Mr. Amorosa reported that the Board reviewed information provided by the County Engineer pertaining to the well at Colonial Park. The Board determined it to be in the best interest of the County to proceed with the installation of water lines. The cost associated with bringing the well pump up to current standards together with the potential recurring operational expenses did not merit reversing the previous decision or modifying the existing contract.

RESOLUTION AUTHORIZING MODIFICATION NUMBER 6 FOR THE FEDERAL AID AGREEMENT WITH THE NEW JERSEY DEPARTMENT OF TRANSPORTATION FOR THE ROUTE 22/CHIMNEY ROCK ROAD INTERCHANGE, BRIDGEWATER TOWNSHIP, SOMERSET COUNTY

WHEREAS, the New Jersey Department of Transportation has informed Somerset County of the availability of additional Federal Funds for the Route 22/Chimney Rock Road Interchange Project, Bridgewater Township; and

WHEREAS, the New Jersey Department of Transportation has proposed a Modification Number 6 for the Federal Aid Agreement between the County of Somerset and the New Jersey Department of Transportation for the Route 22/Chimney Rock Road Interchange, Bridgewater Township, Somerset County; and

WHEREAS, said Agreement is an Agreement Authorizing Reimbursement to the County for costs incurred for the Construction and Inspection of the Route 22/Chimney Rock Road Interchange, Bridgewater Township, Somerset County.

NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Somerset does hereby authorize the Director and Deputy Clerk of the Board to accept and sign Agreement Modification Number 6 for the above captioned project.

RESOLUTION GRANTING APPROVAL TO THE PARTIAL REFUND OF A PREVIOUS PRO RATA CONTRIBUTION TO TURTLE BROOK REALTY, LLC

WHEREAS, Turtle Brook Realty, LLC, c/o Mr. John Montagna (hereinafter referred to as the Applicant), having offices at 103 Godwin Avenue, Suite 193, Midland Park, NJ 07432 has made application to the County Planning Board for the proposed development of Franklin Township, Block 523.03, Lot 35.07 on Elizabeth Avenue (County Route 521) for site plan approval for a 5,880 square foot STS Tire and Auto Center, the aforementioned application being on file with the Somerset County Planning Board as File No. FL-0974S; and

WHEREAS, the County staff has reviewed and analyzed the aforesaid application to make a determination concerning the impact of the implementation of such application on County infrastructure and/or facilities; and

WHEREAS, property which is the subject of this application is located within the boundaries of the existing Elizabeth Avenue Improvement Plan, and as such, triggers a pro rata fair share monetary obligation from this applicant for the continued implementation of the aforesaid improvement plan; and

WHEREAS, by way of the aforesaid analysis and review, the Office of the County Engineer has determined that the applicant's fair share contribution toward the Elizabeth Avenue off tract traffic improvements should be in the amount of $26,944.00 as a result of the impact of such project on County facilities.

WHEREAS, the same property which is the subject of the instant application had been the subject of a previous application to the Somerset County Planning Board for a certain project consisting of a 7,076 square foot retail building with a drive thru facility and said project having previously received the approval of the Somerset County Planning Board; and

WHEREAS, the Office of the County Engineer had determined that the previous applicant’s fair share contribution toward Elizabeth Avenue improvements for the aforesaid previous project to be in the amount of $45,377.00; and

WHEREAS, pursuant to the aforesaid previous approval, the applicant had already paid to the County of Somerset the aforesaid required monetary pro rata contribution in the amount of $45,377.00 which was deposited into account #03-R131-390-08017-08,

WHEREAS, the instant application will supersede and essentially rescind any approvals given to the previous application as such application would essentially be rendered invalid.

WHEREAS, the present project is obviously of a lesser intensity then the previous project and in light of that lesser intensity a lower figure for the aforesaid Elizabeth Avenue contribution has been arrived at for any impact of the newly proposed project.

WHEREAS, the difference between the required monetary contribution for impact on county facilities between the previous project and the instant project is $18,433.00;

WHEREAS, it is necessary, fair, equitable and appropriate to refund the difference between the two contributions at this point since the present applicant being the same as the previous applicant has requested a refund of the difference between the two contributions in light of the lesser intensity and lesser impact of its present application on the County facilities;

WHEREAS, the Somerset County Planning Board has reviewed all of the foregoing and has determined that it would be appropriate to recommend to the Board of Chosen Freeholders that the aforesaid difference of $18,433.00 be refunded to the applicant after a certificate of occupancy has been issued by the Township of Franklin.

WHEREAS, Pursuant to the foregoing, it is agreed and acknowledged that any and all approvals given for the previous project will hereby be rescinded, superseded and rendered invalid insofar as the County is concerned by the return of the aforesaid difference between contributions by the County of Somerset to the applicant.

WHERESA, it is therefore reasonable, appropriate and in the interest of fundamental fairness, that the Board of Chosen Freeholders hereby accepts and concurs with the recommendation of the County Planning Board concerning the refund portion of a pervious pro rata contribution to the Elizabeth Avenue Improvement Program, to Turtle Brook Realty, LLC, and does so on the basis of the information recited heretofore in this resolution.

NOW, THEREFORE, BE IT RESOLVED that based upon the foregoing, the Somerset County Board of Chosen Freeholders hereby approves such partial refund upon the fact that the instant project is of a lesser intensity than the previously approved project for the same piece of property, and therefore this has a lesser impact on County facilities than the previously approved project. Therefore, a lesser contribution to the Elizabeth Avenue Improvement Plan is justified and appropriate; and

BE IT FURTHER RESOLVED that the Somerset County Board of Chosen Freeholders hereby approves and authorizes the refund of a portion of a previous Elizabeth Avenue pro rata contribution in accordance with the provisions of this resolution, with such partial refund to be in the amount of $18,433, and authorizes appropriate County officers and officials to undertake whatever processes or procedures are necessary and appropriate to effectuate and accomplish the aforesaid partial refund.

BE IT FURTHER RESOLVED that copies of this resolution be forwarded to the Somerset County Planning Board, Franklin Township and Turtle Brook Realty, LLC.

RESOLUTION AUTHORIZING ACCEPTANCE OF FUNDING FROM THE STATE OF NEW JERSEY, DEPARTMENT OF LAW AND PUBLIC SAFETY, DIVISION OF CRIMINAL JUSTICE FOR THE VICTIMS OF CRIME ACT (VOCA) GRANT PROGRAM FY 2014-2015 AND INSERTION OF SPECIAL ITEM OF REVENUE INTO THE 2014 BUDGET $114,280

WHEREAS, the State of New Jersey, Department of Law and Public Safety, Division of Criminal Justice has committed to fund the Victims of Crime Act (VOCA) Grant Program for fiscal year 2014/2015 in the amount of $114,280 with an in-kind County match of $28,570, for a total grant amount of $142,850.00, with an effective project period for the grant starting on August 15, 2014 and ending on August 14, 2015; and,

WHEREAS, the Somerset County Prosecutor’s Office is interested in receiving these funds to support the Victim Witness Unit in Somerset County Prosecutor’s Office for years 2014 and 2015; and

WHEREAS, N.J.S. 40:A-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the Budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount; and

NOW, THEREFORE, BE IT RESOLVED that by the Board of Chosen Freeholders of the County of Somerset that the Somerset County Prosecutor’s Office is hereby authorized to accept funding in the amount of $114,280.00 from the State of New Jersey, Department of Law and Public Safety, Division of Criminal Justice; and

BE IT FURTHER RESOLVED that the Director and Deputy Clerk of the Board of Chosen Freeholders are authorized to sign any documents as may be necessary to authorize the acceptance of these funds; and

BE IT FURTHER RESOLVED that the County of Somerset hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $114,280.00 which item is now available as a revenue from the State of New Jersey, Department of Law and Public Safety, Division of Criminal Justice pursuant to the provisions of statute; and

BE IT FURTHER RESOLVED that a like sum of $114,280.00 be and the same is hereby appropriated under the caption of “Victim of Crimes Act…$114,280.00.”

WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Chosen Freeholders of the County of Somerset, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $11,632.00 which item is now available as a revenue from New Jersey Department of Health pursuant to the provision of statute; and

BE IT FURTHER RESOLVED that the like sum of $11,632.00 is hereby appropriated under the caption “Right to Know.”

WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Chosen Freeholders of the County of Somerset, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $1,000.00 which item is now available as a revenue from Wells Fargo pursuant to the provision of statute; and

BE IT FURTHER RESOLVED that the like sum of $1,000.00 is hereby appropriated under the caption “Wells Fargo Community Connection Grant.”

RESOLUTION AUTHORIZING AN AWARD OF CONTRACT FOR A PSYCHIATRIST WITH A SPECIALTY IN CHILD PSYCHIATRY AND LICENSED PSYCHOLOGISTS AND LICENSED MASTERS LEVEL THERAPISTS, LICENSED CLINICAL ADDICTIONS COUNSELOR (LCAC) OR CERTIFIED ADDITIONS COUNSELOR (SUPERVISED BY LCAC) FOR EVALUATIONS OF SOMERSET COUNTY YOUTH RESIDING IN MIDDLESEX COUNTY JUVENILE DETENTION CENTER AND/OR CLIENTS OF JUVENILE JUSTICE MULTI-DISCIPLINARY TEAM CONTRACT # CY-COM-0027-13 and CY-COM-0027-13-S

WHEREAS, the County of Somerset Purchasing Division properly advertise seeking Requests for Proposals as noted above in accordance with N.J.S.A. 40A:11-4.1 et seq. on an Evaluation as Needed contract basis with “Availability of Funds Certificate” to be executed by the Director of Financial Services at the time each service is provided; and

WHEREAS, one (1) sealed proposal (CY-COM-0027-13) was received and read for said services on September 26, 2013 and two (2) sealed proposals (CY-COM-0027- 13-S) were received and read for said services on November 13, 2013 ; and

WHEREAS, the Director of the Office of Youth Services recommends a contract for the second year of a five year contract to CFG Health Systems, LLC, General Healthcare Resources and EmPower Somerset; and

WHEREAS, CFG Health Systems, LLC, 765 East Route 70, Bldg. A-100, Marlton, NJ 08053, General Healthcare Resources, 2250 Hickory Road, Ste. 240, Plymouth Meeting, PA 19462 and EmPower Somerset, 34 West Main Street, Ste. 307, Somerville, NJ 08876 are qualified to furnish the specialized services of the type and nature required to properly provide appropriately designated evaluations to County youth committed to detention facilities and/or who are clients of the Juvenile Justice Multi-disciplinary Team has met the requirements of the County specifications in an efficient and quality manner during the first term; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset as follows:

1. That the Director and Deputy Clerk of the Board of Chosen Freeholders of the County of Somerset are hereby authorized to enter contract with CFG Health systems, LLC, to perform the aforesaid services and to be compensated in the amount of $700.00 per evaluation for Psychiatric Evaluations, $700.00 per evaluation for Psychological Evaluations and $500.00 per evaluation for Psycho-sexual Evaluations, General Healthcare Resources and EmPower Somerset, to perform the aforesaid services and to be compensated in the amount of $178.50/$170.00 per evaluation for Substance Abuse Evaluations, and $45.00 per session for Group and/or Individual Treatment of Sex Offenders be approved as to form and content by County Counsel.

2. That the engagement of the above named has been in conformance with a Competitive Contract process, Local Public Contract Law, N.J.S.A. 40A:11-4.1 et seq.

3. Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of this Agreement is delayed or prevented by any revolutions, insurrections, riots, wars, acts of enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the control of party whose performance is interfered with which by the exercise of reasonable diligence such party is unable to prevent or in the event the County of Somerset is unable to obtain funding for the project for which this contract pertains or in the event the source of funding is curtailed by an act of any governmental body, including the Somerset County Board of Chosen Freeholders. Additionally, if the fulfillment of any of the terms and provisions of this Agreement is delayed of prevented by any court order, or action or injunction or other such agreement, this Agreement shall become voidable by the County of Somerset by notice to each party.

4. A notice of this award shall be published in the Courier News as required by law within twenty (20) days of its passage.

RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR PROFESSIONAL SERVICES TO MARK TINDER APPRAISALS, LLC 29 SOMERSET STREET SECOND FLOOR SOMERVILLE, NJ 08876 FOR APPRAISAL OF THE YABLONSKY FARM BLOCK 204 – LOT 11 TOWNSHIP OF HILLSBOROUGH

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds in the amount of $2,849.00 from account number 13-294- 09050-802-280, for the purposes set forth in this Resolution, and that such funds are provided for in the Open Space and Farmland Preservation Trust Fund, Account; and

WHEREAS, the State Agriculture Development Committee (SADC), under its new rules established for the County Planning Incentive Grant (County PIG), require that an application for farmland preservation undergo a series of staff reviews at the SADC before an appraisal is ordered; and

WHEREAS, the Somerset County Agriculture Development Board (SCADB) received an application for preservation under the Somerset County PIG Program for the Yablonsky Farm, located at 282 Amwell Road in the Township of Hillsborough, in June 2014; and

WHEREAS, after SCADB staff review and a site inspection performed on July 9, 2014, the Yablonsky Farm application was submitted to the SADC for review and receipt of Green Light Approval; and

WHEREAS, the SADC performed their review of the application for the Yablonsky Farm (Block 204 – Lot 11, Hillsborough Township) and authorized Green Light Approval, which allows the County to perform the required appraisals, on September 22, 2014; and

WHEREAS, the SCADB recommended the award of contract to Mark Tinder Appraisals, LLC for the appraisal of the Yablonsky Farm in the amount of $2,849.00 at its meeting of November 10, 2014; and

WHEREAS, Mark Tinder Appraisals, LLC is affording specialized services of the type and nature required to properly carry out the aforesaid and their particular abilities and capacities have been previously demonstrated in work in Somerset County, are on the State Agriculture Development Committee’s List of Approved Appraisers and are recognized by the Office of the Somerset County Engineer and by the Somerset County Board of Chosen Freeholders; and

WHEREAS, the local Public Contracts Law (N.J.S.A.40A:11-1 et seq.) requires that the Resolution authorizing the award of contracts for "professional services" and the contract itself must be available for public inspection, and must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED that by the Somerset County Board of Chosen Freeholders as follows:

1. Mark Tinder Appraisals, LLC is hereby recommended to perform the necessary appraisal as such appraisal is assigned to them by appropriate county representatives, agents, officials and/or employees and that, upon approval of this firm by the Somerset County Board of Chosen Freeholders, the Director and Deputy Clerk of the Board of Chosen Freeholders are authorized to execute a contract with each of the aforesaid appraisers, the contracts to be approved by the Office of County Counsel. The total amount of the contract to Mark Tinder Appraisals, LLC is not to exceed $2,849.00 from Account #13-294-09050-802-280.

2. The County, its officers and employees shall be added as an additional insured as to all insurance coverage of all of the above captioned appraisal companies.

3. Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of this Agreement is delayed or prevented by any revolution, insurrections, riots, wars, acts of enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the control of the party whose performance is interfered with which by the exercise of reasonable diligence such party is unable to prevent or in the event the County of Somerset is unable to obtain funding for the project for which this contract pertains or in the event the source of funding is curtailed by any act of any governmental body, including the Somerset County Board of Chosen Freeholders. Additionally, if this Agreement is delayed or prevented by any court order,

or action of injunction or other such agreement, this Agreement shall become voidable by the County of Somerset by notice to each party.

5. WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds in the amount of $2,200.00 from account number 13-294- 09050-802-280, for the purposes set forth in this Resolution, and that such funds are provided for in the Open Space and Farmland Preservation Trust Fund, Account; and

WHEREAS, the State Agriculture Development Committee (SADC), under its new rules established for the County Planning Incentive Grant (County PIG), require that an application for farmland preservation undergo a series of staff reviews at the SADC before an appraisal is ordered; and

WHEREAS, the Somerset County Agriculture Development Board (SCADB) received an application for preservation under the Somerset County PIG Program for the Yablonsky Farm, located at 282 Amwell Road in the Township of Hillsborough, in June 2014; and

WHEREAS, after SCADB staff review and a site inspection performed on July 9, 2014, the Yablonsky Farm application was submitted to the SADC for review and receipt of Green Light Approval; and

WHEREAS, the SADC performed their review of the application for the Yablonsky Farm (Block 204 – Lot 11, Hillsborough Township) and authorized Green Light Approval, which allows the County to perform the required appraisals, on September 22, 2014; and

WHEREAS, the SCADB recommended the award of contract to Tom Rodriguez Associates for the appraisal of the Yablonsky Farm in the amount of $2,200.00 at its meeting of November 10, 2014; and

WHEREAS, Tom Rodriguez Associates is affording specialized services of the type and nature required to properly carry out the aforesaid and their particular abilities and capacities have been previously demonstrated in work in Somerset County, are on the State Agriculture Development Committee’s List of Approved Appraisers, and are recognized by the Office of the Somerset County Engineer and by the Somerset County Board of Chosen Freeholders; and

WHEREAS, the local Public Contracts Law (N.J.S.A.40A:11-1 et seq.) requires that the Resolution authorizing the award of contracts for "professional services" and the contract itself must be available for public inspection, and must be publicly advertised.

NOW, THEREFORE, BE IT RESOLVED that by the Somerset County Board of Chosen Freeholders as follows:

1. Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of this Agreement is delayed or prevented by any revolution, insurrections, riots, wars, acts of enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the control of the party whose performance is interfered with which by the exercise of reasonable diligence such party is unable to prevent or in the event the County of Somerset is unable to obtain funding for the project for which this contract pertains or in the event the source of funding is curtailed by any act of any governmental body, including the Somerset County Board of Chosen Freeholders. Additionally, if this Agreement is delayed or prevented by any court order, or action of injunction or other such agreement, this Agreement shall become voidable by the County of Somerset by notice to each party.

WHEREAS, the Somerset County Prosecutor’s Office is applying for funding (October 1, 2014 through September 30, 2015) for a project named Somerset County Sexual Assault Nurse Examiner/Sexual Assault Response Team Project in the amount of $56,825.00 with County match of $14,206.00 and

WHEREAS, Somerset County Board of Chosen Freeholders reviewed the application on file with the Deputy Clerk of the Board and approved said request.

NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of Chosen Freeholders that:

1. As a matter of policy Somerset County wishes to participate to the fullest extent possible with the Department of Law and Public Safety, Division of Criminal Justice, State Office of Victim-Witness Advocacy.

2. The Attorney General will receive funds on behalf of all prospective subgrantees.

3. The Division of Criminal Justice shall be responsible for reviewing all applications and making recommendation to the Attorney General for selection of subgrant award recipients.

WHEREAS, Bernardsville Borough has requested that the County of Somerset, Division of Transportation provide accessible transportation services to senior residents of Bernardsville Borough, beyond that which is currently provided by the County, and;

WHEREAS, the County of Somerset, Division of Transportation has determined that accessible transportation services can be provided by using an existing vehicle to accommodate the needs of Bernardsville Borough, and;

WHEREAS, the State of New Jersey through N.J.S.A.52:14-34.4 created Innovations funding to support Juvenile Detention Alternative Initiatives; and

WHEREAS, this funding should be used to purchase services that provide an additional resource and support for those JDAI sites that have demonstrated an active commitment to the implementation of JDAI core strategies; and

WHEREAS, there is a balance of approximately $6000 remaining to be spent; and

WHEREAS, the Executive Director of the Juvenile Justice Commission has granted permission for the extension until March 31, 2015.

WHEREAS, the State of New Jersey through PL 1995, Ch. 283, sec. 31 and PL 1995, Ch. 282 has created the Juvenile Justice Commission and the State/Community Partnership Grant Program to support, through county youth services commissions, sanctions and services to juveniles adjudicated or charged as delinquent and programs for the prevention of juvenile delinquency; and

WHEREAS, a major component of the partnership program is increasing the range of sanctions and services for juvenile adjudicated delinquent: and

WHEREAS, there is a balance of approximately $5000 remaining to be spent in Client Specific funds; and

WHEREAS, the Executive Director of the Juvenile Justice Commission has granted permission for the extension until March 31, 2015.

NOW, THEREFORE, BE IT RESOLVED that the Director and the Deputy Clerk of the Board of Chosen Freeholders of the County of Somerset are hereby authorized to extend the grant for an additional three months to March 31, 2015.

WHEREAS, the County of Somerset (Richard Hall CMHC) became the fiscal agent for the Mental Health Transformation Grant (Employment Works); and

WHEREAS, the initial federal (SAMHSA) grant established vendors for this grant, The Mental Health Association in New Jersey being one such vendor; and

WHEREAS, The Mental Health Association in New Jersey will receive $305,041.00 for partnering with Richard Hall Community Mental Health Center in establishing an employment program covering the period from September 30, 2014 to September 29, 2015.

RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT FOR SERVICES WITH THE SOMERSET COUNTY BUSINESS PARTNERSHIP FOUNDATION

WHEREAS, in April 1997, the Somerset County Freeholder Board, with the support of the Somerset County Chamber of Commerce, the Somerset County Alliance for the Future and the Business, Non-Profit and the Education Community of Somerset County, held an Economic Summit for the purpose of exchanging views and developing strategic recommendations on preserving the County’s quality of life by developing a smart growth program; and

WHEREAS, the Steering Committee Report recommended that a public- private organization be established as a non-profit corporation with 501 ( c ) status, that it have a Board of Directors representing interested stakeholders and representatives from Somerset County, the Somerset County Chamber of Commerce, and other representatives from the public and private sectors; and

WHEREAS, the Business Partnership of Somerset County and the Somerset County Chamber of Commerce have merged as a single entity called the Somerset County Business Partnership and incorporated as a 501 ( c ) 3 non-Profit corporation; and

WHEREAS, the Somerset County Business Partnership Foundation has elected a Board of Directors with representation from Somerset County, and other representatives from the public and private sectors; and

WHEREAS, the Somerset County Business Partnership Foundation developed a program of services that include initiatives in the areas of Improved Regional Mobility, Smart Targeted Redevelopment, Tax Stabilization & Government Efficiency, and Workforce Development.

NOW, THEREFORE, BE IT RESOLVED that the Somerset County Board of Chosen Freeholders supports the Somerset County Business Partnership Foundation as a smart growth economic development organization that provides key specific services and functions in accordance with the findings and conclusions of the Steering Committee; and

BE IT FURTHER RESOLVED that the newly formed organization enter into a contract for services with the County of Somerset for a six month period starting January 1, 2015; and

BE IT FURTHER RESOLVED that Somerset County will commit to fund the Somerset County Business Partnership with $115,500.00 and the Somerset County Chamber of Commerce with $22,000.00 for a total of $137,500.00 for the first 6 months of 2015 and the use of a loaned executive from the Somerset County Economic Development Office during the length of the contract between the organization and the County; and

WHEREAS, the County of Somerset has a compelling interest in guaranteeing that public works projects meet the highest standards of safety and quality; and

WHEREAS, the County has a proprietary interest, as an owner, in the efficient use of resources and the protection of its investment in public works projects; and

WHEREAS, the County has proprietary and governmental interests in high standards and high qualifications; and

WHEREAS, the County believes that its interests are fostered and benefitted by requiring bidders which desire to bid on public works projects estimated to equal or exceed $500,000 to employ highly skilled workers; and

WHEREAS, the State of New Jersey, as set forth in N.J.S.A. 52:38-1, has determined that a highly skilled workforce ensures lower costs for repairs and maintenance over the lifetime of a completed project; and

WHEREAS, using formally trained trade and craft workers ensures a level of competence, productivity, and worker safety that contributes to the timely completion of a public works project; and

WHEREAS, the publication “Apprenticeship Training in New Jersey – Directory of Information and Resources” prepared by the State of New Jersey Department of Labor and Workforce Development Division of Business Services – Office of Workforce Initiatives describes the benefits that apprenticeship programs provide to the public including but not limited to:

• Developing and maintaining a highly skilled workforce which has “learned how to learn” and which is well prepared to adapt to an ever changing employment and economic environment that is the hallmark of today’s global economy. • Increased productivity from apprentices who are more versatile and better able to solve work-related problems than untrained workers.

WHEREAS, a requirement for apprenticeship programs that train highly skilled workers and related bidding requirements are reasonably related to the satisfactory performance and completion of public works projects; and

WHEREAS, a requirement for apprenticeship programs outlines a set of criteria that a contractor, bidding to work on a public works construction project, must meet in order to be awarded a contract; and

WHEREAS, N.J.S.A. 40A:11-2 “Definitions” provides that:

(27) “Lowest responsible bidder or vendor” means the bidder or vendor: (a) whose response to a request for bids offers the lowest price and is responsive; and (b) who is responsible.

(32) “Responsible” means able to complete the contract in accordance with its requirements, including but not limited to requirements pertaining to experience, moral integrity, operating capacity, financial capacity, credit, and workforce, equipment, and facilities availability.

(33) “Responsive” means conforming in all material respects to the terms and conditions, specifications, legal requirements, and other provisions of the request; and

WHEREAS, N.J.S.A. 40A:11-13 provides that any specifications for the provision or performance of goods or services shall be drafted in a manner to encourage free, open and competitive bidding and that no specifications may “(a) Require any standard, restriction, condition or limitation not directly related to the purpose, function or activity for which the contract is awarded”; and

WHEREAS, to meet the purpose of a bidder being responsible, a requirement of a bidder in a qualified apprenticeship program places all bidders on equal footing thereby maintaining a fair and level playing field that does not unnecessarily limit the number or type of bidders on public contracts in as much as all contractors will have a fair and equal chance to bid on County contracts; and

WHEREAS, public works projects with engineering estimates that the total cost of the project to the County, exclusive of any land acquisition costs, will equal or exceed $500,000, will benefit from a requirement that a responsible bidder participated in an approved apprenticeship programs and related requirements advance the interests of the County in ensuring that these public works contracts result in cost efficiency, a skilled labor force, quality, safety and timeliness.

NOW, THEREFORE, BE IT RESOLVED that the County of Somerset has determined that:

1. The County has compelling interest, as an owner, in guaranteeing that public works projects meet the highest standards of safety and quality.

2. The County has a proprietary interest, as an owner, in the efficient use of resources and the protection of its investments in public works projects.

3. A highly skilled workforce ensures lower costs for repairs and maintenance over the lifetime of a completed public works project; ensures that trade and craft workers have been properly trained to adapt to an ever changing employment and economic environment that is the hallmark of today’s global economy; and increases productivity from apprentices who are more versatile and better able to solve work-related problems than untrained workers

4. A requirement that a responsible bidder is one who participates in an apprenticeship program is consistent with N.J.S.A. 40A:11-13 in as much as the requirement is directly related to the cost, efficiency, skilled labor force, quality, safety and timeliness of the County’s public works projects.

5. An apprenticeship program requirement as a requirement of responsible bidder determination is consistent with N.J.S.A. 40A:11-6.1 which requires that public contracts be awarded not to the lowest bidder, but to the “lowest responsible bidder.”

6. A requirement of apprenticeship programs as an element of responsibility places all bidders on equal footing thereby maintaining a fair and level playing field that does not unnecessarily limit the number or type of bidders on public contracts in as much as all contractors will have a fair and equal chance to bid on County contracts.

7. Requiring apprenticeship programs as an element of responsibility is “inherently beneficial” and supports State of New Jersey policy as set forth in N.J.S.A. 34:1A-37 and N.J.S.A. 52:38-1:

A. The State of New Jersey, as set forth in N.J.S.A. 52:38-1, has determined that a highly skilled workforce ensures lower costs for repairs and maintenance over the lifetime of a completed project and such a requirement is directly related to the contract activity;

B. The State of New Jersey, as set forth in N.J.S.A. 34:1A-37, as an example, has recognized the inherent good in the encouragement and promotion of apprenticeship agreements and supports apprenticeship programs through programs of the State Department of Labor and Workforce Development and the “Jobs4Jersey” program;

8. Inherently beneficial apprenticeship programs that train highly skilled workers and improve efficiency in government projects are complimentary to the requirements of the Local Public Contracts Law; and

BE IT FURTHER RESOLVED “public works project” means any construction, reconstruction, demolition, alteration, custom fabrication, or repair work, or maintenance work, including painting and decorating, done under contract and paid for in whole or in part out of the funds of a public body, except work performed under a rehabilitation program.

BE IT FURTHER RESOLVED that “apprenticeship program” and “registered apprenticeship” as set forth in N.J.S.A. 52:38-2 mean:

• “Apprenticeship program” means a registered apprenticeship program providing to each trainee combined classroom and on-the-job training under the direct and close supervision of a highly skilled worker in an occupation recognized as an apprenticeable trade, and registered by the Bureau of Apprenticeship and Training of the U.S. Department of Labor and meeting the standards established by the bureau, or registered by a State apprenticeship agency recognized by the bureau.

• Registered apprenticeship” means apprenticeship in a program providing to each trainee combined classroom and on-the-job training under the direct and close supervision of a highly skilled worker in an occupation recognized as an apprenticeable trade, and registered by the Office of Apprenticeship of the Department of Labor and meeting the standards established by that office.

BE IT FURTHER RESOLVED a requirement for apprenticeship programs and related requirements as an element of bidder responsibility shall require bidders to provide evidence that at the time of the bid, the bidder and all of the bidder’s sub-contractors participate in active apprenticeship and training programs approved and registered with the United States Department of Labor’s Bureau of Apprenticeship and Training for each of the trades of work contemplated under the awarded contract.

BE IT FURTHER RESOLVED that public works projects with engineering estimates that the total cost of the project, exclusive of any land acquisition costs (should you also exclude engineering, design, and construction management costs – or in the alternative, limit it to the “construction cost” of the project), will equal or exceed $500,000 will benefit by a determination that a requirement for apprenticeship programs and related requirements is part of being a responsible bidder.

BE IT FURTHER RESOLVED that any bidder for the public works projects as defined herein with engineering estimates that the total cost of the project, exclusive of any land acquisition costs, will equal or exceed $500,000 who fails to comply with the requirement to participate in an apprenticeship program as described herein shall not be regarded as responsible under the meaning of N.J.S.A. 40A:11-2(32).

BE IT FURTHER RESOLVED that if any provision of this resolution is contrary to State or Federal Law, State and/or Federal law shall control, but all other provisions of this resolution shall remain in full force and effect.

BE IT FURTHER RESOLVED by the Somerset County Board of Chosen Freeholders that the Director and Deputy Clerk of the Board of Chosen Freeholders are hereby authorized to execute this resolution requiring bidders on public works projects estimated to equal or exceed $500,000 to employ highly skilled workers, and the Administrator is authorized to execute any and all bids or other documents necessary to effectuate and complete this resolution.

WHEREAS, the County of Somerset is the owner in fee simple of certain real property located in the Township of Branchburg, County of Somerset, New Jersey, designated as Lot 9, Block 90 on the Official Tax Map of the Township of Branchburg; and

WHEREAS, the County of Somerset has obtained Freshwater Wetlands Permits, NJDEP File Nos. 1805-02-0022 1 FHA020001, 1805-02-0022 1 fha020001 gp#10a AND 1805-02-0022 1 fha020002 gp#17, pursuant to the Wetlands Act of 1970, N.J.S.A.13:9A, the Freshwater Wetlands Protection Act, N.J.S.A. 13:9B-1 and the Freshwater Wetlands Protection Act Rules, N.J.A.C. 7:7A, for a land use development; and

WHEREAS, the Permit issued to The County of Somerset is conditioned up0on the Grantor’s recording an approved Conservation Restriction/Easement, pursuant to N.J.A.C. 7:7-15(b)18, N.J.A.C. 7:7A-15.2(i) for the mitigation site area as shown on the approved plan entitled Conservation Easement for Wetlands Mitigation Site Located on Tax Loa 9 in Tax Block 90, Blackpoint Road, Township of Branchburg, Somerset County, NJ, prepared by Somerset County Engineering Department dated September 12, 2014, last revised date September 12, 2014; and

WHEREAS, wetlands play a significant role in the maintenance of environmental qualify of a community, regional and statewide level; and

WHEREAS, wetland mitigation site areas are a significant natural area and are an integral portion of a wetlands ecosystem; and

WHEREAS, the County of Somerset having the authority to do so, intends to construct a wetland mitigation project known as Raritan River Wetlands Mitigation Site, at Lot 9 Block 90 situate in the Township of Branchburg; and

WHEREAS, the County of Somerset desires to preserve the wetland mitigation site area in its natural state, so as to preserve and protect wetlands, open waters, and residential animal and plant species on the Restricted Area, including the air space and subsurface forever in its natural site; and

WHEREAS, the County of Somerset is authorized by N.J.S.A. 13:1D-9 to formulate comprehensive policies for the conservation of the natural resources, to promote environmental protection and prevent pollution of the environment of the State, and is authorized by N.J.S.A. 13:8B-3 to acquire and enforce conservation restrictions; and

WHEREAS, the County of Somerset having the authority to do so, intends to enter into a Conservation Restriction/Easement in order to grant to the New Jersey Department of Environmental Protection a Conservation Restriction/Easement on Lot 9 Block 90 situate in the Township of Branchburg, Somerset County to restrict subsequent development of the Restricted Area. NOW, THEREFORE, BE IT RESOLVED, by the Somerset County Board of Chosen Freeholders that the Director and Clerk of the Board of Chosen Freeholders are hereby authorized to execute all documents necessary to effectuate the Conservation Restriction Easement.
