service rendered. In landmark “Nakara Case”, the Hon. Supreme Court has held that “Pension is a statutory, inalienable, equally enforceable right that has been earned by the sweat of brow. As such it should be fixed, revised and modified / changed in the ways not entirely dissimilar to the salaries granted to serving employees.” (b) Besides, the Pension Regulations have been framed under section 19(1) of Banking Companies (Acquisition & transfer of undertakings) Act 1970/1980 and as such the relationship between Banks & Retirees is a statutory one. (c) Officers’ Service Regulations / Bi-partite Settlement provisions for workmen, inter- alia, provide for post- retirement benefits including Pension / PF / Gratuity etc. These are in the nature of statutory obligations on the part of Banks. In these circumstances, how can it be inferred that there is no contractual relationship between Banks & Retirees / Pensioners? Moreover in case of officers, Officers’ Service Regulations / Disciplinary Rules providing for disciplinary proceedings after retirement will lose the test of validity before law in the absence of contractual relationship. (d) Like wise in the absence of any contractual relations with Pensioners, clause 48 of the Pension Regulations 1995 i.e. right to proceed against retired employees will also not have any sanctity. (e) As regards comparison with Central Government Pension Scheme, we specifically bring to your notice that Pension Regulations under the head Residuary Provisions, specifically stipulates that “in the matter of application of these Regulations regard may be had to the corresponding provisions of Central Civil Services Rules 1972 or Central Civil Services (Commutation of Pension) Rules 1981 applicable for Government Employees with such modifications as the Bank with previous sanction of Central Government, may from time to time determine”. It is clearly understood that Bank Employees Pension Scheme has been drawn primarily on the basis of Pension Scheme applicable to Central Government Employees/ RBI Employees. Hence comparison with the Central Government Employees pension Scheme is not out of Place. 14 August 2015 SAMVAD 3. Referring to IBA’s response to the demands referred to in the Record Note, we have to state as under: (a) While on several aspects of pension improvement, IBA has been repeatedly forwarding the plea of cost burden but at no point of time during negotiations, authentic data has been presented in support of its contention. On the contrary, authentic pension fund data categorically reveals that as on 31.03.2014, the corpus of Pension Fund stood at about Rs.1,14,000/- crores. More importantly Pension Funds of Banks are in surplus consecutively over the years and such surplus is growing year by year despite the fact that Banks have failed to provide for the required sum in pension funds as agreed in Bipartite Settlements. Under these circumstances, demands of retirees for improvement in Family Pension in line with RBI, 100% DA neutralization to pre Nov 2002 retirees as also updation of Pension, cannot be delayed / denied. (b) We may point out that Bank Employees Pension Regulations specifically provide for updation of Pension. We invite reference to Regulation 35 (1) thereof which reads as under; “Basic Pension and additional pension wherever applicable shall be updated as per formula given in Appendix I” As a matter of fact, such updation has already been given effect earlier for the pensioners retired prior to 01.11.1987, who were positioned on par with retirees under 01.11.1987 Wage Settlement. In view of the above, updation of Pension has a statutory basis and it becomes a statutory obligation. (c) In the matter of 100% DA neutralization for retirees prior to 01.11.2002 for which IBA was positive during discussion, there have been several speaking judgments and favourable court orders. Though the matter is still sub- judice, IBA should settle the matter positively so that the expensive litigation can be put to rest once and for all. But waiting for conclusion of court proceedings will only add to the delay denying justice to pensioners who are above the age of 72-75 years and are anxiously waiting for the justice. (d) The issue of Pension to left overs also a vital one. The category of those retired compulsorily and the resignees have been denied benefits due to strict interpretation of instructions from the Government in June, 2012. Existing Pension Regulations categorically provide for pension to those compulsorily retired from service. Denial of pension option to them is violative of the very existing Pension Regulations itself. Denial of Pension option to Resignees has also been tested through litigation and several judgments including the one in Vijaya Bank Case,is a clear pointer that they cannot be denied pension after the stipulated period. In fact consequent upon such court verdict, several resignees have already been conceded the benefit of pension option. It is also pertinent to note that the number of those retired compulsorily as also those resigned from Banks (after putting in requisite pensionable service) is very small and the cost cannot stand in the way of extending benefits to them. (e) Apart from the above, there are still several issues of pension, which need to be discussed and sorted out. We, therefore, request you to take a positive view and hold discussion on all the issues of retirees on the basis of authentic facts, data and figures. On our part, we are also willing to exchange facts and figures so that a meaningful dialogue can take place with a view to resolving these issues. We look forward to your early response. A LETTER DATED 8-07-2015 ADDRESSED BY OUR FEDERATION TO SHRI M.V.MURALI, CONVENOR OF U.F.B.U AND SECRETARY A.I.S.B.S.F. – A step towards strengthening of the co ordination among the three Federations of our Bank. “Dear Murali, I thank you for sparing your time to meet me along with Shri Ramesh Babu, Secretary of our Federation ,Sarvashri H.Ganapathy and A.Damodaran, Presidents of SBI Pensioners Association, Chennai and Hyderabad Circle respectively on 15th June 2015 at your office . 2. We had the opportunity to know from you the efforts made by UFBU during the 10th.bipartite negotiations for securing the benefits for the past pensioners by pursuing the demands made in your Charter of Demands submitted to I.B.A. We could also learn the circumstances leading to release of the Record Note on 25-05-2015 furnishing the details of discussions held by U.F.B.U with I.B.A and the position taken by I.B.A on pensioners’/retirees’ issues. We offered our congratulations to you for retaining the provisions on the rates of special pay to workmen staff to our Bank and for the provision on pension as per clause 15 of the 10th Bipartite Settlement applicable to our Bank also. 3. We were keen on meeting you with a view to seeking your support to resolve some of our pension issues concerning our Bank only. For this purpose, a copy of our recent appeal made to our Chairman along with a copy of our appeal dated 10-06-2015 has since been handed over to you by Shri Ramesh Babu, our Secretary. We trust you would pursue our above appeal with our Bank. 4. We were also glad to know that despite the position taken by IBA, as disclosed in the Record Note, IBA is examining the question of payment of dearness relief with 100% neutralization to the pre 1-11- 2002 pensioners. Besides this improvement, the family pension needs to be improved and the ceiling of Rs.9, 284/ on family pension stipulated on 10th Bipartite Pay Scales deserves to be increased on the lines of the family pension scheme of RBI. We hope that UFBU would take further steps to follow up these issues, as the Record Note leaves scope for your discussions with IBA on the issues as stated therein. 5. The Medical Insurance Scheme is a very important benefit secured by the 10th Bipartite Settlement for the Bank pensioners. This Scheme does not cover our Bank. We are sure you would take up this matter with our Bank and arrange for a suitable medical benefit or insurance scheme both for the employees and all pensioners and retirees of our Bank including those retired/ retiring voluntarily. 6. We are very keen to strengthen our Co-ordination with both All India State Bank of India Staff Federation and All India State Bank Officers’ Federation. We have also made a request in this regard to Shri Y.Sudarsan, General Secretary of AISBOF. We trust that an early meeting on a mutually agreed date, at convenient venue could be organized. 7.
