Copy County of The Board of Guardians of the poor of the Saint Austell Union do hereby Certify, Cornwall That on the seventh day of August last, James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children became and are now chargeable to the Parish of Saint Austell in the said Union

In testimony whereof, the Common Seal of the said Guardians is hereunto affixed at a Meeting of their Board, this 3rd day of October 1845

County of THE Examination of James Stephens Thomas now residing in the Saint Austell Union Cornwall Workhouse in the Parish of Saint Austell in the County of Cornwall touching the place of his last legal Settlement, taken upon oath before us, Two of Her Majesty's Justices of the Peace in and for the said County of Cornwall at Saint Austell in the said County this eighth day of October 1845

WHO saith I am now about 39 years of Age. I was born as I have heard and believe to be true in the Parish of Crowan in the said County of Cornwall in the year 1806. I am the bastard son of Jane Thomas who has been dead more than 30 years, when I was about 11 years of age and single and Unmarried and not having a Child or Children I went to live into the said Parish of Crowan in the said County of Cornwall with one Francis Poole Innkeeper in Crowan Churchtown. I do not recollect the agreement. I recollect being put before the Magistrates at by Mr Lanyon to be examined, this was about 2 or 3 . . before I went to with [sic] Mr Francis Poole to live as before stated. I . . to fetch the cows and do other work that I was able (Mr Poole also occupied the farm of Tregear adjoining Crowan Churchtown) I resided with and served the said Mr Francis Poole as aforesaid until his death and I also served with his Widow Mrs Eleanor Poole for some time after his death as her servant. I do not know exactly how long; I believe it was two or three Months at Crowan Churchtown. During all the time I was such servant with the said Francis Poole as above stated Which was about 2 or 3 years (I am certain it was more than one year and six Months) I resided and slept in his house at Crowan Churchtown aforesaid in the said parish of Crowan and in the said County of Cornwall, and I received my meat and Clothes from the said Francis Poole during all the time I resided with him as abovenamed. I have never since that time been an Apprentice or a yearly servant and have never done any other Act to gain a Settlement. I was married to me present Wife Grace in the Parish Church of Saint Neot in the said County of Cornwall about 16 years ago her maiden name was Grace Davey and I have by her five Children all born in lawful Wedlock since our Marriage viz. John aged 11 years, James aged 9 years, Henry aged 7 years, Josiah aged 4 years and Joseph aged about 1 year and 8 months. I am now with my said Wife Grace and our said five Children abovenamed resident in the Saint Austell Union Workhouse and receiving relief from the Parish of Saint Austell Since my marriage as before stated I have never rented a tenement for more than £4‐10‐0 per year

County of THE Examination of Benjamin Julyan Nott Cornwall now residing in the Parish of Saint Austell in the County of Cornwall touching the place of the last legal Settlement of James Stephens Thomas taken upon oath before us, Two of Her Majesty's Justices of the Peace in and for the said County of Cornwall this eighth day of October 1845

WHO saith I am relieving officer of the Saint Austell Union in the said County of Cornwall. I produce a Certificate as to the Chargeability of James Stephens Thomas the pauper Abovenamed and Grace his Wife and John, James, Henry, Josiah & Joseph their Children, bearing date the third day of October 1845 which said Certificate was signed by the Chairman and countersigned by the Clerk to the Board of Guardians of the Said Saint Austell Union and sealed with the common seal of the said Guardians in my presence on the said 3rd day of October 1845 and which said Certificate was delivered to me by Mr John Magor Boyle the Clerk to the Guardians of the said Saint Austell Union. I also produce an extract taken from the Register Book of Baptisms in the Parish of Crowan in the said County of Cornwall which said extract was compared by me and is a true Copy of an entry in the said Register Book of Baptisms as to the Baptism of James Stephens Thomas the pauper abovenamed

8th October 1845 Examination of Eleanor Poole (St Austell‐Crowan, re James Stephens Thomas & family)

County of THE Examination of Eleanor Poole Cornwall now residing in the Parish of Crowan in the County of Cornwall touching the place of the last legal Settlement of James Stephens Thomas taken upon oath before us, Two of Her Majesty's Justices of the Peace in and for the said County of Cornwall at Saint Austell this eighth day of October 1845

WHO saith I am now about 60 years of Age. I am the widow of Francis Poole who died in the month of July 1819 I recollect James Stephens Thomas the pauper abovenamed coming to live with my late Husband he was then a boy about 10, 11 or 12 years of age, he used to fetch the cows and do any work he was able. My late Husband and myself at that time Kept an Inn in Crowan Churchtown. I do not recollect exactly how long the pauper James Stephens Thomas lived with my late Husband and myself at Crowan Churchtown, whether it was 2 years or 3 years, but I believe it was more than one year, he lived with us until the death of my late husband Francis Poole above named. The said James Stephens Thomas the pauper abovenamed slept in our house at Crowan Churchtown in the said parish of Crowan during all the time he lived with us, and he had all his meat in our House. He also had his clothes of us but I do not know whether his Uncle paid for them or not. I do not believe that that the said James Stephens Thomas the pauper abovenamed was ever an Apprentice with my late Husband Francis Poole abovenamed. I never saw any indentures of Apprenticeship. I have seen Indentures of other Apprentices which we had before and shortly after the residence of the said James Stephens Thomas with us and have them now in my possession. I consider he was an Apprentice to Thomas Floyd of Gwinear. He was in the habit of coming after the boy & my Husband did not like it. Floyd came & fetched him after my Husband’s Death.

8th October 1845 Examination of John Lanyon (St Austell‐Crowan, re James Stephens Thomas & family)

County of THE Examination of John Lanyon Cornwall now residing in the Parish of Gwinear in the County of Cornwall touching the place of the last legal Settlement of James Stephens Thomas taken upon oath before us, Two of Her Majesty's Justices of the Peace in and for the said County of Cornwall at Saint Austell this eighth day of October 1845

WHO saith I am now about 69 years of Age. In the year 1817 I was Overseer of the Parish of Gwinear in the said County of Cornwall, at or about Michaelmas in that year I recollect putting James Stephens Thomas the pauper abovenamed (who was then a boy) before the Magistrates at their petty sessions held at Camborne to be examined as to the place of his last legal settlement. Other evidence was also then and there produced touching the place of Settlement of the said James Stephens Thomas but I do not recollect who the witnesses were. It was then adjudged by the said Magistrates that the legal Settlement of the said James Stephens Thomas was in the parish of Crowan in the said County of Cornwall. I do not know whether there was an order of Justices at that time made for the removal of the said James Stephens Thomas from and out of the said parish of Gwinear to the said parish of Crowan, or whether the Overseers of the said parish of Crowan consented to take him without an order, but he the said James Stephens Thomas the pauper abovenamed left our said parish of Gwinear at that time, and I have not seen him since until within this week. I have been a resident inhabitant of the said parish of Gwinear since the year 1817, at the time of the Examination of the said James Stephens Thomas before the Magistrates as above stated he was not bound as an Apprentice to the late Francis Poole then an Innkeeper at Crowan Churchtown or to any other person and I never saw any Indentures of Apprenticeship to Mr Poole. I saw an indenture of Apprenticeship produced at the Justices Meeting at Camborne binding the Pauper to one Thomas Floyd as I believe, and I remember the Justices tearing it up because it was not sealed. And the Justices said he belonged to Crowan. And he went there accordingly

County of THE Examination of Nicholas Trevanion Eveleigh now residing in the Parish of Cornwall Saint Austell in the County of Cornwall touching the place of the last legal Settlement of James Stephens Thomas taken upon oath before us, Two of Her Majesty's Justices of the Peace in and for the said County of Cornwall at Saint Austell this Eighth day of October 1845

WHO saith I am the Master of the Saint Austell Union Workhouse in the said County of Cornwall. James Stephens Thomas the pauper abovenamed and Grace his Wife and John, James, Henry, Josiah and Joseph their Children are now residing in the said Saint Austell Union Workhouse and are all chargeable to and receiving relief from the parish of Saint Austell and have been so chargeable and receiving relief from the said Parish of Saint Austell since the seventh day of August last which said parish of Saint Austell is within the said Saint Austell Union and in the said County of Cornwall.

Cornwall To the Churchwardens and Overseers of the Poor of the Parish of Saint Austell in the County of Cornwall and to the Churchwardens and Overseers of the Poor of the Parish of Crowan in the County of Cornwall

UPON the complaint of the Churchwardens and Overseers of the Poor of the Parish of Saint Austell aforesaid, in the said County of Cornwall unto us whose Names are hereunto set and Seals affixed, being Two of Her Majesty’s Justices of the Peace, in and for the said County of Cornwall and one of us of the Quorum, that James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children have come to inhabit in the said Parish of Saint Austell not having gained a legal settlement there, nor produced any certificate owning them to be settled elsewhere, and that the said James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children are now actually chargeable to the said Parish of Saint Austell We the said Justices, upon due proof thereof, as well as upon the examination of the said James Stephens Thomas, Eleanor Poole, John Lanyon, Nicholas Trevanion Eveleigh and Benjamin Julyan Nott upon oath, as otherwise, and likewise upon due consideration had of the premises, do adjudge the same to be true; and we do adjudge that the lawful Settlement of the said James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children is in the Parish of Crowan in the said County of Cornwall ...... require you the Churchwardens and Overseers of the said Parish of Saint Austell or some ...... N.B. Words in bold italics inserted into printed document, the bottom part of which (including the date and Justices’ signatures) is missing. However since all of the Examinations into James Stephens Thomas’ Settlement are dated 8th October 1845, that is clearly the date of the Removal Order itself – particularly since the Notice of Removal Order is dated 9th October.

NOTICE

In the matter of James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children Paupers

To the Overseers of the Poor of the Parish of Crowan in the County of Cornwall

We the Overseers of the Poor of the Parish of Saint Austell in the County of Cornwall, do hereby give you notice that the above named James Stephens Thomas, Grace his Wife and John, James, Henry, Josiah and Joseph their Children are become chargeable to the Parish of Saint Austell aforesaid and that an Order has been duly obtained for their removal to your said Parish of Crowan as the place of their last legal settlement (a Copy of which Order, and also a Copy of the Examinations on which the same Order was founded and made are herewith sent) – And we do also hereby further give you notice, that unless you appeal against the said Order, and within 21 days from the date hereof duly serve notice of such appeal the said Paupers will be removed to your said Parish of Crowan in pursuance of the said Order.
