ORDER In this case, Shri Sadhu Singh, Appellant, vide his RTI application dated 16.11.2017, addressed to the PIO, sought a copy of compromise arrived at with his son. 2. The case was last heard on 05.11.2018, when again, none was present on behalf of the respondents without any intimation. Viewing the defying attitude of the PIO seriously, a Show-Cause Notice was issued to Shri Kulwant Singh, SHO, Police Station Dehlon, Ludhiana for imposition of penalty for the delay in the supply of information. An opportunity of personal hearing was also afforded to him on the next date of hearing before imposition of penalty, in the interest of natural justice. The case was adjourned for today. 3. Today, the appellant is not present. However, a letter dated 04.12.2018 has been received from him through e-mail informing that he is unable to attend hearing due to ill health. 4. Shri Ranjit Singh, Head Constable, appearing on behalf of the respondents, seeks some more time to enable them to supply the requisite information to the appellant, which is granted with the directions that complete information be supplied to the appellant, with a copy to the Commission, before the next date of hearing. Besides, Shri Kulwant Singh, S.H.O., Police Station, Dehlon, District: Ludhiana, is directed to submit reply to the Show-Cause Notice issued to him and avail an opportunity of personal hearing before imposition of penalty. 5. Shri Amarinder Singh Malhi, Assistant Commissioner, (General), Ludhiana, on behalf of the respondents. ORDER In this case, Shri Love Kumar Dua, Appellant, vide his RTI application dated 22.01.2018, addressed to the PIO, sought the names of Deputy Commissioner, Ludhiana and Tehsildar, Ludhiana(East) who were posted in the year 1988 at the time of floods. He also sought the information regarding the record prepared by Deputy Commissioner and Tehsildar(East), Ludhiana at the time of floods. 2. During hearing on 03.10.2018, the representative of the respondents informed that a reply had been sent to the appellant that the information, asked for, by the appellant could not be supplied as it was more than 20 years old. Consequently, after hearing both the parties and discussing the information sought for by the appellant, the PIO was directed to send point-wise reply to the appellant. Besides, Shri Amarinder Singh Malhi, Assistant Commissioner(General), Ludhiana was directed to explain the factual position of the case, in person, on the next date of hearing. However, a letter No. 5378-79/EA, dated 02.11.2018 was received from Shri Amarinder Singh Malhi, Assistant Commissioner(General), Ludhiana vide which he had sent point-wise reply to the appellant, with a copy to the Commission and requested for adjournment of the case. Accordingly, he was again directed to explain the factual position of the case, in person, on the next date of hearing. Besides, the appellant is directed to send his observations, if any, on the reply sent to him by the respondents vide letter dated 02.11.2018. The case was adjourned for today. 4. Today, Shri Amarinder Singh Malhi, Assistant Commissioner(General), Ludhiana, is present as per the orders of the Commission. He explains the position of the case while stating that the record is more than 20 years old and a report has been obtained from District Revenue Officer, Ludhiana stating that the record is not available. Accordingly, it is directed that an inquiry be conducted to look into the missing of record and fix responsibility and a report be sent to the appellant and to the Commission within 3 months. So far as the information regarding names of Deputy Commissioner and Tehsildar(East) Ludhiana, who were posted in 1988 at the time of floods, are concerned, the same be supplied to the appellant after collecting from Punjab Civil Secretariat and from the office of Financial Commissioner, Revenue, before the next date of hearing. 5. ORDER The case was last heard on 06.11.2018, when the appellant informed that compensation amount of Rs. 1000/- had not been paid to him nor the requisite information had been provided to him. None was present on behalf of the respondent-PIO without intimation. Viewing the defying attitude of the PIO seriously, compensation amount of Rs. 1000/- awarded on the last date of hearing was enhanced to Rs. 3,000/- to be paid to the appellant through Bank Draft before the next date of hearing. Besides, a Show-Cause Notice was issued to Shri Davinder Singh, S.H.O., Police Station, Shimlapuri, Ludhiana for imposition of penalty. He was also asked to avail an opportunity of personal hearing on the next date of hearing i.e. today before imposition of penalty. The case was adjourned for today. 2. Today, the appellant informs that compensation has not been paid to him nor the requisite information has been supplied to him. 3. None is present on behalf of the respondent PIO.
