  • The Barroom Door Swings Both Ways (09/17/20)
The Barroom Door Swings Both Ways (09/17/20) When I started practicing law, we brought many due process challenges to the actions of government. Due process is found in the Fifth Amendment to the United States Constitution. The Fourteenth Amendment, according to the United States Supreme Court jurisprudence imposed due process requirements on the states. An individual is entitled to a fair and impartial hearing from the government when the citizen is deprived of his or her rights. With the evolution of the law from the mid-1970s into the new century, due process was given less respect. Akin to due process is what is sometimes referred to in the law as “substantive” due process. This concept requires the government to act in a rational fashion, and to make decisions that have a discernible relationship to the issues confronting government. The courts routinely dismissed due process and rational relationship claims. The courts gave the government the benefit of a very high hurdle that no horse could jump. The courts said that government actions are “presumed” to be constitutional. It was necessary that there be proof of an intent to deprive a person of constitutional liberties. If the courts could find any articulable “rational relationship” between the harm and government action, the complaining citizen was thrown out of court. Successful due process and rational relationship substantive due process claims became rare. At the same time that hurdles to Fifth and Fourteenth Amendment claims were being erected, the First Amendment was being used to prevent the government from impinging upon the First Amendment religious rights of others.

Week of May 16th, 1966 25CENTS CJCA GOES All MOUES! Edmonton: Monday May 2, CJCA became the first Canadian radio station to go all request, 24 hours each day 7 days a week. Certain telephone funlines (request lines) will be open at all times for the 111112 listeners to call. These calls will be tabulated by CJCA's specially hired request staff every hour and given to the radio personality on the air. He will air the tunes most requested by Northern Alberta listeners. It will all basically follow the top forty format now in use and they will air the new up -and coming records as they are received and after a few airings will leave it to the listeners to request the numbers to build them into hits. CJCA will also air "Special Flashbacks" that are requested weekly which will enhance the top forty and also encourage listener participation with CJCA. Much success has been experienced with the airing of the best in Canadian productions and CJCA is slowly but surely creating an interest by their listeners in the Canadian sound. CJCA also has an untapped Volume 5, No. 12 wealth of talent within its studios. Their Program Director, Dalt Elton and a popular group known as The Nomads, who are closely associated with CJCA through commercials and stationpromotions, have been heard by a few Eastern-ites who were amazed that this talent wasn't on wax. Up and coming from CJCA is the unveiling of their specially made Batmobile. The Bat craze Pro Canada is still "in" with the hippys of Edmonton which should make for some pretty exciting promotions for the CJ-DJs.
