Internet: http://www.fcc.gov Washington, D.C. 20554 TTY: 1-888-835-5322 DA 07-4152 Released October 5, 2007 FCC CONTINUES EEO AUDITS On October 4, 2007, the Federal Communications Commission mailed the third set of its Equal Employment Opportunity (EEO) audit letters for 2007. This mailing was sent to randomly selected multi-channel video programming distributors (MVPDs). In accordance with the provisions of Sections 73.2080(f)(4) and 76.77(d) of the Commission’s Rules, 47 C.F.R. §§ 73.2080(f)(4), 76.77(d), the FCC annually audits the EEO programs of randomly selected broadcast licensees and MVPDs. Each year, approximately five percent of all broadcast stations and MVPDs are selected for these random EEO audits. By Public Notices, DA 07-399, released February 12, 2007, and DA 07-2553, released June 13, 2007, the Media Bureau announced its mailing of similar audit letters to the broadcast stations listed in the attachment to each such Public Notice. The information these companies provided in the SPADC is extremely sensitive and could reveal competitive and customer information simply by the fact that they are, in many cases, the only competitive provider in their service areas. The JSI SPADC Filers include companies that provided data and information as competitive providers, purchasers, and best efforts business broadband Internet access service providers. Although the JSI SPADC Filers are confident in the FCC’s Data Protective Order1 and the limitations placed on how requesting parties will be able to access and review SPADC data and information, it is of paramount importance that no identifying competitive or customer information about the JSI SPADC Filers be revealed (intentionally or unintentionally) in the SPADC data analysis.
