Tuesday, 29 Nov 2011 at 11:30 am, From Royal Lake Club to Parliament Martin Luther King Jr once said that “the ultimate measure of a man is not where he stands in moments of comfort and convenience, but where he stands at times of challenge and controversy.” The Malaysian Bar and indeed Malaysia is now facing such a moment of challenge and controversy — an objectionable Bill, being rushed into law with unseemly haste without adequate public consultation, which effectively robs the rakyat of our constitutional right to freedom of assembly. This Peaceful Assembly Bill (“Bill”) is far more restrictive than the current law. It is not a piece of legislation which we, as lawyers, can watch enter our statute books without standing up against it. It is not a piece of legislation which we want future generations to inherit, without us walking, and spending every ounce of our energy to oppose. If this piece of legislation makes it to the statute books, future generations would inherit a nation that is far from modern and progressive. Members of the Bar are now called upon to march to object to this Bill. The walk will take place next Tuesday, 29 Nov 2011, from the entrance of the Royal Lake Club to Parliament House, to deliver the Bar’s Proposed Amendments to the Peaceful Assembly Bill to YB Datuk Liew Vui Keong, Deputy Minister in the Prime Minister’s Department.

A total of 134 more PPS members will be released by midnight, lawyer Gobind Singh Deo said this afternoon. Gobind said the documentation was being done to secure the release of the members. He was accompanied by 21 lawyers from DAP, PKR and the Bar Council’s Legal Aid Centre and they managed to get into a sessions court set up for the matter at the Northeast District police headquarters on Jalan Patani about 12.30pm today. "The police applied to remand them for four days, but since they needed to prepare the documentation, the detainees will be released, temporarily, on police bail today. "The sessions court judge heard the application by the detainees to seek their release," Gobind said. However, the lawyers were not informed about the actual reason for the remand. Sessions judge Mohamad Izwan presided over the matter, while police officer ASP Karuna applied for the remand. The lawyers came out about 3pm and were greeted by supporters who clapped happily upon hearing about the pending release of the detainees. Exact charge yet to be specified According to Gobind, the detainees are being investigated under Section 43 of the 1966 Societies Act, but the exact charge is yet to be specified. Earlier, 21 PPS members - seven women and 14 senior citizens over the age 60 - were released on police bail, after Chief Minister Lim Guan Eng negotiated with the police for their release last night.

Romzi Ationg of Universiti Malaysia Sabah (UMS) said the move could work in Warisan’s favour but only if the MPs appointed to the posts do an outstanding job. He acknowledged that voters might be upset by Chief Minister Shafie Apdal’s (pic) decision to appoint two of his MPs to such positions as it was a clear breach of his election pledge.     COUNTRIES AT THE CROSSROADS Countries at the Crossroads 2012: Malaysia Introduction Malaysia has over 28 million people, of whom approximately 63 percent are ethnic Malay, 25 percent Chinese, 7 percent Indian, and 4 percent Ibans and Kadazan-Dusun.1 Much of this diversity was created through the British formation of an extractive colonial economy, with the “indigenous” Malay community ordered into small holdings and rice cultivation, while the “non-Malays” were recruited from China and India into tin mining and plantation agriculture. Further, in preparing the territory for independence in 1957, the British fashioned a polity that was formally democratic, but would soon be encrusted by authoritarian controls. Throughout the 1960s, greater urbanization brought many Malays to the cities, where they encountered the comparative prosperity of the non-Malays. They perceived the multiethnic coalition that ruled the country, anchored by the United Malays National Organization (UMNO), but including the Malayan Chinese Association (MCA) and the Malayan Indian Congress (MIC), as doing little to enhance their living standards. At the same time, many non-Malays grew alienated by the discrimination they faced in accessing public sector resources. Thus, as voters in both communities swung to opposition parties in an election held in May 1969, the UMNO-led coalition, known as the Alliance, was gravely weakened. Shortly afterward, Malays and Chinese clashed in the capital, Kuala Lumpur, sparking ethnic rioting known as the May 13th incident. Two years of emergency rule followed during which parliament was closed. As the price for reopening parliament in 1971, UMNO imposed new curbs on civil liberties, thereby banning any questioning of the Malay “special rights” that are enshrined in constitution’s Article 153.

    Fresh CEC elections will take place as planned, says DAP’s Guan Eng Malaysian Insider Sept 11 , 2013 By EILEEN NG DAP is going ahead with fresh elections for its central executive committee (CEC) despite attempts to stop it by a disgruntled member. Secretary-General Lim Guan Eng (pic) called on delegates to turn up in full force to ensure it can proceed smoothly later this month. "We hope for a good turnout. There are concerns about attempts to sabotage the re-election. "I hope delegates can turn up for the polls to proceed smoothly and to save the party," he said at the party's headquarters today. Lim said they have yet to receive the injunction by a grassroots leader to stop the election. "Let our lawyers deal with it. We'll proceed with the re-election until we get instructions from the court," he said. The lawyers who will be handling this are DAP chairman Karpal Singh and Puchong MP Gobind Singh Deo. Yesterday, Ladang Paroi branch deputy chairman A. David Dass claimed to have filed an injunction to stop the re-election on September 29, claiming that it was against the party's constitution. DAP is holding fresh elections for its CEC in order to avoid deregistration following a directive by the Registrar of Societies (RoS) on July 30. The re-election was ordered by RoS after several disgruntled members claimed that the election in December last year was not properly conducted after the party announced that a glitch had resulted in the wrong candidate being elected to the CEC.
