(BTC) conducted an environmental assessment of the approximately 17.7-acre Cypress Point Site. This site is located northeast of the intersection of Lake Street and Ruby Lake Road; within Section 15, Township 24 South, Range 28 East in Orange County, Florida (Figures 1, 2 and 3). The environmental assessment included the following elements: • Review of soil types mapped within the site boundaries; • Evaluation of land use types/vegetative communities present; and, • Field review for occurrence of protected flora and fauna. SOILS According to the Soil Survey of Orange County, Florida, prepared by the U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS), two (2) soil types occur within the subject property boundaries (Figure 4). These soil types include the following: Chad O’Brien, Bering I, LLC Cypress Point Site – Orange County, FL Environmental Assessment (BTC File #925-02) Page 2 of 9 • Pomello fine sand, 0 to 5 percent slopes (#34) • Smyrna fine sand (#44) The following presents a brief description of each of the soil types mapped for the subject property: Pomello fine sand, 0 to 5 percent slopes (#34) is a nearly level to gently sloping, moderately well drained soil found on low ridges and knolls on the flatwoods. The surface layer of this soil type generally consists of gray fine sand about 3 inches thick. In most years, the seasonal high water table for this soil type is at a depth of 24 to 40 inches for 1 to 4 months and recedes to a depth of 40 to 60 inches during dry periods. Permeability of this soil type is very rapid in the surface and subsurface layers, moderately rapid in the subsoil, and rapid in the substratum. Smyrna fine sand (#44) is a nearly level, poorly drained soil found on broad flatwoods. The surface layer of this soil type generally consists of black fine sand about 4 inches thick. The seasonal high water table for this soil type is within 10 inches of the surface for 1 to 4 months. It recedes to a depth of 10 to 40 inches for more than 6 months. Permeability of this soil type is rapid in the surface and subsurface layers and in the substratum. It is moderate to moderately rapid in the subsoil. The Florida Association of Environmental Soil Scientists (FAESS) considers inclusions present within Smyrna fine sand (#44) soil to be hydric. This information can be found in the Hydric Soils of Florida Handbook, Third Edition, March 2000. LAND USE TYPES/VEGETATIVE COMMUNITIES The Cypress Point Site currently supports four (4) land use types/vegetative communities. The upland land use types/vegetative communities on the site are classified as Residential, Low Density (110), Open Land (190), Pine–Mesic Oak (414) and Sand Live Oak (432). No wetland or surface water land use types/vegetative communities were identified on the subject property. These areas were mapped using the Florida Land Use, Cover and Forms Classification System, Level III (FLUCCS, FDOT, 1999) (Figure 5). The following provides a brief description of the land use types/vegetative communities identified on the site: Chad O’Brien, Bering I, LLC Cypress Point Site – Orange County, FL Environmental Assessment (BTC File #925-02) Page 3 of 9 Uplands: 110 Residential, Low Density A small portion of the eastern portion of the subject property consists of a single-family home site which would be considered Residential, Low Density (110), per the FLUCFCS. Vegetation observed within this area during the assessment include bahiagrass (Paspalum notatum), Bermuda grass (Cynodon dactylon), Spanish needles (Bidens alba), ragweed (Ambrosia artemisiifolia), dogfennel (Eupatorium capillifolium), beggar ticks (Bidens alba), blackberry (Rubus cuneifolius), gopher apple (Licania michauxii), and Mexican clover (Richardia brasiliensis). 190 Open Land A small portion of the northwest portion of the subject property consists of Open Land (190), per the FLUCFCS. Vegetation observed within this area during the assessment include bahiagrass (Paspalum notatum), Bermuda grass (Cynodon dactylon), Spanish needles (Bidens alba), ragweed (Ambrosia artemisiifolia), American beautyberry (Callicarpa americana), dogfennel (Eupatorium capillifolium), shiny blueberry (Vaccinium myrsinites), beggar ticks (Bidens alba), blackberry (Rubus cuneifolius), flattop goldenrod (Euthamia graminifolia), gopher apple (Licania michauxii), and Mexican clover (Richardia brasiliensis). 414 – Pine – Mesic Oak The upland land use on the western portion of the subject site is most consistent with the Pine – Mesic Oak (414) FLUCFCS classification. Vegetative species identified within this community consists of laurel oak (Quercus laurifolia), slash pine (Pinus elliottii), black cherry (Prunus serotina), winged sumac (Rhus copallinum), saw palmetto (Serenoa repens), American beautyberry (Callicarpa americana), dogfennel (Eupatorium capillifolium), shiny blueberry (Vaccinium myrsinites), beggar ticks (Bidens alba), blackberry (Rubus cuneifolius), flattop goldenrod (Euthamia graminifolia), gopher apple (Licania michauxii), bahiagrass (Paspalum notatum), bracken fern (Pteridium aquilinum var. pseudocaudatum), cogon grass (Imperata cylindrica), broomsedge (Andropogon virginicus), greenbriar (Smilax spp.), Virginia creeper (Parthenocissus quinquefolia), sword fern (Nephrolepis brownii), and caesarweed (Urena lobata). This land use type/vegetative community would be classified as Sand Live Oak (432), per the FLUCFCS. Existing vegetation present within this community includes sand live oak (Quercus geminata), myrtle oak (Quercus myrtifolia), saw palmetto (Serenoa repens), prickly pear cactus (Opuntia humifusa), muscadine grapevine (Vitis rotundifolia), Eastern bracken fern (Pteridium aquilinum), skyblue lupine (Lupinus diffusus), and Florida rosemary (Ceratiola ericoides). PROTECTED SPECIES Using methodologies outlined in the Florida’s Fragile Wildlife (Wood, 2001); Measuring and Monitoring Biological Diversity Standard Methods for Mammals (Wilson, et al., 1996); and Florida Fish and Wildlife Conservation Commission’s Gopher Tortoise Permitting Guidelines (revised January 2017); an assessment for “listed” floral and faunal species was conducted at the site on October 4, 2018. This assessment, which covered approximately 100% of the subject site’s developable area, included both direct observations and indirect evidence, such as tracks, burrows, tree markings and vocalizations which indicated the presence of species observed. The assessment focused on species that are “listed” by the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (updated May 2017) that have the potential to occur in Orange County. The following is a list of those wildlife species identified on the property during the on-site evaluation: Reptiles and Amphibians: black racer (Coluber constrictor) brown anole (Norops sagrei) gopher tortoise (Gopherus polyphemus) green anole (Anolis carolinensis) rat snake (Pantherophis alleghaniensis) Birds: Black Vulture (Coragyps atratus) Blue Jay (Cyanocitta cristata) Carolina Wren (Thryothorus ludovicianus) Mourning Dove (Zenaida macroura) Northern Mockingbird (Mimus polyglottos) Chad O’Brien, Bering I, LLC Cypress Point Site – Orange County, FL Environmental Assessment (BTC File #925-02) Page 5 of 9 Northern Cardinal (Cardinalis cardinalis) Turkey Vulture (Cathartes aura) Mammals: common raccoon (Procyon lotor) eastern gray squirrel (Sciurus carolinensi) nine-banded armadillo (Dasypus novemcinctus) Virginia opossum (Didelphis virginiana) One (1) species was observed on the subject property during the site visit that is listed in the FFWCC’s Official Lists - Florida’s Endangered Species, Threatened Species and Species of Special Concern (January 2013). The listed species identified on site is the gopher tortoise (Gopherus polyphemus); The following provides a brief description of these species and potential species as they relate to development of the property. Gopher Tortoise (Gopherus polyphemus) State Listed as “Threatened” Currently the gopher tortoise (Gopherus polyphemus) is classified as a “Category 2 Candidate Species” by USFWS, and as of September 2007 is now classified as “Threatened” by FFWCC, and as “Threatened” by FCREPA. The basis of the “Threatened” classification by the FFWCC for the gopher tortoise is due to habitat loss and destruction of burrows. Gopher tortoises are commonly found in areas with well-drained soils associated with pine flatwoods, pastures and abandoned orange groves. Several other protected species known to occur in Orange County have a possibility of occurring in this area, as they are gopher tortoise commensal species. These species include the eastern indigo snake (Drymarchon corais couperi), Florida mouse (Podomys floridanus) and the gopher frog (Rana capito). However, none of these species were observed during the survey conducted. The FFWCC provides three (3) options for developers that have gopher tortoises on their property. SUMMARY OF TEXT & PURPOSE FOR THE PPG: This document provides management guidelines for the restoration and management of oak and rosemary scrub habitats in peninsular Florida, defined as the mainland south of an imaginary line from Cedar Key to Jacksonville. These guidelines do not address management of scrub in the panhandle, which differs from that in the peninsular scrub. If followed, these guidelines should benefit most peninsular scrub plant and animal species. Conserving the full suite of species characteristic of scrub requires (1) understanding how a property fits into the regional context for different species and (2) managing for spatial and temporal variability at the local level to create a mosaic of habitat conditions. In oak scrub, managing in a way that benefits the Florida scrub-jay benefits much of scrub-specialized plants and animals, which require a patchy mosaic of low vegetation and open patches of bare sand. In addition to providing habitat management guidelines targeted at Florida scrub-jays, this document contains species-specific management recommendations for state and federally listed species and species of conservation concern. By managing for heterogeneity at local and regional scales, the habitat needs of the complete suite of scrub species can be met, even though the needs of some species are not perfectly aligned with those of the Florida scrub-jay.
