This Amendment has been prepared by Melton City Council, which is the planning authority for this Amendment. The Amendment has been made at the request of Melton City Council. What the Amendment does The Amendment corrects zoning and overlay anomalies within the Melton Planning Scheme by: Rezones on Council owned land 1. Rezoning 19 Rockfern Crescent, Diggers Rest from Public Use Zone – Education (PUZ2) to Public Use Zone – Local Government (PUZ6). OFFICIAL 2. Mapping cadastre related corrections on Western Water owned land 12. Rezoning 2389A Diggers Rest – Coimadai Road and 2389 Diggers Rest – Coimadai Road, Toolern Vale so that the Public Use Zone – Service and Utility (PUZ1) accurately aligns with the title boundary of 2389A Diggers Rest – Coimadai Road, Toolern Vale, plus its connecting northern easement. Overlay corrections 13. Removing HO106 (1200‐1220 Mt Cottrell Road, Strathtulloh (Parcel 3001)) from the Heritage Overlay maps. 14. Removing HO34 (126‐196 McCorkells Road, Toolern Vale) from the Heritage Overlay maps. Overlay schedule corrections 15. Amending the ‘SCHEDULE TO CLAUSE 43.01 HERITAGE OVERLAY’ by relocating the listing of the entry for HO19 from ‘Diggers Rest’ to ‘Toolern Vale’ to reflect the correct suburb within which it is located. Strategic assessment of the Amendment Why is the Amendment required? An internal Council review was undertaken of zoning anomalies across the City of Melton. This Amendment is required to correct minor mapping anomalies regarding zoning and overlays that have been identified in the Melton Planning Scheme. OFFICIAL Correcting the anomalies ensures that the zoning reflects the use and ownership of the land. Incorrect zoning can impact on the ongoing use of land, and in particular trigger the need for a planning permit where one would not normally be required. The Amendment will resolve these errors and anomalies in the Melton Planning Scheme to ensure that the controls on the land are appropriate given the ownership and use, and ensure that unnecessary planning permits are not triggered. Approval of the Amendment will improve the accuracy, general operation and administration of the Melton Planning Scheme. How does the Amendment implement the objectives of planning in Victoria? The Amendment implements the objectives of planning in Victoria as stated in Section 4 of the Planning and Environment Act 1987, in particular those that seek to: • provide for the fair and orderly use and development of land; • conserve and enhance buildings of historical interest; and • protect public utilities and other assets and enable the orderly provision and coordination of public utilities and other facilities for the benefit of the community. The Amendment implements these objectives by ensuring the accuracy of the ordinance and the associated mapping of zones and overlays, so they can be correctly applied across the municipality. How does the Amendment address any environmental, social and economic effects? Environmental effects: Multiple anomaly corrections include the rezoning of land to Public Park and Recreation Zone (PPRZ). This helps to ensure that these areas are protected from development and encourage public access and use. Social effects: The Amendment will have a positive social impact on the municipality. Correction of the zoning anomalies will ensure that areas are appropriately developed in line with their intended use. Economic effects: Where the proposed corrections are on private land, this will give landowners certainty regarding potential uses on their land, including any future associated development potential. Does the Amendment address relevant bushfire risk? The amendment is corrective in nature. While the bushfire management overlay applies to several sites affected by the amendment, it does not result in increased bushfire risk to life, property, community infrastructure and the natural environment. Does the Amendment comply with the requirements of any Minister’s Direction applicable to the Amendment? The Amendment complies with all Minister’s Directions under Section 12 of the Planning and Environment Act 1987. Specifically, the Amendment has considered and complies with the following Ministerial Directions: • Ministerial Direction 11, Strategic Assessment of Amendments: The Amendment has been strategically assessed and justified in accordance with this direction. • Ministerial Direction No. 15, The Planning Scheme Amendment Process: All process requirements to be met under the direction have been considered and met in the preparation of the Amendment. OFFICIAL • Ministerial Direction on the Form and Content of Planning Schemes under section 7(5) of the Act. No other Minister’s Direction is directly affected by the Amendment. How does the Amendment support or implement the Planning Policy Framework and any adopted State policy? The Amendment will support the implementation of the Planning Policy Framework (PPF), with regard to its objectives for Settlement (Clause 11), Built Environment and Heritage (Clause 15) and Housing (Clause 16), by providing clarity and accuracy with regard to the zones and overlays applicable to land within the City of Melton. How does the Amendment support or implement the Local Planning Policy Framework, and specifically the Municipal Strategic Statement? The Amendment complies with, supports and implements the Local Planning Policy Framework of the Melton Planning Scheme. In this regard, the Amendment supports the implementation of the Melton Municipal Strategic Statement. Does the Amendment make proper use of the Victoria Planning Provisions? The Amendment makes proper use of the Victorian Planning Provisions by ensuring that they have been applied appropriately. The changes comply with the VPP Practice Notes, including the Strategic Assessment Guidelines (2013). How does the Amendment address the views of any relevant agency? Agencies were consulted throughout the referral process. The correction shown in map ‘Melton C190melt 010znMap01 Exhibition’ has been endorsed by the landholder Western Water. The Victorian Department of Education and Training is supportive of the correction shown in map ‘Melton C190melt 007znMap07 Exhibition’. Does the Amendment address relevant requirements of the Transport Integration Act 2010? The Amendment is not considered to have a significant impact on the transport system. The Amendment does not propose any rezoning or overlay changes that would affect the transport system. There are no statements of policy principles applicable under section 22 of the Transport Integration Act 2010. Resource and administrative costs What impact will the new planning provisions have on the resource and administrative costs of the responsible authority? The Amendment will reduce administrative costs for Melton City Council by ensuring the
