  • How the Catholic Church Sexual Abuse Crisis Changed Private Law
CARDINAL SINS: HOW THE CATHOLIC CHURCH SEXUAL ABUSE CRISIS CHANGED PRIVATE LAW MAYO MORAN* ABSTRACT For several decades now, the unfolding of the Catholic Church sexual abuse crisis has been front-page news. It has wreaked havoc on hundreds of thousands of lives, cost the Church billions of dollars, and done irreparable harm to a once-revered institution. Along the way, it has also helped to transform the all- important private law of responsibility. When the crisis began to break in the early 1980s, the few survivors who sought legal redress faced a daunting array of obstacles. Limitations periods alone had the effect of barring almost all child sexual abuse claims. Immunities also helped to shield the Church. Private law itself was generally hostile to institutional liability, particularly where the harm resulted from the criminal act of an individual. All of that has changed. Among the catalysts for change within private law, the Catholic Church sex abuse crisis looms large. The scale of the crisis and the universal nature of the Church were certainly both important factors, but so too was the Church's response. From the initial impulse to cover up instances of abuse to choices made in the legal and political arenas, it appeared willing to do almost anything to protect itself. Yet the Church had traditionally bene®ted from special treatment precisely on the ground that it was not an ordinary, self-interested legal actor. The tension between the Church's mission and its approach to covering up abuse began to attract notice. Courts and legislators were prompted to act.

  • Working to Rebuild Trust in the Chilean Church
Working to rebuild trust in the Chilean Church The abuse scandals within Catholicism have had a profound effect on the moral authority of the Church, as well as the devastating effects on the victims. For many people, the spontaneous trust they once had in the Church and its leaders has been damaged. This also has affected the Church’s witness in the public square and allowed critics of the Faith to point fingers. Reassuring people — particularly Catholics — that they can trust the Church, and restoring confidence in leadership, were the key themes of a meeting held in Santiago, Chile, May 6-7. Disquiet among the faithful was brought into sharp focus in the Latin American nation of some 18 million people, where allegations of abuse and claims that some bishops conspired to cover it up marred Pope Francis’ January 2018 visit to the country. Pope Francis later admitted that he had made a “grave error” in not believing some people who claimed they had been abused by priests in the country. He also invited the hierarchy to Rome to discuss the crisis, and the country’s 34 bishops offered their resignations. So far, Francis has accepted the resignations of eight of these bishops. The pope also dropped Chilean Cardinal Javier Errazuriz from his C-9 group of cardinal-advisers over allegations the prelate mishandled abuse claims. In the latest move to try to draw a line under the issue of confidence in the country’s bishops, the pope on March 23 replaced Cardinal Ricardo Ezzati Andrello as archbishop of the sprawling archdiocese of Santiago.

Backgrounder Papal Transition 2013 prepared by Office of Media Relations United States Conference of Catholic Bishops 3211 Fourth Street NE ∙ Washington, DC 20017 202-541-3200 ∙ 202-541-3173 fax ∙ www.usccb.org/comm Papal Transitions Does the Church have a formal name for the transition period from one pope to another? Yes, in fact, this period is referred to by two names. Sede vacante, in the Church’s official Latin, is translated "vacant see," meaning that the see (or diocese) of Rome is without a bishop. In the 20th century this transition averaged just 17 days. It is also referred to as the Interregnum, a reference to the days when popes were also temporal monarchs who reigned over vast territories. This situation has almost always been created by the death of a pope, but it may also be created by resignation. When were the most recent papal transitions? On April 2, 2005, Pope John Paul II died at the age of 84 after 26 years as pope. On April 19, 2005, German Cardinal Joseph Ratzinger, formerly prefect of the Congregation for the Doctrine of the Faith, was elected to succeed John Paul II. He took the name Pope Benedict XVI. There were two in 1978. On August 6, 1978, Pope Paul VI died at the age of 80 after 15 years as pope. His successor, Pope John Paul I, was elected 20 days later to serve only 34 days. He died very unexpectedly on September 28, 1978, shocking the world and calling the cardinals back to Rome for the second time in as many months.

Although the 84-year-old pope had a microphone on March 27 and mouthed the words of the blessing, the only sound heard was his deep, rasping breathing. Holy Week and Easter 2005 marked the first time since his 1978 election that Pope John Paul did not personally preside over the liturgies commemorating Jesus’ last sup- per with his disciples, his suffering, death and resurrection. In his annual Easter message, read by the Vatican secretary of state, Pope John Paul focused on how the risen Lord has remained among his disciples in the Eucharist and in the Scriptures. The disciples on the road to Emmaus said to Jesus, “Stay with us, Lord,” a request renewed each day by Christians around the world, the pope wrote. Sitting in the window of his apartment overlooking St. Peter’s Square, Pope John Paul turned the pages of his text as it was read by Cardinal Angelo Sodano. The pope underwent a tracheotomy on Feb. 24 to ease breathing difficulties.
