Sunil Kumar, General Manager (Presenting Officer), and Mr. K. N. Vaidyanathan, Executive Director. ORDER 1. The hearing commenced today at 10 AM, as scheduled. The learned Advocate for two noticees (No.1 and 3) produced a letter on behalf of those two noticees seeking inspection of documents and postponement of hearing. There was no appearance on behalf of other six noticees. 2. I note that the noticees were served the show cause notices dated June 7, 2010 (SCNs) on June 9, 2010. Vide the said SCNs, they were offered opportunity of inspection and advised to reply to the SCNs within 21 days from the date of receipt, that is, by June 30, 2010. Neither did they inspect the documents nor did they file any reply on merit. Vide letter dated July 21, 2010, an opportunity of personal hearing was offered to them. While two of the noticees (No.1 and No.3) have sought inspection of documents and postponement of hearing, there is no response from six others. 3. I further note that though the two noticees were provided opportunities of inspection of documents and reply to the SCNs, they did not avail the same. They did not do so even after notice for personal hearing was issued. Seeking inspection of documents and postponement of hearing at the hearing delays the disposal of the proceedings. 4. However, it was mutually agreed upon by the Learned Advocate for the two noticees and SEBI that: a. SEBI shall provide inspection of documents relied upon in support of the charges to the two noticees (No.1 and No.3) at a mutually convenient date and time before August 17, 2010; b. The two noticees shall submit their replies to the SCNs latest by August 27, 2010; and c. The personal hearing with regard to the SCNs may be held on September 03, 2010. 5. Accordingly, the personal hearing for the two noticees is posted at 10 AM on September 3, 2010. 6. Though there is no request to that effect from the other six noticees, in deference to principles of natural justice, they are hereby directed, if they wish, to take inspection of the relevant documents on August 17, 2010 at 10 AM, submit replies to the SCNs by August 27, 2010 and appear for personal hearing at 10 AM on September 03, 2010. 7. A copy of this Order shall be served on all the eight noticees. 8. This Order shall come into force with immediate effect. PLACE: MUMBAI M. S. Our total operating income for the quarter was, on a standalone basis, 2287 crores. Vs. 2718 crores, in the corresponding period of last year. And this reduction in topline is due to the lower FAC, that is the fuel adjustment charge, of our Mumbai circle which has been there due to the power purchase cost, that we buy from external sources. Our purchase cost from external sources has gone down, very substantially and that is reflecting in the lower billing value.
