2 झारखड गजट (असाधारण ) शु वार , 14 जुलाई , 2017 जबक यह समयोचत है क कनाटक से सिजतृ एवं पंजीकृ त अरका एजकेशनलु एंड कचरल ट (द जे० जी० आइ० प)ु मयु कायालय-091/2 डॉ० ए० एन० कृ णा राव रोड , भी० भी० परमु , बंगलोर-560004 , ेीय कायालय-डी०-28 , दानष ऑक ड , ओपोिजट-एषयन इन हॉटल , धधकडीह , पो०-वटु परु , जमशेदपर-831001ु (पंजीयन संया-बी०एस०जी०-4-00138-2009-10 दनांक 21 नवबर, 2009) वारा ायोिजत अरका जैन वववयालय , राँची , झारखड क थापना तथा समावेशन और उसके अनपु नजी वववयालय का दजा दान करने हेत ु और उससे संब आनषंगकु मामल के संदभ म आवयक है । एतवारा भारतीय गणराय के अड़सठवे वष म झारखड वधान-सभा वारा ननलखत प म अधनयमत कया जाता हैः- ारंभक 1. संत नाम , वतार एवं ारंभः- 1) यह वधेयक ”अरका जैन वववयालय अधनयम , 2017 “ कहा जाएगा । 2) इसका वतार सपणू झारखड राय म होगा । 3) यह उस तथ से वतृ होगा जैसा क राय सरकार वारा शासकय राजप म अधसचनाू जार कर नयत कया जाय । 2. परभाषा:- अगर इस अधनयम के संदभ म अयथा अपेत/आवयक होः a) ’अकादमक परष ’ का अथ है वववयालय क अकादमक परष जैसा क अधनयम क धारा-24 म वणत है; b) ‘वाषक तवेदन ’ का आशय है वववयालय का वाषक तवेदन जैसा अधनयम क धारा-39 म संदभत है; c) ‘बंधन ’ बोड’ का अथ है, इस अधनयम क धारा-23 के तहत गठत वववयालय का बंधन बोड; d) ‘परसर ’ का आशय है वववयालय का पणू ेफल जहाँ यह अविथत है; e) ‘कु लाधपत ’ से आशय है वववयालय के कु लाधपत , जो इस अधनयम क धारा-12 के अधीन नयतु ह ; झारखड गजट (असाधारण ) शु वार , 14 जुलाई , 2017 3 f) ’मयु वत एवं लेखा पदाधकार ’ का अथ है वववयालय के मयु वत एवं लेखा पदाधकार जो अधनयम क धारा-18 के अधीन नयतु ह ; g) ‘परा नयंक ’ का अथ है वववयालय के परा नयंक , िजनक नयितु अधनयम क धारा-19 के अधीन हुई हो ; h) ‘अंगीभतू महावयालय ’ से आशय है वैसे महावयालय अथवा संथान जो वववयालय वारा संपोषत ह ; i) ‘कमचार ’ से आशय है वववयालय वारा नयतु कमचार ; इसके अतगत वववयालय एवं अंगीभतू महावयालय के शक एवं अय कमचार भी समाहत ह; j) ‘थायी नध ’ का अथ है वववयालय क थायी नध िजसक थापना अधनयम क धारा-37 के तहत हुई हो ; k) ‘संकाय ’ से आशय है समान अनशासनु के अकादमक वभाग ; l) ‘शकु ’ का आशय है वववयालय वारा वयाथय से उगाह गयी राश , जो कसी पायम तथा उससे संबंधत हो ; m) ‘सामाय नध ’ से आशय है वववयालय क सामाय नध , िजसक थापना अधनयम क धारा-38 के अतगत हुई हो ; n) ‘शासी नकाय ’ का अथ है वववयालय का शासी नकाय , िजसका गठन अधनयम क धारा-22 के तहत हुआ हो ; o) ‘राय मयांकनू एवं यायन परषसे आशय है राय मयांकनू एवं यायन परष , बगलु , वववयालय अनदानु आयोग क एक वायत संथा ; p) ‘वहत ’/’ नयत ’ का अथ है इस अधनयम के तहत वहत/नयत परनयम और नयमावल ; q) ‘त-कु लपत ’ का अथ है वववयालय के त कु लपत , िजनक नयितु अधनयम क धारा-15 के तहत हुई हो ; r) ‘कु लसचव ’ का अथ है वववयालय के कु लसचव , िजनक नयितु अधनयम क धारा-17 के तहत हुई हो ; s) ‘नयंी नकाय ’ का आशय है भारत सरकार वारा उच शा के अकादमक तर के सनचयनु हेत ु मानक एवं शत के नधारण के लए थापत नकाय , यथा-वववयालय अनदानु आयोग , अखल भारतीय तकनीक शा परष , राय शक शा परष , भारतीय 4 झारखड गजट (असाधारण ) शु वार , 14 जुलाई , 2017 चकसा परष , बार काउंसल ऑफ इंडया , फामसी काउंसल ऑफ इंडया , राय मयांकनू एवं यायन परष , भारतीय नसग परष , भारतीय कृ ष अनसंधानु परष , वैानक एवं औयोगक शोध परष आद तथा इसके अलावा सरकार अथवा कोई वैसा नकाय , जो भारत सरकार या राय सरकार वारा गठत कया गया हो ; t) ‘नयमावल ’ से आशय है इस अधनयम के अतगत नमत नयमावल ; u) ‘अनसु चीू ’ का अथ है इस अधनयम के तहत संलन अनसु चीू ; v) वववयालय से संबंधत ‘वतक नकाय ’ का अथ हैः- i) सोसाइटज रिजेशन एट , 1860 के अतगत कोई संथा , अथवा ii) इंडयन ट एट , 1882 के अधीन पंजीकृ त कोई लोक यास , अथवा iii) कसी राय क वध के अनपु पंजीकृ त कोई संथा या यास। w) ‘राय सरकार ’ से आशय है झारखड क राय सरकार ; x) ‘परनयम ’ ’ अयादेश ’ और ‘वनयम ' का मशः आशय है, परनयम , अयादेश और वनयम जो इस अधनयम के अतगत वववयालय वारा नमत ह ; y) ‘वववयालय के वयाथ ’ का अथ है वववयालय म उपाध , डलोमा अथवा वववयालय वारा थापत अय अकादमक वशटता ात करने हेत ु एक पायम म नामांकत यित , िजसम शोध-उपाध भी शामल है; z) ‘शक ’ से आशय है ोफेसर , एसोसएट ोफेसर , असटेट ोफेसर अथवा इस तरह के अय यित , िजनक नयितु वववयालय या कसी अंगीभतू महावयालय या संथा म नदशत करने (शण) अथवा शोधकाय संचालन हेत ु हुई हो , इसके तहत अंगीभतू महावयालय अथवा संथान के धानाचाय भी सिमलत ह, िजनक संपिटु वववयालय अनदानु आयोग वारा नधारत नयम के अतगत हुई हो ; aa) ‘वववयालय अनदानु आयोग ’ से आशय है वववयालय अनदानु आयोग अधनयम , 1956 के अधीन थापत वववयालय अनदानु आयोग ; ab) ‘वववयालय ’ का अथ है इस अधनयम के अतगत झारखड म थापत अरका जैन वववयालय ; ac) ‘कु लपत ’ से आशय है वववयालय के कु लपत , िजनक नयितु इस अधनयम क धारा-13 के तहत हुई हो ; झारखड गजट (असाधारण ) शु वार , 14 जुलाई , 2017 5 ad) ‘विजटर ’/‘ अतथ ’/’ आगंतकु ’ से आशय है वववयालय के विजटर/अतथ/आगंतकु यथा इस अधनयम क धारा-10 म वणत है । 3. वववयालय क थापना:- (1) वववयालय क थापना अरका जैन वववयालय के नाम से होगी । (2) वववयालय का मयालयु झारखड राय के अतगत होगा तथा यह गहरया, सरायकेला- खरसावॉ म अविथत होगा । (3) वतक नकाय को राय सरकार वारा ाधकार प जार कये जाने के बाद ह वववयालय का संचालन आरंभ कया जायेगा । (4) इस अधनयम क अनसु चीू ’ए’ म सिमलत शत को वववयालय नधारत समयावध म पराू करेगा । (5) वववयालय के शासी नकाय , बंधन बोड, अकादमक परष , कु लाधपत , कु लपत , त कु लपत , कु लसचव , शक , मयु वत एवं लेखा पदाधकार एवं अय अधकार यासदय या ाधकार एतवारा वववयालय के नाम से गठत नकाय बनाएंगे जब तक वे इस पद पर है अथवा उनकसदयता बनी रहेगी। (6) वववयालय एक असब वववयालय के प म काय करगे और वे कसी भी महावयालय या संथान म नामांकत वयाथय को उपाध (डी), डलोमा और माण-प दान करने हेत ु सबता नहं दे सकगे । (7) वतक नकाय के अंगीभतू महावयालय और संथान , जो सबता ात ह और वववयालय के वशेषाधकार का उपयोग कर रहे ह वे इस अधनयम के भावी होने के साथ ह उस वववयालय से असब हो जाएंगे, उनक ऐसी सवधाएँु इस अधनयम के लाग ू होने के साथ समात हो जाएंगी और अरका जैन वववयालय के वतक नकाय वारा दत सवधाओंु के साथ ऐसे महावयालय और संथान उस अरका जैन वववयालय के अंगीभतू महावयालय या संथान बन जाएंगे । (8) अरका जैन वववयालय नाम से एक नकाय होगा और इस अधनयम के ावधान के अनपु उसके पास सतत ् पद-ाित अनमु और सामाय ता माणन क शित होगी , सपत हण करने व उस पर आधपय रखने, उसे अनबंध/संवदाु पर देने अथवा कथत नाम से वाद चलाने के अधकार हगे या िजस पर वाद दायर कया जा सकेगा । 6 झारखड गजट (असाधारण ) शु वार , 14 जुलाई , 2017 (9) वववयालय राय सरकार अथवा के सरकार से कसी भी कार के अनदानु अथवा वतीय सहायता ात नहं कर सकगे । बशत क राय सरकार अथवा के सरकार अनदानु या अय तरके से वतीयसहायता दे सकती हैः a) शोध वकास और अय गतवधय के लए जैसे राय सरकार के अय संगठन कोवतीय सहायता उपलध करायी जाती है अथवा b) वशट शोध अथवा कायम आधारत कोई गतवध ;
