The following presents a brief description of each of the soil types mapped for the subject property:

Basinger fine sand, depressional (#3) is a nearly level, very poorly drained soil found in shallow depressions and sloughs and along edges of freshwater marshes and swamps. The surface layer of this soil type generally consists of black fine sand about 7 inches thick. The water table for this soil type is above the surface for 6 to 9 months or more each year and is within 12 inches of the surface for the rest of the year. Permeability of this soil type is rapid throughout.

Candler fine sand, 0 to 5 percent slopes (#4) is a nearly level to gently sloping, excessively drained soil found on the uplands. The surface layer of this soil type generally consists of very dark grayish brown fine sand about 5 inches thick. The seasonal high water table for this soil type is at a depth of more than 80 inches. Permeability of this soil type is rapid in the surface and subsurface layers and is rapid to moderately rapid in the subsoil.

Candler fine sand, 5 to 12 percent slopes (#5) is a sloping to strongly sloping, excessively drained soil found on the uplands. The surface layer of this soil type generally consists of dark grayish brown fine sand about 4 inches thick. The seasonal high water table for this soil type is at a depth of more than 80 inches. Permeability of this soil type is rapid in the surface and subsurface layers and is rapid to moderately rapid in the subsoil.

Immokalee fine sand (#20) is a nearly level, poorly drained soil found on broad flatwoods. The surface layer of this soil type generally consists of black fine sand about 5 inches thick. In most years the seasonal high water table for this soil type is within 10 inches of the surface for 1 to 3 months. It recedes to a depth of 10 to 40 inches for more than 6 months. Permeability of this soil type is rapid in the surface and subsurface layers and in the substratum. It is moderate in the subsoil.

St. Johns fine sand (#37) is a nearly level, poorly drained soil found in broad areas on the flatwoods. The upper portion of the surface layer of this soil type generally consists of black fine sand about 7 inches thick. In most years the seasonal high water table for this soil type is within 10 inches of the surface for 6 to 12 months and between depths of 10 to 40 inches for more than 6 months. Permeability of this soil type is rapid in the surface and subsurface layers and substratum, and medium to very high in the subsoil.

Samsula-Hontoon-Basinger association, depressional (#41) are nearly level, very poorly drained soils found in freshwater swamps, depressions, sloughs and broad poorly defined drainageways. Typically the surface layer of Samsula soil is black and dark reddish brown muck about 34 inches thick. Typically the surface layer of Hontoon soil consists of black muck about 16 inches thick. Typically the surface layer of Basinger soil consists of black fine sand about 6 inches thick. During most years, the undrained areas of the soils in this map unit are ponded for 6 to 9 months or more except during extended dry periods. The permeability of Samsula and Hontoon soils is rapid. The permeability of Basinger soil is very rapid.

Sanibel muck (#42) is a nearly level, very poorly drained soil found in depressions, freshwater swamps and marshes and in poorly defined drainageways. Typically the surface layer of this soil type consists of black muck about 11 inches thick. In most years undrained areas mapped with this soil type are ponded for 6 to 9 months or more except during extended dry periods. Permeability of this soil type is rapid throughout.

Smyrna fine sand (#44) is a nearly level, poorly drained soil found on broad flatwoods. The surface layer of this soil type generally consists of black fine sand about 4 inches thick. The seasonal high water table for this soil type is within 10 inches of the surface for 1 to 4 months. It recedes to a depth of 10 to 40 inches for more than 6 months. Permeability of this soil type is rapid in the surface and subsurface layers and in the substratum. It is moderate to moderately rapid in the subsoil.

Tavares fine sand, 0 to 5 percent slopes (#46) is a nearly level to gently sloping, moderately well drained soil found on low ridges and knolls on the uplands. The surface layer of this soil type generally consists of very dark gray fine sand about 6 inches thick. The seasonal high water table for this soil type is at a depth of 40 to 80 inches for more than 6 months, and recedes to a depth of more than 80 inches during extended dry periods. Permeability of this soil type is very rapid throughout.

Tavares - Millhopper fine sands, 0 to 5 percent slopes (#47) are nearly level to gently sloping, moderately well drained soils found on low ridges and knolls on the uplands and on the flatwoods. Typically the surface layer of Tavares and Millhopper soils are dark grayish brown fine sand about 6 inches thick. The seasonal high water table for Tavares soil is at a depth of 40 to 72 inches for more than 6 months, and recedes to a depth of more than 80 inches during extended dry periods. The seasonal high water table for Millhopper soil is at a depth of 40 to 60 inches for 1 to 4 months, and recedes to a depth of 60 to 72 inches for 2 to 4 months. Permeability of Tavares soil is very rapid. Permeability of Millhopper soil is rapid in the surface and subsurface layers and is moderately rapid or moderate in the subsoil.

Zolfo fine sand (#54) is a nearly level, somewhat poorly drained soil found on broad, slightly higher positions adjacent to the flatwoods. The surface layer of this soil type generally consists of dark grayish brown fine sand about 5 inches thick. The seasonal high water table for this soil type is at a depth of 24 to 40 inches for 2 to 6 months. It is at a depth of 10 to 24 inches during periods of heavy rain. It recedes to a depth of about 60 inches during extended dry periods. Permeability of this soil type is rapid in the surface and subsurface layers and is moderate in the subsoil.

The Florida Association of Environmental Soil Scientists (FAESS) considers Basinger fine sand, depressional (#3), Samsula-Hontoon-Basinger association, depressional (#41), and Sanibel muck (#42) to be hydric soil types. Also, the FAESS considers the inclusions present in Immokalee fine sand (#20), St. Johns fine sand (#37), and Smyrna fine sand (#44) to be hydric. This information can be found in the Hydric Soils of Florida Handbook, Third Edition (March, 2000).

LAND USE TYPES/VEGETATIVE COMMUNITIES

The Orange Lake Sites currently supports ten (10) land use type/vegetative communities within it’s boundaries (Figure 5). These land use types were identified utilizing the Florida Land Use, Cover and Forms Classification System, Level III (FLUCFCS, FDOT, January 1999) (Figure 5). The uplands within the subject property consist of Abandoned Groves (224), Pine Flatwoods (411), Pine – Mesic Oak (414), Xeric Oak (421), Disturbed Lands (740), and Roads and Highways (814). The wetland/surface water types identified within the subject property include Bay Swamps (611), Willow and Elderberry (618), Wetland Forested Mixed (630), and Freshwater Marshes (641). The following provides a brief description of the land use type/vegetative community identified on the site:

Uplands:

224 Abandoned Groves

The majority of the upland area on the subject property consists of a former citrus grove which is most consistent with the Abandoned Groves (224) FLUCFCS classification. Vegetative species identified within the grove consists of citrus (Citrus spp.), Chinaberry tree (Melia azedarach), cabbage palm (Sabal palmetto), blue mistflower (Conoclinium coelestinum), pricklypear cactus (Opuntia humifusa), lantana (Lantana camara), hairy indigo (Indigofera hirsute), bahiagrass (Paspalum notatum), dogfennel (Eupatorium capillifolium), American pokeweed (Phytolacca americana), purple passionflower (Passiflora incarnate), rose natalgrass (Melinis repens), coastalplain goldenaster (Chrysopsis scabrella), common ragweed (Ambrosia artemisiifolia), beggarticks (Bidens alba), southern sandbur (Cenchrus echinatus), guinea grass (Panicum maximum), balsampear (Momordica charantia), muscadine grapevine (Vitis rotundifolia), blackberry (Rubus spp.) and greenbriar (Smilax spp.).

411 Pine Flatwoods

The wooded upland areas in the southwestern portion of the subject site are most consistent with the Pine Flatwoods (411) FLUCFCS classification. The vegetative species identified in these areas include laurel oak (Quercus laurifolia), slash pine (), saw palmetto (Serenoa repens), wax myrtle (Myrica cerifera), black cherry (Prunus serotina), camphor (Cinnamomum camphora), broomsedge (Andropogon virginicus), cabbage palm (Sabal palmetto), lantana (Lantana camara), muscadine grapevine (Vitis rotundifolia), blackberry (Rubus spp.), passion flower (Passiflora incarnata), shiny blueberry (Vaccinium myrsinites), elderberry (Sambucus canadensis), greenbriar (Smilax spp.) and common persimmon (Diospyros virginiana).

414 Pine – Mesic Oak

The upland island located in the central/northern area of the project site is most consistent with the Pine – Mesic Oak (414) FLUCFCS classification. The vegetative species identified in this area includes an interior canopy of longleaf pine (Pinus palustris), and live oak (Quercus virginiana), with scattered sand live oak (), turkey oak (), and slash pine (Pinus elliottii), trees. The understory consists of saw palmetto (Serenoa repens), gallberry (Ilex glabra), fetterbush (Lyonia lucida), wax myrtle (Myrica cerifera), staggerbush (), myrtle oak (Quercus myrtifolia), garberia (Garberia heterophylla), blackberry (Rubus spp.), winged sumac (Rhus copallinum), passion flower (Passiflora incarnata), shiny blueberry (Vaccinium myrsinites), vanillaleaf (Carphephorus odoratissimus), Florida bluestem (Andropogon floridanus), Virginia chain fern (Woodwardia virginica), reindeer lichen (Cladonia rangiferina), St. John’s wort (hypericum spp.), cogongrass (Imperata cylindrical), and greenbrier (Smilax spp.).

421 Xeric Oak

The area north of Hartzog Road and adjacent to the abandoned groves is most consistent with the Xeric Oak (421) FLUCFCS classification. Vegetative species identified in this community type include live oak (Quercus virginiana), turkey oak (Quercus laevis) bracken fern (Pteridium aquilinum), gallberry (Ilex glabra), saw palmetto (Serenoa repens), broomsedge (Andropogon virginicus), dogfennel (Eupatorium capillifolium), Virginia creeper (Parthenocissus quinquefolia), reindeer lichen (Cladina rangiferina), fetterbush (Lyonia lucida), wax myrtle (Myrica cerifera), muscadine grapevine (Vitis rotundifolia), greenbrier (Smilax spp.), and blackberry (Rubus cuneifolius),

740 Disturbed Lands

The area in the south and adjacent to Orange Lake Resorts is most consistent with the Disturbed Lands (740) FLUCFCS classification. This area is currently being used to dispose of landscape debris form the Orange Lake Resorts. Vegetation identified within this area includes paper mulberry (Broussonetia papyrifera), live oak (Quercus virginiana), winged sumac (Rhus copallinum), black cherry (Prunus serotine), hairy indigo (Indigofera hirsute), American pokeweed (Phytolacca americana), purple passionflower (Passiflora incarnate), rose natalgrass (Melinis repens), coastalplain goldenaster (Chrysopsis scabrella), common ragweed (Ambrosia artemisiifolia), beggarticks (Bidens alba), southern sandbur (Cenchrus echinatus), guinea grass (Panicum maximum), balsampear (Momordica charantia) caesarweed (Urena lobata), muscadine grapevine (Vitis rotundifolia), greenbrier (Smilax spp.), and dogfennel (Eupatorium capillifolium).

814 Roads and Highways

The project site includes Hartzog Road running east-west and forms the southeastern and eastern project boundary. Bahiagrass (Paspalum notatum) and dogfennel (Eupatorium capillifolium) were the only vegetative species found along the shoulder of Hartzog Road.

Wetlands:

611 Bay Swamps

The southwestern edges of the project site contain wetlands most consistent with the Bay Swamps (611) FLUCFCS classification. Vegetation observed here includes loblolly bay (Gordonia lasianthus), slash pine (Pinus elliottii), wax myrtle (Myrica cerifera), red maple (Acer rubrum), Peruvian primrosewillow (Ludwigia peruviana), fetterbush (Lyonia lucida), galberry (Ilex glabra), elderberry (Sambucus nigra), Carolina willow (Salix caroliniana), spikerush (Eleocharis spp.), southern beaksedge (Rhynchospora microcarpa), St. John’s wort (Hypericum spp.), laurel greenbrier (Smilax laurifolia), muscadine grapevine (Vitis rotundifolia), blackberry (Rubus pensilvanicus), yellow milkwort (Polygala rugelii), southern shield fern (Thelypteris kunthii), cinnamon fern (Osmunda cinnamomea), royal fern (Osmunda regalis), and sphagnum moss (Sphagnum spp.).

618 Willow and Elderberry

There is a small depressional area filled with willows in the northeast area of the southwestern abandoned grove that is most consistent with the Willow and Elderberry (618) FLUCFCS classification. Vegetated species identified include Carolina willow (Salix caroliniana), wax myrtle (Myrica cerifera), elderberry (Sambucus anadensis), blackberry (Rubus cuneifolius), greenbriar (Smilax spp.), dogfennel (Eupatorium capillifolium) and muscadine grape (Vitis rotundifolia).

630 – Wetland Forested Mixed

The northern most wetland community is most consistent with the Wetland Forested Mixed (630) FLUCFCS classification. Vegetative species identified within this land use type include bald cypress (Taxodium distichum), sweetbay magnolia (Magnolia virginiana), loblolly bay (Gordonia lasianthus), dahoon holly (Ilex cassine), black gum (Nyssa sylvatica), dahoon holly (Ilex cassine), pond pine (Pinus serotina), water oak (Quercus nigra), maleberry (Lyonia ligustrina), fetterbush (Lyonia lucida), wax myrtle (Myrica cerifera), Florida dropseed (Sporobolus floridanus), swamp fern (Blechnum serrulatum), greenbriar (Smilax spp.), Virginia chain fern (Woodwardia virginica), netted chain fern (Woodwardia areolata), cinnamon fern (Osmunda cinnamomea), muscadine grape (Vitis rotundifolia), duckweed (Lemna minor) and soft rush (Juncus effusus).

641 Freshwater Marshes

The wetland adjacent to the abandoned groves and upland island is most consistent with the Freshwater Marshes (641) FLUCFCS classification. The vegetation includes islands of loblolly bay (Gordonia lasianthus), with predominant species of bushy bluestem (Andropogon glomeratus), alligatorflag (Thalia geniculata), winged sumac (Rhus copallinum), cattail (Typha spp.), wax myrtle (Myrica cerifera), Peruvian primrosewillow (Ludwigia peruviana), water oak (Quercus nigra), pond pine (Pinus serotina), slash pine (Pinus elliottii), southern shield fern (Thelypteris kunthii), pale meadowbeauty (Rhexia mariana), softrush (Juncus effusus), maidencane (Panicum hemitomon), laurel greenbrier (Smilax laurifolia), highbush blueberry (Vaccinium corymbosum), southern beaksedge (Rhynchospora microcarpa), muscadine grapevine (Vitis rotundifolia), and blackberry (Rubus pensilvanicus).

PROTECTED SPECIES

Using methodologies outlined in the Florida’s Fragile Wildlife (Wood, 2001); Measuring and Monitoring Biological Diversity Standard Methods for Mammals (Wilson, et al., 1996); Wildlife Methodology Guidelines (1988); and Florida Fish and Wildlife Conservation Commission’s (FFWCC) Gopher Tortoise Permitting Guidelines (revised April 2013); a cursory assessment for “listed” floral and faunal species was conducted at the site in September 2015 (Figure 6). This assessment included both direct observations and indirect evidence, such as tracks, burrows, tree markings and birdcalls that indicated the presence of species observed. The assessment focused on species that are “listed” by the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (January 2013) that have the potential to occur in Orange County (See attached Table 1).

Two (2) of the above mentioned species are listed in the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (September 2013). The species are the gopher tortoise (Gopherus polyphemus) and the Florida Sandhill Crane (Grus canadensis pratensis). The following provides a brief description of these species.

Gopher Tortoise (Gopherus polyphemus) State Listed as “Threatened”

Currently the gopher tortoise (Gopherus polyphemus) is classified as a “Category 2 Candidate Species” by the U.S. Fish and Wildlife Service (USFWS), and as of September 2007 is now classified as “Threatened” by FFWCC, and as “Threatened” by FCREPA. The basis of the “Threatened” classification by the FFWCC for the gopher tortoise is due to habitat loss and destruction of burrows. Gopher tortoises are commonly found in areas with well-drained soils associated with the pine flatwoods, pastures and abandoned orange groves. Several other protected species known to occur in Lake County have a possibility of occurring in this area, as they are gopher tortoise commensal species. These species include the eastern indigo snake (Drymarchon corais couperi), Florida mouse (Podomys floridanus) and the gopher frog (Rana capito). However, none of these species were observed during the survey conducted.

The subject property was surveyed for the existence of gopher tortoises through the use of vechicular and pedestrian transects (Figure 6). The survey covered approximately 85% of the suitable habitat present within the subject property boundaries. Eleven (11) active/inactive gopher tortoise burrows were observed and recorded using GPS technology. As such, a formal gopher tortoise survey will need to be conducted on-site and a resolution of the gopher tortoise issue will need to be permitted through FFWCC prior to any construction activities.

Florida Sandhill Crane (Grus canadensis pratensis) State Listed as “Threatened” by FFWCC

The Florida Sandhill Crane is a subspecies of Sandhill Crane that occurs exclusively and is resident to Florida (Stys 1997). Of the six (6) subspecies of Sandhill Crane, the Greater Sandhill Crane (Grus canadensis tabida) is the only other subspecies of Sandhill Crane that occurs regularly in Florida (Stys 1997). This subspecies is a winter migrant, arriving in Florida during late fall (October/November) and leaving in late February (Stys 1997). Since the Florida Sandhill Crane and Greater Sandhill Crane cannot be distinguished from one another in the field, Stys (1997) recommends conducting surveys between May and September to validate the presence of this protected species. However, due to the time of year this survey was conducted (June), it can be assumed that the observed cranes were the State listed subspecies.

Three (3) adult cranes were observed foraging along Hartzog Road, but no nests were identified within or in close proximity to the subject site. If nesting does occur, FFWCC typically requires a 400-foot buffer around nests in order to prevent nest disturbance and potential nest abandonment. Since cranes do not re-use the same nest year after year this 400-foot buffer is only temporary during the nesting season (i.e., anytime from January through June). Since no nests were observed on-site or nearby, there will be no development constraints unless a nest is found.

Bald Eagle (Haliaeetus leucocephalus) State protected by F.A.C. 68A-16.002 and federally protected by both the Migratory Bird Treaty Act (1918) and the Bald and Golden Eagle Protection Act (1940)

In August of 2007, the USFWS removed the Bald Eagle from the list of federally endangered and threatened species. Additionally, the Bald Eagle was removed from FFWCC’s imperiled species list in April of 2008. Although the Bald Eagle is no longer protected under the Endangered Species Act, it is still protected under the Bald and Golden Eagle Protection Act, the Migratory Bird Treaty Act, and FFWCC’s Bald Eagle rule (Florida Administrative Code 68A- 16.002 Bald Eagle (Haliaeetus leucocephalus)).

In May of 2007, the USFWS issued the National Bald Eagle Management Guidelines. In April of 2008, the FFWCC adopted a new Bald Eagle Management Plan that was written to closely follow the federal guidelines. Under FFWCC’s new management plans, buffer zones are recommended based on the nature and magnitude of the project or activity. The recommended protective buffer zone is 660 feet or less from the nest tree, depending on what activities or structures are already near the nest. A FFWCC Eagle permit is not needed for any activity occurring outside of the 660-foot buffer zone. No activities are permitted within 330 feet of a nest during the nesting season, October 1 through May 15 or when eagles are present at the nest.

In addition to the on-site evaluation for “listed” species, BTC conducted a review for any FFWCC recorded Bald Eagle nests on or in the vicinity of the subject property (See Attached). This review revealed one Bald Eagle nest located within two (2) miles of the subject property (Nest ID OS193). As the project site boundary lies well outside the 660 foot buffer, there should be no constraints with respect to the Bald Eagle.

The environmental limitations described in this document are based on observations and technical information available on the date of the on-site evaluation. This report is for general planning purposes only. The limits of any on-site wetlands/surface waters can only be determined and verified through field delineation and/or on-site review by the pertinent regulatory agencies.
