Binder als Einzelrichter über die Beschwerde von XXXX , geboren am XXXX StA. Afghanistan, vertreten durch Dr. Peter LECHENAUER und Dr. Margit SWOZIL, Rechtsanwälte in A-5020 Salzburg, gegen den Bescheid des Bundesamtes für Fremdenwesen und Asyl vom 15.03.2018, Zl. XXXX , zu Recht erkannt: A) I. Die Beschwerde wird als unbegründet abgewiesen. II. Der Antrag auf Zuerkennung der aufschiebenden Wirkung wird zurückgewiesen. B) Die Revision ist gemäß Art. 133 Abs. 4 B-VG nicht zulässig. Text ENTSCHEIDUNGSGRÜNDE: I. Verfahrensgang: I.1. Zum Vorverfahren: I.1.1 Der nunmehrige Beschwerdeführer stellte am 23.08.2012 einen ersten Antrag auf internationalen Schutz in Österreich und machte zu seinen Fluchtgründen im Rahmen seiner Erstbefragung im Wesentlichen geltend, dass er Afghanistan als Kleinkind gemeinsam mit seiner Familie verlassen habe. Weil der Vater im verstorben sei, wäre er mit seiner Mutter wieder in den Herkunftsstaat zurückgekehrt um als zehnjähriger wieder mit ihr in den Iran zu flüchten. Grund für diese Flucht sei die drohende Zwangsverheiratung derMutter mit einem Taliban gewesen. Im Iran habe er in einer Küche gearbeitet, da es nicht möglich gewesen sei, eine Aufenthaltsbewilligung zu bekommen, sei er mit der Mutter aus dem Iran geflüchtet. Daraufhin habe er sich in Athen zwe Jahre als Strandverkäufer durchgeschlagen. Da der Beschwerdeführer am 15.09.2012 aus disziplinären Gründen aus der Grundversorgung entlassen wurde und am 24.09.2012 kein weiterer Aufenthaltsort oder eine zustellfähige Abgabestelle ermittelt werden konnte, war es nicht möglich diesen zu einer weiteren Einvernahme zu laden. -

L 160/50 EN Official Journal of the European Union 17.6.2016 COMMISSION IMPLEMENTING REGULATION (EU) 2016/963 of 16 June 2016 amending Regulation (EC) No 474/2006 as regards the list of air carriers which are subject to an operating ban within the Union (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EC) No 2111/2005 of the European Parliament and the Council of 14 December 2005 on the establishment of a Community list of air carriers subject to an operating ban within the Community and on informing air passengers of the identity of the operating carrier, and repealing Article 9 of Directive 2004/36/EC (1), and in particular Article 4(2) thereof, Whereas: (1) Commission Regulation (EC) No 474/2006 (2) established the list of air carriers which are subject to an operating ban within the Union, referred to in Chapter II of Regulation (EC) No 2111/2005. (2) In accordance with Article 4(3) of Regulation (EC) No 2111/2005, certain Member States and the European Aviation Safety Agency (‘EASA’) communicated to the Commission information that is relevant in the context of updating that list. Relevant information was also communicated by third countries and international organ isations. On the basis of that information, the list should be updated. (3) The Commission informed all air carriers concerned, either directly or through the authorities responsible for their regulatory oversight, about the essential facts and considerations which would form the basis for a decision to impose an operating ban on them within the Union or to modify the conditions of an operating ban imposed on an air carrier which is included in the list. -

Das Bundesverwaltungsgericht erkennt durch die Richterin Dr. Birgit HAVRANEK als Einzelrichterin über die Beschwerde von XXXX , geb. XXXX , afghanischer Staatsangehöriger, vertreten durch die ARGE Rechtsberatung Diakonie und Volkshilfe, gegen den Bescheid des Bundesamtes für Fremdenwesen und Asyl vom 02.09.2016, Zl. XXXX , nach Durchführung einer mündlichen Verhandlung am 10.01.2018 zu Recht: A) Die Beschwerde wird gemäß § 28 Abs. 2 VwGVG iVm §§ 3 Abs. 1 und 8 Abs. 1 Asylgesetz 2005 (AsylG 2005), §§ 55 und 57 AsylG 2005, § 10 Abs. 1 Z 3 AsylG 2005 iVm. § 9 BFA-Verfahrensgesetz (BFA-VG), § 52 Fremdenpolizeigesetz 2005 (FPG) und § 55 FPG als unbegründet abgewiesen. B) Die Revision ist gemäß Art. 133 Abs. 4 B-VG nicht zulässig. Text ENTSCHEIDUNGSGRÜNDE: I. Verfahrensgang: I.1. Der Beschwerdeführer stellte nach seiner Einreise in Österreich am 13.03.2015 einen Antrag auf internationalen Schutz. I.2. Bei seiner Erstbefragung vor Organen des öffentlichen Sicherheitsdienstes am 14.03.2015 gab er an, er sei ledig und gehöre der Volksgruppe der Tadschiken an. Er stamme aus der Provinz Kapisa und habe vier Jahre lang die Grundschule besucht. Seine Mutter, drei Brüder und zwei Schwestern lebten noch in Afghanistan. Zu seinen Fluchtgründen gab er an, dass er auf Grund des Krieges und der instabilen Sicherheitslage geflüchtet sei. Er wolle in Sicherheit leben, eine bessere Zukunft und eine gute Bildung. Sonst habe er keine weiteren Fluchtgründe. I.3. Bei seiner Einvernahme am 13.07.2016 gab der Beschwerdeführer vor dem Bundesamt für Fremdenwesen und Asyl, Regionaldirektion Oberösterreich, Außenstelle Linz (in Folge: BFA) an, dass er der Volksgruppe der Tadschiken angehöre und sunnitischer Moslem sei. -

25th June 2015 LEGAL ANNOUNCEMENT The civil air transportation authorities of each member states of the European Union may check only the aircrafts of the airlines that provide flights to and from the airports of the European Union; and due to random nature of such checks, it is not possible to check each aircraft that lands at each European Union airport. The fact that the airline is not indicated on the list of the Association does not automatically mean that such company complies with the respective safety standards. If the company that is currently indicated on the list of the Association assumes that it complies with the necessary technical standards and requirements indicated in the respective international safety standards, it might request the Committee to initiate the proceedings to withdraw it from the list. All possible effort was made to verify the exact identity of all airlines indicated on the list of the Association – particularly with regard to the following properties: specific (and unique) letter codes for each airline by the ICAO organisation of the country that has issued the certificate as well as the certificate numbers (or the operating licence) of the air transport operator. Nevertheless, the complete verification was not in all cases possible due to the general lack of information on some airlines that could be borderline with the respected international system of the air transportation or entirely inconsistent with it. For this reason we cannot exclude the fact that there might be companies that conduct their business activities in good faith under the same business name as some of the airlines indicated in the list of the Association. -

Unsichere Fluggesellschaften: Schwarze Liste der EU-Kommission Für diese Unternehmen gilt in der EU Start- und Landeverbot In der EU gelten für den Flugverkehr Sicherheitsnormen, die zu den strengsten der Welt gehören. Zwar arbeiten die Europäische Union und ihre Mitgliedstaaten gemeinsam mit den Behörden anderer Länder an der Durchsetzung solcher Sicherheitsstandards weltweit, doch gibt es immer noch einige Fluggesellschaften, deren Betrieb unter Bedingungen erfolgt, die unter dem notwendigen Sicherheitsniveau liegen. Deshalb hat die Europäische Kommission in Abstimmung mit den Flugsicherheitsbehörden der Mitgliedstaaten beschlossen, Luftfahrtunternehmen, die für unsicher befunden werden, Landung und Start auf EU-Flughäfen zu untersagen. Die Schweiz schließt sich diesen Vorgaben an. Auf einer "Schwarzen Liste" veröffentlicht die Europäische Kommission die Namen der Fluggesellschaften, die Flughäfen in der Europäischen Union nicht mehr ansteuern dürfen. Die Entscheidung wird auf Grundlage von Informationen der nationalen Flugsicherungseinrichtungen sowie der Europäischen Agentur für Flugsicherheit (EASA) getroffen. Nach dieser Liste dürfen etwa 100 Fluggesellschaften, in der Mehrheit aus Afrika und Asien, nicht mehr im Luftraum über der EU fliegen. Luftfahrtexperten aus Deutschland betonen allerdings, dass die Schwarze Liste der Europäischen Kommission nur für "relative" Sicherheit sorge. AICD will provide a baseline against which future improvements in infrastructure services can be measured, making it possible to monitor the results achieved from donor support. It should also provide a more solid empirical foundation for prioritizing investments and designing policy reforms in the infrastructure sectors in Africa. AICD will produce a series of reports (such as this one) that provide an overview of the status of public expenditure, investment needs, and sector performance in each of the main infrastructure sectors, including energy, information and communication technologies, irrigation, transport, and water and sanitation. The World Bank will publish a summary of AICD’s findings in spring 2008. The underlying data will be made available to the public, through an interactive Web site, allowing users to download customized data reports and perform simple simulation exercises. The first phase of AICD focuses on 24 countries that together account for 85 percent of the gross domestic product (GDP), population, and infrastructure aid flows of Sub-Saharan Africa.
