ORDER In this case, Shri Love Kumar Dua, Appellant, vide his RTI application dated

22.01.2018, addressed to the PIO, sought the names of Deputy Commissioner, Ludhiana and

Tehsildar, Ludhiana(East) who were posted in the year 1988 at the time of floods. He also sought the information regarding the record prepared by Deputy Commissioner and

During hearing on 03.10.2018, the representative of the respondents informed that a reply had been sent to the appellant that the information, asked for, by the appellant could not be supplied as it was more than 20 years old. Consequently, after hearing both the parties and discussing the information sought for by the appellant, the PIO was directed to send point-wise reply to the appellant. Inder Singh, Joint Registrar(Rules)-cum-PIO, vide which reply has been sent with a copy to the complainant. Accordingly, the complainant is directed to send his observations, if any, on reply of the PIO, to the PIO, with a copy to the Commission.

3. Besides, a perusal of Second Appeal filed with the Commission by the complainant, reveals that he has leveled serious allegations against the PIO in Para 2 of the Appeal, which reads as under:-

“ That PIO did not provide information to complainant so far. That PIO has

openly violation of R.T.I. Act. They have not serious about R.T.I. Act. They

also threatened to applicant falsely implicated and detain my liberty

because I am struggling irregularities expose in judicial officer etc. It is

therefore prayed that may kindly be granted complaint immediate action

on my complaint and heard me and directed to PIO for supply the

information.”

Accordingly, the appellant is directed to file an affidavit naming the PIO, who threatened him and mentioning the place where he was threatened. He is also directed to intimate as to whether he has filed a complaint with the police regarding his threat, failing which necessary action will be initiated against him.

4. To come up on 05.02.2019 at 11.30 A.M. for further proceedings.
