This is not merely a second edition of the previous book on the Animals (Scientific Procedures) Act 1986 [A(SP)A]. The A(SP)A has not changed in the intervening six years, but the impact of the Home Office (HO) on the administration of the Act has increased as the years have rolled by since 1986. The influence in prac- tice of the Inspectorate needs to be more and more taken into consideration if one is to properly understand the legal control of the use of animals in research in practice, at the level of the animal facility or in the implementation of the project licence. The welfare of laboratory animals is demanded by legislation and is, I hope, adequately dealt with in the text. This is by no means intended to be a treatise on animal law in general. It has been written primarily for the use of those involved in animal studies, especially those concerned with animals in research. It is hoped that it will give them an overall view of their legal obligations towards the animals in their care. The public I have in mind is based on the numerous and various animal technicians who have faced me in class during a period of more than 20 years. If the tone, therefore, tends to be lay rather than legal, it will show that I have learnt more from them, perhaps, than they from me. I am fully aware that the material in this book is available elsewhere, particularly on the internet. This text is intended to provide a useful compilation of legal material of interest to busy, non-legal-minded scientists and technicians in research using animals and may be of value to concerned members of the public. The main emphasis in the text will obviously be on the Animals (Scientific Procedures) Act 1986 (referred to throughout the text as the A(SP)A). Other legislation, such as the Animal Welfare Act, the Veterinary Surgeons Act 1966, the Agriculture (Miscellaneous Provisions) Act 1968, the Animal Health Act 1981 and the European Directive 86/609/EEC, will be commented upon in so far as they may be relevant to laboratory animals. The impact of European law on this area of legislation will be noted. Passing reference will be made to some animal laws, such as the Wildlife and Countryside Act 1981, which are peripheral to the main theme of the book. Numerous Statutory Instruments, both Orders and Regulations, along with Directives, Codes of Practice, Guidelines and the Stipulations of Good Laboratory Practice bearing on animal experimentation could be of interest to many scientists and technicians dealing with animals and are often very relevant to their par- ticular area of work. Unfortunately both space and time are limited. Where appropriate I will refer to such documents and attempt to indicate the best place to find them, particularly on websites. There is a list of relevant websites at the end of the text. Preface v In such specialised areas there is the obvious need to consult the actual docu- ments themselves. Their details would be difficult to paraphrase in a work such as this. Furthermore, it must be stressed that where there are actual legal problems or disputes of a litigious nature, the appropriate legal experts must be consulted if an authoritative solution is being sought. For England and Wales, a range of legislation on animal welfare was consolidated under the Animal Welfare Act 2006. This makes it an offence to cause unnecessary suffering to domesticated animals, or any animals under the control of man. The maximum penalty under the Act is currently a six-month sentence and/or an unlimited fine. In 2016 the maximum sentence for animal cruelty offences in Northern Ireland under the Welfare of Animals Act (Northern Ireland) 2011 was increased to five years, following the recommendations of a review of the implementation of the Act.

In it we address the adequacy of the current cost-benefit assessment performed in the course of evaluating project licence applications. We have sought to look at the many issues which arise in relation to this important element of the regulation of the use of animals, but would draw attention to three particular aspects of our work. In the first place we have addressed the fundamental question as to scientific validity of the use of animals. We believe that our considerations and conclusions offer an important clarification of the debate and fulfil the request made by your predecessor, Mike O’Brien, to provide advice on this issue. Secondly, while we conclude that some uses of animals may yield scientific knowledge, we argue that this does not settle the question of justification. We go on to elucidate the full range of factors which must be considered for there to be a rigorous application of the cost-benefit assessment. Thirdly, we also consider how the practice and process of cost-benefit assessment can be enhanced so that it can be, and be seen to be, critical and comprehensive.
