(2018) Directed by Dr. Mark E. Elliott. 376 pp. This dissertation is an intellectual and legal history that traces the evolution of human rights concepts by focusing on American participants who were at the center of the Nuremberg Trial—Robert Jackson, Francis Biddle, and John Parker. It addresses questions such as: What impact did the Nuremberg Trial have on international human rights law in the postwar period? How did Jackson, Biddle, and Parker understand human rights, national sovereignty, international law, and international engagement before the Trial? Did their views change as a result of their Nuremberg experiences? What challenges, if any, did they face in upholding human rights when they returned home? The answers to these questions reveal a key paradox surrounding Nuremberg. A paradox seems to contradict generally received opinion yet is still true, which is an apt description of the Nuremberg Trial. It was a pivotal moment in the development of international human rights law, and of the U.S. commitment to internationalism. One way of measuring Nuremberg’s importance is through the impact it had on Jackson, Biddle, and Parker’s thinking after the Trial ended. These men had already endorsed the idea of “crimes against humanity” and the need for international trials before they received their appointments, which is part of the reason why they were chosen. At Nuremberg, they confronted atrocities of such an extreme nature that they devoted themselves to the Trial’s great purpose: that “never again” would the world allow this to happen. Aggressive war, genocide, racial and religious persecution were among the worst crimes that had to be eradicated. Paradoxically, though, while each participant demonstrated an enhanced commitment to human rights after the Trial, each one also faced his own challenges in applying these principles at home. Jackson faltered on anti-communism, and Parker on civil rights. Only Biddle out of the three went the furthest in consistently advocating human rights.     Why the French said “non”: Creditor-debtor politics and the German financial crises of 1930 and 1931 Simon Banholzer, University of Zurich Tobias Straumann, University of Zurich1 December, 2015 Abstract Why did France delay the Hoover moratorium in the summer of 1931, thus escalating the German financial crisis? In most accounts the announcement of an Austro-German customs union issued in March 1931 is cited as the crucial event that made the French reluctant to continue their cooperation with Germany. We suggest a more comprehensive explanation. While acknowledging the negative impact of the customs union, we think that the collapse of mutual trust came much earlier, namely with the evacuation of the Rhineland in the summer of 1930. It explains why as early as the autumn of 1930 France declined to help Germany mitigate a financial crisis. Introduction Physicians have always played an important role in armed conflicts be- ing the first to treat wounded and sick combatants, prisoners of war, and civilians. This makes them an important, essential category of ac- tors in armed conflicts, a role which is reflected in the laws of war.1 In granting first aid and emergency care, physicians can fulfill a further role by reporting on human rights abuses or violations of international humanitarian law.2 They are thus in a privileged position to watch over the rights of the victims of armed conflicts. However, their position is also susceptible to abuse. Physicians have always used armed conflicts for their own gain, to further their medical skills or to use their skills to enhance military gains or further medical science.

    The Judicial Genealogy (and Mythology) of John Roberts: Clerkships from Gray to Brandeis to Friendly to Roberts BRAD SNYDER* During his Supreme Court nomination hearings, John Roberts idealized and mythologized the first judge he clerkedfor, Second Circuit Judge Henry Friendly, as the sophisticated judge-as-umpire. Thus far on the Court, Roberts has found it difficult to live up to his Friendly ideal, particularlyin several high-profile cases. This Article addresses the influence of Friendly on Roberts and judges on law clerks by examining the roots of Roberts's distinguishedyet unrecognized lineage of former clerks: Louis Brandeis 's clerkship with Horace Gray, Friendly's clerkship with Brandeis, and Roberts's clerkships with Friendly and Rehnquist. Labeling this lineage a judicial genealogy, this Article reorients clerkship scholarship away from clerks' influences on judges to judges' influences on clerks. It also shows how Brandeis, Friendly, and Roberts were influenced by their clerkship experiences and how they idealized their judges. By laying the clerkship experiences and career paths of Brandeis, Friendly, and Roberts side-by- side in detailed primary source accounts, this Article argues that judicial influence on clerks is more professional than ideological and that the idealization ofjudges and emergence of clerks hips as must-have credentials contribute to a culture ofjudicial supremacy. * Assistant Professor, University of Wisconsin Law School.
