No. XIX. An Act to legalize certain Conditional and other Purchases of Crown Land. [19 th December, 1881.] HEREAS the persons whose names are respectively mentioned W in Schedules A and C hereto have made conditional purchases under the law regulating the alienation of Crown Lands in force for the time being of certain portions of Crown Lands and the said purchases have been subsequently found to be either wholly or in part illegal for the reasons respectively specified in connexion with such purchases in the said Schedules And whereas it is alleged that such persons have resided upon and have improved the said lands And whereas a certain condi­ tional purchase of forty-five acres being the portion specified in Schedule B made by James Kelly on the ninth day of December one thousand eight hundred and sixty-nine was inadvertently included in Schedule A of the Act fortieth Victoria number fourteen such purchase having been thought illegal for the reason specified in Schedule A to the said Act but in fact the said purchase by James Kelly had been previously viz. on the eleventh day of August one thousand eight hundred and seventy-one declared forfeited by notification in the Gazette And whereas the said James Kelly has failed to pay the appraised value of the said portion pursuant to the said Act And whereas the said portion was conditionally purchased by Joshua Rapley on the eighteenth day of October October one thousand eight hundred and seventy-seven but it is con­ sidered that such purchase might be held to be invalid on account of the inclusion of the said portion in the Schedule to the said Act and it is expedient to remove such doubts in manner hereinafter provided And whereas the persons whose names are mentioned in Schedule D hereto have applied to purchase certain portions of Crown Lands in virtue of improvements but the sale of the said lands could not be lawfully made and completed for the reasons respectively specified and set against the names of such persons in the said Schedule And whereas the persons whose names are respectively mentioned in Schedules E and E have purchased at and after auction respectively certain portions of Crown Lands but such purchases are illegal for the respective reasons specified and set against the names of such persons in the said Schedules And whereas the person whose name is mentioned in Schedule G applied to purchase a portion of Crown Land in virtue of intended improvements but the sale of the portion of land could not bo legally made and completed for the reason specified in the said Schedule And whereas it is just and expedient that the conditional and other purchases specified in Schedules A B C E and F respectively should be validated and that sales and grants of the portions specified in Schedules D and G respectively should be authorized Be it therefore enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and Legislative Assembly of in Parliament assembled and by the authority of the same as follows :— 1. The conditional purchases under or purporting to be under the thirteenth fourteenth twenty-first and twenty-second sections of the "Crown Lands Alienation Act of 1861" respectively of the portions of Land specified in Schedules A B and C by the persons whose names are therein severally set opposite to such portions shall be held to have been valid and effectual in law subject nevertheless to the fulfilment by the holders thereof of the several conditions and provisions res­ pectively applicable thereto prescribed by the said Act the "Lands Acts Amendment Act 1875" and the " Land Acts further Amendment Act 1880 " and to the conditions of forfeiture or reversion prescribed by the said Acts. 2. The Governor with the advice of the Executive Council may sell and grant the portions specified in Schedules D and G to the persons whose names are therein set opposite to such portions respectively at a price to be fixed by appraisement in accordance with the provisions of the " Land Acts further Amendment Act of 1880 " And every such sale shall be subject to the conditions prescribed by the second and thirty-first sections of the "Lands Acts Amendment Act of 1875." 3. The purchases at and after auction respectively of the portions of Crown Lands specified in Schedules E and F made by the persons whose names are therein respectively set opposite such purchases are hereby declared to have been valid and effectual in law but subject in every case to the conditions and provisions of the twenty-third and twenty-fifth sections of the " Crown Lands Alienation Act of 1861" respectively. 4. In case the estate or interest in such portion of any person whose name is set against any of the portions specified in either of the said Schedules D and G shall before the issue of the grant thereof be by death or devolution or operation of law or by transfer or other act of the party transmitted to or vested in any other person the grant of such portion shall issue to the person or persons in whom such estate or interest shall have been so transmitted or become vested. 5. This Act may be cited as the " Crown Lands Purchases Validation Act 1881."
