HUMAN RIGHTS QUARTERLY Bremer's "Gordian Knot": Transitional Justice and the US Occupation of Iraq Eric Stover,* Hanny Megally, ** & Hania Mufti*** ABSTRACT Shortly after the US invasion and occupation of Iraq, L. Paul Bremer III, in his capacity as the chief administrator of the Coalition Provisional Author- ity (CPA), introduced several transitional justice mechanisms that set the *Eric Stover is Director of the Human Rights Center at the University of California, Berkeley, and Adjunct Professor in the School of Public Health. In 1991, Stover led a team of forensic scientists to northern Iraq to investigate war crimes committed by Iraqi troops during the Anfal campaign against the Kurds in the late 1980s. In March and April 2003, he returned to northern Iraq where he and Hania Mufti monitored the compliance with the 1949 Geneva Conventions by all sides to the conflict. He returned to Iraq in February 2004 to assist Mufti in investigating the status of documentary and physical evidence to be used in trials against Saddam Hussein and other members of the Ba'athist Party. -

At times, the right to ask is more important than the right to life. Unless we express, we cannot live. Man as a social being is linked to society through communication in a variety of ways. Human Society is incomplete without communication. NALSAR considers it very important to work on the legal aspects of communication freedom. It has a Center for Media Law and Public Policy, under the leadership of Professor Madabhushi Sridhar, a well known academician and journalist. Media law is currently offered as a seminar course at NALSAR, and as a special P.G. Diploma Course through NALSAR’s proximate education program. -

Culture of Inaction: The United Nations’ response to the manipulation of the Oil-For-Food Programme Erik Søgård Master’s Thesis in History Department of Historical Studies Norwegian University of Science and Technology (NTNU) Trondheim, 2016 Preface It is with mixed feelings that I am concluding this Master’s Thesis on the United Nations response to the Oil-For-Food Programme. First of all, it is a wonderful feeling to finally put the finishing touches on my very own historical product and being able to call myself a history teacher. It has been months of hard work and I can honestly say that I am proud of what I have written. However, finishing this thesis also means that my five years as a student in Trondheim has come to an end. It has been five incredible years filled with new experiences, fantastic people and tons of fun. Now begins a new chapter in my life. There have been several people who have helped me on the way to finishing my Master’s Thesis. I would especially like to thank my supervisor Espen Storli for everything he has done in assisting me in my research. There have been periods where I faced obstacles in my work that made me both downtrodden and frustrated. However, Espen has always helped me keeping a positive outlook on my research and I have never walked out of his office feeling worse than when I entered. I know that for many students, it is the other way. I would also like to thank everyone who has participated in the seminars Espen arranged and for the feedback you gave me on chapter 4. -

IRAQI INTERIM GOVERNMENT Announcement Ceremony Press Packet Iraqi Interim Government Summary • On 30 June, all governmental authority will be transferred to a fully sovereign Iraqi Interim Government. The Coalition Provisional Authority will cease to exist and Iraqis will govern their own affairs. • The Iraqi Interim Government will consist of a President, two Deputy Presidents, and a Prime Minister leading a Council of Ministers. The President will act as the Head of State. The Prime Minister will preside over the Council of Ministers and oversee the administration of the government. • There will also be an Interim National Council to promote constructive dialogue and create national consensus, to advise the new government, monitor the implementation of laws and approve the 2005 budget. The Interim National Council will be chosen by a National Conference, to be held in July, involving at least a thousand Iraqis from across Iraq. The Interim National Council will reflect Iraq’s diversity. • The judicial branch of government will be as set out in the Transitional Administrative Law (TAL). It includes a Federal Supreme Court, the highest court of the land, which has the authority to resolve constitutional disputes. • The Iraqi Interim Government was formed through a process of wide-ranging consultation with Iraqis, including political leaders, religious and tribal leaders and civic associations. The process was facilitated by Mr. Lakhdar Brahimi, Special Adviser on Iraq to the Secretary General of the United Nations, working in consultation with the CPA and the IIG. • The new Interim Government’s primary responsibility will be to administer Iraq’s affairs, in particular by providing for the welfare and security of the Iraqi people, promoting economic development and preparing Iraq for national elections to be held no later than 31 January 2005. -

Blanchard Analyst in Middle Eastern Affairs Foreign Affairs, Defense, and Trade Division Congressional Research Service ˜ The Library of Congress Iraq: Oil-For-Food Program, Illicit Trade, and Investigations Summary The “oil-for-food” program (OFFP) was the centerpiece of a long-standing U.N. Security Council effort to alleviate human suffering in Iraq while maintaining key elements of the 1991 Gulf war-related sanctions regime. In order to ensure that Iraq remained contained and that only humanitarian needs were served by the program, the program imposed controls on Iraqi oil exports and humanitarian imports. All Iraqi oil revenues legally earned under the program were held in a U.N.-controlled escrow account and were not accessible to the regime of Saddam Hussein. The program was in operation from December 1996 until March 2003. Observers generally agree that the program substantially eased, but did not eliminate, human suffering in Iraq. Concerns about the program’s early difficulties prompted criticism of the United States; critics asserted that the U.S. strategy was to maintain sanctions on Iraq indefinitely as a means of weakening Saddam Hussein’s grip on power. At the same time, growing regional and international sympathy for the Iraqi people resulted in a pronounced relaxation of regional enforcement — or even open defiance — of the Iraq sanctions. The United States and other members of the United Nations Security Council were aware of billions of dollars in oil sales by Iraq to its neighbors in violation of the U.N. -

Mr. Laurence accurately quoted me as saying "I don't believe you come to the UN to make money but to serve mankind. If the intent is to make money, this is not the place for you." But in the next sentence of his story, he referred to the alleged existence of "dominant national blocs" such as the "Swedish mafia" or the "Nigerian mafia".
