Abstract "Three Divorces at one instance with special reference to the Fatãwa of ibn Taymiyya." The legal issue concerning three divorces at one instance and one sitting has been regarded as highly controversial. Muslims opinion on this issue all along 1400 years remained divided. Juristic development on this controversial issue can be divided into three phases: 1. From the time of Prophet (saws) up to two years of the Khilafah of äUmar. 2. From the Caliph äUmar to the period of the Imãm ibn Taymiyyah (1263- 1328AD/661-728AH) 3. From the Imãm ibn Taymiyyah (1328AD/728AH) to date. An attempt has been made to present the views of the most prominent Jurists who support the legal effect of three divorces at one instance as absolutely irrevocable and the legal views of Jurists who consider the matters as one revocable divorce. The selection of the celebrated works representing both views are such that they cover all three phases mentioned above on this legal issue. Concerning the first view, the verdict (Qarãr) of the fatãwa on the subject "Three divorces in one instance by the renowned Islamic Organisation of Saudi Arabia "Dãr al-Iftã" which has sanctioned by the honourable Shaykh Abdul Aziz ibn Abdullah ibn Bãz, the President of Dãr al-Iftã, the grand Muftï of the kingdom of Saudi Arabia. And the very recent views of leading Hanafï scholars of India under the leadership of Hadrat Mawlana Sayed Asäad Madani, Amir al-Hind have been translated. As regards to the second view the relevant pages of the celebrated fatãwa of the Imam ibn Taymiyyah has been translated. This study also presents the evaluation of both views, and is divided into two chapters. The chapter one is sub-divided into two sections. Section one includes a brief introduction of divorce, its Classification and revocation. Section two contains the English translation of above mentioned two contemporary legal verdicts on this issues. The chapter two presents the English Translation of the relevant aspects of the fatãwa of the Imam ibn Taymiyyah. The Conclusion deals with a critical evaluation of both legal views enabling Muslims who are divided in this issue to decide by themselves whenever they confront with such problems. CHAPTER - ONE Three divorces at one instance with special reference to the FatÉwÉ of the ImÉm AÍmad ibn Taymiyyah Introduction: The ImÉm Shaykh al-IslÉm AÍmad ibn Taymiyyah, who lived in the 13th/14th century, was an eminent scholar, MuÍadditha, jurist and historian of IslÉm.1 He wrote voluminously on almost every aspect of IslÉm. He was very systematic and thorough but because of the colossal opposition from different groups of ÑUlamÉÒ and constant political persecution of the then ruling esoteric, much of his writings, fatÉwÉs and contributions were certainly lost.2 Apart from his intellectual and religious pursuits involving scholastical issues of ÑAqÊdah (cult and creed) and theological deliberation between the AshÑarites and ×anbalites, his deep devotion to the juristic problems and Islamic Fiqhb created a new horizon in the field of IjtihÉdc . For the purpose of this research work, it is envisaged to explain in detail the juristic opinion of the ImÉm ibn Taymiyyah. Alongside it opinions of other schools of thought have also been outlined. Now a days it is known to the many learned people that most of the work of the ImÉm ibn Taymiyyah has been preserved, compiled and published under the title of MujmËÑ FatÉwÉ of Shaykh al-IslÉm ibn Taymiyyah. The works were systematized and compiled by Shaykh Abd al Rahman ibn MuÍammad ibn QÉsim al- ÑAsÊmÊ Al NajdÊ al ×anbalÊ. His son MuÍammad assisted him in this great task and the works were printed in 37 volumes under His Royal Highness King Fahd project of a Scholar of Prophet MuÍammad's(saws) tradtions. b The Subject which discuss about Jurisprudence in IslÉm. c Independent judgement in a legal or theological question, based on the interpretation and application of the four UsËl. 1 publication, Saudi Arabia. The juristic opinion of the ImÉm ibn Taymiyyah regarding divorce has been edited in volume 33 of the series.3 As per the requirement of this research work "Three Divorces at one instance with special reference to the FatÉwÉ of ibn Taymiyyah", we are presenting the English Translation of the legal verdict of ibn Taymiyyah on three divorces at one instance from his famous book FatÉwÉ In the translation work I have written within the braket to make the idea clearwith an introduction on the legal implication of three divorces at one instance.

The more genuine schools of Sufism have, no doubt, done good work in shaping and directing the evolution of religious experience in Islam; but their latter-day representatives, owing to their ignorance of the modern mind, have become absolutely incapable of receiving any fresh inspiration from modern thought and experience. They are perpetuating methods which were created for generations possessing a cultural outlook differing, in important respects, from our own. ‘Your creation and resurrection,‘ says the Qur‘an, ‘are like the creation and resurrection of a single soul.‘ A living experience of the kind of biological unity, embodied in this verse, requires today a method physiologically less violent and psychologically more suitable to a concrete type of mind.

Furthermore, this paper elaborates the existence of maslahah mursalah and looks deeper into the implementation of maslahah as a basis for the development of Islamic law in Indonesia. This paper is normative juridical using a doctrinal approach. In the end, it can be concluded that the conception of maslahah is a method of extracting Islamic law which is based on aspects of benefit and goodness for humans as long as it does not conflict with Islamic sharia norms.

Abdulazeem Abozaid Qatar Foundation Abstract It is a well-established rule in the Shariah (Islamic law) that a loan contract is of a charitable nature and as such the lender may not stipulate any excess or benefit from the borrower. However, it is also known in the Shariah that if the benefit from a loan comes to the lender voluntarily and it is not stipulated in the loan contract then it is permissible. This exception derives from some reports that the Prophet used to repay his debt with some increment, and to this effect he said: "The best amongst you are those who benevolently repay their debts”. Moreover, within Islamic law there exist some juristic opinions allowing the lenders to derive some indirect benefits from the loan contract, such as stipulating that the repayment of the debt is to be made in a place different from the one where the loan was first initiated, as this may save transfer costs and effort, or in utilizing, with conditions, the assets mortgaged against the loan. These exceptions may in principle nullify the general understanding that “any loan which results in a benefit is considered a form of usury” in Islam. The paper comes to define the prohibited benefits on a loan in Islam, thereby building the basis for addressing important questions, such as: i) are reciprocal loans prohibited in Islam? ii) is repaying the loan with excess to cater for inflation lawful? iii) is the benefit that pertains to the lender and does not harm or burden the borrower lawful? Answering these questions shall help set out the parameters for what constitutes unlawful benefits obtainable from a loan contract.

Therefore, an islâh movement is needed to minimize and even eliminate these negative impacts. Among the Sufi scholars who were very persistent in implementing the islâh movement was Shaykh Abdul Qadir al-Jilani. At a time when there was a lot of depravity and shocks in his time, al-Jilani with his zuhd was able to play a good role in this islâh movement. Therefore, this article will specifically discuss the implementation of zuhd in the islâh movement of Shaykh Abdul Qadir al-Jilani. Using the descriptive-analytical method, this study finds that the implementation of zuhd in the islâh movement of al-Jilani includes three things, namely in interpreting the true meaning and understanding of zuhd; in education and teaching, as well as in his lectures and preaching. Thus, al-Jilani was one of the Sufi scholars who integrated the teaching of zuhd with his islâh movements. Finally, it seems justifiable to assert that integrating zuhd with the islâh movement is very important to overcome the destructive impacts of modernization.

    The Islamic Caliphate: A Controversial Consensus Ofir Winter The institution of the caliphate is nearly as old as Islam itself. Its roots lie in the days following the death of Muhammad in 632, when the Muslims convened and chose a “caliph” (literally “successor” or “deputy”). While the Shiites recognize ʿAli b. Abi Talib as the sole legitimate heir of the prophet, the Sunnis recognize the first four “rightly guided” caliphs (al-Khulafa al-Rashidun), as well as the principal caliphates that succeeded them – the Umayyad, Abbasid, Mamluk, and Ottoman. The caliphate ruled the Sunni Muslim world for nearly 1,300 years, enjoying relative hegemony until its abolition in 1924 by Kemal Ataturk, the founder of modern Turkey. Although Sunni commentators have defined the essence of the caliphate differently in different periods, they tend to agree that the caliphate was founded for the purpose of managing Muslim affairs in accordance with the laws of God and organizing the lives of their people according to the principles of Islamic religious law.1 In practice, the caliphate has experienced highs and lows over the course of its history. In some periods, it exerted authority over political, administrative, financial, legal, and military affairs; in others, it was reduced to the symbolic and spiritual realm, such as leading mass prayers, much in the manner of the modern Catholic papacy.2 The Islamic State’s 2014 announcement on the renewal of the caliphate showed that the institution is not only a governmental-religious institution of the past, but also a living and breathing ideal that excites the imagination of present day Muslims.

Beberapa terminologi dibahas dengan baik dalam tulisan ini yang dimulai dengan pelarangan riba itu sendiri kemudian pembagian-pembagian riba, diantaranya riba al-Nasi’ah dan riba al-Fadl, serta implikasi dari dua bentuk riba tersebut. Pembahasan didukung dengan pendapat-pendapat para ulama dan ekonom yang merujuk langsung dari ayat-ayat al-Qur’an, sampai pada perdebatan hukum. Demikian juga al-Qur’an sangat jelas membedakan antara riba dan perdagangan, namun pelarangan riba sangat jelas bahkan diperkuat dengan hadits-hadits yang dengan eksplisit melarang riba.     An Introduction to Collective Ijtihad (Ijtihad Jama‘i): Concept and Applications Aznan Hasan Abstract This article explores the concept of collective ijtihad as a means of determining new judicial judgments. Accordingly, it analyzes the theoretical framework of this kind of ijtihad and its applica- tion by discussing the various institutions that practice it. In gen- eral, this article seeks to present this as a practical mechanism for ascertaining the Shari‘ah’s opinion concerning the Muslim ummah on a variety of current issues. At the outset, it will pre- sent briefly the controversy concerning the closure of the gate of ijtihad, for this kind of ijtihad relies heavily upon our recogni- tion that, throughout the history of Islamic law, jurists have never abandoned the task of ijtihad. The Controversy Surrounding the Theory of the Closure of the Gate of Ijtihad In his introduction, Joseph Schacht asserted that Islamic law is no longer relevant to modern life, due to its inflexibility and consequent inability to meet the constant changes therein. He stated further that the nature of Islamic law’s unchanging principles had inevitably resulted in this situa- tion. Jihad term often used for things that are destructive by western scholars and society. For them, jihad is synonymous with terrorism. The similarization of the word Jihad with the word terrorism in the Western perception is strongly reinforced by a series of terror committed by Muslims in the name of jihad. These acts have been increasingly affecting the interpretation of the word jihad in a negative way although in reality that is not the case in a contemporary context. Jihad in contemporary understanding is not just a war against visible enemies but also a war against the devil and carnality. Even a war against visible enemies that are written in classical fiqh books has now replaced by a contemporary interpretation of jihad against the enemies, as was done by Dr. ZakirNaik. Thefirst of these words in terms of adding them to the Almighty Godis not to discusstoo muchfor God Almighty has the knowledge of them. We do not say are the qualities, nor we deny it too; because the texts are not conclusive in indicating the descriptive one. The lack of realization of the proper fit is between it and God Almighty. Otherwise, it is possible to interpret the verses that included these words and interpret them according to the general context in which they are mentioned.

I had some at home and the remaining in the Banks locker. I asked my husband to get the remaining jewellery from the locker but he didn't take me to the bank nor got it. He kept saying he will not. As per him it didn't make sense for me to take all my jewellery to my home for delivery. I told him as it belonged to me I want it but he was not listening to me.. I started crying so my mother spoke to my husband in a harsh and rude (her tone was high) way as she was angry cos I was pregnant and my husband made me cry. she asked him to get it that day only it doesn't matter.. My husband was upset and angry as he thought my mother was accusing him that he has taken my jewellery and misused that's why she wanted to see the gold to cross check if it's there or not. My mother did speak to him in angry Tone but she didn't accuse him directly. My husband still thinks that my mother accused him of taking my jewellery, while I tell him that It's also his mistake as he didn't listen to me when I was pleading him to get the jewellery from bank.
