Algunos datos estadísticos aportados por el Área de Investigación y Estadística del Cosevi, nos informan lo siguiente; es evidente que la cantidad de choques producidos en el país es alarmante, hablamos de un promedio de 138 choques al día en el 2012, 50426 durante todo este año (cuadro N.° 1) y si vemos el dato de las horas en que se producen los accidentes (cuadro N.° 2), veremos que de las 7 am y hasta las 9 pm, la cifra de choques es constante. En Japón por ejemplo (de quienes se dice son los mejores conductores del mundo) es norma básica que en una colisión lo primero que deben hacer los participantes de dicho percance es movilizar sus autos a un espacio más seguro para ellos y los demás conductores que siguen en su traslado. Países como México donde las presas de vehículos son de kilómetros, han implementado la misma idea de mover los automotores cuando exista un accidente de tránsito, permitiendo que el ya congestionado tráfico mexicano se obstaculice por responsabilidad de los colisionados y sus vehículos. Otro ejemplo se da en ciudades con muchas autopistas como Miami que al igual que otros países se vuelve peligroso que en un accidente de tránsito que no permite el poder continuar con el trayecto por quedar cubriendo dos o más carriles, se autoriza la rápida movilización a un solo carril permitiendo que los vehículos circulen por los restantes. En todos los ejemplos anteriores, la solución ha sido recurrir a los instrumentos tecnológicos que se poseen hoy en día como celulares, cámaras fotográficas, tabletas, u otros dispositivos que nos permiten documentar de forma clara la situación en que quedan los diferentes vehículos en una colisión y si por alguna razón no se poseen en ese instante, se puedan valer de terceros para realizar la respectiva documentación del momento. De la misma forma se puede recurrir a cámaras externas cercanas al percance o por último el testimonio de terceros que atestigüen lo sucedido. Es claro señalar que la legislación actual permite mover los vehículos cuando las partes de la colisión deseen arreglar la situación por sus propios medios sin intervención del inspector de tránsito; en los casos donde las partes tengan diferencias sobre las responsabilidades es donde se vendría a aplicar la norma sugerida. Por otro lado importante también recordar que la boleta de tránsito respectiva siempre será confeccionada pero luego de haber movilizado los automotores a zona segura. En los casos donde se produzca lesiones o muertes, es evidente que por las repercusiones legales que estas podrían producir, no se aplicará lo sugerido dejando la normativa como está en la actualidad. Por todo lo anterior es que se somete ante las y los señores y señoras diputados el proyecto de ley siguiente, para su estudio y final aprobación. LA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA, DECRETA: REFORMA DEL ARTÍCULO 168 DE LA LEY DE TRÁNSITO POR VÍAS PÚBLICAS TERRESTRES Y SEGURIDAD VIAL LEY N.º 9078, DE 26 DE OCTUBRE DE 2012, Y SUS REFORMAS ARTÍCULO 1.- Modifícase el artículo 168, de la Ley de Tránsito por vías públicas y terrestres y seguridad vial, Ley N.º 9078 de 26 de octubre de 2012, cuyo texto dirá: “Artículo 168.- Accidente de tránsito, primeras diligencias Cuando se produzca un accidente de tránsito en el que exclusivamente medien daños materiales, las partes de mutuo acuerdo o mediante las entidades aseguradoras podrán convenir en la reparación de estos. Con el fin de respaldar sus gestiones podrán tomar fotografías o grabar videos mediante cualquier instrumento tecnológico que permita fijar la escena del accidente o aportar los testigos presenciales correspondientes y se procederá a mover los vehículos hacia la orilla de la carretera o fuera de sus vías de circulación, para no afectar el libre tránsito. Si ninguna de las partes acepta ser responsable de los hechos acontecidos y, en consecuencia, se requiere la intervención de la policía de tránsito, posterior a mover los vehículos en los términos dispuestos en el párrafo anterior, se solicitará la presencia de un inspector el cual levantará el parte oficial de tránsito y consignará el señalamiento vial del sitio, las huellas de arrastre o frenado, los obstáculos en la vía y cualquier otro detalle relacionado con el accidente.
