This case arises out of a conspiracy of the RwanDan government anD defendants GainJet and Constantin Niyomwungere to engage in the unlawful extradition, arbitrary Detention, anD torture of Paul Rusesabagina. Mr. Rusesabagina is a lawful permanent resident of the UniteD States anD internationally acclaimed hero anD human rights activist. His efforts to save over 1,200 Rwandans from the 1994 genocide inspired the Academy AwarD nominateD film, Hotel RwanDa. Mr. Rusesabagina has become yet another victim of RwanDan President Paul Kagame’s practice of silencing political opponents and arbitrarily detaining them under the pretext of “terrorism.” 2. Mr. Rusesabagina is no terrorist. His life’s work is DeDicateD to bringing peace and democracy to Rwanda and motivating governments, non- governmental organizations, and ordinary people to work together to prevent genocide throughout the world. As a testament to his dedication to human rights anD a life of helping others, Mr. Rusesabagina has received numerous awarDs, incluDing the UniteD States Presidential MeDal of FreeDom in 2005, the nation’s highest civilian accolade. 3. As a natural consequence of his pursuit of human rights in Africa, Mr. Rusesabagina became a staunch critic of PresiDent Paul Kagame’s government anD 5 Case 5:20-cv-01422 Document 1 Filed 12/14/20 Page 6 of 90 its abuses against the RwanDan people. Mr. Rusesabagina became a target of Mr. Kagame in the early nineties, after he refused a position in Kagame’s government. He then became a prime target after the release of the movie Hotel RwanDa, when Mr. Rusesabagina publisheD his autobiography expressing concerns about human rights abuses by the RwanDan government. Targeting of Mr. Rusesabagina increaseD as he became an internationally known humanitarian anD continueD to speak out against RwanDan government human rights abuses, incluDing when Mr. Rusesabagina spoke in support of the UniteD Nations’ Mapping Report in 2010. That report concluDeD that PresiDent Kagame anD his government are responsible for war crimes anD crimes against humanity in the Congo. The report also argues that there is enough evidence to investigate whether genocide is being committeD by Rwandan forces against Hutu refugees in the Congo. 4. As a result of these criticisms of Kagame and his government, Mr. Rusesabagina became the subject of harassment, threats against his life, at least one assassination attempt anD a Decades-long smear campaign by Mr. Kagame’s government and its state-run meDia. As Mr. Rusesabagina himself wrote, “there is no greater gift to an insecure leader that quite matches a vague enemy who can be used to whip up fear and hatred among the population.” Since 2005 Mr. Kagame 6 Case 5:20-cv-01422 Document 1 Filed 12/14/20 Page 7 of 90 has trieD to paint Mr. Rusesabagina as a “false hero” and has frauDulently labelleD him a “terrorist” and “funder of terrorists” without any basis whatever in fact. 5. This case arose after Mr. Kagame’s attacks culminated in late August 2020, when RwanDan officials, in conspiracy with defendants GainJet anD Niyomwungere, executeD a covert mission to silence Mr. Rusesabagina permanently. 6. Tapping into Mr. Rusesabagina’s commitment to humanitarianism, GainJet, Niyomwungere, anD RwanDan operatives hooDwinked Mr. Rusesabagina into leaving his home in San Antonio, Texas anD flying to Dubai, UniteD Arab Emirates. DefenDant Niyomwungere tolD Mr. Rusesabagina that he was then going to boarD a private plane in Dubai to fly to Burundi, where he believed he was going to speak at churches anD public gatherings about his experiences with genociDe. 7. Unbeknownst to Mr. Rusesabagina, DefenDant Niyomwungere was a RwanDan government operative, anD DefenDant GainJet, which owns anD operates the private plane that Mr. Rusesabagina boarded in Dubai, has close ties with the RwanDan government anD PresiDent Kagame personally. Paul Rusesabagina was arrested in Rwanda on August 31, 2020, and he is being tried for terrorism in Rwandan criminal courts. Since his arrest, a number of news outlets, social media, human rights organizations, and com- mentators have consistently referred to him as “Hotel Rwanda hero” without going beyond that label created by a fictional movie and so conveniently without mentioning the real reason of his arrest and trial. The heroism attributed to Paul Rusesabagina was created by the 2004 Hollywood movie Hotel Rwanda, in which the main character allegedly saved 1 2 more than 1200 Tutsi who had sought refuge at Hôtel des Mille Collines du- ring the Genocide against the Tutsi. As a work of art and a call of worldwide attention to the genocide, the movie was effective but the characterization of Rusesabagina as a hero has been discredited.

What happened in Rwanda in 1994? The standard line is that a calculated genocide occurred because of deep-seated tribal animosity between the majority Hutu tribe in power and the minority Tutsis. According to this story, at least 500,000 and perhaps 1.2 million Tutsis—and some ‘moderate’ Hutus—were ruthlessly eliminated in a few months, and most of them were killed with machetes. The killers in this story were Hutu hard-liners from the Forces Armees Rwandais, the Hutu army, backed by the more ominous and inhuman civilian militias—the Interahamwe—“those who kill together.” “In three short, cruel months, between April and July 1994,” wrote genocide expert Samantha Power on the 10th anniversary of the genocide, “Rwanda experienced a genocide more efficient than that carried out by the Nazis in World War II. The killers were a varied bunch: drunk extremists chanting ‘Hutu power, Hutu power’; uniformed soldiers and militia men intent on wiping out the Tutsi Inyenzi, or ‘cockroaches’; ordinary villagers who had never themselves contemplated killing before but who decided to join the frenzy.” [1] The award-winning film Hotel Rwanda offers a Hollywood version and the latest depiction of this cataclysm. Is the film accurate? It is billed as a true story. Did genocide occur in Rwanda as it is widely portrayed and universally imagined? With thousands of Hutus fleeing Rwanda in 2005, in fear of the Tutsi government and its now operational village genocide courts, is another reading of events needed? Noriega, Chair There is little doubt of the fundamental impact of the 1994 Rwanda genocide on the country's social structure and cultural production, but the form that these changes have taken remains ignored by contemporary media scholars. Since this time, the need to identify the the particular industrial structure, political economy, and discursive slant of Rwandan “post- genocidal” media has become vital. The Rwandan government has gone to great lengths to construct and promote reconciliatory discourse to maintain order over a country divided along ethnic lines. Such a task, though, relies on far more than the simple state control of media message systems (particularly in the current period of media deregulation). Instead, it requires a more complex engagement with issues of self-censorship, speech law, public/private industrial regulation, national/transnational production/consumption paradigms, and post-traumatic media theory. POTENTIAL SENTENCE A TrialWatch report, by Mr. Robertson and the American Bar Association Center for Human Rights, finds numerous violations of Life imprisonment Paul Rusesabagina’s rights. These include denial of the facilities necessary for him to prepare his defense and violation of his right to confidential communication with his lawyers. The report stresses that TRIAL MONITOR although Mr. Rusesabagina has withdrawn from the trial, it remains essential that his fair trial rights be protected. The report calls into American Bar Association question the fairness of any convicting verdict. Center for Human Rights Trials in absentia require scrupulous respect for defendants’ rights. However, Geoffrey Robertson QC said: “The trial of Paul Rusesabagina has degenerated into a ‘show trial,’ in which no challenge is permitted to undermine the state’s story.” He explained: • “Even before Mr. Rusesabagina withdrew, the court protected a key witness by disallowing cross-examination and refusing even to require him to testify on oath. He has had no contact with his family, authorized legal counsel, or Belgian diplomats, since Thursday, August 27. The Rwandan Government has not provided proof of life since Monday, August 31, when the authorities in Kigali paraded Mr. Rusesabagina in handcuffs in front of the media.     DEAR EDUCATOR, In 1994 almost one million people were killed in a systematic genocide in the central African country of Rwanda. As the world stood by, a handful of brave, resourceful and inspiring individuals did all they could to save Rwandans from brutal deaths. Paul Rusesabagina, whose story is portrayed in the powerful and hopeful film Hotel Rwanda, reminds all of us what one person can accomplish when moved to act. Hotel Rwanda addresses a horrific issue: genocide. This is a difficult and upsetting topic. Yet, as the film shows, while people and governments chose to ignore the 1994 Rwandan genocide, one individual bravely risked his life and stood up to the horror, calling upon all of his resources to first save his family, then ended up saving 1,268 helpless refugees. Terry George, Hotel Rwanda’s director, takes us on Paul’s journey, showing the country’s struggle and how the world turned a blind eye. He leads us in the end to a place of hope and promise. The enclosed teacher’s guide, a companion piece to the film, is produced by Amnesty International USA in cooperation with United Artists. This guide is intended for use by high school age students and can be used in the traditional classroom or a community setting. The accusations come on the heels of physical harassment. While they are baseless, I feel I must respond. The government has said that I sent money to people who I met many years ago but have not seen or spoken with since the Genocide in 1994. I have not sent money to the Commercial Bank of Burundi or Dar es Salaam The last time I sent money to Rwanda was in 2002 or 2003, I think 2002, to my younger brother for a brain operation. It was about 500 or 1000 Euros. Prosecutor Ngoga said that no matter how small the money amount was, it was used for terrorist purposes. I have sent no money to terrorists. On top of everything, no one has ever heard of this alleged terrorist group he accuses me of funding until Victoire’s false arrest in the past few weeks, yet the money he accuses me of sending he says was sent more than a year ago. He is not only lying, but lying with bad logic. I have been been supportive of an open political process in Rwanda. My support for Victoire Ingabire, along with all of the opposition candidates of all parties has been through press releases issued by my Foundation advocating the need for free and fair and open elections without violence or repression of human rights and political freedoms.

    VULNERABLE POPULATIONS: INTERNATIONAL COMMUNITY RESPONSIBILITIES World Meteorological Organization, Geneva, Switzerland Monday, October 31, 2005 SPEAKERS’ BIOGRAPHIES KEYNOTE ADDRESS: ERNESTO ZEDILLO, Ph.D., Director, Center for the Study of Globalization, Yale University Ernesto Zedillo is the Director of the Center for the Study of Globalization and Professor in the Field of International Economics and Politics at Yale University. He was President of Mexico from December 1994 to December 2000. He earned his undergraduate degree at the National Polytechnic Institute of Mexico and his master and doctoral degrees at Yale University. After leaving office, Mr. Zedillo became Chairman of the UN High Level Panel on Financing for Development and was a Distinguished Visiting Fellow at the London School of Economics. He served as Co- Coordinator of the UN Millennium Project Task Force on Trade and was Co- Chairman of the UN Commission on the Private Sector and Development along with Prime Minister Paul Martin of Canada. He is currently Chair of the Global Development Network and Co-Chairman of the International Task Force on Global Public Goods. In April he was appointed by the UN Secretary-General to serve as his Envoy for the upcoming September 2005 Summit in which heads of state and government will review implementation of the Millennium Declaration. Mr. Zedillo is a member of the Trilateral Commission, serves on the International Advisory Board of the Council on Foreign Relations and the Board of Directors of the Institute for International Economics and is a trustee of the World Economic Forum.
