(FairPoint) (collectively, Applicants), filed a series of applications pursuant to Sections 214 and 310(d) of the Communications Act of 1934, as amended (Act),1 seeking approval for various assignments and the transfer of control of licenses and authorizations held by FairPoint to Consolidated Holdings.2 We find that approval of the transaction will serve the public interest, convenience, and necessity and hereby grant the Applications. In addition, we find that the Applicants have demonstrated good cause for receipt of their requested waiver of Section 61.41(c)(2) of the Commission’s rules.3 2. A public notice accepting the Applications for filing and establishing a pleading cycle for public comments was released on January 12, 2017.4 The Commission received no petitions to deny or comments in opposition to grant of the Applications. The record overwhelmingly demonstrates two UNEs – unbundled DS0 Loops and unbundled dark fiber – are key to FTTH buildout by those using them (competitors) and those responding to the competition with their own buildout (incumbent local exchange carriers (“ILECs”)).

The last report was released November 27, 2001.1 All information in this report is drawn from providers’ April 1, 2002, filing of the Telecommunications Reporting Worksheet (FCC Form 499-A).2 This report can be used by customers to identify and locate telecommunications providers, by telecommunications providers to identify and locate others in the industry, and by equipment vendors to identify potential customers. Virtually all providers of telecommunications must file FCC Form 499-A each year.3 These forms are not filed with the FCC but rather with the Universal Service Administrative Company (USAC), which serves as the data collection agent. Information from filings received after November 22, 2002, and from filings that were incomplete has been excluded from the tables. Although many telecommunications providers offer an extensive menu of services, each filer is asked on Line 105 of FCC Form 499-A to select the single category that best describes its telecommunications business.
