Tuan Yang di-Pertua, saya mohon mencadangkan: “Bahawa walau apa pun peruntukan-peruntukan Peraturan Mesyuarat 11, Majlis Dewan Negara hari ini tidak akan ditangguhkan sehingga selesai semua urusan kerajaan yang tertera dalam Aturan Urusan Mesyuarat pada hari ini diputuskan dan diluluskan dan selepas itu Majlis Mesyuarat akan ditangguhkan ke suatu tarikh yang tidak ditetapkan.” Tuan Yang di-Pertua: Terima kasih Yang Berhormat Menteri. DN 20.12.2018 2 JAWAPAN-JAWAPAN LISAN BAGI PERTANYAAN-PERTANYAAN 1. Laksamana Pertama Haji Mohamad Imran (B) bin Abd Hamid minta Perdana Menteri menyatakan, langkah-langkah kerajaan dalam mereformasi institusi pentadbiran dan politik seperti yang terkandung di dalam Manifesto Buku Harapan, Teras Kedua. Menteri di Jabatan Perdana Menteri [Datuk Liew Vui Keong]: Terima kasih Tuan Yang di-Pertua. Salam sejahtera, salam sayangi Malaysiaku. Terima kasih kepada Yang Berhormat Senator Laksamana Pertama Haji Mohamad Imran (B) bin Abd Hamid atas soalan ini. Tuan Yang di-Pertua, reformasi institusi pentadbiran dan politik merupakan antara agenda utama kerajaan yang telah diberi mandat oleh rakyat pada Pilihanraya Umum Ke-14. Perkara ini terkandung di dalam Teras 2, Manifesto Pakatan Harapan. Kesungguhan kerajaan dalam hal ini telah terbukti dalam peruntukan dan penubuhan Jawatankuasa Reformasi Institusi ataupun lebih dikenali sebagai IRC, pada 15 hari bulan Mei tahun ini dengan keanggotaan seramai lima orang ahli. IRC ini telah dipertanggungjawabkan untuk mengkaji langkah-langkah dan juga cadangan penambahan baik terhadap institusi-institusi penting dalam negara ini, termasuklah Parlimen Malaysia, Suruhanjaya Pilihan Raya, Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) dan juga Polis Diraja Malaysia. IRC dianggotai oleh lima orang tokoh tanah air seperti: (i) Datuk K C Vohrah merupakan seorang bekas Hakim Mahkamah Rayuan; (ii) Datuk Mah Weng Kwai yang merupakan seorang bekas Hakim Mahkamah Rayuan dan juga Pesuruhjaya Suruhanjaya Hak Asasi Manusia; (iii) Brig Jen (B) Datuk Mohd Arshad Raji- Presiden Persatuan Patriot Kebangsaan (Patriot); (iv) Datuk S Ambiga- Presiden Persatuan Hak Asasi Manusia Kebangsaan (SUHAKAM); dan juga (v) Emeritus Profesor Datuk Dr Shad Saleem Faruqi yang merupakan seorang pakar perlembagaan dan juga pensyarah undang-undang. Laporan akhir IRC telah pun dibentangkan kepada Majlis Penasihat Kerajaan ataupun dikenali sebagai Council of Eminent Persons (CEP) pada 17 hari bulan Julai lalu dan juga diserahkan kepada Yang Amat Berhormat Perdana Menteri pada 19 hari bulan Julai tahun ini. DN 20.12.2018 3 Sejumlah 223 cadangan Tuan Yang di-Pertua, dari IRC yang berkaitan dengan skop kerja governans, integriti dan juga pencegahan rasuah diselaraskan dan dipantau oleh Pusat Governans Integriti dan Anti-Rasuah Nasional (GIACC). Keputusan dasar berkenaan cadangan-cadangan tersebut dibawa ke Mesyuarat Jawatankuasa Khas Kabinet mengenai anti rasuah. Dikenali sebagai JKKMAR yang dipengerusikan oleh Yang Amat Berhormat Perdana Menteri. Seterusnya, keputusan dasar ini akan dibawa ke Mesyuarat Jemaah Menteri untuk mendapatkan persetujuan kerajaan. Semenjak ditubuhkan Tuan Yang di-Pertua, pada 1 hari bulan Jun tahun ini, JKKMAR telah bermesyuarat sebanyak 5 kali sehingga hari ini. Fungsi JKKMAR ini ialah merangka dasar yang akan menangani perlanggaran integriti dan juga salah laku anggota kerajaan serta kementerian dan juga agensi kerajaan, termasuk reformasi institusi dan agensi-agensi kerajaan. Sehingga kini Tuan Yang di-Pertua, sebanyak 61 keputusan dan juga inisiatif telah pun diputuskan oleh JKKMAR untuk dilaksanakan. Antara keputusan yang telah dicapai adalah pemeriksaan institusi-institusi seperti mahkamah, Parlimen, SPRM dan Jabatan Audit Negara agar peranannya lebih berkecuali dan dapat bertindak dengan lebih bebas. ■1010 Inisiatif-inisiatif lain yang dipersetujui adalah penubuhan Suruhanjaya Bebas Aduan dan Salah Laku Polis ataupun dikenali sebagai IPCMC. Peranan Biro Pengaduan Awam sebagai ombudsman mekanisme perisytiharan harta dan mekanisme pelaporan penerimaan hadiah. Sebahagian usaha-usaha tersebut seperti mengehadkan tempoh perkhidmatan Perdana Menteri, SPRM sebagai satu suruhanjaya yang diiktiraf oleh Perlembagaan Persekutuan dan pemisahan tanggungjawab Peguam Negara daripada Pendakwa Raya memerlukan pindaan kepada Perlembagaan Persekutuan. Pihak kerajaan akan terus meneliti cadangan-cadangan pelaksanaan tersebut dari masa ke semasa. Malah kerajaan juga akan berusaha untuk memastikan usaha-usaha reformasi ini dapat dicapai melalui dialog dan juga sokongan dari semua pihak walaupun ianya mengambil jangka masa yang lama untuk dilaksanakan dengan jayanya. Laksamana Pertama (B) Haji Mohamad Imran bin Abd Hamid: Tuan Yang di-Pertua, saya rasa rakyat tidak mempersoalkan ataupun mempertikaikan lantikan jawatankuasa yang DN 20.12.2018 4 telah diwujudkan. Cuma rakyat melihat adakah dengan pemindahan jabatan daripada satu kementerian ke satu kementerian itu merupakan tindakan reformasi institusi juga. Oleh kerana kita lihat apabila APMM diletakkan di bawah Jabatan Perdana Menteri, ia berlaku kekeliruan apabila pasukan polis marin masih lagi wujud sedangkan APMM mengurus hal ehwal marin. Begitu juga dengan PLKN apabila dipindahkan kepada Kementerian Belia dan Sukan peruntukannya tidak dibawa ke Kementerian Belia dan Sukan. Ini menjadi masalah kepada pegawai dan juga anggota-anggota di dalam jabatan tersebut. Saya mohon penerangan ataupun penjelasan daripada Yang Berhormat Menteri. Terima kasih, Tuan Yang di-Pertua. Tuan yang di-Pertua: Silakan Yang berhormat Menteri. Datuk Liew Vui Keong: Terima kasih kepada Yang Berhormat Senator atas soalan tambahan ini. Seperti Ahli-ahli Yang Berhormat Senator sedia faham bahawa pentadbiran daripada segi reformasi telah pun dijalankan sejak bulan Mei ini untuk memastikan bahawa pelaksanaan agensi-agensi di bawah pentadbiran JPM terutamanya dapat dijalankan dengan lancar. Jadi satu pendekatan telah pun dibuat daripada pihak JPM bersama-sama dengan semua anggota-anggota terutamanya dari pihak KSN untuk memastikan bahawa agensi- agensi berkenaan yang telah pun dimasukkan oleh pihak Yang Berhormat tadi dapat dijalankan dengan lancar. Jadi di sini pihak kerajaan telah pun memutuskan bahawa pihak APMM dapat dijadualkan di dalam pihak JPM dan juga dengan agensi yang telah pun disebutkan tadi. Ini untuk memastikan bahawa pelaksanaan dapat dijalankan dengan lebih lancar. Jadi ini pendekatan telah pun dijalankan selepas penilaian telah pun dibuat kepada semua pihak agensi di mana ini adalah merupakan satu reformasi kepada pentadbiran untuk memastikan kita dapat menjalankan peranan mereka dengan lebih efisien, Tuan Yang di- Pertua. Jadi saya rasa sekiranya pihak mereka yang tidak puas hati dengan ini dapat berjumpa dengan pihak kerajaan untuk memastikan bahawa pelancaran dapat dijalankan dengan lebih telus, lebih lancar dan lebih cekap untuk memastikan bahawa rakyat dapat manfaat dan terutamanya juga kepada anggota-anggota yang terlibat dalam agensi-agensi tersebut. Jadi kita akan dapat terus berbincang dengan perjalanan lancar lah saya rasa bahawa Yang Berhormat Senator Laksamana Pertama ini memang ambil berat dengan pihak tentera kerana beliau merupakan seorang bekas tentera. Dalam perkara ini dan seperti yang kita dapat DN 20.12.2018 5 maklum bahawa kerajaan memang prihatin dengan semua penjawat awam termasuk tentera dan juga pasukan keselamatan. Di sinilah di mana kerajaan melalui Kementerian Kewangan telah pun pada dua hari yang lalu mengumumkan bahawa Bantuan Bayaran Khas sebanyak RM500 akan dibuat kepada semua pegawai perkhidmatan awam persekutuan. Ini termasuk kepada pihak pegawai keselamatan. Jadi ini adalah satu langkah yang kita dapat ambil untuk memastikan bahawa semua pihak dapat dijaga dengan baik. Jadi, itu sahaja. Tuesday, 29 Nov 2011 at 11:30 am, From Royal Lake Club to Parliament Martin Luther King Jr once said that “the ultimate measure of a man is not where he stands in moments of comfort and convenience, but where he stands at times of challenge and controversy.” The Malaysian Bar and indeed Malaysia is now facing such a moment of challenge and controversy — an objectionable Bill, being rushed into law with unseemly haste without adequate public consultation, which effectively robs the rakyat of our constitutional right to freedom of assembly. This Peaceful Assembly Bill (“Bill”) is far more restrictive than the current law. It is not a piece of legislation which we, as lawyers, can watch enter our statute books without standing up against it. It is not a piece of legislation which we want future generations to inherit, without us walking, and spending every ounce of our energy to oppose. If this piece of legislation makes it to the statute books, future generations would inherit a nation that is far from modern and progressive. Members of the Bar are now called upon to march to object to this Bill. The walk will take place next Tuesday, 29 Nov 2011, from the entrance of the Royal Lake Club to Parliament House, to deliver the Bar’s Proposed Amendments to the Peaceful Assembly Bill to YB Datuk Liew Vui Keong, Deputy Minister in the Prime Minister’s Department.

    COUNTRIES AT THE CROSSROADS Countries at the Crossroads 2012: Malaysia Introduction Malaysia has over 28 million people, of whom approximately 63 percent are ethnic Malay, 25 percent Chinese, 7 percent Indian, and 4 percent Ibans and Kadazan-Dusun.1 Much of this diversity was created through the British formation of an extractive colonial economy, with the “indigenous” Malay community ordered into small holdings and rice cultivation, while the “non-Malays” were recruited from China and India into tin mining and plantation agriculture. Further, in preparing the territory for independence in 1957, the British fashioned a polity that was formally democratic, but would soon be encrusted by authoritarian controls. Throughout the 1960s, greater urbanization brought many Malays to the cities, where they encountered the comparative prosperity of the non-Malays. They perceived the multiethnic coalition that ruled the country, anchored by the United Malays National Organization (UMNO), but including the Malayan Chinese Association (MCA) and the Malayan Indian Congress (MIC), as doing little to enhance their living standards. At the same time, many non-Malays grew alienated by the discrimination they faced in accessing public sector resources. Thus, as voters in both communities swung to opposition parties in an election held in May 1969, the UMNO-led coalition, known as the Alliance, was gravely weakened. Shortly afterward, Malays and Chinese clashed in the capital, Kuala Lumpur, sparking ethnic rioting known as the May 13th incident. Two years of emergency rule followed during which parliament was closed. As the price for reopening parliament in 1971, UMNO imposed new curbs on civil liberties, thereby banning any questioning of the Malay “special rights” that are enshrined in constitution’s Article 153.

It was attended by members of the diplomatic community, Italian government officials and private sectors and Malaysians in Italy. In his remark, Dato’ Malik hopes that the Malaysia-Italy relations would escalate further. On 16 September 2018, TYT Dato’ Malik organized the Malaysian Day celebration with Malaysians residing in Italy at Rumah Malaysia. The celebration was attended by almost 60 people. Malaysians sang the Negaraku followed by a cake cutting ceremony. It was a good gathering as Malaysians could mingle amongst themselves and at the same time enjoy the wonderful Malaysian cuisine prepared. MALAYSIA – ITALY SENIOR OFFICIALS BILATERAL CONSULTATIONS, ROME 2018 On 2 August 2018, the Senior Officials Bilateral Consultations were held at the Italian Ministry of Foreign Affairs and International Cooperation. The Malaysian delegation was led by H.E. Raja Dato’ Nushirwan Zainal Abidin, Deputy Secretary General, Ministry of Foreign Affairs Malaysia, while the Italian side was led by H.E. Massimo Gaiani, Director General Global Affairs. The consultation was fruitful and both parties were glad to convene this meeting since the last time in 2009. Prior to the consultations, H.E. Raja Dato’ Nushirwan called on H.E. Elisabetta Belloni, Secretary General of the Ministry of Foreign Affairs and International Cooperation Italy. On 8 August 2018, H.E. It was led by an ADPAN member and two lawyers from the Malaysian Bar Council, who conducted semi-directive individual interviews with death row prisoners, relatives of people sentenced to death, faith-based organisations providing religious counselling in prison, lawyers and psychiatrists in Malaysia. Carole Berrih, the author of the report, accurately uses all the accounts collected and puts them in the context of the country’s criminal and penitentiary systems. This report is part of the “Fact-Finding mission on death row” collection which aims to make an assessment of the living conditions on death row in various countries across the world. The goal is both to report on the reality of death row and to engage public opinion.
