Knott‘s Berry Farm, billed as America‘s first theme park, is the kind of success story that America was all about in pre-World War II America. A little guy, not looking for a handout, pulling himself up by his own bootstraps to eventually become a virtual American institution. It‘s the story of Walter and Cordelia Knott, who, in 1920, were sharecroppers in San Louis Obispo, CA.

They hadn't had it easy. They and their three children had already spent three years trying to homestead in the Mojave Desert (!). When Walter‘s cousin offered him a partnership in raising berries in Buena Park, it sounded like a good opportunity to stake a claim on their own farm. For $1,000 a year, they could rent 20-acres on a five-year lease with an option to rent for another two years.

Things still didn‘t come easily. Most of the family‘s savings went to purchase equipment and berry plants. Several heavy frosts, almost unheard of in Southern California, nearly wiped them out in that first year in 1920. The second year, berry prices plummeted. But it was Walter‘s roadside stand that got the family through.

Walter had heard of a new type of berry, the “Youngberry,‖ recently developed by a farmer in Alabama. He bough enough to plant half an acre, packaged his berries distinctively and sold them directly to the public, for Walter was more than a farmer...he had a talent for business and marketing, as continued on p.3 2 RMS Bulletin July/August 2008, No. 533

He advertised the new berries, and interest became so high that the family grossed more than $2,000 from the half acre.

The family enterprise prospered until an oil boom in 1927 drove land prices sky-high. The lease expired, and the landlord naturally wanted to sell the land. For the Knott‘s, it was buy or leave. Walter contracted to buy 10 of the acres at $1,500 an acre and build a bigger stand and, behind it, a new house for his family. Walter wanted to add a restaurant, as well, but Cordelia said she already had her hands full with the stand and the newly proposed tea room.

In 1929, the stock market crash and the impending Depression threatened to ruin everything. Just in the nick of time, though, Walter‘s sharp eye saved the day. The USDA contacted him, asking if he knew anything about a supposedly new, superior berry developed by Rudolph Boysen of Orange County, Walter didn‘t...but he was certainly going to find out.

As it turned out, Mr. Boysen had developed a new berry, but he had given up on it because there didn‘t seem to be any commercial interest in it. Walter got permission to take the last few plants in existence. He tended them and found that they were not only very hardy, but the berries were so big that as few as 25 filled a standard fruit basket...and thus the ―boysenberry‖ was born. Sales soared. The boysenberry was in demand for canning, cooking, and table eating. Knott‘s Berry Farm, the nursery, berry salesroom, and the tea room had all the business they could handle.

In 1934, still insisting that she wasn‘t going into the restaurant business, Cordelia added chicken and rhubarb to the tea room menu. The next day, using her wedding china, Cordelia served eight customers chicken dinners with rhubarb appetizers for 65¢. The response was phenomenal. Within weeks, people were waiting in lines at every meal. The Knotts doubled the size of their small tea room, and still there were lines.

Cordelia‘s ‗restaurant‘ opened in 1937. On Thanksgiving Day, it served 1,774 dinners! Until her dying day, 40 years later, Cordelia still insisted, ―I‘m not in the restaurant business.‖

In his 50th year, Walter took stock. The berry farm was succeeding beyond his wildest dreams; hiss family had grown; but the country was still struggling to get itself out of the Depression. That‘s when it all happened...Walter decided that people needed to be reminded of the pioneer spirit that had made America great. He could build something on thee berry farm that would be a monument to those pioneers (including his parents) and an educational diversion for people waiting to get into the restaurant.

Walter decided to get an artist to do a big ‘cyclorama‘ (a painting with real objects in the foreground) of a wagon train crossing the desert. He‘d build a town around it so that people could see how little those pioneers had to work with and yet how much they were able to accomplish. When the artist 4 RMS Bulletin July/August 2008, No. 533 suggested bringing in actual old buildings for a more natural atmosphere, that was all that history- loving Walter needed.

He found a hotel built in 1868 near Prescott, Arizona, and had it moved to the farm in 1940. An authentic saloon was soon found, although Walter wouldn‘t allow any alcohol to be sold anywhere on the premises. In the following year, he added other buildings, including a jail complete with a ―talking‖ inmate, a Kansas school house, a blacksmith‘s shop, and a variety of shacks. Covered wagons, stage coaches, Boot Hill Cemetery, and employees dressed in authentic attire completed Knott's Berry Farm‘s now famous Ghost Town. Almost everything was authentic. Between 1940 and 19955, Knott‘s grew into a genuine tourist attraction. Visitors flocked to see the Ghost Town; the restaurants were surrounded by successful shops; and Knott‘s berry Farm jams and jellies were packaged and sold throughout the United States. And then Disneyland appeared...the dream of another Walter.

The Knotts were apprehensive about the impact of Disneyland. As it turned out, 1955 went on to be a banner year for Knott‘s. Gradually, however, Knott‘s Berry Farm began to change directions. Rides and activities for the kids were added, including a whole mountain where six mine trains took people on a tour of a gold mine...the Calico Gold Mine. In 1968, the Knott family decided to fence the park and charge admission, a move many other amusement parks had already made. The fence was a turning point. Before, people had come to Knott‘s for the chicken dinners and simply browsed through the other attractions. Now, when paying admission, people expected entertainment. $17 million was expended on the farm to meet this demand. Between 1968 and 19976, the park added its Log Ride, Fiesta Village, and Roaring 20s amusement area. By 1976, the additions were complete. Attendance went up 52% in its first summer. Knott‘s Berry Farm now ranked third in national attendance, behind Disneyland and Disney World.

After Walter‘s death in 1981, the family vowed to keep Knott‘s oriented toward families and education. In 1983, Knott‘s allied itself with a much-loved comic strip, opening Camp Snoopy, featuring six scenic areas themed to the California High Sierra, complete with rushing waterfalls, a meandering stream, pontoon and suspension bridges, and all sorts of shows and attractions for the young-at-heart. Four years later, the Kingdom of Dinosaurs opened, offering a dark and noisy voyage through the world of the prehistoric. Recently, the park unveiled the new Boomerang roller coaster, which takes riders upside down six times in less than a minute. Today, Knott‘s sells 1.5 chicken dinners annually. Annual attendance tops 4 million people, and another million people come just to shop at Knott‘s MarketPlace.

Today, the Chicken Dinner Restaurant seats more than 900 guests at a time, serves more than 1. 5 million guests each year, and is the largest full-service restaurant in California that serves chicken as its main course. Amidst this grand success story, Knott‘s has immortalized its story with a succession of matchcovers, a few of which have been pictured here. Notice how the covers, almost all 20-strikes, chronicle the addition of new features to Knott‘s Berry Farm over the years. Also, notice the successive change of addresses. Finally, notice the addition of Snoopy to one of the later covers. The next time you come across such covers, you might stop to think about the story behind Knott‘s Berry Farm. Army Air Corps

The Army Air Corps became the branch for Army aviation in 1926. A few years later, in 1935, General Headquarters (GHQ) Air Force was created for operational aviation units. This arrangement existed in the period leading up to United States entry into WW II. There were two aviation organizations: the Air Corps managed materiel and training and GHQ Airforce had operational units.

Army aviation existed before 1926, but then we‘re talking bi-planes, and I‘ve never seen an honest-to-goodness Military cover which pictured any, except perhaps in historical retrospect. And, since the Army Air Corps was surplanted in June 1941 by the new Army Air Forces, there just aren‘t many AAC covers to be seen. Also, both branches used the same logos, making the whole thing even more muddled, from a collecting standpoint. Collecting

As the #1 producer of warm fuzzies, Hallmark Cards is the Goliath of greeting cards. The company's cards are sold under brand names such as Hallmark, Shoebox, and Ambassador and can be found in more than 43,000 US retail stores (about 4,000 of these stores bear the Hallmark Gold Crown name; the majority of these stores are independently owned).

Hallmark also owns crayon manufacturer Crayola (formerly known as Binney & Smith). It offers electronic greeting cards and flowers through its web site. It also owns a controlling stake of Crown Media. Members of the founding Hall family own two-thirds of Hallmark.

Hallmark Cards, Inc., the personal expression industry leader virtually synonymous with consumers' preferred brand of greeting card, was founded in January 1910 by Joyce C. Hall (1891-1982). Donald J. Hall succeeded his father as chief executive officer from 1966 until 1986, presided over a period of explosive growth, and continues to influence and shape the company as chairman of the board. In 2002, Donald J. Hall, Jr. succeeded Irvine O. Hockaday, Jr. as president and chief executive officer.

Well, that‘s the Wall Street rundown on the company, but what about the covers? It seems to me that I was in the hobby for almost two decades before I even heard that there were covers and that at least some collectors sought such out as a category. If I had actually run across any prior to that I never noticed them, probably just writing them off as ―nationals‖. Well, now, of course, I collect them, myself! [I‟m smacking my forehead!].

All of the covers here that I‘m aware of bear the Hallmark name somewhere on the cover, so you can , unlike the old me, readily tell them apart from other covers. They all have multi-colored designs and are 20 and 30-strikes (almost all 20-strike). I‘ve never seen any 10s or 40s.

Collecting

Disneyland opened to the public on Monday, July 18, 1955…and I was there! I was only 9 years old, and all I really remember is that it was so hot that my shoes left heel marks in the asphalt as I walked along side my parents...but I was there!

Disneyland became an enormous success within its first few months. In 1971, Walt Disney World Resort opened in Lake Buena Vista, Florida as the world's largest privately owned vacation destination. In 1983, the first international Disney theme park opened: Tokyo. Tokyo Disneyland is now part of Tokyo Disney Resort and has a sister theme park, Tokyo Disney Sea. Tokyo Disneyland and Tokyo Disney Sea are owned by a Japanese corporation, Oriental Land Company. The Walt Disney Company receives royalties based on revenues and maintains creative control. And the last time I looked, Tokyo Disneyland was the most often visited amusement/theme park in the world.

In 1992, Euro Disney opened in France. It has since been renamed Disneyland Resort Paris and currently contains two theme parks. And in 2005, Hong Kong Disneyland opened in Hong Kong and is owned jointly by the Hong Kong Government and The

But, collecting Disney, as I‘m presenting it here, means collecting all Disney—and that includes covers from not only the Disneyland /Disney Resort sites, but also from the various other Disney enterprises: Disney Cruise Lines, Disney Studios, etc. And, if you are really going after as ‗complete‘ a Disney collection as you can put together, you‘d also have the Disney Pepsi set and any other covers that sported WW II Disney art.

The late Hank Northam, CA, reported having 404 Disney covers as of October 1990, but I don‘t think he included all the Disney types I‘ve alluded to above. I don‘t have all of such in one collection, myself. I have a Disneyland/DisneyWorld collection, but other Disney covers are in my Shiplines collections, Military collections, etc. Come to think of it, you could have a pretty nifty small collection just of Disney logos.

There‘s great variety here, with just about all sizes, Matchoramas, Jewelites, Foilites, boxes, Foreign. No matter how you divvy them up, this is a very popular and satisfying small category.

Ode To The Commode [or, “Everything you never wanted to know about toilets”]

Just when you thought I couldn‘t sink any lower…[perhaps that might have been phrased differently] … But, wait! This is a legitimate topic! Don Fisher, WA, has 155 of these porcelain beauties! As usual, though, it‘s the behind-the-cover information that really makes the topic come alive (!). For example…

- 2500 BC: In Mohenjo-daro, there existed highly developed drainage system where waste water from each house flowed into the main drain. - 1000 BC: In the Bahrein Island in the Persian Gulf, flush type toilet was discovered. - 69 AD: Vespasianus (Roman Empire) for the first time levied tax on toilets. - 1214 AD: Construction for the first time of public toilets manned by scavengers in Europe. - 1596 AD: JD Harrington invents W.C. - 1668 AD: Edict issued by Police Commissioner Paris, construction of toilets in all houses. - 1728 AD: Architect J.F. Although a precursor to the modern flush toilet system was designed in 1596 by Sir John Harington, the toilet did not enter into widespread use until the late nineteenth century, when it was adopted in English upper class residences. By the early 1900s, water closet innovations were occurring on a nearly daily basis. The U.S. Patent Office received applications for 350 new water closet designs between 1900 and 1932, including a siphonic wash-down closet that would become the norm in this country in later years. Sound familiar?...Think „Sound of Music‟!...Who hasn‟t seen that?! What a story!

Maria Augusta von (January 26, 1905 – March 28, 1987) was the matriarch of the Singers. Her story and that of her family's escape from the Nazis after the Anschluss was the inspiration for the musical .

Maria Kutschera, born in Austria, had entered Nonnberg Abbey, a Benedictine (Roman Catholic) convent in Salzburg, intending to become a nun. While still a novice, she was asked to teach one of the seven children of widowed naval commander Georg Ritter von Trapp and his first wife, Agathe Whitehead von Trapp. Maria and Georg were married on November 26, 1927.

As Maria explains in her books, the Captain lost his fortune in 1935. Previously, it was safely invested in a bank in London. The Captain, to help Mrs. Lammer, a friend in the banking business, withdrew the money from the English bank and deposited it in Mrs. Lammer's bank, which promptly failed. Austria had been experiencing economic pressure as a result of German pressure and other factors.

To survive, the Trapps sent away most of their servants, moved into the top floor, and rented the empty rooms to students of the Catholic University. The Archbishop sent Father Wasner to stay with them as their chaplain, and the family began turning its love of music into a career. After performing at a festival in 1935, they became a popular touring act. Shortly after the Nazi annexation of Austria in 1938, the family escaped to Italy and then to the United States. The family home became the headquarters of Heinrich Himmler. Calling themselves Singers, the family, which by then included ten children, became famous in a new context and was soon touring the world. After the war, they founded the Trapp Family Austrian Relief, Inc., which sent hundreds of thousands of pounds of food and clothing to impoverished Austria. The Trapps made their home at a farm in Stowe, Vermont, where they founded a music camp. died of lung cancer on May 30, 1947.

Maria's book, The Story of the Trapp Family Singers, was a best-seller. It was made into two successful German/Austrian .The book was later adapted into The Sound of Music, a phenomenally successful Broadway musical by Rodgers and Hammerstein, which resulted in an immensely popular US motion picture. However, because Maria had sold the rights for a sum less than $10,000, the von Trapp family did not benefit greatly from the movie's enormous success. Maria wrote a sequel, "A Family on Wheels."

In 1957, the Trapp Family Singers disbanded and went their separate ways. Maria and three of her children became missionaries in the South Pacific. Maria later moved back to Vermont and managed the until her death in 1987 at the age of 82. , her husband Georg, and Hedwig von Trapp (1917–1972), the fifth child of Georg and Agathe von Trapp, are interred in the family cemetery at the Lodge. Four of the couple's great-grandchildren, all children of Stefan von Trapp, the son of Georg's son Werner, sing as the Von Trapp Children. Maria von Trapp's granddaughter, Elisabeth von Trapp, is a singer whose concerts are a mixture of Gregorian chant, musical comedy, country and contemporary folk.

Maria von Trapp made a cameo appearance in the movie version of The Sound of Music. For an instant she can be seen walking past an archway when Julie Andrews sings the song, "I Have Confidence". [Everyone load your DVD and see if you can spot her!]

The Trapp family first started welcoming guests to their 27-room lodge in the summer of 1950. Thirty-three years later the family opened its doors to a new 93-room resort with the same country charm of the original lodge. The Lodge continues to be owned and operated by the Trapp family.

Ace-Saxon Set

James Willard, MD: James is trying to find out how many are in this WGBS ―Ace-Saxon‘ set featuring various radio personalities. He has four covers, and apparently there are two set variations--a grey striker set and a black striker set. Not all of the covers here have ―Star‖ on them, but they all have the same sponsor, Ace-Saxon, Inc. There may also be a third set relating to the inside text.

If anyone has a definitive answer, please let us know....And, if you have a question about a set or series, send in a clear pic and details, and we‟ll see what information we can garner from our readers.

Two problems right off the bat—pictures here don‘t show what a Filigree is...and you‘re not going to see “Filigree‖ on the inside of a cover where other trademarks normally appear.

―Filigree‖ refers to Universal‘s covers (all sizes) which have a plastic bubbled appearance. Other companies put out ‗Filigree-like‘ covers, but ―Filigree refers specifically to Universal specimens. They were produced from 1969-1987 and qualify as one of the “Fancies.‖ They used to be quite popular, but the popularity of all the Fancies has, illogically, declined with the demise of Universal.

There are at least 10,104 varieties known to exist (Helen Hollmann‘s collection), but the actual listing ceased in 1989 at 6,063 covers. RMS Bulletin July/August 2008, No. 533 19

My Most Prized Cover Forest City Matchcover Club Here are my favorite covers. I have been collecting and looking at other collections for of Ohio over 65 years, and I have never seen the 15¢ cover anywhere else. Upon my goodbye, my On Feb. 7, 1960, an article in a Cleveland wife is going to give it to the McDonald‘s newspaper on the matchcover endeavors of a Mr. Museum in Des Plaines, IL. The Jewelite cover Robbins and a Mr. Chap caught the eye of Hal is more of an ego thing. Dues are $6, and the club puts out five bulletins annually, plus, of course, there‘s that annual swapfest. Club meetings feature club business, freebie table, an auction, refreshments and that great friendship and comradery that the hobby is noted for.

The Mississippi Valley League was a Class D league -- roughly the equivalent to today's Class A ball. The league fielded eight teams from 1929- 32, then operated as a six-team Class B league (similar to AA) in 1933. The local franchise took on the name of the Davenport Blue Sox in 1932. The franchise moved into the Western League, a Class A league (the equivalent of today's AAA) in 1934 and won pennants under Dixon in 1935 and 1936. In the late 1960s, the government, in order to save money, made the questionable decision to combine the three forces into one. The move was very unpopular among those serving in the three services.

The cover in question was issued in the early 1970s to show the three services combined: the anchor for the Navy, the soaring eagle with spread wings for the Air Force, and the crossed swords for the Army. This cover was issued for several years, as well as separate covers identifying different bases, stations, and ships. I guess you could call the one in question a generic cover for the integrated service.

Arthur Alderton, Hon. Secretary, BML&BS: I was pleased to see the illustration of the R.Bell & Co's label (RMS Bulletin No.532, p19). R.Bell & Co. was founded in 1832, and this label dates from about 1888 - even older than Larry Bell suggests! The bulbous head was said to be ideal for lighting pipes and cigars, especially as it glowed rather than flamed. The "braided" in the title refers to the fact that the paper stems were braided with fine wire, which gives the criss-cross effect seen in the illustration. Dear Mr. Perkins:

In the past six months there seems to have developed in the Hobby a new and most unwelcome menace. This is what is commonly known as the Dealer-Trader. His prey is the new and unwary collector, and at least once the veteran collector will become enmeshed in the ―propaganda feelers‖ which he sends out. He operates something like this: Ads are inserted in Match Cover publications offering covers in all groups for sale at a scale of prices which are attractive even to the seasoned collector. In most cases the supply is ―limited‖, excuses generally accompanying the return order. Some specialize in certain groups and of course offer to swap devious ways for covers in this Group. As a result the trader who is sincere will find himself on the short end if he is not alert to the tricks employed by these ―sharks‖. The most objectionable feature of this practice is that thousands of covers are ―frozen‖ to the legitimate collector and to many who enjoy the hobby for the pleasure and friendship which it affords, and who are likewise in a great majority. They do not wish, or they can not afford to purchase these covers. Hence many a valuable trader or collector becomes discouraged and is driven out of a hobby, which, until recently has been enjoyed by thousands the world over. Keep it free from these practices if our hobby is to endure. Cooperation and fair dealing will help ―slap the saps‖ who seem determined to destroy our Hobby with their unfair and unethical practices. Here‘s to the bigger and better swaps.

Dear Dr. Higgs: This will make you green with envy! Last night I saw the World‘s ―largest‖ collection! Actually - it was shown in the movies under a short skit entitled - Believe it or Not - . This hobbyist, a fireman in Iowa, had the enormous sum of 11,000 different covers! He was seen in the act of gluing a number of them to a home-made album! (Ask Al Polick what he thinks of the glue idea.) Now I ask you, isn‘t such enlightenment as this a boon to our hobby, especially to the embryo collector? Regarding figures, you and ten other collectors of whom we know have at least 11,000, or better on different hotel issues alone. Many of the R.M.S. members received with welcome a copy of a recent Wilkes-Barre, Pa. paper which carried a lengthy article purporting to show what truly was the World‘s Largest Collection. Those of us who have visited you at 57 Carey Ave. would say that 175,000 different, and 1,000,000 duplicates were modest announcements, and exceed by at least 5,000 miles of thread (rather than glue) the ―stupendous‖ number depicted in the News Reel. Unfortunately movie shorts are more widely circulated than Pennsylvania newspapers!

Labels? [July 1957 RMS Bulletin]

For a long time, label collecting has been almost a dead issue in these United States. With foreign correspondence growing among the matchcover collectors, almost all of them have started a match- label collection in conjunction. A lot of them will not admit it, but if you look thru their collections, you‘ll find some labels popping up. The most prolific country seems to be Czechoslovakia. Johnny Weaver and your Editor has received many colorful sets from youngsters in this country, some wanting bubble-gum in exchange, others wanting labels (which are few in this country) and others are interested in matchcovers. Evidently, our foreign friends have no compunctions regarding ...[flats!]

What To Do With Unwanted Covers

'Unwanted covers'? Who has unwanted covers? Most collectors, I think. Of course, there are your dupes, but they're usually wanted as trading material, even by those collectors who don't do any regular trading....You don't want to be caught short, after all, if an enticing trading situation happens to present itself.

But there are other covers collectors may actually not want. Indeed, I can think of several different types, even some of your dupes. For example, I do a lot of trading, and I also put up auction lots, but there's basically nothing I can do with 50+ dupes of the same cover. Can't trade that many, can's sell that many, etc. So, in my case, those covers aren't wanted.

Then there are all the covers I come across that are struck. Don't want them (unless they're oldies); can't trade them; won't put them up for auction. If they're really messed up, I toss them out, although I can see that there are arguments both for and against that. From my vantage point, I'm doing everyone a favor by culling out the garbage from the hobby, and throwing them out also prevents such garbage from endlessly circulating from one freebie table to another. On the other hand, one might argue that someone, somewhere, might want those covers.

If the struck covers are only lightly struck and in otherwise nice condition, I put mine aside for the freebie table at the annual Sierra-Diablo Spring Swapfest. Those covers have a much better chance of finding a home with someone, even if it's only temporarily until an unstruck cover is found to take its place.

Bob-tailed covers are always a tragic story. If they're bob-tailed, they're almost certainly 1950s or older, and their resulting age just makes us all groan to see them rendered useless. They get thrown out! Although, I should note, that since I maintain the listings on almost all of the old manufacturers, I can still use such bob-tailed covers to add to the listings, as long as the manumark still shows...but I don't keep them...and in case you have some, and don't want them yourself, I'd appreciate getting them, just to see if there are any unlisted ones in there.

There are also the run-of-the-mill damaged covers we encounter (and sometimes, you know it's true, we're the ones who damaged them!)...Strikers that are hopelessly corroded or broken, covers whose sides or corners have been broken and mangled by slotted or hand-sewn pages, covers that have been left out in the sun and have been noticeably faded, covers that are irreversibly dirty or stained, ones that are creased or wrinkled, ones that have had the match heads pressed into them so that now they're 'embossed'! I chuck them all.

Flats! Occasionally, we all run across flats. I don't keep them. When I accumulate a stack, I usually advertise them, promising to send them along to anyone who will pay the postage. There are collectors who are interested in flats, and I can see why. They're almost always in mint condition and are beautiful examples of matchcover art, even if they aren't real covers.

Still, Nationals are probably the most common unwanted covers. They don't have any specific address, hence the term 'National', but moreover, as a general rule, they're pretty bland, uninspiring covers to begin with. Even in mint condition, hardly anyone wants them. So, I end up throwing out at least the more common ones. The rest I eventually put on the freebie tables, assuming that there are at least some collectors, who, like myself, are looking for one of each and every cover in their respective categories. Thus, in my Sheraton Hotel collection, for example, I include one of every Sheraton RMS Bulletin July/August 2008, No. 533 25

National. Otherwise, from my point of view, such a collection would never be complete.

And, you might even be able to think of a couple of other situations in which covers were unwanted by the collector. In any event, eventually, I would think, we all end up with some. So, my own sugges- tions as to their disposition...

1. Determine if other collectors might reasonably want such (and I say reasonably because even though you could expect that at least one person, somewhere, would want even the most messed-up cover imaginable...keeping it stored at home or continually circulating it through the hobby for such a rare opportunity wouldn't justify its continued existence).

a) If so, devise a means of attempting to match up those covers with those collectors.

1) Put them up for sale if you think there's a market for them.

2) or, Offer them as freebies for postage only.

3) or, Donate them to the freebie tables of your local club, swapfest, or convention.

2. If not, toss 'em!

In 1981, James W. Temple, Jr., opened up some fast food restaurants called Taco Uno in South Carolina. Pizzeria Uno, ever vigilant over its own trademark, brought an action to restrain Temple from using the name Taco Uno. The District Court dismissed Pizzeria Uno's action, finding that it was not entitled to an injunction because it had not yet extended its chain into the South Carolina area, and thus allowed Taco Uno to keep its name. The Circuit Court affirmed, but noted that Pizzeria Uno might be entitled to such an injunction at such time as it did penetrate the South Carolina market.
