MUSCOGEE NATION Last Will and Testament DEP ARTMENT OF HEALTH ESTABLISHED 1970

Judy an energetic 77-year-old mother of 4, grandmother of 13 and great grandmother of 3 passed away in her sleep last Friday. Her husband, a successful business man, died 15 years earlier leaving her a thriving business and several lucrative investments…. Bob and Marry died in a car accident last Wednesday on their way home from a community event. They were the parents of two young boys ages 3 and 5…. Sadly, these are obituaries we may see in the paper. The part that is not noted and rarely discussed is did they have a Will. In the scenarios above Judy did not have a Will thus her family spent years in court (probate) fighting over who got what of her investments and the company. This divided the family and cost the family thousands. Bob and Marry did not have a Will, nor did they have any siblings thus their kids went into the DHS system and the State decided who would raise their children. One of these important documents that is often put off, is called a Last Will and Testament also known as a will. A will is one of the most vital documents that all adults should consider creating, earlier rather than later, in their lifetime. A will is a legal document reflecting the creators wishes about how they want their assets and personal property to be distributed; custody of minor children and pets; and funeral and burial options upon their death. Everyone over the age of 18 should consider drafting a will while they are of sound mind and body to ensure their wishes are enforced by the courts and that their property is distributed how and to whom they wish. There are several types of inheritance wills that are recognized in the state of Oklahoma but the most common two are a testamentary will and a holographic will. It is important to seek legal counsel to discuss the differences and help you make the best decision for you and your family. This will help alleviate any confusion or disputes later on.

A testamentary will can be used to transfer assets and property to assigned beneficiaries upon death. The creator can also appoint a guardian for minor children in a testamentary will. There is certain language and technicalities that need to be included in a will to increase the likelihood of the creators wishes to be fulfilled. It is advised that the creator seek legal support in drafting to ensure it contains the proper information needed according to the state law. It is best to have your will signed in the presence of a witness. The witness should not be someone that could benefit from your death. A holographic will is one that is written and signed by the creator but is not necessarily witnessed. In the state of Oklahoma, a holographic will is valid if it is written in the creators handwriting, signed and dated in its entirety. It must contain no printed nor typed information in order to be valid. To decrease the possibility of disputes later on, there are certain requirements that need to be met in order for the document to be valid, including proof the creator drafted it and held mental capacity at the time of signing. Although both testamentary and holographic wills are recognized in Oklahoma, it is recommended that you consult with your legal advisor to increase the validity of the will. Often times the problem lies with what the creator often fails to say rather than what they do say. Without legal consultation, the creator may leave out vital information from the document.
