The Origins and Application of Title VII of the Civil Rights Act of 1964 We the people of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. — Preamble to the Constitution of the United States of America This preamble sets forth goals for the United States. But when? After adoption of the Constitution, nearly 100 years passed before emancipation, and that involved a civil war. It was more than two generations after that before women were allowed to vote. Our history is replete with discrimination on the basis of race, ethnicity, religion, and gender. Historically, many societies have survived with homogeneity of race, ethnicity, or religion, but never with homogeneity of gender. Because of this one might expect gender based discrimination to be among the first to fall in a democratic society, rather than one of the last. And yet, the 200 year history of our high court boasts of only two female justices. Only a small percentage of the Congress are female and there has never been a female president or vice- president. England has had its Margaret Thatcher, Israel its Golda Meir, and India its Indra Ghandi. The American Democracy has certainly missed the opportunity to lead the world in gender equality in leadership, and without that how can we expect to see gender equality in society? There will never be complete equality until women themselves help to make the laws and elect lawmakers. -

LABOR IN POLITICS MARY GODDARD ZON* There are now more American trade unionists actively involved in political affairs than ever before in the history of the nation. It is the constant and continuing purpose of the AFL-CIO's Committee on Political Education (COPE) to broaden the base of the electorate. We believe that as each American citizen benefits from assuming an active and responsible role in political decisions, so the nation benefits from a dedicated and informed electorate. This job will never be finished. Each year thousands of youngsters reach voting age. Each year millions of families change residence and face the problem of re- registering under different and sometimes restrictive laws. As technological dis- coveries affect employment opportunities, our members are often forced to move in order to find work. As the nationwide residential pattern shifts from the city to the encircling suburbs, our members move across city, county, and sometimes state lines. The problem of maintaining contact with our mobile membership is growing in complexity. Only a small fraction of the total can be reached at regular union meetings. We are exploring new techniques for communicating with our members and providing them with the tools they seek and the information they demand as the basis for mature political judgment. It has governed the way the United States has organized, planned, and conducted military operations for the last twenty five years. It passed the Senate and House of Representatives with margins of victory reserved for birthday and holiday resolutions. It is praised throughout the U.S. defense establishment as a universal good. Despite this, it engendered a strong opposition movement organized primarily by Navy Secretary John F. Lehman but also included members of the Joint Chiefs of Staff, prominent Senators and Congressman, and President Reagan's Secretary of Defense Casper Weinberger. This essay will examine the forty year background of defense reform movements leading to the Goldwater Nichols Act, the fight from 1982 to 1986 by supporters and opponents of the proposed legislation and its twenty-five year legacy that may not be as positive as the claims made by the Department of Defense suggest. -

Mahan, Chief Historian Secretaries of Defense i Historical Origins of the Secretary of Defense The 1947 National Security Act (P.L. 80-253) created the position of Secretary of Defense with authority to establish general policies and programs for the National Military Establishment. Under the law, the Secretary of Defense served as the principal assistant to the President in all matters relating to national security. James V. Forrestal is sworn in as the first Secretary of Defense, September 1947. (OSD Historical Office) The 1949 National Security Act Amendments (P.L. 81- 216) redefined the Secretary of Defense’s role as the President’s principal assistant in all matters relating to the Department of Defense and gave him full direction, authority, and control over the Department. Under the 1947 law and the 1949 Amendments, the Secretary was appointed from civilian life provided he had not been on active duty as a commissioned officer within ten years of his nomination.
