Baffert filed a complaint on June 14, 2021, and that same day moved for an order to preliminarily enjoin NYRA from enforcing its suspension pending the resolution of this lawsuit. A hearing on the motion was held on July 12, 2021. For the reasons stated below, the motion is GRANTED. FACTUAL BACKGROUND1 I. Jurisdiction Plaintiff Bob Baffert is a California resident. Defendant NYRA is a New York corporation. Baffert invokes both this Court’s federal question jurisdiction, 28 U.S.C. § 1331, and diversity jurisdiction, 28 U.S.C. § 1332(a). II. The Parties A. Bob Baffert Baffert is a thoroughbred racehorse trainer. (ECF Docket Entry (“D.E.”) # 3-3 (“Baffert Aff.”) ¶ 2.)
