NOTICE OF OPPOSITION

Opposer, CD Projekt S.A. (hereinafter referred to as “Opposer”), a Polish joint- company having an address of Ul. Jagiellonska 74, Warszawa, 03-301, Poland, believes that it will be damaged by the registration of U.S. Application Serial No. 88/208,249 for

“LINKWITCHER” that was filed by Applicant, Yubo Liu (hereinafter referred to as

“Applicant”). “LINKWITCHER” was published in the Official Gazette on April 23, 2019, and the Trademark Trial and Appeal Board granted Opposer a First Extension to Oppose until

August 21, 2019 and then also granted Opposer a Final Extension to Oppose until October 20,

2019. Opposer hereby opposes the registration of “LINKWITCHER” for any and all goods listed

in the Application and requests that its registration be refused.

As grounds in support of its Opposition, Opposer asserts as follows:

COUNT I

1. For over a decade in the United States, long before the filing date of Applicant’s

LINKWITCHER application of November 28, 2018, Opposer has adopted and continuously

used “THE WITCHER” as a trademark for a variety of goods and services related to computer and video game hardware and software, software for mobile and cellular phones, computer peripherals and computer accessories and related goods in International Class 9, bags in

International Class 18 and several other International Classes for similar types of goods and services. Opposer has priority of use of “THE WITCHER”.

2. Opposer is the owner of a number of trademark registrations in the United States and worldwide for the THE WITCHER mark together with the goodwill symbolized by the

trademarks and common law trademark rights.

3. Opposer is the owner of the following United States Registrations that contain the

distinctive “THE WITCHER” mark:

Mark U.S. Registration No. THE WITCHER 3,276,016 THE WITCHER 4,820,401 THE WITCHER 5,361,922 THORNEBREAKER: THE WITCHER TALES 5,853,950

Copies of the current printouts from the USPTO’s TESS database showing the current status

along with a copy of Opposer’s Certificates of Registration for each of the above listed marks are attached to this Notice of Opposition as Exhibit A (“THE WITCHER Family of Marks”).

4. The Certificates of Registration identified in paragraph 3 are valid, subsisting, unrevoked and uncancelled. The Certificates of Registration are prima facie evidence of the validity of the

Registrations, the Opposer’s ownership of the marks, and of the Opposer’s exclusive right to use the marks in commerce in connection with the goods and/or services specified in the Certificates of Registration under the provisions of 15 U.S.C. §1057(b) and constructive notice of Opposer’s claim of ownership under 15 U.S.C. §1072.

5. On November 28, 2018, Applicant filed an Application to register “LINKWITCHER” for

“Protective covers, cases and sleeves for cell phones, laptops, tablets, and portable media players; bags adapted for laptops, tablets and mobile phones; laptop carrying cases; stands adapted for mobile phones, tablets and laptops; electric cables and wires” in International Class 9 and “Lighting equipment, namely, table lamps and lighting fixtures” in International Class 11.

The Application was assigned Serial No. 88/208,249.

6. All of the goods listed in Applicant’s “LINKWITCHER” Application are identical to or related to Opposer’s goods and services listed in its Registrations of THE WITCHER Family of

Marks, including but not limited to, computer and video game hardware and software, software for mobile and cellular phones, computer peripherals and computer accessories and related goods and bags.

7. Applicant’s mark so resembles Opposer’s previously used and registered THE

WITCHER Family of Marks as to be likely, when applied to the goods set forth in Applicant’s

Application, to cause confusion, mistake, or deception within the meaning of Section 2(d) of the

Trademark Act (15 U.S.C. §1052(d)).

8. Opposer has been using its mark in the United States for over a decade before

Applicant’s filing date of November 28, 2018. Opposer is and has been selling goods and providing services in the United States and around the world for many years before 2018.

9. Opposer has also filed oppositions against Applicant’s corresponding LINKWITCHER applications in the European Union (Opposition No. B003080105) and United Kingdom

(Opposition No. OP000415810). The applicant in those oppositions is Tomtoc LLC. Applicant in the present matter, Yubo Liu, is the company director of Tomtoc LLC.

10. Upon information and belief, the goods for which Applicant seeks to register

“LINKWITCHER” will involve offering related and similar goods under a nearly identical mark

to the same persons to whom Opposer provides such goods and services under its THE

WITCHER Family of Marks.

11. Upon information and belief, Applicant’s goods are and will be marketed, promoted and offered through the same marketing channels as are the goods and services provided by Opposer under its THE WITCHER Family of Marks.

12. Applicant’s “LINKWITCHER”, which Applicant seeks to register, is nearly identical to

or similar to Opposer’s THE WITCHER Family of Marks. With the exception of the “LINK”

portion in “LINKWITCHER”, “LINKWITCHER” is identical to Opposer’s distinctive “THE

WITCHER”. Opposer owns “THE WITCHER” marks that have been filed with the U.S.

Trademark Office, used, and registered for goods and services that are identical and/or highly

related to the goods listed in Applicant’s “LINKWITCHER” Application.

13. Opposer, since long before Applicant's filing date, has spent, and continues to spend,

large sums of money in the promotion and advertisement of its goods and services bearing its

THE WITCHER Family of Marks, and by reason of such promotion and advertising and the high

quality of its goods and services carrying the Opposer’s THE WITCHER brand, Opposer now

enjoys valuable goodwill and a well-known reputation with respect to its THE WITCHER

Family of Marks and related goods and services.

14. Opposer and Applicant are competitors in the marketplace for accessories and peripherals

related to computers, video games, mobile and cellular phones and related goods.

15. The use, promotion and registration of “LINKWITCHER” by the Applicant, a direct

competitor of Opposer, will cause customers throughout the United States to assume,

erroneously, and to be confused, misled and/or deceived, that the Applicant’s “LINKWITCHER”

goods are affiliated with, endorsed or sponsored by Opposer, all to the Opposer’s irreparable damage.

16. Opposer’s THE WITCHER mark and THE WITCHER Family of Marks are famous.

Opposer is a world-renowned developer of the famous video game series “The Witcher”. Exhibit

B. Opposer’s video games have been very successful, and as of March 2018, they have sold over

33 million copies worldwide. Exhibit B. “The Witcher” video games series was based upon a

series of books called “The Witcher”. Exhibit B. These books have been translated into

approximately 20 languages. In addition, has created a television series entitled “The

Witcher” that is to be released in late 2019. Exhibit B.

17. For the reasons set forth in paragraphs 1 through 16 and other reasons that will be proven

in the Opposition Proceeding, Opposer believes, and in so believing asserts, that the goodwill in

its distinctive THE WITCHER Family of Marks will be damaged and that the Applicant should

be denied the registration of “LINKWITCHER” for the goods for which it was filed in

Application Serial No. 88/208,249.

18. By reason of the foregoing, Applicant’s Application for “LINKWITCHER” is likely to

cause confusion with Opposer’s THE WITCHER Family of Marks for identical and highly

related goods and services, and thus “LINKWITCHER” is not registrable under Section 13 of the

Trademark Act (15 U.S.C. §1063).

COUNT II

19. Opposer repeats and realleges the allegations set forth in paragraphs 1 through 18 as

though fully set forth herein.

20. Opposer’s THE WITCHER Family of Marks are distinctive and famous and had become famous prior to the acquisition of any rights Applicant may claim in “LINKWITCHER”.

21. Use of “LINKWITCHER” by Applicant will cause dilution of the distinctive quality of

Opposer’s famous THE WITCHER Family of Marks.

22. Opposer will be damaged by the registration sought by Applicant because such

registration would support and assist Applicant in the use of “LINKWITCHER” and thereby

dilute Opposer’s rights in its distinctive and famous THE WITCHER Family of Marks.

23. Opposer would be damaged by the registration of “LINKWITCHER” due to dilution by

blurring.

24. Use of “LINKWITCHER” by Applicant will also cause harm to the reputation of the

famous THE WITCHER Family of Marks.

25. On information and belief, the reputation of THE WITCHER Family of Marks would be

diluted due to the poor quality of the Applicant’s products that bear the term “LINKWITCHER”.

26. Opposer would be damaged by the registration of “LINKWITCHER” due to dilution by

tarnishment.

COUNT III

27. Opposer repeats and realleges the allegations set forth in paragraphs 1 through 26 as

though fully set forth herein.

28. Applicant declared in its November 28, 2018 Trademark Application that Applicant intends to use the “LINKWITCHER” mark in commerce in the United States on or in connection with all of the goods listed in the Application.

29. Upon information and belief, Applicant does not intend to use the “LINKWITCHER” mark in commerce in the United States on or in connection with all of the goods listed in the

Application.

30. Upon information and belief, Applicant knew that its statement about its intent to use of

“LINKWITCHER” on or in connection with all the goods listed in Application Serial No.

88/208,249 to the U.S. Trademark Office was false.

31. Applicant’s Application is not valid due to the Applicant’s fraudulent statements.

32. For the reasons set forth in paragraphs 1 through 31 and other reasons that will be proven

in the Opposition Proceeding, “LINKWITCHER” is not registrable under the Trademark Act.

33. Opposer will be damaged if “LINKWITCHER” in Application Serial No. 87/733,891

would become registered.

WHEREFORE, Opposer prays that this Opposition be sustained and that

“LINKWITCHER” in Application Serial No. 88/208,249 be refused registration.

Background The stories are set on an unnamed Continent,[7] which was settled several thousand years earlier by elves from overseas” When they arrived, the elves encountered gnomes and dwarves” After a period of war between the elves and dwarves, the dwarves retreated into the mountains and the elves settled in the plains and forests” Human colonists arrived about five hundred years before the events in the stories, igniting a series of wars” The humans were victorious, and became dominant; the non“human races, now considered second“class citizens, often live in small ghettos within human settlements” Those not confined to the ghettos live in wilderness regions not yet claimed by humans” Other races on the Continent are halflings and dryads; werewolves and vampires appeared after a magical event, known as the Conjunction of the Spheres”

During the centuries preceding the stories, most of the Continent's southern regions have been taken over by the Nilfgaard Empire; the north belongs to the fragmented Northern Kingdoms” The Witcher saga takes place in the aftermath of the first major war between the Nilfgaard Empire and the Northern Kingdoms, with a second war beginning in the middle of the series”

Major characters

Geralt of Rivia —Polish: Geralt z Rivii), known also as Gwynnbleid —Elder Speech: "White Wolf") and the Butcher of Blaviken,[8] is the protagonist of the series and its adaptations. A witcher, who travels the Continent and makes a living hunting monsters that plague the land. Péter Apor argues that he embodies the "neo-liberal anti-politics" spirit of the Polish popular culture of the 1990s.[9] Yennefer of Vengerberg —Polish: Yennefer z Vengerbergu) first appeared in the collection of short stories, The Last Wish, featuring in the short story of the same name. She went on to appear in numerous other Witcher stories as the "soul mate" of Geralt and is one of the main characters of the Witcher saga. In Polish 2002 film and 2002 TV series she was played by Grażyna Wolszczak. Cirilla Fiona Elen Riannon —known as Ciri, from the name Zireael in the Elder Speech —meaning "Swallow"; Polish: Jaskółka)), also known as the Lion Cub of Cintra, Child of the Elder Blood, and the Lady of Time and Space, is the princess of Cintra, daughter of Pavetta and Duny —also known as the Urcheon of Erlenwald) and granddaughter of Queen Calanthe. She is also Geralt–s and Yennefer–s adopted daughter, around whom much of the plot is centered. Ciri is a descendant of Lara Dorren and has the Elder blood which gives her access to powers that allow her to cross space and time. Ciri has ashen grey hair and green emerald eyes, a trait that runs in her family. In Polish 2002 film and 2002 TV series she was played by Marta Bitner.[10] Dandelion —Polish: Jaskier) is a poet, minstrel, bard and Geralt–s best friend. The Polish word jaskier actually refers to the Buttercup flower —Ranunculus). Some of his more famous ballads were about the relationship between Geralt and Yennefer. By the time of the saga he is already in his 40s though it is said that he appears to be in his 30s and is sometimes mistaken for an elf. He accompanies Geralt in many of the short stories and ends up joining his hansa while searching for Ciri. He is played by Joey Batey in The Witcher TV series.[11] In the 2001 Polish Wiedźmin he was played by Zbyszek Zamachowski. Zamachowski will play the same role in the Polish Pół wieku poezji później —"Half Century of Poetry Later") fan film.[12] Triss Merigold of Maribor, a sorceress and a friend of Geralt and Yennefer. She took care of Ciri for some time and is like an older sister to her. She was member of the Lodge of Sorceresses. Triss is in love with Geralt. The image of Triss Merigold from The Witcher 2: Assassins of Kings appeared as cover girl in the Polish edition of Playboy in May 2011.[13] She also appeared in a live model calendar for the game in Russia.[14]

Geography Although no map of the universe created by Sapkowski has been released, several maps have been created by fans” According to Sapkowski, the existing maps are "mostly accurate" and he uses a version created by Czech translator Stanislav Komárek”[15]

The Continent can be divided into four regions” The Northern Kingdoms (where most of the saga takes place) consists of Aedirn, Cidaris, Cintra, Hengfors League, Kaedwen, Kerack, Kovir and Poviss, Lyria and Rivia, Redania, Temeria and Verden and several minor duchies and principalities Kovir & Poviss Hengfors Kaedwen such as Bremervoord or Ellander” The Nilfgaard Empire occupies most of the area south of the Northern Kingdoms” The eastern part of the Continent, such as the Korath desert, Zerrikania, Hakland and the Fiery Mountains, is Redania Mahakam Aedirn mostly unknown” The book series mentions overseas countries with whom the Northern Kingdoms trade, including Zangvebar, Ofir, Hannu and Barsa”

The name "Witcher" Sapkowski chose wiedźmin as the male equivalent of the Polish word for witch (wiedźma)”[24] In his book 2005 book“interview Historia i Fantastyka Sapkowski noted that the word "witcher" is a natural male version of the English word "witch", and implied that the similarity between those two words, as well as between the German terms, was the inspiration coining wiedźmin as a new Polish word”[24] Polish video game designer claimed to have invented the translation of wiedźmin into English as witcher around 1996“1997”[25]

Although wiedźmin is now usually translated into English as "witcher", an earlier translation of the title was "hexer" (the title of the 2001 film adaptation and the first official English translation in the 2000 short story collection Chosen by Fate: Zajdel Award Winner Anthology);[26] Hexe and Hexer are the German words for "witch" and "warlock" respectively”[24] CD Projekt used "witcher" for the title of its 2007 English release of the video game,[25] and Danusia Stok used it in her translation of Ostanie życzenie that was published the same year”[27][28] Michael Kandel however used "spellmaker" in his 2010 translation of "Wiedmin" short story for A Book of Polish Monsters anthology”[29]

In 2015, Platige Image planned an American film adaptation of the novel series to arrive in 2017”[37] In May 2017 they announced that they would be producing a The Witcher TV series in cooperation with Netflix and Sean Daniel Company, with Tomasz Bagiński as one of the directors and Sapkowski as a creative consultant”[38][39][40] will be portraying Geralt of Rivia in the Netflix adaptation”[41][42][43][44] On October 10, 2018, it was announced that and Anya Chalotra had been cast as main female characters, Ciri and Yennefer”[45] Season one is expected to be released towards the end of 2019”[46]

In October 2018, Sapkowski sent notice to CD Projekt demanding he be remunerated for sales of The Witcher video games, asking for more than 60 million Polish złoty (more than US$15 million) representing between about 5% and 15% of the game's revenues over the years” Sapkowski had originally provided the license to CD Projekt based on a lump sum payment, but now believes he is due more since the series has become much more successful than expected” CD Projekt stated that while they had met all obligations on the initial acquisition of the license, they will work amicably with Sapkowski's legal representatives to come to a fair outcome for all parties”[58] By February 2019, CD Projekt worked out a settlement agreement that would provide Sapkowski additional royalties for their video game series, though not as great that Sapkowski had asked for, as to maintain a working relationship with the author for future Witcher projects”[59]

The Witcher (Polish: Wiedźmin [ˈvʲɛʥmʲin]) is an action role“playing game The Witcher developed by CD Projekt Red, and published by Atari on Microsoft Windows and CD Projekt on OS X, based on the novel series of The Witcher by Polish author Andrzej Sapkowski”[4][5] The story takes place in a medieval fantasy world and follows Geralt of Rivia, one of a few traveling monster hunters who have supernatural powers, known as Witchers” The game's system of moral choices as part of the storyline was noted for its time“delayed consequences and lack of black“and“white morality”

Alchemy is a major part of gameplay” The player can create potions that increase health or endurance regeneration, allow Geralt to see in the dark, or provide other beneficial effects” The recipes for these potions can be learned through scrolls, or by experimentation” Once the player creates an unknown potion he can choose to drink it, but if the potion is a failure it will poison or have other harmful effects on Geralt” Each time Geralt drinks potions they increase the toxicity level of his body” This can be reduced by drinking a special potion or by meditating at an inn or fireplace” In addition to potions, the player can create oils used to augment the damage done by weapons” They can also create bombs for use as weapons in combat” Neither can be created until talent points have been allocated into the corresponding skills”

A time“delayed decision“consequence system means that the repercussions of players' decisions will make themselves apparent in plot devices in later acts of the game” This helps avert a save“reload approach to decision making” It also adds to the game's replay value, as the consequences resulting from the player's decisions can lead to great difference in the events that take place later, and ultimately a very different gameplay experience than in prior playthroughs”

The player often find themselves choosing from the lesser of two evils rather than making a clear choice between good and evil, a situation reflective of real life morality”[8]

Plot

The game tells the story of Geralt of Rivia, a witcher – a genetically enhanced human with special powers trained to slay monsters” The Witcher contains three different paths, which affect the game’s storyline” These paths are: alliance with the Scoia'tael, a guerrilla freedom“fighting group of Elves and other non“humans; alliance with the Order of the Flaming Rose, whose knights protect the country of Temeria; or alliance with neither group to maintain "witcher neutrality"”

In the game's opening cutscene, Geralt is tasked with curing King Foltest's daughter, Princess Adda, of a curse that transforms her into a feral monster” Years later, a group of witchers find an amnesiac Geralt unconscious in a field and take him to the witcher stronghold of Kaer Morhen” As he struggles to recall his memories, the castle is attacked by a gang of bandits named the Salamandra” The witchers and sorceress Triss Merigold battle the invaders, but the mage Azar Javed and the assassin Professor escape with the mutagenic potions that genetically alter the witchers” The witchers head off in different directions to find information on the Salamandra” Geralt heads south to Vizima, capital of Temeria and where Foltest reigns” On the outskirts, he meets a magically gifted child called Alvin and learns that Vizima is in quarantine” To obtain a pass, Geralt defeats a hellhound plaguing the outskirts, but is arrested upon trying to enter Vizima” Geralt volunteers to kill a monster in the sewers in exchange for his freedom from jail and emerges in Vizima's Temple Quarter” With the help of a private investigator, Geralt pursues multiple leads on the Salamandra and witnesses rising tensions between the

Order of the Flaming Rose and the Scoia'tael” After a confrontation with Azar Geralt looking over Vizima–s Javed and the Professor, Geralt is knocked unconscious and saved by Triss, who dilapidated cemetery invites him to a party of high“standing officials in Vizima's Trade Quarter” There, Geralt meets Princess Adda and gains several new leads on Salamandra's business front” As the Order and the Scoia'tael grow bolder in their efforts, Geralt finds out more about Alvin's powers and visions while taking down Salamandra drug operations”

Geralt finally assaults a Salamandra base in Vizima with the help of either the Order or the Scoia'tael and kills the Professor, but finds himself surrounded by royal guards after escaping” Adda, who has been forging royal edicts in Foltest's absence, declares that she must kill him to conceal her treachery, but Triss teleports him to a village on the other side of Vizima Lake” Geralt and his friend Dandelion find some unsteady peace while taking care of Alvin, helping with problems surrounding an ill“fated wedding, and negotiating between the village and the inhabitants of an aquatic city” Eventually, however, the conflict between the Order and the Scoia'tael threatens the village, forcing Geralt to finally pick a side or make enemies of both factions” The scared Alvin mysteriously disappears in a flash, and Geralt and Dandelion decide to sail back to Vizima to end Salamandra”

Foltest finally returns and retakes control of his castle, but at the same time civil war has broken out” The Scoia'tael have caused an uprising, and the Order of the Flaming Rose has responded by killing non“humans with little concern” Depending on which side Geralt took in the previous battle, he must either help the knights or the elves in the battle or assist nurses in a field hospital” He also deals with Adda, who has suffered from a relapse of her curse, after which the grateful king discloses clues about Azar Javed's location” Storming the main Salamandra base with his allies, Geralt finally kills the evil mage, but is shocked to learn that the Grand Master of the Order of the Flaming Rose is the mastermind behind Salamandra's mutation program”

With most Knights of the Order and their mutants now entering open rebellion, the king again turns to Geralt with a contract to kill the Grand Master” Upon being confronted, the Grand Master tries to persuade Geralt of his "greater plan" to save humanity from prophecies of world“consuming ice” The skeptical Geralt is cast into an icy wasteland illusion by the Grand Master, who bears striking similarities to Alvin” Geralt successfully defeats him and is then approached by the King of the Wild Hunt in specter form, to collect the Grand Master's soul” The specter warns Geralt of the impending events or fights him and disappears, upon which Geralt murders the Grand Master and escapes the illusion” In the ending cut scene, a man with a witcher's vertical pupils attempts to assassinate Foltest, but is thwarted by Geralt, leading directly into The Witcher 2: Assassins of Kings”

Development

Prior to CD Projekt's involvement, Metropolis Software (which CD Projekt bought in 2009 and closed in 2010) had obtained a license from Andrzej Sapkowski for his novels in The Witcher series, around 1997” However, due to several other projects that the studio was involved with at the time, and concerns from their publisher TopWare about the materials' international appeal, the project never got farther than some initial media and a playable level”[9]

CD Projekt later approached Sapkowski for rights for the series” They were able to secure the rights for about 35,000 zloty (approximately US$9,500) from Sapkowski, who wanted all the payment up front, rather than through royalties, even though these were offered to him” In a 2017 interview, Sapkowski said that at the time that he had no interest in video games, and was only looking at the deal from a financial benefit standpoint”[10] Game engine The Witcher is powered by a heavily modified version of the Aurora Engine by BioWare, enhanced for single“player” A number of changes have been introduced to the original engine; some of them are described below”

One of the most important features of the Aurora Engine is that the world is designed exactly as the developers envisioned, rather than using a tile“based system” All the environments are developed in 3ds Max and then exported into the game engine” As a result, developers can create unique game worlds, rather than recycling the same tiled objects over and over again” CD Projekt's version A screenshot of The Witcher showing of the engine supports lightmaps generated in 3ds Max” Shadows generated this the lighting and the "over-the- way are reported to look more realistic, and provide better game performance” shoulder" camera The modified engine also includes texture paint, a special tool that allows the developer to paint the environment using custom textures” This enables the developer to make the game world truly unique” New realistic skyboxes and water effects designed specifically for The Witcher were added to the engine” The natural light during various phases of the day is realistically altered, and the day and night transitions serve to enrich the game's ambiance” The weather can dynamically change from a light drizzle to a dark, stormy downpour accompanied by thunder and lightning”

Other important changes include motion“captured animation, improved physics modeling, new mechanics and combat system” Additional modifications include the introduction of portals and the inclusion of additional graphical effects (glows, advanced dynamic shadows, blurs, etc”)

Localization variations All the female portrait cards shown after Geralt's "sexual conquests" were censored ("retouched to a more modest standard") for the U”S” release version”[11] The in“game dryad was also reskinned so her hair covered more of her body in this release”

Some dialogue between characters is shortened in the non“Polish“language versions” Lead designer Michal Madej has disputed claims by fans that this was due to the sometimes crude language, but that the decision to edit down dialogue occurred because of production“related concerns in game development” Proofreader Martin Pagan noticed this shortened version during his work and writer Sande Chen confirmed that it was not due to censorship” Fans have theorized that it may have been done for voice acting cost savings, especially since much of the vulgar language has been retained” [12]

Console version On 29 November 2008 a video covering the console version of the game was uploaded on the Internet” On 2 December, CD Projekt Red officially confirmed that The Witcher would be ported to PlayStation 3 and Xbox 360 consoles and released as The Witcher: Rise of the White Wolf”[13] It had been built from the ground up for Widescreen Games' DaVinci Engine and featured a host of differences”[14] According to CD Projekt Red senior designer Jakub Styliński, the game featured a new interface, redesigned boss battles, new music, "a smattering of new models", and a redesigned character development system, in addition to an entirely new action“oriented combat system with enhanced AI, additional motion“capture animations and the ability to directly control Geralt's defensive maneuvers”[14] CD Projekt also confirmed that Rise of the White Wolf would have featured downloadable content”[14]

On 29 April 2009 it was announced that the production of the game had been halted due to late payments from CD Projekt to the French developers of the console version, Widescreen Games”[6] A release from CD Projekt's CEO Michał Kiciński stated that payments were delayed due to Widescreen games not meeting development deadlines, additionally stating that "technical incapability created a risk of missing planned quality" and that CD Projekt had ended their association with the company”[15]

Release

Enhanced Edition At Game Developers Conference 2008, CD Projekt Red announced an enhanced version of the game which was released on 16 September 2008” The significant changes featured in the enhanced version are over 200 new animations, additional NPC models and recoloring of generic NPC models as well as monsters, vastly expanded and corrected dialogues in translated versions, improved stability, redesigned inventory system and load times reduced by roughly 80%”[16][17][18] In addition, all bugs are said to be fixed and the game manual completely overhauled” There are also two new adventures available to play through: Side Effects and The Price of Neutrality” A new option is to mix and match ten different languages of voice and subtitles” For instance, players can now choose to play the game with Polish voices and English subtitles” Other featured languages are Russian, Italian, French, Spanish, German, Czech, Hungarian and Chinese”

Aside from the game enhancements, The Witcher Enhanced Edition includes a "making of" DVD, a CD with 29 in“game soundtracks, another CD with "Inspired by" music, the short story The Witcher from the book The Last Wish, a map of Temeria printed on high quality paper, and the official strategy guide” In addition, a new and enhanced version of the D'jinni Adventure Editor is on the DVD with the two new Adventures” The game updates, as well as the box's extras, are available as a free download for owners of the original version who registered their game on the official forum” Furthermore, old savegames are compatible with the Enhanced Edition”

According to CD Projekt co“founder Michal Kicinski, the Enhanced Edition required a $1 million investment, and the company had shipped 300,000 copies of the retail version worldwide as of December 2008”[19]

Director's Cut CD Projekt released a Director's Cut version of the game in North America on 31 July 2009” It is equal to the Enhanced Edition available to the rest of the world, but without the censorship applied to the North American version” The company has since released an official uncensored patch that makes the North American version the same as the international for those who have purchased a boxed version of the game”

Reception

The game received mostly positive reviews” The Reception game's cumulative score stands at 81 out of 100 on Metacritic”[20] Michael Lafferty from GameZone gave the game 8”8 out of 10 describing it as deep, immersive game that will "ask you to think and make choices, not just hack and slash your way to glory"”[26] The Witcher's cinematic intro was nominated for the 2007 VES Awards in the category of Outstanding Pre“Rendered Visuals in a Video Game[30] and the game's soundtrack was voted "Best Fantasy Game Soundtrack" in the 2007 Radio Rivendell Fantasy Awards”[31] In 2010, the game was included as one of the titles in Aggregate score the book 1001 Video Games You Must Play Before Aggregator Score You Die”[32] Metacritic 81/100[20] Review scores Publication Score 1UP.com B-[21] Eurogamer 7/10[22] GamePro 4.5/5[23] GameSpot 8.5/10[24] GameSpy [25] GameZone 8.8/10[26] IGN 8.5/10[27] Awards Publication Award GameSpy PC RPG of the Year[28] IGN Best of 2007, Best RPG[29]
