Singapore Medical Council v Kwan Kah Yee [2015] SGC3J 01 Court of Three Judges — Originating Summons No 1 of 2015 Sundaresh Menon CJ, Chao Hick Tin JA, Andrew Phang Boon Leong JA 6 July 2015 Administrative law — Disciplinary tribunals — Disciplinary proceedings 31 July 2015 Sundaresh Menon CJ delivering the grounds of decision of the court: Introduction 1 This appeal was brought by the Singapore Medical Council (“the Applicant”) against the sentence imposed on Dr Kwan Kah Yee (“the Respondent”) by the Disciplinary Tribunal (“DT”) after the Respondent pleaded guilty to two charges of wrongfully certifying the cause of death. In this judgment, the charges will be referred to separately as the “First Charge” and “Second Charge”, and collectively as the “Charges”. In relation to both Charges, it was not only determined that the Respondent issued false death certifications, but also that he misled the investigators in an attempt to cover up his wrongdoing in the Second Charge. While the DT acknowledged the gravity of the offences, it imposed a sentence on the Respondent that struck us as manifestly inadequate. The DT decided that the Respondent should: Singapore Medical Council v Kwan Kah Yee [2015] SGC3J 01 (a) have his registration as a medical practitioner suspended for a period of three months on each charge, these to run concurrently; (b) be censured; (c) undertake in writing that he would henceforth not engage in the conduct complained of or any similar conduct; and (d) pay half of the costs and expenses of and incidental to the proceedings, including the costs of the Applicant’s solicitors.

On the contrary, in The Maldives there was a recent increase in the number of crimes that are punishable by death, and in countries such as Pakistan and Indonesia, who had de-facto moratoriums for several years, executions have resumed. Of particular concern, notably in Asia, is the continued imposition of the death penalty for drug crimes despite this being a clear violation of international human rights stan- dards.

Fang et al. BMC Geriatrics (2016) 16:107 DOI 10.1186/s12877-016-0282-6 RESEARCH ARTICLE Open Access A knowledge synthesis of culturally- and spiritually-sensitive end-of-life care: findings from a scoping review Mei Lan Fang1*, Judith Sixsmith2,3, Shane Sinclair4,5 and Glen Horst5 Abstract Background: Multiple factors influence the end-of-life (EoL) care and experience of poor quality services by culturally- and spiritually-diverse groups. Access to EoL services e.g. health and social supports at home or in hospices is difficult for ethnic minorities compared to white European groups. A tool is required to empower patients and families to access culturally-safe care. This review was undertaken by the Canadian Virtual Hospice as a foundation for this tool. Methods: To explore attitudes, behaviours and patterns to utilization of EoL care by culturally and spiritually diverse groups and identify gaps in EoL care practice and delivery methods, a scoping review and thematic analysis of article content was conducted. Fourteen electronic databases and websites were searched between June–August 2014 to identify English-language peer-reviewed publications and grey literature (including reports and other online resources) published between 2004–2014. Results: The search identified barriers and enablers at the systems, community and personal/family levels. Primary barriers include: cultural differences between healthcare providers; persons approaching EoL and family members; under-utilization of culturally-sensitive models designed to improve EoL care; language barriers; lack of awareness of cultural and religious diversity issues; exclusion of families in the decision-making process; personal racial and religious discrimination; and lack of culturally-tailored EoL information to facilitate decision-making.
